Circular No. 15/BYT-TT guides the implementation of Decision No. 811/BYT-QĐ dated November 1, 1993, issued by the Minister of Health on the management and operation of funds for national health programs to prevent malaria, goiter, expanded immunization, and HIV/AIDS prevention.

CIRCULAR OF THE MINISTER OF HEALTH

GUIDING THE IMPLEMENTATION OF DECISION NO. 811/BYT-QĐ DATED November 1, 1993 OF THE MINISTER OF HEALTH ON THE MANAGEMENT AND CONTROL OF FUNDS FOR NATIONAL HEALTH PROGRAMS TO PREVENT MALARIA, ENLARGED IMMUNIZATION, IODINE DEFICIENCY DISORDERS, AND AIDSY Implementing Decision No. 811/BYT-QĐ dated November 1, 1993 of the Minister of Health on the restructuring of financial management structures for national health programs to prevent malaria, enlarged immunization, iodine deficiency disorders, and AIDS which are funded by the State budget; the Minister of Health guides specific points regarding the management and control of funds for these programs as follows:

The funds of the National Health Program (NHP) are part of the State budget. The Director of the NHP is responsible for managing the funds to ensure the goals assigned according to the financial and accounting regulations for public institutions established by the State.

A- GENERAL PROVISIONS:

I. The funds of each national health program include:

II. 1. Public funds provided by the State.

2. International aid for the activities of the NHPs concerning medicines, chemicals, equipment, specialized materials, biological products, tests, and HIV testing kits.

3. Other sources

To ensure strict management of the State-provided funds for the NHPs.

III. The head of the unit entrusted with managing the program's funds is a member of the NHP Management Board and is responsible for effectively managing and utilizing the allocated funds.

Budget planning and allocation:

B. SPECIFIC PROVISIONS:

I. 1. Annually, the NHP Management Board develops an annual action plan in terms of professional and technical aspects; based on this plan, they prepare the budget for the program's funds including:

Part of the State-provided funds

International aid funds (as per item A.II.2)

This budget includes detailed items:

Other sources.

Physical assets (medicines, equipment, materials, chemicals...) from international aid; physical assets purchased by units managing the program's funds (PMF) upon assignment.

Central cash expenditures; cash allocations to localities.

2. After the State officially announces the annual budget for the NHPs, the program management board prepares a proposed allocation of State-provided funds, aid amounts, and other sources (including additional State-provided funds) for central and local tasks, detailing the time frame, funding, and distribution of physical assets during the period.

3. The content of the professional and technical activity plans, budget estimates, and budget allocations of the NHP Management Boards must be approved by the Ministry of Health leadership.

4. Based on the budget allocation plan and the program management board's action plan approved by the Ministry leadership, the head of the PMF unit proactively prepares a quarterly budget estimate to submit to the Ministry of Health for consolidation and to request State allocation.

Management and distribution of drug, material, equipment, and chemical funds:

II. 1. The head of the PMF unit shall perform the following tasks:

Based on the approved budget allocation plan and the program management board's action plan, in accordance with the State's financial management, price control, and economic contract signing regulations, actively carry out the following:

1.1. Signing economic contracts to purchase drugs, chemicals, materials, equipment... directly serving the program's professional and technical work.

1.2. Distributing drugs, tools, devices, materials, chemicals... (including aid amounts) to relevant units, localities, and sectors.

For the provinces in the Central Highlands, Central Coast, and South, depending on the specific circumstances of each program, the provinces may receive materials, drugs, chemicals... at regional institutes and branch institutes under the unified direction of the program management board.

1.3. Directly spending on certain program expenses as stipulated by the Ministry of Finance and Health.

1.4. Urging localities and facilities to complete settlement reports. The PMF unit is responsible for summarizing and reporting on direct program expenditures.

2. In necessary cases, the NHP director may adjust the plan within the program's allocated budget.

3. Based on the approved NHP budget plan, the program management board prepares data for allocation to each locality for the Ministry of Health to request the Ministry of Finance to authorize the provincial health departments, while the program management board immediately informs the PMF units, provincial people's committees, provincial finance departments, and local health departments to participate in management.

Aid management:

III. Upon notification of aid amounts for the NHPs to prevent malaria, iodine deficiency disorders, enlarged immunization, and AIDS:

If it is physical assets, the Planning and Finance Department will notify the project directors of international cooperation (ICP) and the NHP directors simultaneously notifying the PMF units to handle receipt and management procedures.

If it is money, it will be transferred to the Ministry of Health's account at the Foreign Trade Bank. Then, it will be allocated and distributed to each locality and facility according to the plan of the ICP project director approved by the relevant NHP management board.

Responsibility for management and supervision of implementation:

IV. The Director of the Planning and Finance Department and the NHP management boards shall, based on the financial and accounting regulations for public institutions and the approved budget allocation plan, regularly inspect and supervise the management and use of funds, aid amounts, and other sources of funds for the NHPs funded by the State placed at subordinate units of the Ministry as well as at localities and sectors that have been allocated and utilized funds.

IMPLEMENTATION PROVISIONS:

The Planning and Finance Department, the Preventive Medicine Department, the Malaria Institute, the Endocrine Hospital, the Parasitology and Tropical Medicine Institute, the Ministry of Health Office, and the NHP management boards funded by the State budget are responsible for organizing the implementation of this circular. During the implementation process, if there are difficulties, the unit should report in writing to the Ministry for consideration and resolution./.

This Circular takes effect from the date of issuance.

The Department of Science and Technology for Health, the Department of Preventive Medicine, the Institute of Malariology - Parasitology - Entomology, the Endocrine Hospital, the Institute of Hygiene and Tropical Medicine, the Office of the Ministry of Health, and the Boards of Directors of the National Specialized Tertiary Hospitals shall be responsible for organizing the implementation of this circular using funds from the State Budget. In case of difficulties during the implementation process, units are requested to report in writing to the leadership of the Ministry for consideration and resolution./.
