REGULATIONS
ON THE ISSUANCE, USE AND MANAGEMENT OF BARCODE NUMBERS
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These regulations stipulate the issuance, use, and management of various types of barcode numbers (hereinafter referred to as "MSMV") with the national code of Vietnam and the management of foreign MSMV usage.
Article 2. Applicability
These regulations apply to Vietnamese organizations and individuals, foreign organizations and individuals operating within the territory of Vietnam (hereinafter collectively referred to as "organizations/businesses") that have a need to use MSMV and organizations and individuals related to the issuance of MSMV.
Article 3. Explanation of Terms
In this regulation, the following terms are understood as follows:
1. Code Number is a series of digits used to distinguish products, locations, and organizations.
2. Barcode is a series of dark parallel lines and spaces interspersed to represent a number so that a scanner can read it.
3. EAN is the name of the international barcode organization before February 2005.
4. is the name of the international barcode organization from February 2005 to date.
5. EAN number is the standard number defined by the international barcode organization for global application.
6. National code is the first three-digit number assigned by GS1 to member countries. The national code of Vietnam is 893.
7. Business code is a series of numbers consisting of the national code and the organization/business identifier, comprising four to seven subsequent digits.
8. is an eight-digit number specified for small-sized items (products), including the national code, item identifier, and a check digit.
9. Global Location Number (GLN), is a thirteen-digit number specified for organizations/businesses and locations, including the national code, organization/business or location identifier, and a check digit.
10. Global Trade Item Number (GTIN),
11. is the product (item, goods) number, composed of the business code, including types of thirteen-digit numbers - abbreviated as EAN 13; fourteen-digit numbers - EAN 14; eight-digit shortened numbers - EAN 8 and UCC (Uniform Code Council, abbreviated as UCC) of the United States and Canada's Uniform Code Council. Chapter II
is a global electronic registration network for information about members using the barcode system established and managed by GS1.
Article 4. Types of MSMV to be issued and managed
1. Types of MSMV to be issued and uniformly managed include:
a) Business code;
b) Shortened code (EAN 8);
c) Global Location Number (GLN).
2. Types of MSMV that organizations/businesses establish for their own use after being assigned a business code include:
a) Global Trade Item Number (GTIN);
b) Global Location Number (GLN);
c) Various types of codes for logistics units, assets, or other objects when there is a need to use them.
3. Each organization/business may register to use one business code. In special cases, an organization/business may register to use more than one business code upon proving that all allocated numbers have been exhausted. When registering to use additional business codes, the organization/business must follow the initial registration procedures and provide an explanation that all allocated numbers have been used up.
Article 5. Responsibilities for Issuing and Managing MSMV
1. The Standardization, Metrology and Quality Control General Department (hereinafter referred to as the General Department of TCĐLCL) is the agency assisting the Ministry of Science and Technology in issuing the types of MSMV specified in Clause 1 of Article 4 of this regulation and managing the types of MSMV specified in Clauses 1 and 2 of Article 4 of this regulation.
2. After being assigned a business code, organizations/businesses shall establish the types of MSMV specified in Clause 2 of Article 4 of this regulation for their own use and report the list of used codes to the General Department of TCĐLCL every six months.
Article 6. Procedure for Issuing MSMV
The issuance of MSMV shall be carried out according to the following procedure:
1. Registering to use MSMV;
2. Receiving the application dossier for using MSMV;
3. Examining the dossier and issuing the Certificate of Right to Use MSMV;
4. Guiding the use of MSMV.
Article 7. Registration to Use MSMV
1. Organizations/businesses wishing to use MSMV must register to use MSMV at agencies designated by the General Department of TCĐLCL to receive application dossiers for using MSMV (hereinafter referred to as the Dossier Receiving Organization).
2.[2] The application dossier for using MSMV consists of one set, specifically as follows:
a) Application form for using MSMV according to the model prescribed in Appendix I of this regulation (two copies); Clause 2, Article 5 b) Copy of the Business Registration Certificate for production, trading, and commercial businesses or copy of the Establishment Decision for other organizations (present the original for verification, except in cases where the copy has already been certified) (one copy);
c) List of products using GTIN according to the model prescribed in Appendix II of this regulation (two copies).
Article 8. Receiving the Application Dossier for Using MSMV Clause 2, Article 5 1. The Dossier Receiving Organization is responsible for guiding organizations/businesses to prepare the application dossier for using MSMV; receiving and preliminarily processing the application dossier for using MSMV.
2. Within no more than five working days from the date of receipt of the complete dossier, the Dossier Receiving Organization must transfer the dossier to the General Department of TCĐLCL.
Article 9. Examination of the Dossier and Issuance of the Certificate of Right to Use MSMV
Within no more than three working days from the date of receipt of the dossier, the General Department of TCĐLCL will examine the application dossier for using MSMV.
a) If the dossier is valid, the General Department of TCĐLCL will assign a code; register in the registry, store in the national code bank, and issue the Certificate of Right to Use MSMV.
1.[3] b) If the dossier is invalid, the General Department of TCĐLCL will request the organization/business to complete it.
2. The Certificate of Right to Use MSMV will be sent to the organization/business using MSMV through the Dossier Receiving Organization within no more than ten days from the date of issuance by the General Department of TCĐLCL. The model of the Certificate of Right to Use MSMV is prescribed in Appendix IV of this regulation.
3. When there is a change in the legal status, name, or transaction address of the organization/business using MSMV, or if the Certificate is lost or damaged, the organization/business using MSMV must notify the General Department of TCĐLCL in writing to obtain a replacement or new Certificate. The organization/business using MSMV is responsible for paying the costs of replacing and reissuing the Certificate of Right to Use MSMV..
2. The Certificate of Right to Use MSMV shall be sent to the organization/business using the MSMV through the organizations receiving the application files within a period not exceeding ten days from the date on which the General Department of Quality Inspection issues it. The model of the Certificate of Right to Use MSMV is specified in Appendix IV of this Regulation.
3. When there is a change in the legal status, name, or transaction address of the organization/business using the MSMV, or when the Certificate is lost or damaged, the organization/business using the MSMV must notify the General Department of Quality Inspection in writing to obtain a replacement or new Certificate. The organization/business using the MSMV shall bear the responsibility for paying the costs of replacing and issuing the new Certificate of Right to Use MSMV.
Article 10. Guidelines for Using MSMV
The organization receiving applications has the responsibility to guide organizations/businesses registering to use MSMV to comply with the regulations on using MSMV stipulated in Chapter III of this Regulation and other relevant regulations concerning the use of MSMV.
Article 11. Fees for Issuing MSMV
1.[4] Organizations/businesses using MSMV must pay the fee for issuing MSMV when registering to use MSMV and the annual maintenance fee to the organization receiving applications according to Circular No. 88/2002/TT-BTC dated October 2, 2002 on "Regulations on Collection, Payment, and Management of Usage Fees for Barcode Numbers"; Circular No. 36/2007/TT-BTC dated April 11, 2007 amending and supplementing Circular No. 88/2002/TT-BTC of the Ministry of Finance, and other current relevant regulations..
2. The annual maintenance fee for using MSMV must be paid before June 30 each year. If it is not paid within that period, the organization receiving applications will notify the organization/business using MSMV to make the payment. If an organization/business does not pay the annual maintenance fee for using MSMV within one year, the General Department of Standardization and Quality will reclaim the issued code number, notify the organization/business, and widely inform related agencies.
Chapter III
USE OF BARCODE NUMBERS
Article 12. Use of Issued MSMV
After being assigned a business code, organizations/businesses using MSMV shall independently define product identification numbers, organizational/place identifiers, and establish various types of MSMV as specified in Clause 2 of Article 4 for their products and organizational/places. Organizations/businesses using MSMV must submit a list of Global Trade Item Numbers (GTIN) and Global Location Numbers (GLN) used to the General Department of Standardization and Quality (through the organization receiving applications) for centralized management, in accordance with Clause 2 of Article 5 of this Regulation. The product registration list using GTIN shall be submitted in the format prescribed in Appendix II of this Regulation.
Article 13. Affixing and Recording MSMV
The affixing or recording of MSMV on products, labels, packaging, transportation means, and accompanying documents must comply with national standards, international standards, and other relevant regulations.
Article 14. Ensuring the Uniqueness of Registered Code Numbers and Barcode Quality
Organizations/businesses using MSMV are responsible for ensuring the uniqueness of registered code numbers and barcode quality, adhering to relevant national and international standards. Organizations/businesses using MSMV have the responsibility to provide information describing the objects bearing MSMV to partner organizations and individuals.
Article 15. Transfer, Authorization to Use MSMV, and Use of Foreign Codes
1. Organizations/businesses are not allowed to transfer the right to use MSMV issued by the General Department of Standardization and Quality to another organization/business.
2. When an organization/business wishes to authorize a joint venture entity or a processing entity to use the MSMV issued by the General Department of Standardization and Quality on joint venture products or under processing contracts, the organization/business must issue an authorization letter (letter of authorization, usage contract, or other forms of authorization) confirmed by the General Department of Standardization and Quality and send it to the joint venture entity or processing entity as proof of authorization.
3. Organizations/businesses operating in Vietnam using foreign codes on their products must obtain permission from the competent authority of the foreign country or be authorized by the organization/business owning the foreign code, and must report the use of foreign codes to the General Department of Standardization and Quality in writing, attaching a copy of the certificate of code usage rights or the authorization letter.
Chapter IV
RECALL OF ISSUED BARCODE NUMBERS
Article 16. Voluntary cessation of use of MSMV
When an organization/business using MSMV wishes to cease using MSMV, it must submit a written notice and return the Certificate of Right to Use MSMV to the General Department of Quality Inspection through organizations receiving applications. The General Department of Quality Inspection shall issue a decision to reclaim the issued code number and the Certificate of Right to Use MSMV, notify the organization/business using MSMV, and widely publicize this information to relevant organizations.
Article 17. Revocation of the Certificate of Right to Use MSMV
The Certificate of Right to Use MSMV that has been issued will be revoked when the organization/business using MSMV violates provisions and clauses of this Regulation and the commitments made at the time of registration for using MSMV.
Chapter V
MANAGEMENT OF THE NATIONAL CODE NUMBER BANK AND MAINTENANCE OF RECORDS AND DATA ON ISSUANCE AND USE OF CODE NUMBERS AND BARCODES
Article 18. Management of the national code number bank and maintenance of records
The General Department of Quality Inspection is responsible for establishing and maintaining the National Code Number Bank of Vietnam with the country code 893; keeping records on issuance and use of MSMV and records and documents related to the use of foreign MSMV.
Article 19. Establishment and publication of the list of issued codes
Annually, the General Department of Quality Inspection is responsible for establishing and publishing the list of issued codes of Vietnam (Annual Catalogue of MSMV) and managing the list of Global Trade Item Numbers (GTIN) and Global Location Numbers (GLN) used, reported periodically by organizations/businesses using MSMV.
Article 20. Management of Database
[5]The General Department of Quality Inspection is the unified management agency for registration data on the use of MSMV in Vietnam and the use of foreign codes in Vietnam, organizing data exploitation in accordance with the regulations of the International Organization for Standardization (ISO) and Vietnamese law..
Article 21. Confidentiality of information about organizations/businesses
The General Department of Quality Inspection and organizations receiving registration applications for using MSMV have the responsibility to keep confidential the information of organizations/businesses registering to use MSMV, except for information required to be disclosed according to the requirements of the International Organization for Standardization (ISO).
Chapter VI
INSPECTION, SUPERVISION, SETTLEMENT OF COMPLAINTS AND REPORTS REGARDING THE ISSUANCE AND USE OF CODE NUMBERS AND BARCODES
Article 22. Responsibility for conducting inspections
The specialized inspection body of the Quality Inspection performs inspections regarding MSMV in accordance with the laws on inspection.
Article 23. Responsibility for conducting supervision
1. The General Department of Quality Inspection (Vietnam Standards and Quality Center) conducts supervision of the use of MSMV in accordance with Chapter III of this Regulation and other relevant standards and regulations.
2. Upon discovering improper use of MSMV, the supervisory authority has the responsibility to remind and guide the organization/business using MSMV to comply with current regulations.
3. Upon discovering violations in the use of MSMV, the supervisory authority has the responsibility to recommend to the competent authority to handle the matter.
Article 24. Handling of violations
1. Organizations and individuals violating the law on MSMV shall be subject to administrative penalties in accordance with Decree No. 126/2005/NĐ-CP dated October 10, 2005 of the Government on administrative penalties in the field of measurement and product quality.
2. Heads of organizations, civil servants, and officials who abuse their positions and powers to cause inconvenience to organizations/businesses using MSMV or cover up for violators shall be dealt with in accordance with the law.
Article 25. Complaints and Reports
1. Organizations and individuals have the right to file complaints and reports regarding violations of regulations on issuing and using MSMV in accordance with the laws on complaints and reports.
2. The resolution of complaints and reports concerning the issuance and use of MSMV shall be carried out in accordance with the laws on complaints and reports.
Chapter VII
IMPLEMENTING PROVISIONS
[6]Article 26. Reporting on Issuance and Management of MSMV Usage
The General Bureau for Standardization, Metrology and Quality Control is responsible for annually compiling and reporting to the Ministry of Science and Technology on the situation of issuance, usage, and management of MSMV; inspection, supervision, complaint, and report handling work related to the issuance and use of MSMV; feedback information related to the implementation of this Regulation as well as suggestions for amending and supplementing the content of this Regulation when necessary.
Article 27. Guidance on Implementation
The General Bureau for Standardization, Metrology and Quality Control is responsible for organizing and guiding the implementation of this Regulation./.
