CIRCULAR

Regulations on detailed provisions and guidance for commendation and reward

in the Vietnam People's Army.

Based on the Law on Commendation and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward dated November 16, 2013;

Pursuant to the Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward;

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Political Department;

The Minister of National Defense issues this Circular providing detailed regulations and guidance for commendation and reward in the Vietnam People's Army.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed regulations and guidance for commendation and reward in the Vietnam People's Army (hereinafter referred to as the Army), including: Scope, subjects, principles of commendation and reward; organization of competition; titles and standards for titles of commendation; forms, subjects, standards for rewards; authority to decide rewards; procedures, formalities, files for rewards; competition and reward councils, competition and reward teams; funds for competition and reward; rights and obligations of individuals and collectives receiving rewards; complaints, denunciations and handling violations in competition and reward.

Article 2. Applicability

1. For individuals:

a) Military personnel, workers, civil servants, defense officials and laborers belonging to agencies, units, organizations, enterprises within the Army;

b) Reserve military personnel; civilian militia and self-defense forces personnel during concentrated time performing military and national defense tasks;

c) Vietnamese citizens, overseas Vietnamese, foreigners who have contributed to the construction of the Army, consolidation of national defense, and protection of the Socialist Republic of Vietnam.

2. For groups:

a) Ministry of National Defense;

b) General Staff Department, Political Bureau; Logistics General Corps, Engineering General Corps, Defense Industry General Corps; General Corps II; military regions, military branches, Border Guard Force, Command of the Capital City of Hanoi, Command of the Coast Guard, Command of the Mausoleum Protection Unit of President Ho Chi Minh, Command 86, corps, arms, and equivalent units (hereinafter referred to as subordinate units of the Ministry of National Defense);

c) Agencies, units from platoon level to division level and equivalent; youth, women, trade union organizations (hereinafter referred to as mass organizations);

d) Enterprises under the Ministry of National Defense; shareholding enterprises where the Ministry of National Defense holds less than 50% of the charter capital and participate in the competition movement in the Army;

đ) State agencies; political organizations; political-social organizations; political-social-professional organizations; social-professional organizations; economic organizations; international organizations in Vietnam; foreign agencies and organizations and other relevant agencies, units, organizations, and individuals related to commendation and reward in the Army.

Article 3. Principles of Competition and Reward

1. Competition principles shall be implemented according to Clause 1, Article 6 of the Law on Commendation and Reward and the following provisions:

a) Collectives and individuals participating in the competition movement must register for competition.

b) The awarding of commendation titles must be based on the achievements of collectives and individuals in the competition movement. Commendation titles shall not be awarded to collectives and individuals who did not register for competition.

c) In cases of short-term training or training lasting less than one year, achieving results from good and above, and complying with unit training or training regulations, such periods can be combined with working time at the unit for evaluation of commendation titles.

d) For individuals transferred to new positions, new units are responsible for evaluating and awarding commendation titles (in cases where the individual has worked at the previous unit for six months or more, the opinion of the previous unit must be obtained).

đ) Commendation titles shall not be awarded to newly established collectives under ten months old, newly recruited individuals under ten months, individuals absent from work for forty days or more (except for female employees on maternity leave; those engaged in combat, combat support, rescue operations, and who were injured and required treatment; those on leave or taking advantage of the system); collectives and individuals subject to administrative penalties or disciplinary actions from reprimand and above.

2. Reward principles shall be implemented according to Clause 2, Article 6 of the Law on Commendation and Reward 2003; Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward 2013, and Article 3 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing implementation of certain provisions of the Law on Commendation and Reward (hereinafter referred to as Decree No. 91/2017/ND-CP). Specifically as follows:

a) Forms and levels of rewards must be appropriate to the nature of each type of achievement, commensurate with the results achieved or the degree of effort, contribution, and dedication of each collective and individual. Emphasis should be placed on rewarding collectives and individuals directly involved in combat, combat support, training, work, and production.

b) In one year, it is not recommended to propose the awarding of two of the following national-level reward forms to a single collective or individual: Orders; titles: "Heroic Laborer", "Heroic Worker", "National Model Worker"; "Prime Minister's Commendation" (except for outstanding and sudden achievements or recognition of a long-term contribution).

c) A reward form may be given multiple times to a recipient; multiple reward forms shall not be given for a single achievement; for the same achievement, at the same time, a single reward form shall not be given to multiple levels within the same unit. Rewards given in batches or special topics do not count as conditions or criteria for proposing national-level rewards.

d) When considering rewards based on merit (regular rewards), two flags of commendation from subordinate units of the Ministry of National Defense can be exchanged for one flag of commendation from the Ministry of National Defense.

đ) Rewards in various mass organizations and in mid-term and final reviews of campaigns and competition movements mainly use reward forms within the scope and authority of the organizing unit; in cases of particularly outstanding and exemplary achievements with significant influence throughout the army and the country, proposals can be made to the Minister of National Defense, Prime Minister, or President for rewards; the highest level of reward is up to "Third-Class National Defense Order" or "Third-Class Labor Order".

e) Rewards for the heads of agencies and units must be based on both their individual achievements and the achievements of the agency or unit they are responsible for. When considering rewards during the summary of the competition movement, rewards for the heads of agencies and units will only be considered when the agency or unit under their responsibility has been rewarded.

g) For female leaders and managers, the time required to hold a position to be eligible for reward for dedication shall be reduced by one-third compared to the general regulations.

Rewards shall not be considered for groups or individuals who are currently under disciplinary review or investigation, inspection, or examination due to suspected violations, or whose complaints or reports are still being verified and have not yet concluded.

3. No commendation titles shall be awarded annually in the summary of the competition movement and Certificates of Merit from the Minister of National Defense, but rather national-level rewards shall be granted for achievements at different stages, with the performance of subordinate units serving as criteria for rewarding the following collectives: General Staff Department, Political Bureau; Logistics, Engineering, Defense Industry General Departments; General Department II; military regions, military branches, corps, arms, formations; Border Guard Force, Command of Hanoi Capital, Coast Guard Command, Command for Guarding Ho Chi Minh Mausoleum, Command 86, Government Communication Service Department, Military Industry-Telecommunication Group.

Article 4. Responsibilities of organizations, agencies, units, and individuals in implementing and organizing the competition movement

1. The Minister of National Defense shall organize responses to competition movements initiated by the President and the Prime Minister; initiate, direct, and implement competition movements throughout the entire military; consider and decide on rewards or propose to the Prime Minister and the President to reward groups and individuals with outstanding achievements in the competition movement.

2. The Political Bureau assists the Central Military Commission, the Minister of National Defense in directing, guiding, inspecting, and evaluating the results of competition and reward work and the "Determined to Win" competition movement within the military.

3. Party committees, political commissars, political officers (party secretaries), commanding officers of agencies and units are responsible for leading and directing competition and reward work and the "Determined to Win" competition movement; identifying and selecting groups and individuals with outstanding achievements in the competition movement for rewards within their authority or proposing higher-level rewards.

4. Political organs at all levels are responsible for advising and proposing to party committees, political commissars, political officers, and commanding officers to lead and direct competition and reward work; guiding, inspecting, and evaluating the results of competition and reward work; advising and proposing the awarding of state honors, commendation titles, and various forms of rewards for groups and individuals within the unit.

5. Competition and Reward Councils, competition and reward teams are responsible for advising, consulting, inspecting, and supervising the implementation of the Party's policies, the State's laws, directives, resolutions of the Central Military Commission, the Ministry of National Defense, and the Political Bureau's guidance on competitions and rewards within the unit; reviewing groups and individuals with outstanding achievements to advise and consult with party committees, political commissars, political officers, and commanding officers to consider and decide on rewards within their authority or propose higher-level rewards.

6. Military personnel councils are responsible for motivating all military personnel, workers, civil servants, defense officials, and employees in the unit to actively and voluntarily participate in the competition movement; identifying and proposing awards for commendation titles, state honors, and various forms of rewards for groups and individuals with outstanding achievements in the competition movement.

7. Professional departments and mass organizations cooperate in propaganda and motivation for cadres, soldiers, workers, civil servants, defense officials, employees, league members, and association members to participate in the competition movement. Before implementing the competition movement and considering rewards according to the directives of central ministries, sectors, and mass organizations, they must report to the Chief of the Political Bureau and the Minister of National Defense.

8. Steering committees, permanent offices of steering committees for specialized competition movements, and permanent offices of summary tasks and main areas of work collaborate with political organs at the same level to research and advise on drafting guidelines and directives for implementing competition and reward work in their respective fields.

9. Functional agencies are responsible for assisting the chairpersons of competition and reward councils at the same level in summarizing, evaluating, and commenting on the results of competition and reward work in their respective fields or industries; providing opinions on the granting of commendation titles or rewards for groups and individuals within the scope and functions of their respective fields or industries.

10. Military information and press agencies are responsible for regularly and promptly publicizing the Party's policies, the State's laws, directives, and resolutions of the Central Military Commission, the Ministry of National Defense, and the Political Bureau's guidance on competitions and rewards; identifying, promoting, and widely disseminating exemplary models and good deeds in the competition movement; participating in struggles to prevent violations of laws on competitions and rewards.

Chapter II

ORGANIZATION OF COMPETITIONS, COMMENDATION TITLES, AND STANDARDS FOR COMMENDATION TITLES

Section 1. ORGANIZATION OF COMPETITIONS

Article 5. Forms of Competition and Award Programs

1. Regular competition is a form of competition based on the functions and tasks assigned to collectives and individuals, organized to promote the effective completion of daily, monthly, quarterly, and annual work of agencies and units. The target of regular competition includes individuals within a collective, collectives within the same agency or unit, or between agencies and units with similar functions, tasks, and nature of work.

2. Periodic (specialized) competition is a form of competition organized to effectively accomplish key, urgent, or difficult tasks of agencies and units.

Article 6. Content of organizing the competition movement

1. Plan Development

a) The content of the plan includes: Purpose, requirements, theme, objectives, scope, targets, duration of the competition; content, indicators, measures for organizing and implementing.

b) The organization of the competition movement plan is established by the agency or unit.

2. Organizing the launch of competitions must be appropriate to the characteristics, nature of tasks, scope, and participants of each agency or unit. It can be organized as a separate launching ceremony or combined with other activities of the agency or unit.

The program of the launching ceremony includes:

a) Raising the flag;

b) Stating the reasons, introducing representatives;

c) Reporting on the results of the previous competition movement (period), launching a new competition movement (period), awarding prizes (if any);

d) Superior leaders delivering guidance speeches (if any); unit leaders responding;

đ) Representatives of the agency or unit making competition pledges;

e) Signing the competition agreement;

g) Reviewing the formation (when launching the competition outdoors);

h) Closing the ceremony.

3. Implementing measures to organize competitions

a) Organizing the dissemination and encouragement of collectives and individuals to actively respond to and register for competitions;

b) Monitoring and supervising the process of organizing competitions, promptly identifying and adjusting contents that are not suitable to the actual conditions of the unit;

c) Identifying, nurturing, promoting, and expanding exemplary models in the competition movement.

4. Summarizing and concluding competitions: At the end of each competition movement or period, a summary and conclusion must be organized to evaluate the results of the competition, select outstanding and exemplary collectives and individuals in the competition movement for commendation and awards, or recommend them to the competent authority for awards. For long-term competition periods, an interim summary may be organized in the middle of the period to draw lessons.

Article 7. Requirements for Organizing Competition Movements

1. The content, indicators, and methods of competition must be feasible, consistent with the characteristics and tasks of the agency or unit, and aimed at effectively fulfilling political tasks; set standards higher than normal levels to encourage each collective and individual to strive to complete their tasks.

2. Effectively conducting propaganda, education, encouragement, motivation, and fostering a sense of responsibility and self-awareness among officers, soldiers, workers, civil servants, and defense officials to participate actively.

3. Agencies and units from division level or equivalent, if the immediate superior has already organized a launching ceremony for the competition, then subordinate agencies and units only need to disseminate, specify, register for competition, and implement.

4. Continuously urging, guiding, summarizing, drawing lessons; building, expanding exemplary models, innovative models, and effective practices.

5. Diversifying forms of organizing competition movements; opposing all superficial and wasteful practices in organizing competition movements.

Article 8. Reporting and Announcing Competition Results

1. Form: Reports and announcements of competition results shall be made in written form on paper. At the same time, cultural institutions and internal broadcasting systems shall be utilized to promptly announce competition results to subordinate agencies and units.

2. Content of reports and announcements include: leadership, guidance, organization and implementation; results of achieving competition goals, contents, and targets (with supporting data and comparisons), highlighting outstanding collectives and individuals, new models, innovative and effective methods in implementing competition goals and contents, identifying causes and experiences; directions for organizing competitions in the subsequent period.

3. Time for reporting and announcing competition results

a) The Ministry of National Defense shall report to the Central Steering Committee for Competition and Rewarding (through the Central Office for Competition and Rewarding) and announce competition results to subordinate agencies and units twice a year: mid-year, before July 15; end-of-year, before December 31.

b) Subordinate agencies and units of the Ministry of National Defense shall report to the Political General Department (through the Propaganda Bureau) and inform other agencies and units twice a year: mid-year, before June 15 (a quick report before May 31); end-of-year, before November 30 (a quick report before November 1).

c) Division-level units and equivalent units shall report to their immediate superiors and inform other agencies and units once every quarter (in the first and third quarters, before the last day of the quarter; in the second and fourth quarters, combined with mid-year and end-of-year reports, before June 10 and November 15).

d) Regimental-level units and equivalent units shall report to their immediate superiors once a month, before the last day of each month. Mid-year report before June 1; annual report before November 1. Inform other agencies and units weekly.

đ) Battalion-level units and equivalent units shall report to their superiors every Friday. Inform units daily.

e) Company-level units and equivalent units shall report to their immediate superiors and inform units daily.

g) Reporting and announcing competition results during campaigns or special topics: Conducted immediately after the completion of the campaign or interim summary of the competition.

h) In case of outstanding achievements, report to immediate superiors and inform other agencies and units immediately after the collective or individual achieves the outstanding achievement.

Section 2. DECISIVE COMPETITION CONGRESS

Article 9. Scope and Duration of Congress Organization

1. The Decisive Competition Congress is organized from regimental level and equivalent to the entire military.

2. The Decisive Competition Congress is held every five years.

Article 10. Contents of the Congress

1. Summarizing and evaluating the results of competition and reward work and the Decisive Competition Movement over the past five years, identifying strengths and weaknesses, drawing lessons from leadership, guidance, and organization of the Decisive Competition Movement and competition and reward work at each level and throughout the military.

2. Determining directions, goals, and tasks for competition and reward work and the Decisive Competition Movement for the next five years; focusing on measures and methods to improve the quality and effectiveness of competition and reward work and the Decisive Competition Movement of agencies and units.

3. Honoring and rewarding outstanding collectives and individuals in the Decisive Competition Movement; promoting and encouraging all organizations and individuals to learn from exemplary advanced models, good people, and good deeds.

Section 3. COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

Article 11. Commendation Titles

The commendation titles for individuals and groups shall be implemented according to the provisions of Article 20 of the Law on Encouragement and Reward in 2003. Specifically as follows:

1. Competition titles for individuals include:

a) "National Model Soldier";

b) "Army-wide Model Soldier";

c) "Unit-level Model Soldier";

d) "Advanced Soldier", "Advanced Worker".

2. Commendation titles for groups include:

a) "Flag of Encouragement from the Government";

b) "Flag of Encouragement from the Ministry of National Defense";

c) Flag of Encouragement from subordinate units under the Ministry of National Defense;

d) "Victory Unit", "Outstanding Labor Group";

đ) "Advanced Unit", "Advanced Labor Group".

3. In addition to the commendation titles specified in Clause 1 and Clause 2 of this Article, agencies, units, sectors, and mass organizations may propose other forms of honor, but must report to the Director of the General Political Department and the Minister of National Defense.

Article 12. Standards for Commendation Titles

The standards for commendation titles shall be implemented according to the provisions of Articles 9, 10, 11, and 12 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. Title "National Model Soldier"

a) The title "National Model Soldier" is awarded to individuals with outstanding achievements, selected from those who have twice consecutively received the title "Army-wide Model Soldier" and must have initiatives to improve work efficiency, labor productivity, or scientific research projects that have been accepted and applied in practice, or acts of bravery and creativity in combat or service support recognized by the Minister of National Defense.

Initiatives (technical solutions, management solutions, work solutions, operational solutions, application of technological progress) or scientific research projects serving as grounds for awarding the title "National Model Soldier" must be applied in practice; acts of bravery and creativity in combat or service support must yield high effectiveness and have a wide impact throughout the army and the country.

b) The time for considering the title "National Model Soldier" is carried out immediately following the year the individual receives the title "Army-wide Model Soldier" for the second time.

2. Title "Army-wide Model Soldier"

a) The title "Army-wide Model Soldier" is awarded to individuals with outstanding achievements, selected from those who have three consecutive times received the title "Unit-level Model Soldier" and must have initiatives to improve work efficiency, labor productivity, or scientific research projects that have been accepted and applied, or acts of bravery and creativity in combat or service support recognized by the head of subordinate units under the Ministry of National Defense.

Initiatives, scientific research projects of individuals; acts of bravery and creativity in combat or service support must yield high effectiveness and have an impact within subordinate units under the Ministry of National Defense.

b) The time for considering the title "Army-wide Model Soldier" is carried out immediately following the year the individual receives the title "Unit-level Model Soldier" for the third time.

3. Title "Unit-level Model Soldier"

a) The title "Unit-level Model Soldier" is regularly awarded annually to individuals who are outstanding and complete their assigned tasks excellently, selected from those who meet the criteria for the title "Advanced Soldier" or "Advanced Worker" and must have initiatives to improve work efficiency, labor productivity, or scientific research projects that have been accepted and applied at the unit, or acts of bravery and creativity in combat or service support recognized by the head of the unit at the brigade level or equivalent.

b) The ratio of awarding the title "Unit-level Model Soldier" does not exceed 10% of the total number of personnel in the unit.

4. Title "Advanced Soldier", "Advanced Worker"

a) The title "Advanced Soldier" is regularly awarded annually to military personnel, civil servants, and public officials who meet the following criteria:

Completing well the plans, targets, and tasks assigned for the year; all contents of tests or inspections must reach the required standard or higher, with at least 75% achieving good or excellent results; having a spirit of unity, actively participating in competitive movements, contributing positively to the completion of common tasks of the agency or unit;

Adhering strictly to the policies of the Party, state laws, and military discipline.

The ratio of awarding the title "Advanced Soldier" does not exceed 40% of the total number of personnel in the unit.

b) The title "Advanced Worker" is regularly awarded annually to military personnel, workers, civil servants, and public officials in factories and enterprises; contractual employees in agencies, units, factories, and enterprises who meet the following criteria:

Completing well the plans, targets, and tasks assigned for the year, achieving high productivity and quality; having a spirit of unity, actively participating in competitive movements, contributing positively to the completion of common tasks of the agency or unit;

Adhering strictly to the policies of the Party, state laws, and military discipline.

The ratio of awarding the title "Advanced Worker" does not exceed 70% of the total number of personnel in the unit.

5. Title "Flag of Encouragement from the Government"

Exceeding the set competition targets for the year; having new and outstanding models and factors; leading among units that meet the criteria for awarding the "Flag of Competition of the Ministry of National Defense". If it is a production or business unit, it must comply with legal regulations and fulfill its obligations to the State.

Internal unity, exemplary in practicing thrift, combating waste, corruption, and social evils; if it is a grassroots Party organization, it must meet the criteria for outstanding purity and strength; the unit must be comprehensively strong; mass organizations must be exceptionally strong.

b) The number of nominations for the title "Flag of Competition of the Government" shall be guided annually by the Political Bureau, but not exceeding 20% of the total number of collectives meeting the criteria for the "Flag of Competition of the Ministry of National Defense".

6. The title "Flag of Competition of the Ministry of National Defense"

a) The title "Flag of Excellence of the Ministry of National Defense" is awarded annually to collective units at the regiment, brigade, division, or equivalent level; academies, officer schools; hospitals, centers, institutes, general corporations, corporations directly under the Ministry of National Defense; departments, faculties with grassroots party organizations; systems, battalions managing students under academies, officer schools directly under the Ministry of National Defense, meeting the following criteria:

Exceeding annual competitive targets; having outstanding new factors and models; leading among units meeting the standards for awarding the Flag of Excellence of subordinate units of the Ministry of National Defense. If it is a production or business unit, it must comply with legal regulations and fulfill its obligations to the State.

Internal solidarity, taking the lead in practicing thrift, combating waste, corruption, and social evils. If it is a grassroots Party organization, it must meet the exemplary clean and strong standard; the unit must be comprehensively strong; mass organizations must be exceptionally strong.

b) The number of nominations for the "Flag of Excellence of the Ministry of National Defense" is guided annually by the Political General Department.

7. Title of the Flag of Excellence of Subordinate Units of the Ministry of National Defense

a) The title of the Flag of Excellence of Subordinate Units of the Ministry of National Defense is awarded annually to collective units at the division, brigade, regiment, or equivalent level; departments, faculties with grassroots party organizations; systems, battalions managing students under academies, officer schools, meeting the following criteria:

Exceeding annual competitive targets; having outstanding new factors and models; leading among competition clusters and groups of the unit. If it is a production or business unit, it must comply with legal regulations and fulfill its obligations to the State.

Internal solidarity, taking the lead in practicing thrift, combating waste, corruption, and social evils. If it is a grassroots Party organization, it must meet the clean and strong standard; the unit must be comprehensively strong; mass organizations must be strong.

b) The number of Flags of Excellence of Subordinate Units of the Ministry of National Defense is determined by the head of the subordinate unit, but not exceeding 20% of the total number of units eligible for the Flag of Excellence at their respective levels.

8. Titles "Victory Unit", "Outstanding Labor Collective"

a) The title "Victory Unit" is awarded annually to collective units at the brigade, regiment, battalion, company, or equivalent level, meeting the following criteria:

Exceeding annual competitive targets;

Having a regular, practical, and effective competitive movement;

100% individuals completing assigned duties and responsibilities, including those who meet the criteria for the "Outstanding Grassroots Soldier" title; no serious disciplinary violations or accidents caused by negligence during training, work, or traffic participation; the same-level Party organization must meet the clean and strong standard; the unit must be comprehensively strong; mass organizations must be exceptionally strong.

The ratio of awarding the "Victory Unit" title shall not exceed 20% of the total number of units eligible for the "Victory Unit" title.

b) The title "Outstanding Labor Collective" is awarded annually to collective units at the factory, workshop, enterprise, team, or equivalent level within units and enterprises, meeting the following criteria:

Exceeding annual competitive targets; complying with legal regulations and fulfilling obligations to the State;

Having a regular, practical, and effective competitive movement;

100% individuals completing assigned duties and responsibilities, including those who meet the criteria for the "Outstanding Grassroots Soldier" title; no serious disciplinary violations or accidents caused by negligence during labor, production, or traffic participation; the same-level Party organization must meet the clean and strong standard; mass organizations must be exceptionally strong.

The ratio of awarding the "Outstanding Labor Collective" title shall not exceed 20% of the total number of units eligible for the "Outstanding Labor Collective" title.

9. Titles "Advanced Unit", "Advanced Labor Collective"

a) The title "Advanced Unit" is awarded annually to collective units at the battalion, company, platoon, squad; department, faculty, office, or equivalent level, meeting the following criteria:

Meeting annual competitive targets well; 100% of test or inspection contents meet requirements, with at least 70% being good or excellent;

Having a regular, practical, and effective competitive movement; internal solidarity, no serious disciplinary violations or accidents caused by negligence during training or traffic participation; the same-level Party organization must meet the clean and strong standard; mass organizations must be strong.

The ratio of awarding the "Advanced Unit" title shall not exceed 30% of the total number of units eligible for the "Advanced Unit" title.

b) The title "Advanced Labor Collective" is awarded annually to collective units at the enterprise, workshop, team, group, or equivalent level within factories, units, and enterprises, meeting the following criteria:

Meeting annual competitive targets well; complying with legal regulations and fulfilling obligations to the State;

Having a regular, practical, and effective competitive movement; internal solidarity, no serious disciplinary violations or accidents caused by negligence during labor or production or traffic participation; the same-level Party organization must meet the clean and strong standard; mass organizations must be strong.

The ratio of awarding the "Advanced Labor Collective" title shall not exceed 30% of the total number of units eligible for the "Advanced Labor Collective" title.

Chapter III

FORMS, OBJECTS AND CRITERIA FOR REWARDS

Section 1. FORMS OF RECOGNITION AND REWARD

Article 13. Types of Awards

The types of awards shall be implemented in accordance with the provisions of Article 13 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. Award for outstanding achievements and accomplishments is a form of awarding groups and individuals who have achieved outstanding results or excellently completed assigned tasks, contributing to the cause of building and defending the country.

The level of outstanding completion of tasks for groups and individuals shall be determined by the award-granting authority based on regulations for examination, assessment, and recognition.

2. Award for a period (or special topic) is an award given to groups and individuals who achieve outstanding results after the end of a campaign initiated by the President, Prime Minister, Minister, or heads of agencies and units.

3. Immediate award is an award given to groups and individuals who achieve outstanding results unexpectedly.

Unexpected achievement is an achievement obtained outside the program, plan, or assigned tasks.

Particularly outstanding unexpected achievement is an unexpected achievement reached at a particularly outstanding level when courageously rescuing people or state property, or during combat or service in combat, or achieving particularly outstanding results in fields recognized by regions or the world.

4. Award for dedication is an award given to individuals who have participated in activities during revolutionary stages, held leadership or management positions in state agencies, public institutions, political organizations, political-social organizations, made significant contributions, and achieved outstanding results, contributing to the revolutionary cause of the Party and the nation.

5. Anniversary award is an award given to individuals belonging to the People's Army and the People's Public Security, who have achieved results and served in building the people's armed forces according to regulations.

6. Foreign relations award is an award given to groups and individuals from foreign countries who have contributed to the construction and defense of Vietnam in one of the following areas: politics, economy, culture, society, national defense, security, diplomacy, or other fields.

Section 2. MEDALS

Article 14. "Golden Star Order"

Implemented in accordance with the provisions of Article 14 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Golden Star Order" is awarded or posthumously awarded to individuals meeting one of the following criteria:

a) Having great contributions, particularly outstanding achievements for the country in one of the following fields: politics, economy, society, literature, art, science, technology, national defense, security, diplomacy, or other fields;

b) Participating in revolutionary activities since 1935 or earlier, continuously engaged, and holding one of the following positions: Member of the Politburo, Secretary of the Central Committee of the Party, Head of a Party Department at the Central level, Minister of Defense, or being conferred the rank of Senior General in the people's armed forces;

c) Participating in revolutionary activities before 1945, continuously engaged, and holding one of the following positions: Member of the Politburo, Secretary of the Central Committee of the Party, or being conferred the rank of General in the people's armed forces;

d) Continuously participating in both the anti-French and anti-American resistance wars (from 1945 to April 30, 1975), being conferred the rank of General in the people's armed forces before April 30, 1975.

2. "Golden Star Order" is awarded to groups: Ministry of National Defense; General Staff, Political Bureau; Logistics, Engineering, Defense Industry General Departments; General Department II; military regions, military branches, military corps, arms, formations; Border Guard Force, Command of Hanoi Capital, Coast Guard Command, Command for Protecting Ho Chi Minh Mausoleum, Command 86, Government Cryptographic Service, Military Industry-Telecommunications Group; academies, officer schools, hospitals under the Ministry of National Defense, state-owned corporations established by the Prime Minister's decision, meeting the following criteria:

a) Having been awarded the "Ho Chi Minh Order" for 25 years or more, continuously achieving particularly outstanding results with wide-ranging impact and exemplary factors and models for the whole country to emulate;

b) Having a long-standing tradition, making significant contributions to the revolutionary cause of the Party and the nation; internal unity, clean and strong Party and mass organizations.

Article 15. "Ho Chi Minh Medal"

Pursuant to the provisions of Article 15 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The "Ho Chi Minh Medal" shall be awarded or posthumously awarded to individuals who have made significant contributions and achieved outstanding achievements, meeting one of the following criteria:

a) Made significant contributions and achieved outstanding achievements in one of the main fields such as politics, economy, society, literature, art, science, technology, national defense, security, diplomacy, or other fields;

b) Participated in revolutionary activities from 1935 or earlier, continuously engaged, and held one of the positions: Deputy Minister of National Defense or equivalent positions, or were conferred the rank of Major General of the People's Armed Forces;

c) Participated in revolutionary activities before 1945, continuously engaged, and held one of the positions: Minister of National Defense or equivalent positions, or were conferred the rank of Lieutenant General of the People's Armed Forces;

d) Continuously participated in two anti-French and anti-American resistance wars, and held one of the positions: Member of the Politburo, Secretary of the Central Committee of the Party or equivalent positions for at least one term (from three to five years), or were conferred the rank of General of the People's Armed Forces;

đ) Had a continuous work period during the anti-American resistance war or the period of building and defending the country, held one of the positions: Member of the Politburo, Secretary of the Central Committee of the Party or equivalent positions for two terms (from eight to ten years), or were conferred the rank of General of the People's Armed Forces for ten years or more;

2. The "Ho Chi Minh Medal" shall be awarded to organizations: Ministry of National Defense; General Staff Department, Political Bureau; Logistics, Engineering, Defense Industry General Departments; General Department II; military regions, military branches, corps, services, formations; Border Guard Force, Command of Hanoi Capital, Coast Guard Command, Command for Protecting Ho Chi Minh Mausoleum, Command 86, State Cryptography Agency, Military Industry-Telecommunications Group, academies, officer schools, hospitals under the Ministry of National Defense, state-owned holding companies established by the Prime Minister's Decision, meeting the following standards:

a) Already received the "Independence Medal" first class or "Military Merit Medal" first class, and continuously excelled in tasks for ten years or more, with wide influence and exemplary factors and models for the whole country to learn from;

b) Having a long-standing tradition, making significant contributions to the revolutionary cause of the Party and the nation; internal unity, clean and strong Party and mass organizations.

Article 16. "Independence Medal" first class

Pursuant to the provisions of Article 16 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The "Independence Medal" first class shall be awarded or posthumously awarded to individuals who have achieved particularly outstanding achievements in the revolutionary cause of the Party and the nation, meeting one of the following criteria:

a) Participated in revolutionary activities continuously before 1945 and held one of the positions: Deputy Minister of National Defense or equivalent positions; Major General of the People's Armed Forces;

b) Continuously participated in two anti-French and anti-American resistance wars and held one of the positions: Minister of National Defense or equivalent positions for two terms (from eight to ten years); Lieutenant General of the People's Armed Forces;

c) Continuously participated in the anti-American resistance war or the period of building and defending the country, and held one of the positions:

Member of the Politburo, Secretary of the Central Committee of the Party for one term (from three to five years); General of the People's Armed Forces;

Minister of National Defense or equivalent positions for three terms (from thirteen to fifteen years); Lieutenant General of the People's Armed Forces for ten years or more;

d) Achieved particularly outstanding achievements with wide influence and exemplary role throughout the country in one of the fields such as politics, economy, society, literature, art, science, technology, national defense, security, diplomacy, or other fields recognized by the State.

2. The "Independence Medal" first class shall be awarded to organizations, meeting the following standards:

a) Already received the "Independence Medal" second class;

b) Continuously excelled in tasks for ten years or more, during which time received the "Flag of Excellence from the Government" three times and the "Certificate of Merit from the Prime Minister" once, or received the "Flag of Excellence from the Government" three times and the "Flag of Excellence from the Ministry of National Defense" twice;

c) Internal solidarity, Party organization, mass organizations clean and strong.

Article 17. The second-class "Independence Medal"

Implement in accordance with the provisions of Article 17 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The second-class "Independence Medal" shall be awarded or posthumously awarded to individuals who have achieved outstanding merits in the revolutionary cause of the Party and the nation, meeting one of the following criteria:

a) Recognized as a pre-revolutionary cadre, having held one of the positions: Deputy Minister of National Defense or equivalent position for at least one term (from three to five years);

b) Engaged continuously in two anti-French and anti-American resistance wars, having held one of the positions:

Minister of National Defense or equivalent position for at least one term (from three to five years);

Deputy Minister of National Defense or equivalent position for at least two terms (from eight to ten years);

c) Engaged continuously in the anti-American resistance war or in the period of building and defending the country, having held one of the positions:

Minister of National Defense or equivalent position for at least two terms (from eight to ten years); Senior General of the People's Armed Forces for at least five years;

Deputy Minister of National Defense or equivalent position for at least three terms (from thirteen to fifteen years);

d) Achieved many outstanding merits with national influence and exemplary conduct in one of the fields: politics, economy, society, literature, art, science, technology, defense, security, diplomacy, or other fields recognized and proposed by competent authorities.

2. The second-class "Independence Medal" shall be awarded to collectives meeting the following criteria:

a) Already received the third-class "Independence Medal";

b) Continuously excelling in tasks for at least ten consecutive years, during which time they were awarded the "Flag of Excellence from the Government" twice, the "Certificate of Merit from the Prime Minister" once, and the "Certificate of Merit from the Minister of National Defense" once, or were awarded the "Flag of Excellence from the Government" twice and the "Flag of Excellence from the Ministry of National Defense" twice, and the "Certificate of Merit from the Minister of National Defense" once.

c) Internal solidarity, Party organization, mass organizations clean and strong.

Article 18. The third-class "Independence Medal"

Implement in accordance with the provisions of Article 18 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The third-class "Independence Medal" shall be awarded or posthumously awarded to individuals who have achieved outstanding merits in the revolutionary cause of the Party and the nation, meeting one of the following criteria:

a) Participated in the revolution before 1935;

b) Participated in the revolution before 1945, engaged continuously and held one of the positions: Director of a Bureau, Head of a Department, Provincial Committee Member, Municipal Committee Member, Head of a Sector, Provincial-level Department, or equivalent position;

c) Recognized as a pre-revolutionary cadre and held one of the positions: Director of a Bureau, Head of a Department at the Central level, Provincial Committee Member, Municipal Committee Member, Head of a Sector, Provincial-level Department, and equivalent positions, or participated continuously in combat in the South during the anti-American resistance from 1964 to 1975, holding the position of County Committee Member or equivalent position before April 30, 1975;

d) Engaged continuously in two anti-French and anti-American resistance wars, having held one of the positions: Deputy Minister of National Defense or equivalent position for at least one term (from three to five years);

đ) Engaged continuously in the anti-American resistance war or in the period of building and defending the country, having held one of the positions:

Minister of National Defense or equivalent position, serving in the position for at least one term (from three to five years); Senior General of the People's Armed Forces;

Deputy Minister of National Defense or equivalent position for at least two terms (from eight to ten years);

e) Achieved outstanding merits with national influence and exemplary conduct in one of the fields: politics, economy, society, literature, art, science, technology, defense, security, diplomacy, or other fields recognized and proposed by competent authorities.

2. The third-class "Independence Medal" shall be awarded to collectives meeting the following criteria:

a) Already received the first-class "Labor Medal";

b) Continuously excelled in tasks for at least ten consecutive years, during which time they were awarded the "Flag of Excellence from the Government" twice and the "Certificate of Merit from the Prime Minister" once, or were awarded the "Flag of Excellence from the Government" twice and the "Flag of Excellence from the Ministry of National Defense" twice;

c) Internal unity, clean and strong organizational structure of the Party and mass organizations;

d) A history of construction and development of thirty years or more.

Article 19. "Military Merit Medal" First Class

Implement in accordance with the provisions of Article 19 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Military Merit Medal" First Class shall be awarded or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having served for 35 years or more, excellently fulfilling their tasks and having held one of the positions: Minister, Director of the Political General Department, Chief of the General Staff, Deputy Minister, or equivalent position; Senior General, Lieutenant General of the People's Armed Forces for at least 5 years;

b) Achieving outstanding and exceptional feats of arms, bravery in combat, support for combat, training, building forces, consolidating the whole people's national defense, or sacrificing heroically recognized and set as an example nationwide by the State.

2. "Military Merit Medal" First Class shall be awarded to collectives meeting the following criteria:

a) Already been awarded the "Military Merit Medal" Second Class;

b) Excellently fulfilling tasks continuously for 10 years or more, during which time they have received the "Prime Minister's Flag of Excellence" three times and the "Prime Minister's Commendation" once, or have received the "Ministry of National Defense Flag of Excellence" three times and the "Prime Minister's Flag of Excellence" twice;

c) Clean and strong Party organizations and mass organizations.

Article 20. "Military Merit Medal" Second Class

Implement in accordance with the provisions of Article 20 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Military Merit Medal" Second Class shall be awarded or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having served for 35 years or more, excellently fulfilling their tasks and having held one of the positions: Commander of Military Region or equivalent positions for at least 5 years;

b) Achieving many outstanding and brave feats of arms in combat, support for combat, training, building forces, consolidating the whole people's national defense, or sacrificing heroically recognized and set as an example throughout the military by the State.

2. "Military Merit Medal" Second Class shall be awarded to collectives meeting the following criteria:

a) Already been awarded the "Military Merit Medal" Third Class;

b) Continuously excelling in tasks for at least ten consecutive years, during which time they were awarded the "Flag of Excellence from the Government" twice, the "Certificate of Merit from the Prime Minister" once, and the "Certificate of Merit from the Minister of National Defense" once, or were awarded the "Flag of Excellence from the Government" twice and the "Flag of Excellence from the Ministry of National Defense" twice, and the "Certificate of Merit from the Minister of National Defense" once.

c) Clean and strong Party organizations and mass organizations.

Article 21. "Military Merit Medal" Third Class

Implement in accordance with the provisions of Article 21 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Military Merit Medal" Third Class shall be awarded or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having served for 35 years or more, excellently fulfilling their tasks and having held one of the positions: Commander of Army Corps or equivalent positions for at least 5 years;

b) Achieving outstanding and brave feats of arms in combat, support for combat, training, building forces, consolidating the whole people's national defense, or sacrificing heroically recognized and set as an example throughout the Military Region, Military Branch, Army Corps, Arms, General Departments, and equivalents by the State.

2. "Military Merit Medal" Third Class shall be awarded to collectives meeting the following criteria:

a) Already been awarded the "National Defense Protection Medal" First Class;

b) Continuously excelled in tasks for at least ten consecutive years, during which time they were awarded the "Flag of Excellence from the Government" twice and the "Certificate of Merit from the Prime Minister" once, or were awarded the "Flag of Excellence from the Government" twice and the "Flag of Excellence from the Ministry of National Defense" twice;

c) Clean and strong Party organizations and mass organizations;

d) Having a process of construction and development for 30 years or more.

Article 22. "Labor Medal" First Class

Implement in accordance with the provisions of Article 22 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Labor Medal" First Class shall be awarded or posthumously awarded to individuals who continuously excellently fulfill their tasks, make many innovations in labor, contribute to building and defending the country, serve as exemplary models in implementing the Party's policies and State laws, and meet one of the following criteria:

a) Already been awarded the "Labor Medal" Second Class and for the next five consecutive years or more, achieving outstanding achievements, during which time four initiatives were applied with high effectiveness, having a wide impact and serving as examples nationwide, recognized by the Ministry of National Defense;

b) Achieving outstanding and exceptional achievements suddenly in labor, study, work with a wide impact and serving as examples nationwide, recognized by the Ministry of National Defense, or achieving outstanding and exceptional achievements suddenly, winning high awards in the region or world;

c) Having inventions or innovations applied with high effectiveness, having a wide impact and serving as examples nationwide, recognized by the Ministry of National Defense;

d) Having outstanding scientific works or representative state-level works recognized by the Ministry of National Defense.

2. "Labor Medal" First Class shall be awarded to collectives that serve as exemplary models in implementing the Party's policies and State laws, have internal unity, and meet one of the following criteria:

a) Already been awarded the "Labor Medal" Second Class and for the next five consecutive years or more, excellently fulfilling tasks, during which time they have received the "Prime Minister's Flag of Excellence" once and the "Ministry of National Defense Flag of Excellence" twice, or have received the "Ministry of National Defense Flag of Excellence" four times. For collectives not eligible for the flag of excellence during that period, they have received the "Ministry of National Defense Minister's Commendation" three times;

b) Achieving outstanding achievements with a wide impact and disseminated as examples nationwide, recognized by the Ministry of National Defense.

Article 23. Second-class Labour Medal

Implement in accordance with the provisions of Article 23 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The Second-class Labour Medal shall be awarded to individuals who have continuously excelled in their duties, demonstrated many innovations in work, construction, and national defense, set a good example in implementing Party guidelines, state policies, and laws, and met one of the following criteria:

a) Having been awarded the Third-class Labour Medal and for at least five consecutive years thereafter achieved outstanding results, during which time three initiatives were applied and yielded significant benefits, had a wide impact, and served as exemplary models throughout the military, recognized by the Ministry of National Defense;

b) Achieved particularly outstanding and sudden excellence in work, study, or service, with a wide impact and serving as exemplary models throughout the military, recognized by the Ministry of National Defense, or achieved particularly outstanding and sudden excellence, receiving high awards in the region or worldwide;

c) Possessing inventions or patents that have been applied and yielded significant benefits, with a wide impact and serving as exemplary models throughout the military, recognized by the Ministry of National Defense;

d) Having scientific works or outstanding representative works recognized by the Ministry of National Defense.

2. The Second-class Labour Medal shall be awarded to groups that have excellently completed their tasks, set a good example in implementing Party guidelines, state policies, and laws, maintain internal unity, and meet one of the following criteria:

a) Having been awarded the Third-class Labour Medal and for at least five consecutive years thereafter excellently completed their tasks, during which time they received once the "Flag of Excellence from the Government" and once the "Flag of Excellence from the Ministry of National Defense," or three times the "Flag of Excellence from the Ministry of National Defense." For groups not eligible for flags of excellence during this period, they must have received twice the "Certificate of Merit from the Minister of National Defense";

b) Achieving outstanding results with a wide impact and serving as exemplary models throughout the military, recognized by the Ministry of National Defense.

Article 24. Third-class Labour Medal

Implement in accordance with the provisions of Article 24 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The Third-class Labour Medal shall be awarded to individuals who have continuously excelled in their duties, demonstrated many innovations in work, construction, and national defense, set a good example in implementing Party guidelines, state policies, and laws, and met one of the following criteria:

a) Having been awarded the "Certificate of Merit from the Prime Minister" and for at least five consecutive years thereafter achieved outstanding results, during which time two initiatives were applied and yielded significant benefits, had a wide impact, and served as exemplary models throughout the military, recognized by the Ministry of National Defense;

b) Achieved particularly outstanding and sudden excellence in work, study, or service, with a wide impact and serving as exemplary models throughout the military, recognized by the Ministry of National Defense, or achieved particularly outstanding and sudden excellence, receiving high awards in the region or worldwide;

c) Possessing inventions or patents that have been applied and yielded significant benefits, with a wide impact and serving as exemplary models throughout the military, recognized by the Ministry of National Defense;

d) Possessing scientific works or outstanding representative works throughout the military recognized by the Ministry of National Defense.

2. The Third-class Labour Medal shall be awarded to groups that have excellently completed their tasks, set a good example in implementing Party guidelines, state policies, and laws, maintain internal unity, and meet one of the following criteria:

a) Having a development process of ten years or more, during which time they received the "Certificate of Merit from the Prime Minister" and for at least five consecutive years thereafter excellently completed their tasks, including twice receiving the "Flag of Excellence from the Ministry of National Defense" or once the "Flag of Excellence from the Ministry of National Defense" and once the "Certificate of Merit from the Minister of National Defense." For groups not eligible for flags of excellence during this period, they must have received twice the "Certificate of Merit from the Minister of National Defense";

b) Achieving outstanding results with a wide impact and serving as exemplary models throughout the military in their field of work, recognized by the Ministry of National Defense.

Article 25. First-class "National Defense Merit Medal"

Implement according to the provisions of Article 25 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The first-class "National Defense Merit Medal" shall be awarded or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having been awarded the second-class "National Defense Merit Medal" and continuously for five years thereafter achieving outstanding results in training, readiness for combat, work, force building, consolidation of the whole people's national defense and public security, during which period four initiatives have been applied with high effectiveness, having a wide impact and serving as role models nationwide recognized by the Ministry of National Defense;

b) Achieving particularly outstanding and sudden results or making inventions, patents, outstanding scientific works, or particularly outstanding state-level works on national defense and security, recognized by the Ministry of National Defense or the Ministry of Science and Technology;

c) Serving in the Military for thirty-five years or more, excellently completing tasks, and holding one of the positions: Deputy Commander of a Corps, Division Commander, or equivalent position for ten years or more.

2. The first-class "National Defense Merit Medal" shall be awarded to exemplary collectives that strictly follow the Party's policies, State laws, clean and strong Party organizations and mass organizations, meeting one of the following criteria:

a) Having been awarded the second-class "National Defense Merit Medal" and continuously for five years or more thereafter excellently completing tasks, during which period once receiving the "Prime Minister's Flag of Excellence" and twice receiving the "Ministry of National Defense's Flag of Excellence" or four times receiving the "Ministry of National Defense's Flag of Excellence". For collectives not eligible for excellence flags during that period, three times receiving the "Minister of National Defense's Certificate of Merit";

b) Achieving outstanding results in training, readiness for combat, force building, consolidation of the whole people's national defense and public security, having a wide impact and being showcased as role models twice at the national typical model commendation conference, recognized by the Ministry of National Defense.

Article 26. Second-class "National Defense Merit Medal"

Implement according to the provisions of Article 26 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The second-class "National Defense Merit Medal" shall be awarded or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having been awarded the third-class "National Defense Merit Medal" and continuously for five years or more thereafter achieving outstanding results in training, readiness for combat, force building, consolidation of the whole people's national defense and public security, during which period three initiatives have been applied with effectiveness, having a wide impact and serving as role models throughout the military recognized by the Ministry of National Defense;

b) Achieving particularly outstanding and sudden results or making inventions, patents, outstanding scientific works, or state-level works on national defense and security, recognized by the Ministry of National Defense or the Ministry of Science and Technology;

c) Serving in the Military for thirty-five years or more, excellently completing tasks, and holding one of the positions: Deputy Division Commander, Brigade Commander, or equivalent position for ten years or more.

2. The second-class "National Defense Merit Medal" shall be awarded to exemplary collectives that strictly follow the Party's policies, State laws, clean and strong Party organizations and mass organizations, meeting one of the following criteria:

a) Having been awarded the third-class "National Defense Merit Medal" and continuously for five years or more thereafter excellently completing tasks, during which period once receiving the "Prime Minister's Flag of Excellence" and once receiving the "Ministry of National Defense's Flag of Excellence" or three times receiving the "Ministry of National Defense's Flag of Excellence". For collectives not eligible for excellence flags during that period, two times receiving the "Minister of National Defense's Certificate of Merit";

b) Achieving outstanding results in training, readiness for combat, force building, consolidation of the whole people's national defense and public security, having a wide impact and being showcased as role models twice at the national typical model commendation conference, recognized by the Ministry of National Defense.

Article 27. Third-class "National Defense Medal"

Implement as provided for in Article 27 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The third-class "National Defense Medal" shall be awarded to or posthumously awarded to individuals in the Military who meet one of the following criteria:

a) Having been awarded the "Prime Minister's Commendation" and continuously achieving outstanding results in training, combat readiness, force building, and consolidating the whole people's national defense for at least five consecutive years thereafter, with two applied initiatives recognized by the Ministry of National Defense that have had significant impact and set examples throughout the military region, branch, corps, service, general department, or equivalent entity, and have been recognized by the Ministry of National Defense;

b) Achieving particularly outstanding results or making inventions, innovations, scientific works, or excellent literary works recognized by the Ministry of National Defense or the Ministry of Science and Technology;

c) Serving for thirty years or more, completing tasks excellently, and having held one of the following positions for ten years or more: Regiment Commander, Deputy Regiment Commander, or equivalent position.

2. The third-class "National Defense Medal" shall be awarded to exemplary collectives that conscientiously implement Party policies, State laws, organizational Party, and mass organizations' regulations, maintaining integrity and strength, meeting one of the following criteria:

a) Having a development process of ten years or more, during which time they were awarded the "Prime Minister's Commendation," and continuously achieving outstanding results for at least five consecutive years thereafter, including twice being awarded the "Ministry of National Defense's Flag of Excellence" or once being awarded the "Ministry of National Defense's Flag of Excellence" and once being awarded the "Minister of National Defense's Commendation." For collectives not eligible for the excellence flag during that period, they must have been awarded the "Minister of National Defense's Commendation" twice;

b) Achieving outstanding results in training, combat readiness, force building, and consolidating the whole people's national defense and public security, with significant impact throughout the military region, branch, corps, service, general department, or equivalent entity, and being promoted as models in the Ministry of National Defense's conference on advanced typical examples.

Article 28. First-class "Military Merit Medal"

Implement as provided for in Article 28 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The first-class "Military Merit Medal" shall be awarded to or posthumously awarded to individuals who meet one of the following criteria:

a) Achieving particularly outstanding feats in combat or support to combat, with achievements having significant impact and setting examples nationwide, recognized by the Ministry of National Defense;

b) Demonstrating intelligence, creativity, and high effectiveness in combat or support to combat to protect national sovereignty and security or not fearing sacrifice to resolutely struggle against crime, contributing to maintaining political stability, social order, and safety; completing assigned tasks excellently; achievements having significant impact and setting examples nationwide, recognized by the Ministry of National Defense.

2. The first-class "Military Merit Medal" shall be awarded to collectives that meet one of the following criteria:

a) Achieving particularly outstanding results in combat or support to combat, with achievements having significant impact and setting examples nationwide, recognized by the Ministry of National Defense;

b) Being loyal to the country and people; being proactive, creative, intelligent, brave, and achieving high effectiveness in combat or support to combat to protect national sovereignty and security or struggling against crime, maintaining political stability, social order, and safety; completing assigned tasks excellently; achievements having significant impact and setting examples nationwide, recognized by the Ministry of National Defense.

Article 29. The "Order of Military Merit" second class

Implement according to the provisions of Article 29 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The "Order of Military Merit" second class shall be awarded or posthumously awarded to individuals who meet one of the following criteria:

a) Achieving outstanding military feats in combat or support for combat, with achievements that have a motivating, educational, and exemplary effect throughout the entire military force, recognized by the Ministry of National Defense;

b) Being proactive, intelligent, and courageous, achieving high effectiveness in combat and support for combat to defend national sovereignty, national security, or in the struggle against crime, contributing to maintaining political stability, public order, and social safety; with achievements that have a motivating, educational, and exemplary effect throughout the entire military force, recognized by the Ministry of National Defense.

2. The "Order of Military Merit" second class shall be awarded to units that meet one of the following criteria:

a) Achieving exceptionally outstanding achievements in combat or support for combat, with achievements that have a motivating, educational, and exemplary effect throughout the entire military force, recognized by the Ministry of National Defense;

b) Being loyal to the country and the people; being proactive, creative, intelligent, and courageous, achieving high effectiveness in combat or support for combat to defend national sovereignty, national security, or in the struggle against crime, maintaining political stability, public order, and social safety, with achievements that have a motivating, educational, and exemplary effect throughout the entire military force, recognized by the Ministry of National Defense.

Article 30. The "Order of Military Merit" third class

Implement according to the provisions of Article 30 of Decree No. 91/2017/NĐ-CP. Specifically in the military, it is implemented as follows:

1. The "Order of Military Merit" third class shall be awarded or posthumously awarded to individuals who meet one of the following criteria:

a) Being courageous, intelligent, and creative, completing tasks excellently in combat or support for combat, with achievements that have a motivating, educational, and exemplary effect throughout military regions, corps, branches, services, departments, and equivalent units, recognized by the Ministry of National Defense;

b) Being intelligent and courageous, achieving high effectiveness in combat or support for combat to defend national sovereignty, national security, or in the struggle against crime, contributing to maintaining political stability, public order, and social safety, with achievements that have a motivating, educational, and exemplary effect throughout military regions, corps, branches, services, departments, and equivalent units, recognized by the Ministry of National Defense.

2. The "Order of Military Merit" third class shall be awarded to units that meet one of the following criteria:

a) Achieving exceptionally outstanding achievements in combat or support for combat, with achievements that have a motivating, educational, and exemplary effect throughout military regions, corps, branches, services, departments, and equivalent units, recognized by the Ministry of National Defense;

b) Being loyal to the country and the people; being proactive, creative, intelligent, and courageous, achieving effectiveness in combat or support for combat to defend national sovereignty, national security, or in the struggle against crime, maintaining political stability, public order, and social safety, with achievements that have a motivating, educational, and exemplary effect throughout military regions, corps, branches, services, departments, and equivalent units, recognized by the Ministry of National Defense.

Article 31. "Medal of Bravery"

Implement according to the provisions of Article 32 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

The "Medal of Bravery" shall be awarded or posthumously awarded to individuals who have demonstrated brave actions in combating crime, rescuing people and state property, achieving one of the following criteria:

1. Demonstrating brave actions in rescuing people and state property when encountering fires, natural disasters, accidents, or disasters; bravely protecting state property, the lives and property of the people from criminals; or bravely entering dangerous areas caused by epidemics to protect the lives of the people; achievements having a motivational, educational, exemplary effect throughout the entire military and the country.

2. Sacrificing heroically while rescuing people and state property, earning the respect and emulation of the people.

Article 32. "Medal of Friendship"

Implement according to the provisions of Article 33 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The "Medal of Friendship" shall be awarded to organizations, or awarded or posthumously awarded to individuals belonging to the following categories:

a) State agencies or government organizations of foreign countries equivalent to ministerial level, provincial, or city level;

b) Foreign organizations of which Vietnam is a member or has partnership relations;

c) Diplomatic representative offices of foreign countries in Vietnam;

d) Foreign individuals serving as heads of agencies or organizations specified in point a Clause 1 of this Article for at least five consecutive years or having worked in Vietnam for at least one term of three years;

đ) Foreign individuals who have been awarded the "Medal of Friendship" and over the next five years continue to make significant contributions to building, consolidating, and developing friendly and comprehensive cooperation relations with Vietnam;

e) Foreign individuals not falling under the above categories but having outstanding achievements in the construction and development of Vietnam's economy, society, national defense, security, and diplomacy; in building, consolidating, and developing friendly and comprehensive relations between Vietnam and other countries and foreign organizations.

2. Criteria for awarding the "Medal of Friendship".

The "Medal of Friendship" shall be awarded to foreign organizations, or awarded or posthumously awarded to foreign individuals, meeting the following criteria:

a) Demonstrating a spirit of friendship and solidarity, respecting Vietnam's independence, sovereignty, unity, territorial integrity, laws, and customs;

b) Making significant contributions to the cause of fighting for national independence and unification in the past and to the construction and development of Vietnam's economy, society, national defense, security, and diplomacy today; recognized and recommended by central ministries, departments, mass organizations, political and social organizations, and provincial and municipal People's Committees;

c) Actively contributing to building, consolidating, and developing friendly and comprehensive relations between Vietnam and other countries and foreign organizations.

Section 3. Medals shall be awarded to officers, professional soldiers, and defense workers working in agencies or units under the People's Army; officers and professional non-commissioned officers working in agencies or units under the People's Public Security; and foreigners who have contributed to the cause of building and defending the country.

Article 33. "Military Flag Victory Badge"

Implement according to the provisions of Article 54 of the Law on Encouragement and Reward and Article 34 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

The "Military Flag Victory Badge" shall be awarded or posthumously awarded to officers, professional soldiers, workers, civil servants, and defense officials who meet the following criteria:

1. Having a continuous dedication period of at least 25 years;

2. Being loyal to the revolutionary cause of the Party and the nation; fulfilling assigned responsibilities and tasks well; not violating any serious disciplinary measures such as being expelled from the Party, forced to leave work, deprived of military rank, or convicted by a court.

Article 34. "Medal of Distinguished Soldiers"

Implement in accordance with the provisions of Article 56 of the Law on Competition and Rewards and Articles 34 and 35 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. Recipients for rewards include:

a) Officers, professional soldiers, non-commissioned officers, and soldiers (excluding cases where they have already been awarded the "Order of Distinguished Soldiers");

b) Workers, civil servants, and defense officials serving in the Military from after June 30, 2004, if they have completed the required service time in the Military to be considered for the award of the "Medal of Distinguished Soldiers".

2. Criteria for rewards:

The "Medal of Distinguished Soldiers" shall be awarded or posthumously awarded to officers, professional soldiers, workers, civil servants, defense officials, non-commissioned officers, and soldiers serving in the Military who have fulfilled their assigned duties and responsibilities well, remained loyal to the revolutionary cause of the Party and the nation, and not violated any serious disciplinary measures such as being expelled from the Party, forced to resign, stripped of military rank, or convicted by a court. Specific criteria are as follows:

a) The "Medal of Distinguished Soldiers, First Class" shall be awarded or posthumously awarded to individuals with a continuous period of dedication of at least 20 years.

b) The "Medal of Distinguished Soldiers, Second Class" shall be awarded or posthumously awarded to individuals with a continuous period of dedication of at least 15 years but less than 20 years.

c) The "Medal of Distinguished Soldiers, Third Class" shall be awarded or posthumously awarded to individuals with a continuous period of dedication of at least 10 years but less than 15 years.

3. Officers, professional soldiers, workers, civil servants, defense officials, non-commissioned officers, and soldiers performing tasks in coastal areas, islands, and communes in special economic and social conditions from after May 31, 2014, who receive special allowances of 100% or more, shall be considered for the award of the "Medal of Distinguished Soldiers" as follows:

a) Officers, professional soldiers, workers, civil servants, and defense officials working in the aforementioned areas shall have their service time doubled when calculating eligibility for the "Medal of Distinguished Soldiers" in all classes.

b) Non-commissioned officers and soldiers who have served for at least one year in the aforementioned areas, fulfilling their military obligations well, shall be eligible for the "Medal of Distinguished Soldiers, Third Class" upon discharge.

c) Officers, professional soldiers, workers, civil servants, defense officials, non-commissioned officers, and soldiers who die while performing tasks in the aforementioned areas and are recognized as martyrs, if their service time was less than one year, shall be eligible for posthumous award of the "Medal of Distinguished Soldiers, Third Class"; if their service time was from one to less than five years, they shall be eligible for posthumous award of the "Medal of Distinguished Soldiers, Second Class"; if their service time was five years or more, they shall be eligible for posthumous award of the "Medal of Distinguished Soldiers, First Class".

Article 35. "Friendship Medal"

Implement in accordance with the provisions of Article 36 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The "Friendship Medal" shall be awarded to foreign individuals belonging to the following categories:

a) Foreign individuals belonging to agencies and organizations specified in points a, b, c, d, đ, e, Clause 1, Article 33 of Decree No. 91/2017/NĐ-CP, who have worked continuously for these agencies and organizations for at least five years or have served in Vietnam for at least one term of three years.

b) Foreign individuals not belonging to the above categories but meeting the criteria stipulated in Clause 2 of this Article and having made continuous contributions for at least five years.

2. Criteria for awarding the "Friendship Medal".

The "Friendship Medal" shall be awarded to foreign individuals meeting the following criteria:

a) Demonstrating a spirit of friendship and solidarity, respecting Vietnam's independence, sovereignty, unity, territorial integrity, laws, and customs;

b) Having made positive contributions to the construction and development of the economy, society, national defense, security, and diplomacy of Vietnam, recognized and recommended by central ministries, agencies, mass organizations, and political-social organizations, provincial and municipal people's committees under the central government.

c) Contributing to building, consolidating, and developing friendly and comprehensive relations between Vietnam and other countries, foreign organizations, and international organizations.

Section 4. NATIONAL HONOR TITLES

Article 36. Title "People's Armed Forces Hero"

Implemented according to the provisions of Article 60 of the Law on Competition and Reward. Specifically as follows:

1. The title "People's Armed Forces Hero" shall be awarded or posthumously awarded to individuals who meet the following criteria:

a) Absolutely loyal to the Socialist Republic of Vietnam, with heroic, courageous, intelligent, self-sacrificing actions, achieving outstanding achievements in combat, training, serving combat, maintaining national security, social order, and safety, setting examples nationwide;

b) Having innovative ideas, solutions, or research projects of special value applied in military, security activities or socio-economic operations, bringing about substantial benefits nationwide;

c) Excelling in technical and tactical skills, proficient in their profession; continuously improving professional and political levels, completing all tasks excellently; making significant contributions to training technical and tactical skills, professional knowledge for comrades;

d) Possessing firm political resolve, having good moral character and healthy lifestyle, promoting unity and cooperation, being exemplary in all aspects.

2. The title "People's Armed Forces Hero" shall be awarded to collectives that meet the following criteria:

a) Achieving outstanding achievements in combat, serving combat, maintaining national security, social order, and safety, loyal to the country;

b) Being brave, intelligent, and creative in combat, training, and readiness for combat; being a prominent flag in patriotic competition movements, contributing significantly to the development of the Military;

c) Leading the entire Military in promoting innovation, improving technology, reforming leadership methods, and achieving many successes in applying new scientific and technological advancements to serve combat, training, and work;

d) Leading in training and developing technical and tactical skills, professional knowledge, and political awareness for officers and soldiers; managing weapons and technical facilities safely and securely;

đ) Leading in implementing Party policies and State laws; setting examples in complying with military discipline, regulations, and rules; promoting internal unity, cooperation, and solidarity between military and civilian populations; caring for the material and spiritual well-being of officers and soldiers;

e) Having a clean and strong Party organization; a comprehensive strong unit; an excellent mass organization; actively participating in local movements and being trusted by the people; being exemplary in all aspects.

3. The title "People's Armed Forces Hero" shall be reviewed every five years, except in cases of outstanding and sudden achievements.

Article 37. Title "Labor Hero"

Implemented according to the provisions of Article 61 of the Law on Competition and Reward. Specifically as follows:

1. The title "Labor Hero" shall be awarded or posthumously awarded to individuals who meet the following criteria:

a) Absolutely loyal to the Socialist Republic of Vietnam, with a spirit of creative labor, achieving high productivity, quality, and efficiency, making outstanding contributions towards the goals of a wealthy people, a strong nation, democracy, fairness, and civilization;

b) Making significant contributions to the development of units, localities, sectors, and the country for at least ten years, recognized by collective bodies;

c) Achieving many accomplishments in researching and applying new scientific and technological advancements, having innovative ideas, solutions, research projects, scientific products, literary and artistic works of special value, bringing about high benefits nationwide;

d) Actively training, guiding colleagues and younger generations in technical guidance, technology transfer, production, and business experience;

đ) Possessing firm political resolve, having good moral character, leading a healthy lifestyle, promoting unity and cooperation, being exemplary in all aspects.

2. The title "Labor Hero" shall be awarded to collectives that meet the following criteria:

a) Achieving outstanding achievements in creative labor towards the goals of a wealthy people, a strong nation, democracy, fairness, and civilization, loyal to the country;

b) Being a leading example in the entire Military and the entire country in terms of productivity, quality, and efficiency, positively contributing to the construction of the Military and the socio-economic development of the country for at least ten years;

c) Leading the entire Military and the entire country in technological innovation, achieving many successes in applying new scientific and technological advancements, in promoting innovation and improvement in technology, and environmental protection;

d) Leading in training and developing comprehensive levels for cadres, civil servants, public officials, and workers; being a model for other collectives to follow in professional training and skill enhancement;

đ) Leading in implementing and effectively executing Party policies, State laws, ensuring the rights of workers, managing capital and assets safely and securely;

e) Having a clean and strong Party organization; a comprehensive strong unit; an excellent mass organization; actively participating in local movements and being trusted by the people.

3. The title "Labor Hero" shall be reviewed every five years, except in cases of outstanding and sudden achievements.

Article 38. Honorary titles "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor", "People's Artist", "Outstanding Artist", "People's Artisan", "Outstanding Artisan""People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor", "People's Artist", "Outstanding Artist", "People's Artisan", "Outstanding Artisan"

1. The subjects and criteria for awarding the honorary titles "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor", "People's Artist", "Outstanding Artist", "People's Artisan", "Outstanding Artisan" shall be implemented in accordance with the provisions of Articles 62, 63, 64, and 65 of the Law on Mobilization and Reward.

2. The General Political Department shall base on guiding documents from relevant ministries and sectors to guide and organize implementation within the Military.

Section 5. AWARDS

Article 39. "Ho Chi Minh Award"

1. The subjects and criteria for awarding the "Ho Chi Minh Award" shall be implemented in accordance with the provisions of Articles 66 and 67 of the Law on Mobilization and Reward.

2. The General Political Department shall base on guiding documents from relevant ministries and sectors to guide and organize implementation within the Military.

Article 40. "State Award"

1. The subjects and criteria for awarding the "State Award" shall be implemented in accordance with the provisions of Articles 66 and 68 of the Law on Mobilization and Reward.

2. The General Political Department shall base on guiding documents from relevant ministries and sectors to guide and organize implementation within the Military.

Section 6. CERTIFICATES OF MERIT AND AWARD LETTERS

Article 41. "Certificate of Merit of the Prime Minister"

Implemented in accordance with the provisions of Article 38 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. "Certificate of Merit of the Prime Minister" shall be awarded to individuals who model exemplary compliance with the Party’s guidelines, State laws, military discipline, and achieve one of the following standards:

a) Outstanding achievements recognized during mass mobilization campaigns initiated by the Government or the Ministry of National Defense when summarizing over three years;

b) Having been awarded a "Certificate of Merit of the Minister of National Defense"; continuously excelling in duties for five consecutive years thereafter, during which time five recognized and effectively applied initiatives were implemented at the grassroots level or demonstrated bravery, creativity in combat or support operations, and received commendations five times or more;

c) Achieving significant or outstanding sudden achievements with wide-ranging influence throughout the entire military.

2. "Certificate of Merit of the Prime Minister" shall be awarded to groups that model exemplary compliance with the Party’s policies, State laws, military discipline, and achieve one of the following standards:

a) Outstanding achievements recognized during mass mobilization campaigns initiated by the Government or the Ministry of National Defense when summarizing over three years.

b) Having been awarded a "Certificate of Merit of the Minister of National Defense"; continuously excelling in duties for five consecutive years thereafter, during which time they received the "Flag of Mobilization Campaigns of the Ministry of National Defense". For groups not eligible for such flags, they must have received two "Certificates of Merit of the Minister of National Defense".

c) Achieving significant or outstanding sudden achievements with wide-ranging influence throughout the entire military and nation.

Article 42. "Certificate of Merit of the Minister of National Defense"

1. "Certificate of Merit of the Minister of National Defense" shall be awarded to individuals who model exemplary compliance with the Party’s guidelines, State laws, military discipline, and achieve one of the following standards:

a) Achieving outstanding results with wide-ranging influence throughout the entire military, in each field of national defense and military work, or recognized during mass mobilization campaigns or movements initiated by the Government or the Ministry of National Defense;

b) Excelling in duties for two consecutive years, during which time they received two "Model Worker of the Base" titles, two recognized and effectively applied initiatives at the grassroots level, or demonstrated bravery, creativity in combat or support operations.

2. "Certificate of Merit of the Minister of National Defense" shall be awarded to groups that model exemplary compliance with the Party’s guidelines, State laws, military discipline, and achieve one of the following standards:

a) Achieving outstanding results with wide-ranging influence throughout the entire military, in each field of national defense and military work, or recognized during mass mobilization campaigns or movements initiated by the Government or the Ministry of National Defense;

b) Excelling in duties for two consecutive years, receiving the title "Victorious Unit" or "Excellent Labor Collective"; maintaining internal unity, implementing democratic regulations at the grassroots level, organizing mass mobilization campaigns well; caring for the material and spiritual life of staff, soldiers in the unit; practicing thrift; fulfilling all systems and policies for officers, employees, and soldiers in the unit.

3. "Certificate of Merit of the Minister of National Defense" shall be awarded to individuals or groups from state agencies, political organizations, socio-political organizations, socio-political-professional organizations, social-professional organizations, economic organizations, who have made many achievements and contributions to the development of the Military, recognized and proposed by competent authorities.

Article 43. Commendation Certificate from the Head of Subordinate Units under the Ministry of National Defense

1. The Commendation Certificate from the Head of Subordinate Units under the Ministry of National Defense shall be awarded to individuals who set a good example in implementing the Party's guidelines, State policies, laws, and military discipline, and meet one of the following criteria:

a) Achieving outstanding results in performing tasks;

b) Demonstrating outstanding and exemplary achievements in campaigns and movements initiated by the Ministry of National Defense or the unit.

2. The Commendation Certificate from the Head of Subordinate Units under the Ministry of National Defense shall be awarded to groups that set a good example in implementing the Party's guidelines, State policies, laws, and military discipline, and meet one of the following criteria:

a) Achieving outstanding results in performing tasks;

b) Demonstrating outstanding and exemplary achievements in campaigns and movements initiated by the Ministry of National Defense or the unit.

Article 44. Certificate of Merit from the Head of Subordinate Units under the Ministry of National Defense, Division, Brigade, Regiment, and Equivalent Units

1. The Certificate of Merit from the Head of Subordinate Units under the Ministry of National Defense, Division, Brigade, Regiment, and Equivalent Units shall be awarded to individuals who set a good example in implementing the Party's guidelines, State policies and laws, and military discipline, and meet one of the following criteria:

a) Achieving outstanding results;

b) Demonstrating outstanding achievements in campaigns and movements initiated by the Ministry of National Defense or the unit.

2. The Certificate of Merit from the Head of Subordinate Units under the Ministry of National Defense, Division, Brigade, Regiment, and Equivalent Units shall be awarded to groups that set a good example in implementing the Party's guidelines, State policies and laws, and military discipline, and meet one of the following criteria:

a) Achieving outstanding results;

b) Demonstrating outstanding achievements in campaigns and movements initiated by the Ministry of National Defense or the unit.

Section 7. REMEMBRANCE CHAPTER

Article 45. Commemorative Medal "For the Cause of Building the People's Army of Vietnam"

The Commemorative Medal "For the Cause of Building the People's Army of Vietnam" shall be awarded to:

1. Comrades leading the Party, State, central agencies, mass organizations, provincial and municipal authorities; Vietnamese citizens, overseas Vietnamese, foreigners who have made significant contributions to the construction and development of the People's Army of Vietnam;

2. Military personnel, civil servants, officials, defense workers who have worked continuously for thirty years or more in the People's Army of Vietnam, fulfilled their duties well, not been disciplined with a warning or higher, upon retirement or transfer.

Article 46. Commemorative Medal "For the Cause of Mass Armed Forces"

1. The Commemorative Medal "For the Cause of Mass Armed Forces" shall be awarded to militia and self-defense force officers and soldiers who have excellently fulfilled their assigned responsibilities; awarded to Vietnamese citizens, overseas Vietnamese, foreigners who have made significant contributions to the construction and development of the militia and self-defense forces of Vietnam.

2. The recipients and criteria for awarding the Commemorative Medal "For the Cause of Mass Armed Forces" shall be guided by the General Staff.

Section 8. OTHER FORMS OF RECOGNITION

Article 47. Other forms of recognition

1. In addition to the commendations and awards stipulated in the Law on Competition and Reward, the Ministry of National Defense implements other forms of recognition within the military, including:

a) Title of "All-Round Strong Unit";

b) Title of "Cultural Unit";

c) Title of "Excellent Training Unit";

d) "Photograph before the Military Flag".

2. The titles of "All-Round Strong Unit", "Excellent Training Unit", and "Photograph before the Military Flag" shall be guided by the General Staff.

3. The title of "Cultural Unit" shall be guided by the Political General Department.

Chapter IV

AUTHORITY TO DECIDE AWARDS AND PRESENTATIONS

Article 48. The Minister of National Defense

1. Bestow the title "Flag of Excellence of the Ministry of National Defense", "Certificate of Merit of the Minister of National Defense", and the title "Outstanding Soldier of the Entire Military".

2. Bestow the title "Outstanding Soldier at the Base Level" to individuals who are leaders or commanders in charge of units under the Ministry of National Defense; officers with the rank of general.

3. Bestow the Commemorative Medal "For the Cause of Building the People's Army of Vietnam" and the Commemorative Medal "For the Cause of Mass Armed Forces".

Article 49. Heads of Units Under the Ministry of National Defense

1. Bestow "Certificates of Merit", "Letters of Praise", and titles: "Outstanding Soldier at the Base Level", "Advanced Soldier", "Advanced Worker" to individuals under their authority with the highest position up to division commander, division political commissar, or equivalent; the highest military rank up to major general or equivalent salary level.

2. Bestow the Flag of Excellence of the Unit Under the Ministry of National Defense; bestow "Certificates of Merit", "Letters of Praise", and titles: "Victorious Unit", "Outstanding Labor Collective" up to regiment level or equivalent; bestow the title "Advanced Unit", "Advanced Labor Collective" up to battalion level or equivalent.

Article 50. Chief Judge of the Central Military Court, Prosecutor-in-Chief of the Central Military Procuracy, Deputy Director of the Central Military Inspection Committee, Chief Inspector of the Ministry of National Defense

1. Bestow "Letters of Praise" and titles: "Outstanding Soldier at the Base Level", "Advanced Soldier" to individuals under their authority with the highest position up to department head; the highest military rank up to senior colonel or equivalent salary level.

2. Bestow "Letters of Praise" and the title "Advanced Unit" to the highest collective up to department level and equivalent.

Article 51. Division Commanders and Equivalent Positions

1. Bestow "Letters of Praise" and titles: "Outstanding Soldier at the Base Level", "Advanced Soldier", "Advanced Worker" to individuals under their authority with the highest position up to battalion commander, battalion political commissar, and equivalent positions; officers with the highest military rank up to colonel; professional soldiers with the highest military rank up to senior colonel or equivalent salary level.

2. Bestow "Letters of Praise" and titles: "Advanced Unit", "Advanced Labor Collective" to the highest collective up to battalion level or equivalent.

Article 52. Brigade Commanders, Regiment Commanders and Equivalent Positions

1. Bestow "Letters of Praise" and titles: "Advanced Soldier", "Advanced Worker" to individuals under their authority with the highest position up to company commander, company political commissar, and equivalent positions; officers with the highest military rank up to lieutenant colonel; professional soldiers with the highest military rank up to major or equivalent salary level.

2. Bestow "Letters of Praise" and titles: "Advanced Unit", "Advanced Labor Collective" to the highest collective up to company level or equivalent.

Article 53. Awards by Agencies and Units Without Legal Person Status

For agencies and units equivalent to regiments, brigades, divisions but without legal person status that issue decisions to bestow commendation titles and awards to collectives and individuals under their authority, the immediate superior head shall issue decisions to bestow commendation titles and awards to collectives and individuals within the scope of rewards of the subordinate agencies and units mentioned above.

Article 54. Bestowing and receiving commendation titles and reward forms

1. When there is a reward result, units shall announce the reward decision and present rewards to collectives and individuals within the unit.

2. The organization of bestowing and receiving commendation titles or reward forms shall be carried out in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013 on organizing memorial days; the ceremony for bestowing and receiving reward forms and commendation titles; foreign diplomatic rituals and reception of foreign guests.

Chapter V

PROCEDURE, FORMALITIES, FILE FOR PROPOSING REWARDS; STORAGE OF REWARD FILES

Section 1. PROCEDURE FOR PROPOSING REWARDS

Article 55. General procedure

Based on functions, tasks, and specific circumstances, agencies and units shall establish the examination and reward procedure through the following steps:

1. Organizing report and evaluation meetings: Collectives and individuals report achievements at military personnel, workers, civil servants, defense officials, and laborers' conferences of the agency or unit. The conference conducts evaluations through secret ballot or voting.

2. The Competition and Reward Council or Competition and Reward Team convenes to review and vote secretly or conduct voting for each collective and individual.

3. The political department or political cadre (where there is no political department) compiles and reports to the same-level party committee (standing committee) for consideration and resolution.

4. Based on the resolution of the party committee (standing committee), the political commissar, political commander, or unit commander issues a reward decision within their authority or proposes higher-level rewards.

Article 56. Procedure at the Ministry of National Defense level

1. Titles "Hero of the People's Armed Forces", "Hero of Labor" during the period of renewal: The Office of the Steering Committee for Competition and Reward of the Ministry of National Defense reviews the file, sends documents requesting opinions from relevant agencies; compiles and reports to the Office and the Steering Committee. The Steering Committee convenes to provide comments before reporting to the Council. The Council convenes to review and vote secretly (if Council members are absent, then opinions are obtained in writing). Based on the Council's trust votes, the Political Bureau reviews and reports to the Standing Committee of the Central Military Commission. Based on the Standing Committee's conclusion, the Minister of National Defense submits to the Prime Minister.

2. Awarding Orders, "Certificate of Merit of the Prime Minister", title "National Model Worker", "Military Model Worker": The Office of the Steering Committee for Competition and Reward of the Ministry of National Defense reviews the file, sends documents requesting opinions from relevant agencies; compiles and summarizes achievements, proposes reward forms and levels for each case, sends documents requesting opinions from Council members. Based on the opinions of Council members, the head of the Political Bureau reviews and submits to the Minister of National Defense for a reward decision or submits to the Prime Minister. For cases proposing to award "Golden Star Order", "Ho Chi Minh Order", "Independence Order", "Military Service Order", and the title "National Model Worker", the Political Bureau reports to the Standing Committee of the Central Military Commission for review. Based on the Standing Committee's conclusion, the Minister of National Defense submits to the Prime Minister.

3. Title "Flag of Merit of the Government", "Flag of Merit of the Ministry of National Defense": The Office of the Steering Committee for Competition and Reward of the Ministry of National Defense compiles a list, sends documents requesting opinions from relevant agencies; compiles and reports to the Office and the Steering Committee. The Steering Committee convenes, provides comments, and proposes to the Council. The Council convenes to review and vote secretly (if Council members are absent, then opinions are obtained in writing). Based on the Council's trust votes, the Political Bureau reports to the Standing Committee of the Central Military Commission for review. Based on the Standing Committee's conclusion, the Minister of National Defense decides to award "Flag of Merit of the Ministry of National Defense" and proposes to award "Flag of Merit of the Government".

4. Rewards for dedication: The Office of the Steering Committee for Competition and Reward of the Ministry of National Defense reviews the file, summarizes achievements, sends documents requesting opinions from Council members. Based on the Council's opinions, the Political Bureau reviews and reports to the Minister of National Defense for consideration and submission to the Prime Minister. For cases proposing to award "Golden Star Order", "Ho Chi Minh Order", "Independence Order", "Military Service Order", the Political Bureau reports to the Standing Committee of the Central Military Commission for review. Based on the Standing Committee's conclusion, the Minister of National Defense submits to the Prime Minister.

5. "Military Flag Victory Medal", "Brave Soldier Medal"; Commemorative Medals and "Certificate of Merit of the Minister of National Defense": The Propaganda Department reviews the file, compiles, and reports to the head of the Political Bureau for review and submission to the Minister of National Defense for a reward decision or submission to the Prime Minister.

6. Unexpected rewards: The Propaganda Department leads and coordinates with units to review achievements, complete files according to simplified procedures, report to the head of the Political Bureau for review and submission to the Minister of National Defense for rewards or submission to the competent authority for rewards.

7. Thematic rewards: The steering committee for thematic competition movements of the Ministry of National Defense considers and proposes rewards. The chairman of the steering committee for thematic competition movements decides on rewards or submits to the Ministry of National Defense (through the Propaganda Department/Political Bureau). The Propaganda Department compiles and reports to the head of the Political Bureau for review and submission to the Minister of National Defense for a reward decision or submission to the Prime Minister.

8. Rewards for competitions and sports events: The organizing committee for competitions and sports events of the Ministry of National Defense considers and proposes rewards. The chairman of the organizing committee for competitions and sports events decides on rewards or submits to the Ministry of National Defense (through the Propaganda Department/Political Bureau). The Propaganda Department compiles and reports to the head of the Political Bureau for review and submission to the Minister of National Defense for a reward decision or submission to the Prime Minister.

9. Award for foreign organizations and individuals: The Propaganda Department shall take the lead in coordinating with the Foreign Affairs Department of the Ministry of National Defense to review the application files, achievements, and report to the head of the Political General Department for consideration, then submit to the Minister of National Defense for award decision or to the Prime Minister for approval.

Article 57. Procedures for considering and presenting commendation titles at various levels

1. Organize meetings of military personnel, workers, civil servants, public officials, defense employees: Publicize standards and introduce collectives and individuals for evaluation; collectives and individuals report their achievements; the meeting of military personnel proceeds with the evaluation. For the title "Model Soldier at the Base Level," the evaluation is conducted through secret ballot.

2. The secretariat of the commendation and reward council compiles opinions from functional agencies at the same level regarding the collectives and individuals proposed for awards; compile and report to the standing body of the commendation and reward council at the same level.

3. The standing body of the council convenes to consider and report to the commendation and reward council at the same level.

4. The commendation and reward council convenes to consider and propose recommendations.

5. The Party Committee (Standing Committee) considers and makes resolutions.

6. The Political Commissar, Political Instructor, or unit commander decides on rewards within their authority or proposes higher-level rewards.

Article 58. Procedures for considering and proposing rewards based on meritorious deeds and achievements

1. Collectives and individuals report their achievements at a meeting of military personnel or a meeting of cadres (for heads of agencies and units) for evaluation and proposal.

2. The secretariat of the commendation and reward council compiles and seeks opinions from functional agencies at the same level; compiles and reports to the standing body of the commendation and reward council at the same level.

3. The standing body of the commendation and reward council convenes to consider, unify proposals on forms and levels of rewards for each case, and prepare content for reporting to the commendation and reward council at the same level.

4. The commendation and reward council convenes to consider and propose recommendations.

5. The Party Committee (Standing Committee) considers and makes resolutions.

6. The Political Commissar, Political Instructor, or unit commander decides on rewards within their authority or proposes higher-level rewards.

Article 59. Procedures for considering and proposing immediate rewards

1. The political department (political assistant) compiles and reports proposals to the head of the agency or unit.

2. The Political Commissar, Political Instructor, or unit commander considers and decides on rewards within their authority or proposes higher-level rewards.

The person making the reward decision reports to the Party Committee (Standing Committee) at the same level in the nearest meeting; simultaneously reports to the superior political department for management and monitoring.

3. The superior political department coordinates, reviews achievements, and reports to the unit head for consideration and decision on rewards or proposal for higher-level rewards.

4. In cases where the Ministry of National Defense, the Prime Minister, or the President awards: Units quickly report in writing to the Ministry of National Defense (through the Propaganda Department of the Political General Department).

Article 60. Procedures for considering and proposing annual rewards and commemorative medals

1. Individuals declare their work history, confirmed by the unit head.

2. The political department reviews, summarizes, and reports to the Party Committee, Political Commissar, Political Instructor, and unit commander.

3. The Political Commissar, Political Instructor, or unit commander considers and submits to the direct superior.

4. The Political Commissar or unit commander under the Ministry of National Defense considers and submits to the Minister of National Defense (through the Propaganda Department of the Political General Department).

Article 61. Procedures for awarding prizes on specific topics, summarizing mission awards, and competition and sports meeting awards

1. Procedures for awarding prizes on specific topics and summarizing mission awards

a) The permanent office of the campaign steering committee on specific topics or summarizing missions shall take the lead in coordinating with the political agency at the same level to study and advise on the issuance of guiding documents for awards.

b) The permanent office of the campaign steering committee on specific topics or summarizing missions shall compile and report to the head of the steering committee or the head of the unit for consideration and decision on awarding prizes within their authority or propose higher-level awards.

2. Procedures for awarding prizes at competitions and sports meetings

a) The organizing board of the competition or sports meeting shall compile results, review, evaluate performance, and assess for awards.

b) The permanent office of the organizing board of the competition or sports meeting or the political agency at the same level shall report to the head of the organizing board of the competition or sports meeting or the head of the unit for decision on awarding prizes within their authority or propose higher-level awards.

Article 62. Procedures for proposing awards by mass organizations

1. Hold a member conference to disseminate criteria, introduce, and assess for awards through voting.

2. The agency (assistant) responsible for mass work shall compile and report to the political agency or the party comrade in charge of mass work; compile and report to the party committee (executive board) at the same level for consideration and resolution.

3. The Political Commissar, Political Instructor, or commanding officer shall decide on awards within their authority or submit to higher authorities for awards.

Article 63. Procedures for proposing the conferment of the titles "Heroic Soldier of the People's Armed Forces" and "Heroic Laborer" during the period of renewal

1. The collective or individual shall report achievements at a military personnel conference; the conference shall examine and propose recommendations.

2. The secretariat of the competition and award council shall seek opinions from the competent agencies at the same level; compile and report to the permanent office of the competition and award council.

3. The permanent office of the competition and award council shall convene to examine and report to the competition and award council at the same level.

4. The competition and award council shall convene to examine and vote secretly.

5. The political agency shall compile and report to the party committee (executive board) at the same level.

6. The Political Commissar, Political Instructor, or commanding officer shall submit to the immediate superior.

Section 2. PROCEDURES, TIME LIMITS, AND APPLICATION FILES FOR PROPOSING AWARDS

Article 64. General provisions on procedures and application files

1. The level that manages organizational matters, military personnel, workers, civil servants, defense officials, employees, and salary funds shall be responsible for awarding or submitting proposals for awards to higher levels for individuals under their management.

2. For retired individuals who have transferred their files to local management, the examination and preparation of award application files shall be carried out by local military agencies from the commune level upwards, submitted to the immediate superior according to the organizational system of units in the Military. For retired individuals (or those deceased), when considering awards based on their rank and achievements, the application files for awards shall be examined and submitted to the immediate superior according to the organizational system of units in the Military by the agency or unit managing the individual before retirement (or death).

3. For units with the obligation to pay state budget, when proposing national-level awards, the Flag of Excellence, and the title "Outstanding Labor Collective" for groups or proposing awards for leaders and commanders mainly responsible for the unit, there must be a confirmation document from the authorized tax management agency.

4. The time for submitting subsequent awards is calculated based on the time recorded in the previous award decision for achieving accomplishments. For decisions not recording the time of achievement, the time for subsequent awards is calculated based on the issuance date of the previous decision.

5. Reports on achievements of groups and individuals proposed for awards must be consistent with the form and level of awards. Achievement reports shall be made according to templates (from template number 01 to 09) attached to Decree No. 91/2017/ND-CP. The content of the achievement report must include all bases for comparison with the standards stipulated in the Law on Competition and Awards and Government Decrees. When submitting to the Ministry of National Defense, the document or appendix must be stamped along the right edge of the document or appendix, covering part of the page; each stamp covers a maximum of five pages of the document; simultaneously send the electronic file of the application to the Propaganda Department/Political General Department (except for documents containing state secrets or military secrets).

6. The innovation councils and scientific councils at various levels shall be established by the heads of agencies and units. These councils shall advise and assist unit commanders in recognizing innovations, research topics, and scientific studies applied in practice to achieve effectiveness as a basis for recommending the conferment of the title "Model Worker" and forms of awards as prescribed. The competition and award councils at various levels shall advise and assist unit commanders in recognizing courageous, creative actions in combat, support for combat, training, readiness for combat, and work.

7. The results of voting by competition and award councils at various levels when proposing to confer national honors, commendation titles, Orders, and "Certificates of Merit from the Prime Minister" shall be implemented as follows:

a) Groups and individuals proposed for the conferment of the titles "Heroic Soldier of the People's Armed Forces," "Heroic Laborer," "Flag of Excellence from the Government," and "National Model Worker" must have a rate of agreement of 90% or more compared to the total number of members of the competition and award council.

b) Groups and individuals proposed for the conferment of the titles "Flag of Excellence from the Ministry of National Defense," "Flag of Excellence from subordinate agencies of the Ministry of National Defense," "National Army Model Worker," and other commendation titles; Orders, and "Certificates of Merit from the Prime Minister" must have a rate of agreement of 75% or more compared to the total number of members of the competition and award council.

8. Method for electing the title "Model Worker at the Grassroots Level"

a) Organize meetings for military personnel, workers, civil servants, defense officials, and laborers at battalion or company level or equivalent to select outstanding individuals who have met the criteria for the titles "Advanced Soldier" and "Advanced Worker" to be considered for the title "Model Soldier at the Base Level" through secret ballot voting. Individuals proposed for nomination for the title "Model Soldier at the Base Level" report their achievements; the meeting considers and votes on their trustworthiness. For leaders and commanders participating in meetings at various levels, they are nominated for the title "Model Soldier at the Base Level" at the meeting where they participate in activities.

b) The meeting to consider the title "Model Soldier at the Base Level" must have at least two-thirds of the total number of personnel present compared to the total number of personnel currently working at the agency or unit. Individuals proposed for the title "Model Soldier at the Base Level" must receive more than 50% of the trust votes compared to the total number of personnel currently working at the agency or unit.

c) For leaders and commanders in charge of subordinate agencies and units under the Ministry of National Defense and officers with general rank, if they are considered for the title "Model Soldier at the Base Level," the agency or unit must submit to the Minister of National Defense for consideration and decision.

9. The Political General Department solicits public opinion in the People's Army Newspaper, the Ministry of National Defense's electronic portal, regarding proposals to confer the titles "People's Armed Forces Hero" and "Labor Hero" within ten working days (except in cases of rewarding outstanding and exceptional achievements or those involving confidential factors).

Article 65. Consultation on Awards

Military agencies and units when proposing national-level awards for commendation titles and forms of commendation must seek opinions from local authorities where the units are stationed or from central ministries, departments, and mass organizations managing them or relevant functional agencies. Specifically as follows:

1. Agencies and units at division level and above must seek opinions from the Provincial People's Committee; agencies and units at brigade and regiment levels; independent units at battalion and company levels must seek opinions from the District People's Committee.

The consultation content includes compliance with the Party's guidelines and state laws and participation in local competitive movements. For units engaged in production and business operations, there must be comments on the implementation of labor insurance systems; environmental protection; ensuring occupational safety and hygiene, food safety according to legal regulations.

2. Local armed forces units must have a consultation document agreeing with the proposal of the same-level party committee and local authority.

3. Collectives and individuals in the military receiving commendations from central ministries, departments, mass organizations, and localities must obtain the consent of their direct superiors.

4. Collectives and individuals managed by the military, when being considered for commendations by foreign countries, international organizations, or foreign military forces, must report to the Political General Department and obtain the approval of the Ministry of National Defense.

Article 66. Timeframe and Application for Consideration of Commendation Titles

Implemented in accordance with Articles 49, 50, and 51 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. Timeframe for Proposals

a) The awarding of the "Flag of Government Excellence" and "Flag of Ministry of National Defense Excellence" is conducted once annually. Units report their proposals to the Ministry of National Defense before November 1st each year.

b) The consideration and proposal for the title "Model Soldier at the Base Level" for leaders and commanders of units under the Ministry of National Defense or officers with general rank is conducted once annually. Units report their proposals to the Ministry of National Defense before December 15th each year.

c) The consideration and proposal for the title "National Model Soldier" and "Military Model Soldier" is conducted once annually. Units report their proposals to the Ministry of National Defense before March 15th each year.

2. Application documents

Application for awarding the titles: "Military Model Soldier," "Base Model Soldier," and "Ministry of National Defense Flag of Excellence" consists of one set (original); application for awarding the "Government Flag of Excellence" and the title "National Model Soldier" consists of three sets (originals), each set including:

a) A submission letter accompanied by a list of nominees for commendation titles;

b) Minutes and results of the trust vote of the competition and commendation council of subordinate units under the Ministry of National Defense;

c) Achievement reports of collectives and individuals proposed for commendation titles, confirmed by the head of the submitting unit.

Article 67. Time and Documents for Proposing Awards of Orders, "Certificate of Merit from the Prime Minister", "Certificate of Merit from the Minister of National Defense"

Pursuant to the provisions of Articles 52 and 57 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The examination and proposal for awarding Orders, "Certificate of Merit from the Prime Minister", "Certificate of Merit from the Minister of National Defense" based on achievements and merits (regular awards) shall be conducted twice a year. Units submit to the Ministry of National Defense before March 15 and July 15 each year.

2. Application documents

The documents for proposing awards of Orders include four sets (originals), "Certificate of Merit from the Prime Minister" includes three sets (originals), "Certificate of Merit from the Minister of National Defense" includes one set (original), each set contains:

a) A report attached with a list of proposed awardees. The list is compiled separately according to each form and level of proposed award.

b) Minutes and results of the trust vote of the competition and commendation council of subordinate units under the Ministry of National Defense;

c) Reports on achievements and summaries of achievements of each proposed awardee, confirmed by the head of the unit submitting the award proposal.

Article 68. Time and Documents for Proposing Awards of Medals and Commemorative Medals

1. The examination and proposal for awarding "Military Flag Victory Medal", "Brave Soldier Medal" shall be conducted twice a year. Units submit to the Ministry of National Defense before March 15 and July 15 each year. The time for proposing commemorative medals follows the guidance of the Political General Department.

2. Application documents

Pursuant to the provisions of Article 54 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

The documents for proposing awards of medals and commemorative medals include one set (original), each set contains:

a) A report from the head of the subordinate unit under the Ministry of National Defense.

b) A list of individuals proposed for awarding medals and commemorative medals. The list is compiled separately according to each form and level.

Article 69. Time and Documents for Proposing Bestowal of Titles "People's Armed Forces Hero", "Labor Hero"

Pursuant to the provisions of Article 56 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. The title "People's Armed Forces Hero", "Labor Hero" shall be reviewed once every five years during the National Patriotic Exemplary Congress, except for cases of outstanding and exceptional achievements.

2. Application documents

The documents for proposing bestowal of titles "People's Armed Forces Hero", "Labor Hero" include four sets (originals), each set contains:

a) A report attached with a list of proposed awardees at all levels.

b) Minutes of meetings and results of secret ballots of the commendation and reward council at all levels.

c) Reports on achievements and summaries of achievements of the collective and individual proposed awardees, confirmed by the heads of units at all levels.

Article 70. Time, Procedures, and Documents for Proposing Awards for Long-term Contributions

1. The examination and proposal for awarding long-term contributions shall be conducted twice a year. Units submit to the Ministry of National Defense before March 15 and July 15 each year. For leaders and commanders in charge of subordinate units under the Ministry of National Defense and generals, there will be separate notifications.

2. Procedures for awarding long-term contributions

a) Individuals declare their work history, confirmed by the head of the unit submitting the award proposal (in cases where the individual has passed away, their relatives or the unit submitting the award proposal shall declare).

b) The political department reviews, summarizes, and sends documents seeking opinions from members of the commendation and reward council. Based on the council's opinions, the political department compiles reports and submits them to the party committee and unit commander for review and submission to higher authorities.

c) The head of the subordinate unit under the Ministry of National Defense examines and submits to the Ministry of National Defense (through the Propaganda Bureau of the Political General Department).

3. Submission process for awards

a) For officers currently working who have reached retirement age, the unit directly managing the officer shall examine and compile documents for submission through the organizational system within the Military.

b) For retired officers (or those who have passed away or died), if their files have been transferred to local management, the examination and compilation of documents for award proposals shall be handled by military agencies at the district level or above, submitted through the organizational system within the Military.

c) For officers who have transferred out of the Military, the agency or unit managing the officer prior to transfer shall confirm the officer's work history and time in position within the Military as a basis for the agency managing the officer prior to retirement to consider and propose awards.

4. Documents for proposing awards of "Golden Star Order", "Ho Chi Minh Order", "Independence Order", "Military Merit Order": five sets (originals); "National Defense Order": four sets (originals), each set contains:

a) A report attached with a summary list of the work history of the proposed awardee.

b) Minutes and results of trust votes of the commendation and reward council of subordinate units under the Ministry of National Defense.

c) Reports on achievements for proposed awards, confirmed by the heads of units at all levels.

d) Related documents: Copies of appointment decisions for positions, groups of positions, or position allowance coefficients, or copies of the officer's resume or party member resume, or social insurance book. For officers on special assignment, confirmation documents from the agency managing the officer on special assignment are required. For revolutionary old-timers or pre-revolutionary activists, copies of decisions recognizing them as revolutionary old-timers or pre-revolutionary activists by competent authorities are required.

Article 71. Simplified Procedures and Documents

Implement according to the provisions of Article 85 of the Law on Competitions and Awards and Clause 55 of Decree No. 91/2017/NĐ-CP. Specifically as follows:

1. Cases meeting all the following conditions may be proposed for awards through simplified procedures:

a) The award serves political requirements, timely encouraging and motivating collectives and individuals;

b) Individuals or collectives have achieved outstanding and exceptional achievements in combat, work, labor, or study.

c) Achievements and merits are clear.

2. Agencies and units shall consider and decide on awards or propose higher authorities to grant awards immediately after individuals or collectives achieve their accomplishments.

3. The application for State and Government awards includes four sets (originals); the application for Ministry of National Defense awards includes one set (original), each set containing:

a) A report attached with the list of proposed awardees;

b) A summary report of the achievements of the collective or individual, confirmed by the head of the unit proposing the award.

Article 72. Procedures and Documents for Proposing Awards to Foreign Organizations and Individuals

1. The preparation of documents for proposing awards to foreign collectives and individuals is carried out by the agency or unit responsible for proposing the award.

2. The application includes four sets (originals), each set containing:

a) A report from the head of the subordinate unit under the Ministry of National Defense;

b) A report on the achievements of foreign collectives or individuals (prepared by the agency proposing the award);

c) A confirmation document from the competent authority regarding the obligations to be fulfilled towards the Socialist Republic of Vietnam as stipulated by law (if applicable).

Section 3. ANNOUNCEMENT OF AWARD RESULTS AND STORAGE OF AWARD DOCUMENTS

Article 73. Announcement of Award Results

1. After receiving the decision and award items from the Central Board of Competitions and Awards, the Department of Propaganda and Training / Political General Department shall copy the decision and announce the award results to the agencies and units that submitted to the Ministry of National Defense.

2. After receiving the decision and award items from the competent authority, the agency or unit proposing the award shall announce the award results to the awardees.

3. In cases where the conditions, standards, and documents do not meet the prescribed requirements, the Department of Propaganda and Training / Political General Department shall notify in writing to the agencies and units that submitted to the Ministry of National Defense.

Article 74. Storage of Award Documents

1. Agencies and units are responsible for storing the award documents of collectives and individuals within their management scope in accordance with the law.

2. The agency in charge of competition and award work shall implement the application of information technology and modernize the management of competition and award work; develop software for managing competition and award data to serve tracking, summarizing, researching, searching, resolving citizen complaints or confirming for subjects when requested.

Chapter VI

COMPETITION AND AWARD COUNCIL, COMPETITION AND AWARD TEAM

Article 75. Competition and Award Council of the Ministry of National Defense

1. The Competition and Award Council of the Ministry of National Defense is the advisory body to the Central Military Commission and the Ministry of National Defense on competition and award work in the military.

2. The members of the Competition and Award Council of the Ministry of National Defense include:

a) Chairman of the Council: Director of the Political General Department.

b) Vice-Chairman in charge of the Council: Deputy Director of the Political General Department in charge of competition and award work.

c) Vice-Chairman of the Council: Deputy Chief of the General Staff in charge of training.

d) Members of the Council: Heads of the Departments of Logistics, Engineering, Defense Industry, Department II, and heads of some functional agencies of the Ministry of National Defense.

3. The Competition and Award Council of the Ministry of National Defense has its organizational regulations and operational rules.

Article 76. Competition and Reward Councils, Competition and Reward Teams from the level of units directly under the Ministry of National Defense to the company level and equivalent

1. Organization

a) Competition and Reward Councils shall be established from the level of units directly under the Ministry of National Defense to the regimental and brigade levels and equivalents.

b) Competition and Reward Teams shall be established at battalion, company levels and equivalents.

2. Functions

Provide advisory services to the Party committees, political commissars, political officers, and commanders at the same level regarding competition and reward activities of the agencies and units.

Point 3. Tasks

a) Propose to the Party committees, political commissars, political officers, and commanders at the same level on directions, goals, contents, forms, targets, measures for implementing competition and reward activities of the agencies and units.

b) Urge, inspect, and supervise the implementation of the Party's guidelines and policies, State laws, directives, resolutions of the Central Military Commission, the Ministry of National Defense, and guidance of the Political Department on competition and reward activities of the agencies and units.

c) Regularly evaluate the results of competition and reward work and the competition movement in the unit; provide advisory services for interim and final reviews of competition and reward work.

d) Provide advisory services to the Party committees, political commissars, political officers, and commanders at the same level to consider and decide on awarding commendations and rewards according to their authority or to submit to competent authorities for rewards.

4. Structure and Composition

a) Chairman of the Competition and Reward Council, Team Leader of the Competition and Reward Team: Political Commissar, Political Officer (Party Secretary).

b) Vice-Chairman in charge of the Competition and Reward Council: Deputy Political Commissar, Deputy Political Officer.

c) Vice-Chairman of the Competition and Reward Council, Deputy Team Leader of the Competition and Reward Team: Unit Commander (Commander, Division Commander, Brigade Commander, Battalion Commander, Company Commander and equivalents). For the General Staff and the Political Department, the Vice-Chairman of the Competition and Reward Council shall be held by the Chief of the Political Department.

d) Standing Member of the Competition and Reward Council: Head of Political Affairs. For the General Staff and the Political Department, the Standing Member of the Competition and Reward Council shall be held by the Deputy Chief of the Political Department in charge of propaganda and education.

đ) Other members shall be decided by the head of the agency or unit.

5. Quantity

a) The Competition and Reward Council of units directly under the Ministry of National Defense shall not exceed twenty-two members, the division-level or equivalent shall not exceed eighteen members; the brigade-level or equivalent shall not exceed fifteen members.

b) The Competition and Reward Team of battalion-level or equivalent shall not exceed seven members, the company-level or equivalent shall not exceed five members.

6. Inspection System

a) The Competition and Reward Councils of units directly under the Ministry of National Defense shall inspect competition and reward work and the Quyet Thang competition movement of subordinate agencies and units twice a year.

b) The Competition and Reward Councils at the division level and equivalents shall inspect and score competition and reward work and the Quyet Thang competition movement of subordinate agencies and units once every quarter.

c) The Competition and Reward Councils at the brigade level and equivalents shall inspect and score competition and reward work and the Quyet Thang competition movement of subordinate agencies and units once a month.

d) The Competition and Reward Teams at the battalion level and equivalents shall inspect and score competition among subordinate agencies and units once a week.

đ) The Competition and Reward Teams at the company level and equivalents shall inspect and score competition daily.

e) In addition to regular inspections, based on specific requirements and tasks, the Competition and Reward Councils and Teams may conduct surprise inspections.

7. Meeting System

a) The Competition and Reward Councils of units directly under the Ministry of National Defense shall meet twice a year.

b) The Competition and Reward Councils at the division level and equivalents shall meet once every quarter.

c) The Competition and Reward Councils at the brigade level and equivalents shall meet once a month.

d) The Competition and Reward Teams at the battalion level shall meet once a week; the Competition and Reward Teams at the company level shall hold daily discussions.

đ) In addition to regular meetings, the Councils and Teams may organize surprise meetings.

e) The time, content, and meeting materials of the Council shall be notified and sent to the Council members at least three days in advance.

8. Competition and Reward Councils and Teams at all levels shall establish regulations on the organization and operation of their own Competition and Reward Councils and Teams.

Article 77. Standing bodies of the competition and reward councils at all levels

1. Tasks

a) Drafting the work program and activity plan of the council, submitting to the chairman of the council for signature and issuance.

b) Preparing the agenda for council meetings and organizing the proceedings during council sessions.

c) Compiling and reporting on the results, directions of competition and reward activities, and the "Determined Victory" competition movement; the results of competition movements carried out in phases and special topics within the agency or unit.

d) Tham mưu cho hội đồng xét, đề nghị tặng thưởng các danh hiệu vinh dự Nhà nước, danh hiệu thi đua và các hình thức khen thưởng thành tích theo công trạng (khen thưởng thường xuyên).

đ) Tổ chức triển khai thực hiện kết luận của chủ tịch hội đồng; thường trực giải quyết các công việc của hội đồng.

e) Thực hiện các nhiệm vụ khác khi được chủ tịch hoặc phó chủ tịch hội đồng thi đua - khen thưởng yêu cầu.

2. Cơ cấu, thành phần

a) Tổng cục Chính trị là cơ quan thường trực Hội đồng Thi đua - Khen thưởng Bộ Quốc phòng. Đồng chí Phó Chủ nhiệm Tổng cục Chính trị phụ trách công tác thi đua, khen thưởng là thủ trưởng Cơ quan thường trực Hội đồng Thi đua - Khen thưởng Bộ Quốc phòng.

b) Cơ quan thường trực hội đồng thi đua - khen thưởng từ cấp đơn vị trực thuộc Bộ Quốc phòng đến cấp trung đoàn và tương đương là cơ quan chính trị cùng cấp. Đồng chí chủ nhiệm chính trị là thủ trưởng cơ quan thường trực hội đồng.

3. Chế độ hội họp

a) Cơ quan thường trực hội đồng thi đua - khen thưởng các cấp họp trước mỗi kỳ họp của hội đồng.

b) Ngoài các phiên họp thường kỳ, cơ quan thường trực hội đồng có thể tổ chức họp đột xuất.

Điều 78. Thư ký hội đồng thi đua - khen thưởng các cấp

1. Nhiệm vụ

a) Giúp cơ quan thường trực hội đồng và hội đồng xây dựng chương trình, kế hoạch hoạt động của hội đồng; tổng hợp, dự thảo báo cáo tổng kết, đánh giá kết quả công tác thi đua, khen thưởng và phong trào thi đua Quyết thắng của đơn vị hàng năm hoặc từng giai đoạn.

b) Chuẩn bị nội dung, tài liệu, làm công tác tổ chức và bảo đảm cho các cuộc họp của cơ quan thường trực hội đồng và hội đồng.

c) Tổng hợp các ý kiến thành viên hội đồng; soạn thảo, hoàn chỉnh các văn bản theo kết luận của chủ tịch hội đồng.

d) Thực hiện các nhiệm vụ khác khi được chủ tịch hoặc phó chủ tịch hội đồng thi đua - khen thưởng yêu cầu.

2. Cơ cấu, thành phần

a) Ban Thư ký Hội đồng Thi đua - Khen thưởng Bộ Quốc phòng gồm thủ trưởng một số cơ quan chức năng của Bộ Quốc phòng. Đồng chí Cục trưởng Cục Tuyên huấn là Trưởng ban Thư ký Hội đồng Thi đua - Khen thưởng Bộ Quốc phòng.

b) Ban thư ký hội đồng thi đua - khen thưởng từ cấp đơn vị trực thuộc Bộ Quốc phòng đến cấp sư đoàn và tương đương gồm một số đồng chí trưởng phòng, ban của cơ quan tham mưu, chính trị, hậu cần, kỹ thuật. Trưởng ban thư ký do đồng chí trưởng phòng, ban tuyên huấn đảm nhiệm.

c) Ban thư ký hội đồng thi đua - khen thưởng cấp trung đoàn và tương đương gồm một số đồng chí trợ lý cơ quan tham mưu, chính trị, hậu cần, kỹ thuật. Trưởng ban thư ký do đồng chí phó chủ nhiệm chính trị phụ trách công tác tuyên huấn đảm nhiệm.

d) Thư ký tổ thi đua - khen thưởng ở cấp tiểu đoàn, đại đội do chính trị viên phó đảm nhiệm.

đ) Các cơ quan, đơn vị không có cơ quan chính trị, không có chính trị viên, chính trị viên phó, thư ký hội đồng thi đua - khen thưởng do đồng chí trợ lý chính trị đảm nhiệm.

3. Chế độ hội họp

a) Ban thư ký hội đồng thi đua - khen thưởng các cấp họp trước khi cơ quan thường trực hội đồng họp.

b) Ngoài các phiên họp thường kỳ, ban thư ký có thể tổ chức họp đột xuất.

Chương VII

KINH PHÍ THI ĐUA, KHEN THƯỞNG VÀ MỨC TIỀN THƯỞNG

Điều 79. Nguồn kinh phí thi đua, khen thưởng

1. Kinh phí thi đua, khen thưởng của các đơn vị dự toán hưởng lương từ ngân sách do Bộ Quốc phòng đảm bảo. Ngoài ra có thể huy động từ nguồn đóng góp của các tổ chức, cá nhân trong, ngoài Quân đội và các nguồn thu hợp pháp khác phục vụ cho mục đích thi đua, khen thưởng.

2. Kinh phí thi đua, khen thưởng của các doanh nghiệp được trích từ quỹ thi đua, khen thưởng của đơn vị theo quy định tại Nghị định số 91/2015/NĐ-CP ngày 13 tháng 10 năm 2015 của Chính phủ về đầu tư vốn nhà nước vào doanh nghiệp và quản lý, sử dụng vốn, tài sản doanh nghiệp. Mức trích lập quỹ do ban giám đốc doanh nghiệp quyết định và phù hợp với quy định của Luật Doanh nghiệp. Ngoài ra có thể huy động từ nguồn đóng góp của các tổ chức, cá nhân trong, ngoài nước và các nguồn thu hợp pháp khác phục vụ cho mục đích thi đua, khen thưởng.

3. Nguồn kinh phí bảo đảm

a) Đối với các cơ quan, đơn vị dự toán: Được tính trong dự toán ngân sách quốc phòng hàng năm của cơ quan, đơn vị.

b) Đối với các doanh nghiệp, đơn vị sự nghiệp công lập và các cơ sở hạch toán kinh doanh, dịch vụ được trích, lập theo chế độ quy định.

4. Kinh phí bảo đảm cho công tác khen thưởng trong sơ kết, tổng kết các cuộc vận động, các phong trào thi đua theo chuyên đề của các ngành, đoàn thể quần chúng do các ngành, đoàn thể chủ trì nội dung lập dự toán bảo đảm.

Điều 80. Quản lý kinh phí thi đua, khen thưởng

1. Kinh phí thi đua, khen thưởng của cấp nào do cấp đó quản lý và được lập, cấp phát, thanh toán theo quy định hiện hành.

2. Thủ trưởng đơn vị cấp nào ra quyết định khen thưởng thì cấp đó chịu trách nhiệm chi trả tiền thưởng từ nguồn tiền thưởng do cấp mình quản lý.

3. Tập thể, cá nhân được Bộ Quốc phòng, Chính phủ, Thủ tướng Chính phủ, Chủ tịch nước khen thưởng, tiền thưởng do Bộ Quốc phòng đảm bảo (trừ tiền thưởng trong sơ kết, tổng kết các cuộc vận động, các phong trào thi đua theo chuyên đề của ngành, đoàn thể).

Điều 81. Sử dụng kinh phí thi đua, khen thưởng

1. Kinh phí thi đua, khen thưởng được dùng để chi cho việc tổ chức thực hiện phong trào thi đua, công tác thi đua, khen thưởng và chi thưởng đối với danh hiệu thi đua, hình thức khen thưởng mà thành tích đạt được trong thời kỳ đổi mới và được sử dụng để:

a) Chi cho in ấn, làm hiện vật khen thưởng (giấy chứng nhận, giấy khen, bằng khen, huân chương, huy chương, kỷ niệm chương, huy hiệu, thêu cờ thi đua, hộp, khung);

b) Chi tiền thưởng hoặc tặng phẩm lưu niệm cho các cá nhân, tập thể;

c) Chi cho công tác tổ chức, chỉ đạo các phong trào thi đua: Không quá 10% trong tổng kinh phí thi đua, khen thưởng của từng cấp. Nội dung chi gồm: Tổ chức lễ phát động thi đua; xây dựng, nhân điển hình tiên tiến; sơ kết, tổng kết, tuyên truyền phổ biến, rút kinh nghiệm; tổ chức Đại hội thi đua Quyết thắng; bảo đảm cho các hoạt động của hội đồng thi đua - khen thưởng, tổ thi đua - khen thưởng.

2. Cá nhân, tập thể được khen thưởng ngoài việc được công nhận các danh hiệu thi đua, cờ thi đua, danh hiệu vinh dự Nhà nước, Giải thưởng Hồ Chí Minh, Giải thưởng Nhà nước; tặng thưởng Huân chương, Huy chương, Bằng khen, Giấy khen kèm theo hiện vật khen thưởng còn được thưởng tiền hoặc hiện vật có giá trị tương đương quy định tại các Điều 69, 70, 71, 72, 73, 74 của Nghị định số 91/2017/NĐ-CP, theo quy định sau:

a) Trong cùng một thời điểm, một đối tượng đạt nhiều danh hiệu thi đua, thời gian để đạt được các danh hiệu thi đua đó khác nhau thì được nhận tiền thưởng của các danh hiệu thi đua;

b) Trong cùng thời điểm, một đối tượng vừa đạt danh hiệu thi đua vừa đạt hình thức khen thưởng thì được nhận tiền thưởng của danh hiệu thi đua và của hình thức khen thưởng.

Điều 82. Mức tiền thưởng

Mức tiền thưởng kèm theo các danh hiệu thi đua và các hình thức khen thưởng thực hiện theo quy định tại các Điều 69, 70, 71, 72, 73, 74 Nghị định số 91/2017/NĐ-CP và Thông tư số 83/2011/TT-BQP ngày 16 tháng 6 năm 2011 của Bộ Quốc phòng hướng dẫn quản lý, sử dụng kinh phí thi đua, khen thưởng và mức tiền thưởng trong Quân đội nhân dân Việt Nam.

Chương VIII

QUYỀN, NGHĨA VỤ CỦA CÁ NHÂN, TẬP THỂ; KHIẾU NẠI, TỐ CÁO VÀ XỬ LÝ VI PHẠM; TƯỚC VÀ PHỤC HỒI DANH HIỆU

Điều 83. Quyền của cá nhân, tập thể trong thi đua, khen thưởng

Quyền của cá nhân, tập thể trong thi đua, khen thưởng thực hiện theo quy định tại Điều 76 Nghị định số 91/2017/NĐ-CP. Cụ thể như sau:

1. Được tham gia các phong trào thi đua do Nhà nước, cơ quan, tổ chức, đơn vị phát động.

2. Được đề nghị xét tặng danh hiệu, hình thức khen thưởng theo đúng quy định của pháp luật.

3. Có quyền góp ý hoặc đề nghị cấp có thẩm quyền xét tặng danh hiệu, hình thức khen thưởng cho cá nhân, tập thể có đủ thành tích và tiêu chuẩn theo quy định của pháp luật.

4. Đề nghị cấp có thẩm quyền không xét tặng danh hiệu, hình thức khen thưởng, thu hồi các danh hiệu, hình thức khen thưởng đã được tặng hoặc khen thưởng không đúng tiêu chuẩn, không đúng thủ tục do pháp luật quy định.

Điều 84. Nghĩa vụ của cá nhân, tập thể trong thi đua, khen thưởng

Thực hiện theo quy định tại Điều 77 Nghị định số 91/2017/NĐ-CP. Cụ thể như sau:

1. Chấp hành nghiêm các quy định của pháp luật, quy định của cơ quan, đơn vị trong công tác thi đua, khen thưởng.

2. Cá nhân, tập thể được khen thưởng có nghĩa vụ bảo quản các hiện vật khen thưởng, không được cho người khác mượn để thực hiện hành vi vi phạm pháp luật.

3. Từ chối nhận danh hiệu vinh dự Nhà nước, danh hiệu thi đua hoặc hình thức khen thưởng không xứng đáng với thành tích và không đúng tiêu chuẩn, thủ tục do pháp luật quy định.

Điều 85. Xử lý vi phạm trong thi đua, khen thưởng

Thực hiện theo quy định tại Điều 96 Luật Thi đua, khen thưởng. Cụ thể như sau:

1. Người nào gian dối trong việc kê khai thành tích để được khen thưởng thì bị hủy bỏ quyết định khen thưởng, bị thu hồi hiện vật và tiền thưởng đã nhận; tùy theo tính chất, mức độ vi phạm mà còn bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

2. Cá nhân xác nhận sai sự thật hoặc làm giả hồ sơ, giấy tờ cho người khác để đề nghị khen thưởng; người lợi dụng chức vụ quyền hạn quyết định khen thưởng trái pháp luật thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

Điều 86. Khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo trong thi đua, khen thưởng

Thực hiện theo quy định tại Điều 98 Luật Thi đua, khen thưởng. Cụ thể như sau:

1. Tổ chức, cá nhân có quyền khiếu nại, tố cáo đối với hành vi vi phạm trong công tác thi đua, khen thưởng theo quy định của pháp luật về khiếu nại, tố cáo.

2. Cơ quan, người có thẩm quyền giải quyết khiếu nại, tố cáo trong Quân đội có trách nhiệm giải quyết khiếu nại, tố cáo đúng quy định của pháp luật Nhà nước và kỷ luật Quân đội.

Điều 87. Hủy bỏ quyết định khen thưởng

Thực hiện theo quy định tại Điều 78 Nghị định số 91/2017/NĐ-CP. Cụ thể như sau:

1. Cá nhân gian dối trong việc kê khai thành tích để được khen thưởng Huân chương, Huy chương, Bằng khen, Giấy khen thì bị hủy bỏ quyết định khen thưởng và bị thu hồi hiện vật, tiền thưởng đã nhận.

2. Căn cứ vào kết luận của cơ quan có thẩm quyền xác định việc cá nhân kê khai gian dối thành tích để được khen thưởng, cơ quan trình khen thưởng có trách nhiệm đề nghị cấp có thẩm quyền khen thưởng ban hành quyết định hủy bỏ quyết định và thu hồi hiện vật, tiền thưởng.

3. Hồ sơ đề nghị hủy bỏ quyết định khen thưởng gồm:

a) Tờ trình của cơ quan, đơn vị trực tiếp trình khen thưởng đối với từng loại hình khen thưởng cho cá nhân;

b) Báo cáo tóm tắt lý do trình cấp có thẩm quyền hủy bỏ quyết định khen thưởng.

4. Trường hợp tập thể, cá nhân đã khen thưởng mà sau đó có kết luận của cơ quan có thẩm quyền về việc có sai phạm, khuyết điểm trong khoảng thời gian tính thành tích đề nghị tặng danh hiệu thi đua hoặc hình thức khen thưởng thì tùy theo mức độ sai phạm, khuyết điểm để hạ mức thi đua, khen thưởng hoặc hủy bỏ quyết định khen thưởng theo quy định, trừ những cá nhân đã hy sinh, từ trần.

5. Sau khi có quyết định hủy bỏ danh hiệu, hình thức khen thưởng hoặc danh hiệu vinh dự Nhà nước, cơ quan trình khen thưởng có trách nhiệm thu hồi hiện vật khen thưởng giao nộp về cơ quan làm công tác thi đua, khen thưởng cấp trên; số tiền thưởng thu nộp vào ngân sách Nhà nước hoặc quỹ thi đua, khen thưởng theo quy định.

Điều 88. Thủ tục, hồ sơ tước hoặc phục hồi danh hiệu

Thực hiện theo quy định tại Điều 79 Nghị định số 91/2017/NĐ-CP. Cụ thể như sau:

1. Cá nhân được tặng thưởng danh hiệu vinh dự nhà nước mà vi phạm pháp luật hình sự, bị tòa án xét xử bằng bản án đã có hiệu lực pháp luật và bị tuyên án từ hình phạt tù có thời hạn trở lên thì bị tước danh hiệu vinh dự nhà nước.

2. Trong thời hạn 30 ngày kể từ ngày bản án có hiệu lực pháp luật, cơ quan trình khen thưởng có trách nhiệm trình cấp có thẩm quyền đề nghị Bộ Quốc phòng báo cáo Thủ tướng Chính phủ trình Chủ tịch nước quyết định việc tước danh hiệu vinh dự Nhà nước.

3. Trong thời hạn 15 ngày kể từ ngày nhận được quyết định của Chủ tịch nước, cơ quan trình khen thưởng có trách nhiệm thu hồi hiện vật khen thưởng để giao nộp cơ quan làm công tác thi đua, khen thưởng cấp trên; thu hồi tiền thưởng và nộp vào ngân sách Nhà nước hoặc quỹ thi đua, khen thưởng theo quy định.

4. Cá nhân bị xét xử oan, sai và đã được cơ quan có thẩm quyền minh oan, sửa sai thì được xem xét phục hồi và trao lại danh hiệu vinh dự Nhà nước.

5. Hồ sơ đề nghị tước, đề nghị phục hồi và trao lại danh hiệu vinh dự Nhà nước gồm:

a) Tờ trình của cấp trình khen;

b) Báo cáo tóm tắt, nêu rõ nội dung hoặc giải trình lý do đề nghị và ý kiến của cấp có thẩm quyền.

Chương IX

ĐIỀU KHOẢN THI HÀNH

Điều 89. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 25 tháng 11 năm 2018 và thay thế Thông tư số 160/2014/TT-BQP ngày 09 tháng 11 năm 2014 của Bộ Quốc phòng quy định chi tiết và hướng dẫn thi đua, khen thưởng trong Quân đội nhân dân Việt Nam, Thông tư số 172/2011/TT-BQP ngày 05 tháng 9 năm 2011 của Bộ trưởng Bộ Quốc phòng Ban hành Quy chế Công tác thi đua, khen thưởng của Bộ Quốc phòng, Thông tư số 67/2013/TT-BQP ngày 19 tháng 5 năm 2013 của Bộ Quốc phòng sửa đổi, bổ sung một số điều Quy chế Công tác thi đua, khen thưởng của Bộ Quốc phòng.

2. Những quy định trước đây của Bộ Quốc phòng về thi đua, khen thưởng trái với Thông tư này đều bãi bỏ.

Điều 90. Trách nhiệm thi hành

1. Tổng cục Chính trị hướng dẫn, triển khai thực hiện Thông tư này và chủ trì, phối hợp với các cơ quan có liên quan kiểm tra việc thực hiện công tác thi đua, khen thưởng trong toàn quân.

2. Thủ trưởng các cơ quan, đơn vị, tổ chức và cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.

3. Các văn bản viện dẫn trong Thông tư này khi được sửa đổi, bổ sung hoặc thay thế bằng văn bản mới thì nội dung viện dẫn cũng được điều chỉnh, thực hiện theo văn bản sửa đổi, bổ sung hoặc thay thế.

4. Quá trình thực hiện, nếu có vướng mắc, các cơ quan, đơn vị phản ánh kịp thời về Bộ Quốc phòng (qua Tổng cục Chính trị) để xem xét, giải quyết./
