DECISION OF THE MINISTER OF FINANCE
Regulations on functions, tasks, powers, and organizational structure of the Investment Department
THE MINISTER OF FINANCE
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Based on Circular No. 1912/BNV-TCBC dated August 15, 2003, of the Ministry of Home Affairs regarding agreement to establish rooms at some units under the Ministry of Finance;
Considering the proposal of the Head of the Investment Department and the Head of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1.
The Investment Department is a unit within the state management machinery of the Ministry of Finance, assisting the Minister of Finance in performing state management functions concerning financial investment and construction throughout the country.
Article 2. The Investment Department has the following tasks:
1. Submitting to the Minister of Finance draft regulatory legal documents, mechanisms, and policies on financial management in the fields of investment and construction; mechanisms for mobilizing, managing, and using capital for national target programs and important State projects.
2. Submitting to the Minister of Finance strategic orientations, development plans, and plans (long-term, five-year, annual) on financial investment and construction.
3. Leading and coordinating with units under the Ministry to develop budget expenditure standards and norms in investment and construction; participating in developing policies, systems, and mechanisms for mobilizing, managing, and using foreign investment capital and domestic investment credit capital.
4. Leading and coordinating with units under the Ministry to participate with other Ministries, central agencies, and localities in formulating mechanisms, policies, and management systems related to financial investment and construction.
5. Directing, inspecting, and evaluating the implementation of regulatory legal documents, strategies, plans, and programs approved by competent authorities in the field of financial investment and construction within the scope of the Ministry of Finance's state management.
6. Coordinating with the Legal Department to inspect regulatory legal documents issued by Ministries, central agencies, People's Councils, Provincial People's Committees, and centrally-administered city People's Committees; submitting to competent authorities for handling violations within the assigned scope and management jurisdiction of the Department.
7. Guiding financial agencies at all levels in reviewing the financial aspects of investment projects regarding content, procedures, methods of preparing and managing investment and construction budgets of state organizations in accordance with the law.
8. Leading and coordinating with units under the Ministry to participate in financial-related contents in general planning projects, economic and social development planning projects, urban and rural planning projects, industry and regional economic development planning projects, detailed urban planning projects, industrial zones, high-tech zones, border economic zones.
9. Leading and coordinating with units under the Ministry to review funding mobilization plans, financial plans, total investment amounts, investment capital structures, and economic-financial effectiveness of Group A investment projects (regardless of funding sources) and large projects decided by the Prime Minister.
10. Coordinating with specialized agencies of the Ministry of Planning and Investment in preparing the annual state budget investment expenditure plan; the level of state credit support annually and adjustments to the budget when necessary in the field of investment and construction; allocation schemes of the central budget for investment and construction expenditures.
Participating in determining the total investment amount and the state budget contribution in projects where the State participates in investment.
11. Directing and coordinating inspections of the annual investment capital allocation plans of ministries and central agencies as stipulated by the State Budget Law, Investment Management Regulations, and annual state budget plan and estimate directives issued by the Prime Minister. Leading the consolidation, reporting, and proposing solutions to the Minister of Finance and the Prime Minister for handling issues related to the allocation and assignment of annual investment capital plans.
Announcing payment plans for investment capital at the State Treasury for projects managed by central agencies. Monitoring and managing the use of central government investment funds controlled by the State Treasury.
Submitting to the Ministry and the Prime Minister for handling adjustments and supplements to annual investment capital plans; implementing additional capital and advance payments for urgent and unexpected purposes.
Leading and coordinating with central Ministries, agencies, and relevant units to guide, monitor, and inspect the implementation of annual investment capital plans; inspecting the execution of central government investment capital payments.
12. Proposing measures to accelerate the disbursement of investment capital.
13. Directing and coordinating inspections of the annual investment capital allocation plans of localities as stipulated by the State Budget Law, Investment Management Regulations, and annual state budget plan and estimate directives issued by the Prime Minister. Leading the consolidation, reporting, and proposing solutions to the Minister of Finance for handling issues related to the allocation and assignment of annual investment capital plans of localities.
Submitting to the Ministry proposals for supplementary investment capital targets for local investment projects, handling arising issues during the implementation of investment plans and capital payments.
Coordinating inspections of the implementation of investment capital plans by localities.
Coordinating with local financial agencies to inspect the execution of local government investment capital payments.
14. Participating in tender examinations in construction investment according to regulations.
15. Directing and inspecting Ministries, central agencies, and localities in preparing, examining, and approving final accounts of investment capital for projects according to regulations.
Organizing examinations and submitting to the Ministry for approval of final accounts of investment capital for projects decided by the Prime Minister and Group A projects using state budget capital.
Leading and coordinating with the State Budget Department to examine final accounts of annual investment capital usage from the central budget that the State Treasury implements control and payment over.
16. Developing regular information reporting systems on the situation of mobilizing, managing, and using state budget investment capital, state-guaranteed credit capital, state investment development credit capital, and other sources of capital for investment and construction.
Coordinating the organization of information work related to state management activities in the field of financial investment and construction.
17. Compile reports, analyze the situation regarding the mobilization, management, utilization, and settlement of investment capital.
Carry out analytical forecasting work, statistics, and compilation of situations and data; analyze and evaluate the effectiveness of state investment capital usage by sector, field, and territory; propose supplements and improvements to policies, systems, and management measures to enhance the efficiency of state development investment capital usage.
18. Coordinate and participate in drafting national financial policy, scientific research activities, and international cooperation in the field of financial investment as assigned by the Ministry.
Article 3. The Director of the Investment Department has the authority:
1. To recommend the Minister of Finance to suspend payment of capital for projects that do not comply with regulations; to make recommendations on other related issues to continue improving the control of investment capital settlement at the State Treasury;
2. To sign guiding and explanatory documents for financial-budgetary management policies and systems concerning investment and construction;
3. To request central ministries and agencies, the State Treasury, local finance authorities, state development support fund management agencies, and other relevant units to submit reports on the mobilization, receipt, and management of investment capital as stipulated by the Minister of Finance; to request relevant units within the Ministry of Finance, local finance authorities, project sponsors, and other relevant agencies to provide necessary materials and data for the performance of assigned tasks.
Article 4.
The Investment Department shall have a Director and several Deputy Directors. The Director is responsible for comprehensive management of the staff of the department; organizing training and enhancing the competence of staff; being accountable to the Minister for all activities of the department.
Deputy Directors are accountable to the Director for the tasks assigned to them.
The Investment Department shall have the following divisions:
1- Policy and Compilation Division
2- Central Investment Division
3- Local Investment Division
4- Settlement Division
Specific tasks of the Divisions shall be defined by the Director of the Investment Department.
The Investment Department shall organize the implementation of work under a specialist system combined with divisional organization; for tasks carried out under the specialist system, the Director of the Investment Department shall be responsible for organizing work and assigning tasks to specialists in accordance with their positions, standards, and professional capabilities to complete assigned tasks.
The staffing of the Investment Department shall be decided by the Minister of Finance.
Article 5. This Decision takes effect from the date of signature. Decree No. 144/1999/QĐ-BTC dated November 26, 1999 of the Minister of Finance on the tasks, powers, and organizational structure of the Investment Department under the Ministry of Finance is hereby abolished. The Director of the Investment Department, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry's Office, heads of units and organizations under the Ministry shall be responsible for implementing this Decision./.
