OF THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
CHAIRMAN
THE DEMOCRATIC REPUBLIC OF VIETNAM
Pursuant to Decree-Law No. 63 dated November 22, 1945, No. 77 dated December 21, 1945 and subsequent decrees organizing and establishing local people's administrations;
Pursuant to Decree-Law No. 91 - SL dated October 1, 1947 merging the Resistance Committees and Administrative Committees at all levels;
Pursuant to Decree-Law No. 151 - SL dated March 25, 1948 defining the composition and procedures for recognizing or appointing members of the Resistance Committees and Administrative Committees;
Pursuant to Decree-Law No. 254 - SL dated November 19, 1948 organizing local people's administrations during the resistance period;
Pursuant to Decree-Law No. 255 - SL dated November 19, 1948 defining the organization and methods of operation of People's Councils and Resistance Committees and Administrative Committees in areas temporarily occupied or threatened;
Pursuant to Decree-Law No. 37 - SL dated May 11, 1949 placing the Hanoi Resistance Committee under the central government;
At the request of the Supreme National Defense Council and the Minister of Interior Affairs;
In accordance with a resolution of the Government Council after consultation by the Standing Committee of the National Assembly;
ISSUES THE DECREE-LAW
Article 1
For Resistance Committees at all levels, in addition to the duties and powers prescribed in current laws and regulations, from now on, the Minister of Interior Affairs shall have the following additional duties and powers:
1 - Propose to the President of the Democratic Republic of Vietnam to issue a decree appointing members, chairman, and vice-chairman of Resistance Committees at provincial level and Hanoi City.
2 - Appoint or recognize members, recognize chairmen and vice-chairmen of Resistance Committees at provincial or city levels (except for Hanoi) upon the proposal of provincial-level Resistance Committees after submitting to the Chairman of the Government.
3 - Decide on resignation requests from members of Resistance Committees at provincial or city levels (except for Hanoi) and propose to the Government to decide on resignation requests from members of provincial-level Resistance Committees and Hanoi City Resistance Committee.
4 - Dismiss, remove, or discipline members of Resistance Committees at provincial or city levels (except for Hanoi) who commit offenses after submitting to the Chairman of the Government.
Article 2
Any provisions contrary to this decree-law are hereby abolished.
Article 3
The Supreme National Defense Council and the Minister of Interior Affairs shall implement this decree-law accordingly.
