NUMBER 15/TBXH OF JULY 18, 1980 GUIDING THE ORGANIZATION AND MANAGEMENT OF THE LIFE OF RETIRED WORKERS, OFFICIALS, AND MILITARY PERSONNEL WHO HAVE STOPPED WORKING DUE TO POOR HEALTH

BASED ON DIRECTIVE NO. 27-CTTW OF DECEMBER 24, 1977 ISSUED BY THE CENTRAL COMMITTEE SECRETARIAT;

BASED ON DECISION NO. 296-CP OF NOVEMBER 20, 1978 ISSUED BY THE STATE COUNCIL TO SUPPLEMENT AND AMEND CERTAIN POINTS REGARDING THE REGIME FOR RETIRED OFFICIALS AND WORKERS WHO HAVE STOPPED WORKING DUE TO POOR HEALTH;

AFTER DISCUSSING WITH THE PARTY CENTRAL ORGANIZATION COMMITTEE, THE GOVERNMENT ORGANIZATION COMMITTEE, THE GENERAL UNION OF VIETNAMESE LABOR, AND THE MINISTRY OF NATIONAL DEFENSE, THE MINISTRY OF WAR INVALIDS AND SOCIAL AFFAIRS NOW GUIDES THE ORGANIZATION AND MANAGEMENT OF THE LIFE OF RETIRED WORKERS, OFFICIALS, AND MILITARY PERSONNEL WHO HAVE STOPPED WORKING DUE TO POOR HEALTH AS FOLLOWS:

I. THE MEANING OF THE ORGANIZATION AND MANAGEMENT OF THE LIFE OF RETIRED WORKERS, OFFICIALS, AND MILITARY PERSONNEL WHO HAVE STOPPED WORKING DUE TO POOR HEALTH

IN THE PAST, THE MINISTRY OF WAR INVALIDS AND SOCIAL AFFAIRS HAS GUIDED THE MANAGEMENT AND CARE OF THE LIVES OF RETIRED OFFICIALS AND WORKERS WHO HAVE STOPPED WORKING DUE TO POOR HEALTH. NOW, THE NUMBER OF PEOPLE RETIRING IS INCREASING; MANY LOCATIONS HAVE SEVERAL THOUSANDS OF SUCH PERSONS, AND MANY COMMUNITIES HAVE HUNDREDS. THEREFORE, IT IS NECESSARY TO STRENGTHEN AND IMPROVE THE ORGANIZATION AND MANAGEMENT OF THE LIFE OF THESE RETIRED PERSONS TO BE SUITABLE WITH THE NEW SITUATION; TO CREATE CONDITIONS FOR THEM TO CONTINUE TO PROMOTE TRADITIONS, MAINTAIN REVOLUTIONARY ETHICS AND QUALITIES, AND FULLY PERFORM THEIR CITIZENSHIP OBLIGATIONS; TO ACTIVELY CONTRIBUTE TO THE CONSTRUCTION OF THE LOCALITY IN ALL ASPECTS OF WORK. AT THE SAME TIME, TO COORDINATE WITH THESE ORGANIZATIONS, GOVERNMENT AUTHORITIES MUST ENSURE THE IMPLEMENTATION OF POLICIES AND REGIMES FOR RETIRED PERSONS WHO HAVE STOPPED WORKING DUE TO POOR HEALTH.

II. THE ORGANIZATION AND MANAGEMENT OF THE LIFE OF RETIRED WORKERS, OFFICIALS, AND MILITARY PERSONNEL WHO HAVE STOPPED WORKING DUE TO POOR HEALTH.

A. RETIREMENT GROUP: THE RETIREMENT GROUP IS ESTABLISHED ACCORDING TO THE UNIT OF COMMUNE, WARD, SUB-DISTRICT, AND EQUIVALENT UNITS AS AN ORGANIZATION FOR THE LIFE OF RETIRED WORKERS, OFFICIALS, AND MILITARY PERSONNEL AFTER THEY HAVE STOPPED WORKING DUE TO POOR HEALTH, INCLUDING THOSE WHO ARE RETIRED TO RECEIVE SOCIAL INSURANCE BENEFITS ACCORDING TO DECISIONS NO. 206-CP OF MAY 30, 1979 AND NO. 174-CP OF JUNE 4, 1980 ISSUED BY THE STATE COUNCIL.

IN THE ABOVE MENTIONED UNITS, IF THERE ARE FROM 3 TO 30 RETIRED PERSONS, ONE GROUP SHALL BE FORMED; IF MORE THAN THAT, THE GROUPS SHALL BE DIVIDED INTO 2, 3... GROUPS. THE ESTABLISHMENT OF RETIREMENT GROUPS AIMS TO:

- ENSURE REGULAR LIFE FOR RETIRED PERSONS TO HAVE THE OPPORTUNITY TO GRASP THE PARTY'S AND STATE'S POLICIES AND THE LOCAL SITUATION AND TASKS SO AS TO ACTIVELY IMPLEMENT AND ENCOURAGE THE POPULATION TO DO THE SAME.

- BUILD A HEALTHY LIFE, HELP EACH OTHER OVERCOME DIFFICULTIES IN LIVING, PREVENT AND COMBAT ANY NEGATIVE PHENOMENA.

- ENCOURAGE EACH OTHER TO EXPLOIT EVERY ABILITY TO PARTICIPATE IN CONTRIBUTING TO THE CONSTRUCTION OF THE LOCALITY ACCORDING TO THEIR HEALTH CONDITIONS, FAMILY CIRCUMSTANCES, AND LEVELS OF ABILITY.

THE RETIREMENT GROUP HAS A GROUP LEADER AND ONE OR TWO GROUP DEPUTIES ELECTED BY THE GROUP. THE GROUP LEADER AND DEPUTIES MUST BE TRUSTED BY THE LOCALITY AND RETIRED MEMBERS, BE ENTHUSIASTIC AND RESPONSIBLE FOR THE COLLECTIVE, AND HAVE SUITABLE HEALTH.

THE GROUP LEADER AND DEPUTIES HAVE THE FOLLOWING DUTIES:

- TO GRASP THE SITUATION OF GROUP MEMBERS AND MAINTAIN REGULAR GROUP ACTIVITIES;

- TO CAREFULLY BUILD A STRONG GROUP AND STRIVE TO REACH A GOOD LEVEL IN ALL ASPECTS;

- TO REPRESENT THE GROUP IN RELATING WITH LOCAL PARTY AND GOVERNMENT ORGANIZATIONS AND ASSOCIATIONS TO PROVIDE ADVICE ON THE IMPLEMENTATION OF THE PARTY'S AND STATE'S POLICIES; TO REFLECT THE GROUP'S OPINIONS AND WISHES TO SUPERIOR AUTHORITIES; AND TO MANAGE THE GROUP'S EXPENDITURES (IF ANY).

THE RETIREMENT GROUP SHALL MEET AT LEAST THREE TIMES A YEAR (ONCE A MONTH WHERE CONDITIONS PERMIT, AND IRREGULARLY WHEN NECESSARY), ENDING THE YEAR WITH A REVIEW OF ACTIVITIES, EVALUATION OF PERFORMANCE, RANKING OF THE GROUP, AND RE-ELECTION OF THE GROUP LEADER AND DEPUTIES (IF NECESSARY).

GROUP ACTIVITIES MUST BE LIGHT, SHORT, AND OF HIGH QUALITY. REPRESENTATIVES OF LOCAL PARTY AND GOVERNMENT ORGANIZATIONS CAN BE INVITED TO ATTEND TO KNOW MORE ABOUT THE SITUATION AND PROVIDE ADVICE TO THE GROUP.

CONTENT OF GROUP ACTIVITIES:

- HEARING REPORTS ON THE GROUP'S ACTIVITIES, WHAT HAS BEEN ACHIEVED, AND UPCOMING TASKS FOR DISCUSSION AND SUGGESTIONS;

- DISCUSSING MEANS TO HELP THOSE WITH LIVING DIFFICULTIES AND THOSE WITH IDEATIONAL AND PERCEPTUAL OBSTACLES;

- DISCUSSING THE IMPLEMENTATION OF THE TASKS AND RIGHTS OF RETIRED PERSONS, AND RECOGNIZING GOOD PERSONS AND ACTIONS IN THE GROUP;

- HEARING SPEECHES ON CURRENT SITUATIONS, POLICIES, AND TASKS OF THE LOCALITY TO INFORM EVERYONE AND TO PROVIDE ADVICE ON THE IMPLEMENTATION OF THE PARTY'S AND STATE'S POLICIES IN THE LOCALITY.

THE GROUP NEEDS TO HAVE A SET OF RULES FOR ACTIVITIES, A LIST OF GROUP MEMBERS, AND RECORDS OF MEETING MINUTES AND OTHER ACTIVITIES.

B. RETIREMENT CONTACT BOARD AT THE LOCAL LEVEL

IN COMMUNITIES WHERE THERE ARE THREE OR MORE RETIREMENT GROUPS AND EACH GROUP HAS TOO MANY MEMBERS, A RETIREMENT CONTACT BOARD SHALL BE ESTABLISHED.

THE RETIREMENT CONTACT BOARD AT THE LOCAL LEVEL IS A UNIFIED POINT OF CONTACT FOR LOCAL PARTY AND GOVERNMENT ORGANIZATIONS AND THE DEPARTMENT OF WAR INVALIDS AND SOCIAL AFFAIRS.

THE MEMBERS OF THE RETIREMENT CONTACT BOARD INCLUDE THE GROUP LEADERS OF THE RETIREMENT GROUPS. THE BOARD ELECTS A CHAIRPERSON AND ONE OR TWO DEPUTIES TO MAINTAIN COMMON ACTIVITIES.

IN ADDITION TO THE DUTIES OF THE RETIREMENT GROUP LEADER, THE RETIREMENT CONTACT BOARD ALSO REGULARLY ORGANIZES THE EXCHANGE OF EXPERIENCE IN ACTIVITY BETWEEN RETIREMENT GROUPS. EACH MEMBER OF THE BOARD IS RESPONSIBLE FOR THE GENERAL MOVEMENT OF RETIRED PERSONS IN THE LOCALITY.

THE RETIREMENT CONTACT BOARD MEETS THREE TIMES A YEAR (IRREGULARLY WHEN NECESSARY) TO HEAR REPORTS ON THE SITUATION OF RETIREMENT GROUPS, THE SITUATION AND TASKS OF THE LOCALITY, AND TO PLAN UNIFIED ACTIONS TO IMPLEMENT IN RETIREMENT GROUPS, AND TO DISCUSS ISSUES RELATED TO RETIREMENT GROUPS.

AFTER BEING ESTABLISHED, THE RETIREMENT GROUP AND THE RETIREMENT CONTACT BOARD AT THE LOCAL LEVEL MUST REPORT TO THE LOCAL GOVERNMENT.

C. RETIREMENT REPRESENTATIVE BOARD AT THE DISTRICT LEVEL

TO ASSIST LOCAL GOVERNMENTS AND THE DEPARTMENT OF WAR INVALIDS AND SOCIAL AFFAIRS IN MANAGING AND CATERING TO THE LIVES OF RETIRED WORKERS AND OFFICIALS WHO HAVE STOPPED WORKING DUE TO POOR HEALTH, AND TO ENCOURAGE THEM TO PARTICIPATE IN LOCAL WORK, DISTRICTS SHALL ESTABLISH A RETIREMENT REPRESENTATIVE BOARD UNDER THE FORM OF NON-PAYMENT ACTIVITY AIMING TO:

- Support the veterans and social affairs sector in organizing the dissemination of directives and resolutions from higher authorities, disseminating current events, policies, and political tasks of the locality to civil servants and military personnel on retirement to enhance their understanding and thereby mobilize everyone to set a good example in implementation and mobilize the people to participate;

- Contribute to building, consolidating, and promoting the role and effectiveness of retired associations and retired liaison boards at the grassroots level, organizing beneficial and healthy social activities such as physical exercise for health, sightseeing, club activities, offering advice to the locality, mobilizing participation in mass revolutionary movements, etc.;

- Propose opinions to assist the Party Committee, government, agencies, and organizations at the district level in implementing state policies and systems for retirees;

- Through retired associations and liaison boards, collect opinions, understand the aspirations of civil servants and military personnel on retirement due to loss of working capacity, and report them to higher authorities for timely guidance measures;

The county-level retired representative council is elected by the meeting of representatives of the liaison boards (or retired associations in places without liaison boards) and recognized by the County People's Committee; the term is two years (in places where elections have not been held, it is temporarily designated by the County People's Committee); the number ranges from ten to fifteen people (depending on the number of retirees and the geographical conditions of each locality). The standing body of the council includes a chairman, one to two vice-chairmen, and a permanent member who is the head of the department or the head of the veterans and social affairs board at the county level. Other members are assigned responsibilities based on their capabilities, specialties, and operational conditions, such as current events, policies, competitions, clubs, material living conditions, and monitoring and assisting some retired associations;

The council meets three times a year, and the standing body meets once a month, following the principle of democratic discussion, with collective agreement being the main focus;

III. IMPLEMENTATION

The Departments of Veterans and Social Affairs assist the Provincial People's Committees in inspecting and understanding the situation of civil servants and military personnel on retirement due to loss of working capacity in the locality to implement organizational consolidation according to the above regulations and integrate these organizations into regular activities;

Annually and every six months, the Departments of Veterans and Social Affairs organize meetings with county-level retired representative councils to hear reports on the situation, exchange experiences in operation among localities, and provide favorable conditions (travel, work tools, material and spiritual incentives, etc.) based on the specific circumstances of the locality to ensure that these comrades perform their tasks well;

The Departments, Offices, and Boards of Veterans and Social Affairs assign dedicated staff to monitor and develop programs and plans for training on duties and methods of operation for retired representative councils, retired liaison boards at the grassroots level, and retired association chairpersons;

During the implementation of this circular, if there are any difficulties, localities should report to the Ministry of Veterans and Social Affairs for prompt resolution./.
