Pursuant to Resolution No. 42-NQ/TW dated November 30, 2004 of the Politburo on cadre leadership and management planning during the period of accelerating industrialization and modernization of the country;
Pursuant to Guideline No. 22-HD/BTCTW dated October 21, 2008 of the Central Organization Department guiding Resolution No. 42-NQ/TW dated November 30, 2004 of the Politburo on cadre leadership and management planning during the period of accelerating industrialization and modernization of the country;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Considering the proposal of the Director of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1. This Decision promulgates the "Regulation on Leadership Planning of Units under and Affiliated with the Ministry of Finance".
Article 2. This Decision shall take effect from the date of signing.
The Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry of Finance's Office, the Heads of units under and affiliated with the Ministry of Finance shall be responsible for implementing this Decision./.

REGULATIONS
Leadership planning of units
under and affiliated with the Ministry of Finance
(Issued together with Decision No. 1512/QD-BTC dated June 22, 2011)

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Regulation stipulates principles, standards, procedures, and related matters concerning leadership planning of units under and affiliated with the Ministry of Finance, including:
1. Leadership planning of units under the Ministry of Finance's agency (Deputy Directors, Deputy Deputy Directors and equivalent positions; Heads of Departments, Deputy Heads of Departments and equivalent positions; leadership positions of subordinate public institutions under Bureaus and equivalent positions).
2. Leadership planning at various levels of General Departments and equivalent (including: leadership positions managed by the Minister of Finance; leadership positions delegated to General Department Directors for management; leadership positions delegated to Bureau Directors in provinces and centrally governed cities for management according to the regulations on cadre management delegation by the Minister of Finance).
Heads, Deputy Heads, and other leadership positions of public institutions directly under the Ministry of Finance.
Article 2. Principles of Planning
1. Cadre planning must ensure democracy, objectivity, and compliance with procedures.
2. Cadres in planning must meet the required conditions and standards, have development potential.
3. Cadre planning is a regular task; annually, it must be reviewed and evaluated to supplement, while removing from planning those who no longer meet the prescribed standards.
4. In addition to planning cadres for each unit individually, cadre planning also involves cross-unit planning between central and local units of the Ministry of Finance (cross-planning).
Article 3. Number of Cadres Included in Planning
1. Planning is calculated for each leadership position, wherein:
a) The Head of each unit is defined as a leadership position;
b) The Deputy Head of each unit is defined as a leadership position (for example, Deputy Director of the Provincial or City Tax Bureau is a leadership position).
2. The number of cadres included in planning for one leadership position is from 2 to 3 people. For Deputy Heads of units, if necessary, more can be planned but not exceeding the current number of Deputy Heads in the unit.
3. For cadres with capability and development potential, one person may be planned for up to 3 leadership positions.
Article 4. Organization of planning review work
1. Annually, at the end of each year, the leadership collective of the unit shall organize the implementation of planning review work. The planning review includes the following contents:
a) Comments and evaluation of planned cadres;
b) Consideration of maintaining cadres in the planning, removing cadres from the planning list, and proposing policies to supplement additional planned cadres according to the procedures and regulations stipulated in Chapter III of this Regulation.
2. The planning review must be completed before February 28th of each year.
3. Based on the results of the review, the authority with jurisdiction over planning must complete the confirmation for cases continuing to maintain planning no later than the end of March of each year.
4. The implementation of procedures, formalities, and decisions to supplement new planning must be completed no later than the end of June of each year.
Chapter II
STANDARDS FOR PLANNED CADRES,
EVALUATION OF PLANNED CADRES
Article 5. Planning standards
1. Planned cadres must meet the standards prescribed in the Resolution of the 3rd Plenum (8th term) of the Central Committee on the cadre strategy during the period of accelerating industrialization and modernization of the country. For units under the Ministry of Finance, planned cadres must meet the following standards:
1.1. Political quality, morality, lifestyle:
a) Firm political stance; not negative, harassment, bureaucratic, arbitrary, corrupt, wasteful;
b) Clear history, good morality, clean and healthy lifestyle;
c) Unity within the organization; exemplary in implementing Party guidelines and state laws;
d) Eager to learn, progressive; honest in performing tasks; high sense of responsibility in work.
1.2. Practical capability:
a) Proficient in Party policies and state laws; have deep knowledge in the specialized field assigned;
b) Effectively implement assigned tasks; proactive and creative in executing duties;
c) Leadership and management capability;
d) Ability to unite the masses and coordinate with related agencies and units in organizing the implementation of assigned tasks.
1.3. Specialized training qualifications:
a) General criteria:
Planners leading units under the Ministry of Finance must hold a bachelor's degree; for those under 45 years old, they must hold a regular bachelor's degree or a master's or doctoral degree relevant to the requirements of the planned position.
b) Specific standards for certain positions and areas:
- For the following positions, when planning, cadres must hold a regular bachelor's degree or a master's or doctoral degree relevant to the requirements of the position (regardless of age):
+ Deputy Heads and above of Departments, Bureaus, and equivalent units under the Ministry of Finance (including Heads and Deputies of affiliated public service units);
+ Deputy Heads and above of Departments, Bureaus, and equivalent units under General Departments (including Heads and Deputies of affiliated public service units);
+ Heads and Deputies of public service units directly under the Ministry of Finance;
+ Directors and Deputy Directors of General Departments located in Hanoi and Ho Chi Minh City.
- In mountainous, border, island, remote, ethnic minority, and particularly difficult economic and social conditions areas, specific cases may be considered for planning cadres who have graduated with a bachelor's degree.
- For female cadres and ethnic minority cadres, if they lack the required educational qualifications but have outstanding practical leadership capabilities and are trusted by colleagues, specific cases may be considered for planning.
- For planning positions such as Team Leaders and Group Leaders in Inspection Bureaus and equivalent units, Bureau Chiefs, based on actual conditions, specific educational qualifications can be set for each area, prioritizing bachelor's degree holders and ensuring the quality of planned cadres.
c) Apart from the cases specified in paragraph b above, other cases must meet the standards stipulated in paragraph a, point 1.3, clause 1, of this Article.
1.4. Age limit for planning: Planners must ensure that they are not older than 55 years for males and not older than 50 years for females.
2. Based on the aforementioned standards, the General Department Director and heads of public service units directly under the Ministry may specify additional standards for each planned position.
Article 6. Evaluation of cadres for planning
1. Pre-planning evaluation:
a) The evaluation of cadres before planning shall be carried out according to the criteria stipulated in Article 5 of this Regulation; additionally, an assessment of the direction and prospects for development (ability to meet job requirements when assigned to planned positions) of planned cadres shall be conducted.
b) The process of evaluating cadres before planning shall be implemented concurrently with the implementation of the planning process as prescribed in Chapter III of this Regulation.
2. Annual periodic evaluation:
The annual periodic evaluation of planned cadres shall be conducted in accordance with the current regulations of the Party and State, and the guidelines of the Ministry of Finance on the annual evaluation and classification of cadres and civil servants.
Chapter III
PROCEDURES AND FORMALITIES FOR PLANNING OF CADRES
Section I
GENERAL PROCEDURES AND FORMALITIES
Article 7. General Procedures
Planning of cadres at various levels of units under the Ministry of Finance shall be carried out through four steps:
Step 1: Proposing the policy for planning (conducted concurrently with the annual review of planning).
Step 2: Organizing a full meeting of cadres and civil servants or a key cadre meeting to provide comments, evaluations, and ballots for introducing planning.
Step 3: Approving the list of planning at the unit level.
Step 4: Approving the plan (including the content of soliciting opinions from the competent party committee - if applicable).
The procedures and formalities for implementing each step of planning shall be carried out in accordance with the provisions of Sections II, III, and IV of this Chapter.
Article 8. Provisions on organizing planning meetings
1. A meeting may only be held when at least two-thirds of the participating cadres are present. In cases where participating cadres are absent, they are not permitted to delegate others to attend on their behalf.
2. For meetings with the same participants, the same meeting can implement the content and procedures of planning for multiple planned positions.
3. Prior to the meeting, the chairperson designates one of the attending members to serve as the Secretary of the meeting.
4. The content and results of the meeting must be recorded in minutes.
Article 9. Provisions on organizing ballots for introducing planning
1. When conducting ballots for introducing planning, the following individuals do not belong to the voting group:
a) Probationary civil servants and officials;
b) Cadres under employment contracts who have worked at the unit for less than 12 months (for units permitted to enter into labor contracts under Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government regarding the implementation of the system of contracts for certain types of work in administrative agencies and public institutions).
2. If an individual participates in multiple positions within the voting group, they shall cast only one ballot when introducing planning.
3. When conducting ballots for introducing planning through secret voting, a Ballot Counting Committee must be established. The Ballot Counting Committee is proposed by the chairperson and must be approved by the meeting (by raising hands).
4. The results of ballots for introducing planning shall be publicly announced at the meetings.
Article 10. Provisions on the time limit for consultation
1. For planned positions requiring consultation with the local party committee, the unit must clearly specify the time for requesting consultation in the letter seeking opinions. The maximum time for requesting consultation shall not exceed 30 days, starting from the date of the consultation letter.
2. If the consultation period has passed but the local party committee has not provided a response, it shall be handled as follows:
a) After exceeding the consultation period by 15 days, the unit sends a second reminder letter for consultation;
b) After 15 days from the second reminder letter, the unit sends a third reminder letter. In the third reminder letter, the unit specifies that after 15 days from the date of the third reminder letter, if the local party committee still does not provide a response, it will be considered that the local party committee agrees with the planning proposal of the unit.
c) After the deadline specified in the third reminder letter, the unit implements the approval of the plan or submits the plan for approval by the competent authority according to the management hierarchy of cadres of the Ministry of Finance.
The decision approving the plan shall be sent to the local party committee for monitoring.
Article 11. Templates for unified application of documents in planning work
1. Report on reviewing and proposing policies to supplement planning (Template No. 01/QHCB).
2. Minutes of the Conference (Template No. 02/QHCB).
3. Opinion solicitation form for introducing planning (Template No. 03/QHCB).
4. Summary table of opinion solicitation results for introducing planning (Template No. 04/QHCB).
5. Minutes of the vote counting for opinion solicitation for introducing planning (Template No. 05/QHCB).
6. Curriculum vitae of officials: Currently implemented according to Template No. 2C-BNV/2008 issued together with Decision No. 02/2008/QĐ-BNV dated October 6, 2008 of the Minister of Home Affairs on issuing templates for managing personnel files and civil servants (Template No. 06/QHCB attached).
7. Document soliciting opinions for joint approval from the Party Committee (Template No. 07/QHCB).
8. Report requesting approval of planning (Template No. 08/QHCB).
9. Decision on approving planning (Template No. 09/QHCB).
PART II
PLANNING AT THE MINISTRY OF FINANCE
Article 12. Planning for leadership at the Department, General Directorate, Inspectorate, Ministry Office, Institute of Strategy and Financial Policy level
1. Step 1: Proposing planning policy
1.1. The head of the unit organizes a meeting of the collective leadership of the unit (collective leadership of the Department, General Directorate, and equivalent units) to propose the number and list of officials expected to be added to the planning.
Content of the meeting:
- Reviewing and evaluating the current situation of planned officials and predicting the additional number of planned officials needed.
- Discussing and proposing a list of officials to be added to the planning (the proposed officials must be agreed upon by more than 50% of the total number of unit leaders attending the meeting).
1.2. Based on the meeting results, the unit prepares a report to the Ministry (through the Department of Organization and Cadres) proposing the planning policy. The proposal file includes:
- Report on reviewing and proposing policies to supplement planning.
- Minutes of the meeting of the collective leadership of the unit.
1.3. Based on the unit's report, the Department of Organization and Cadres submits to the Ministry Leadership (Deputy Minister responsible for the sector, Deputy Minister responsible for organization and cadres, Minister) for comments on the number and list of proposed planning. Based on the approved comments from the Ministry Leadership, the Department of Organization and Cadres informs the unit to proceed with implementation.
2. Step 2: Organizing a full staff meeting or a key cadre and civil servant meeting of the unit.
2.1. Chairing the meeting: A representative of the Department of Organization and Cadres or a representative of the unit's leadership with planned officials.
2.2. Participants:
- For units with less than 100 civil servants participating in voting, the participants are all cadres and civil servants of the unit.
Specifically for General Directorates with affiliated public institutions: Participants include all cadres and civil servants of the Departments within the General Directorate; heads and deputies of affiliated public institutions under the General Directorate.
- For units with 100 civil servants participating in voting or more, the participants include: Heads of Departments and equivalent positions, senior specialists and equivalent positions, Chairman of the Trade Union, Secretary of the Youth League.
2.3. Content of the Meeting:
- Emphasizing the purpose, requirements, number, and criteria for planned officials.
- Announcing observations and evaluations of the unit's collective leadership regarding proposed planned officials.
- Participants attending the meeting provide observations and evaluations on the planned officials.
- Conducting a secret ballot to introduce planning. In addition to the prepared list, participants can introduce additional sources of planned officials (if any) and record directly on the opinion solicitation form.
Cases where the introduction rate exceeds 50% of the total number of participants will be discussed at the Conference of the Collective Leadership and the Party Committee at Step 3.
3. Step 3: Approving the list of proposed planning at the unit level.
3.1. The head of the unit organizes a joint conference between the collective leadership of the unit and the Party Committee to implement the following tasks:
- Analyzing the summary of the opinion solicitation forms for introducing planning from the meeting at Step 2.
- Evaluating the proposed planned officials according to the provisions set out in Article 5 of Chapter II of this Regulation.
- Conducting a secret ballot to introduce planning.
3.2. Cases where the introduction rate exceeds 50% of the total number of unit leaders and Party Committee members attending the meeting will be selected for inclusion in the planning.
4. Step 4: Approving the planning
4.1. The unit compiles and completes the planning file to report to the Ministry (through the Department of Organization and Cadres).
The planning proposal file includes:
- Report requesting approval of planning.
- Minutes of the meetings and minutes of the vote counts from the meetings at Steps 2 and 3.
- Curriculum vitae of officials (with photo).
4.2. Based on the unit's proposal, the Department of Organization and Cadres (Ministry of Finance) implements the following tasks:
- Submitting to the Ministry Leadership (Deputy Minister responsible for the sector, Deputy Minister responsible for organization and cadres, Minister) for comments on the proposed planned officials and approving the document soliciting opinions for joint approval from the Standing Committee of the Party Committee of the Ministry of Finance.
- Based on the joint approval results, the Department of Organization and Cadres prepares a report for the secret ballot of the members of the Cadre Management Board.
The Department of Organization and Cadres chairs, coordinating with the Standing Committee of the Party Committee of the Ministry of Finance to prepare the minutes of the vote count.
- The Department of Organization and Cadres submits to the Cadre Management Board of the Ministry of Finance, the Minister of Finance for approval of planning for cases where the introduction rate exceeds 50% of the total number of Cadre Management Board members.
Article 13. Planning for leadership positions at the Department level and equivalent under the Department, Bureau, Inspectorate, Ministry Office, Institute of Strategy and Financial Policy
1. Step 1: Proposing planning policy
1.1. The proposal to supplement planning shall be carried out as prescribed in Point 1.1 and Point 1.2, Clause 1, Article 12 of this Regulation.
1.2. Based on the unit's proposal, the Cadre and Civil Servant Organization Department reports to the Ministry (Deputy Minister in charge of the sector, Deputy Minister in charge of cadre and civil servant organization) to seek opinions on the number and list of proposed planning. Based on the approval opinion of the Ministry Leadership, the Cadre and Civil Servant Organization Department informs the unit to implement.
2. Step 2: Organize a meeting of all cadres and civil servants in the Department where there are proposed planning cadres.
2.1. Chairing the Meeting: A representative of the unit's leadership.
2.2. Participants: All civil servants in the Department.
2.3. Content of the Meeting: Implemented according to the provisions in Point 2.3, Clause 2, Article 12 of this Regulation.
3. Step 3: Approving the list of proposed planning at the unit level.
The head of the unit organizes a joint meeting between the collective leadership of the unit and the unit's Party Committee to review, evaluate, and collect nominations for planning as stipulated in Clause 3, Article 12 of this Regulation.
4. Step 4: Approving the planning
4.1. The unit compiles and completes the planning file to report to the Ministry (through the Cadre and Civil Servant Organization Department). The application for planning is implemented according to the provisions in Point 4.1, Clause 4, Article 12 of this Regulation.
4.2. Based on the unit's proposal, the Cadre and Civil Servant Organization Department submits to the Ministry Leadership (Deputy Minister in charge of the sector, Deputy Minister in charge of cadre and civil servant organization, Minister) to seek opinions. On the basis of the Ministry's approval opinion, the Director of the Cadre and Civil Servant Organization Department acts on behalf of the Minister to sign the decision approving the planning.
Article 14. Planning for leadership positions at the Department level and equivalent in subordinate public service units of Bureaus and equivalent
1. The planning process is carried out through the following steps:
- Step 1: The head of the unit organizes a meeting of the collective leadership of the unit (collective leadership of the Bureau and equivalent) to unify the policy, quantity, and list of planned candidates and notify the units with planned cadres to organize implementation.
- Step 2: Organize a meeting of all civil servants and staff in the Department or department with planned candidates to review, evaluate, and collect nominations for planning (by secret ballot method).
- Step 3: The head of the unit organizes a joint meeting between the collective leadership of the unit and the unit's Party Committee to review, evaluate, and collect nominations for planning for cadres.
- Step 4: Based on the unit's proposal, the Cadre and Civil Servant Organization Department reports to the Ministry (Deputy Minister in charge of the sector, Deputy Minister in charge of cadre and civil servant organization) to seek opinions. On the basis of the Ministry's approval opinion, the Director of the Cadre and Civil Servant Organization Department acts on behalf of the Minister to sign the decision approving the planning.
2. The content of the meetings, the percentage of nomination votes that need to be achieved at each meeting, and the application for planning are implemented as for planning for Department-level leaders under the Ministry.
Section III
PLANNING AT THE GENERAL BUREAUS
Article 15. Planning for General Bureau Directors, Deputy General Bureau Directors, and equivalents
1. Step 1: Proposing planning policy
1.1. The General Bureau Director organizes a meeting of the collective leadership of the General Bureau to propose the number and list of cadres expected to be supplemented in the planning.
Content of the Meeting:
- Reviewing and evaluating the current situation of planned officials and predicting the additional number of planned officials needed.
- Discuss and propose the list of planning cadres (cadres proposing the policy to supplement planning must be agreed upon by more than 50% of the total number of General Bureau leaders attending the meeting).
1.2. Based on the meeting results, the General Bureau prepares a report to the Ministry (through the Cadre and Civil Servant Organization Department) to propose the planning policy.
The proposal file includes:
- Report on reviewing and proposing policies to supplement planning.
- Minutes of the meeting of the General Bureau's collective leadership.
- Curriculum vitae of officials (with photo).
1.3. Based on the report of the General Bureau, the Cadre and Civil Servant Organization Department submits to the Ministry Leadership (Deputy Minister in charge of the sector, Deputy Minister in charge of cadre and civil servant organization, Minister) to seek opinions on the number and list of proposed planning and approve the notification letter informing the General Bureaus to organize implementation.
2. Step 2: Organize a meeting of key cadres of the General Bureau to review, evaluate, and collect nominations for planning for cadres.
2.1. Chairing the Meeting: A representative of the Ministry of Finance's leadership or authorized by the Cadre and Civil Servant Organization Department's leadership (Ministry of Finance) or the General Bureau's leadership.
2.2. Participants:
- General Bureau leaders, Department leaders and equivalents within the General Bureau; heads and deputies of subordinate public service units under the General Bureau. For the Securities Commission, participants also include: Chairman of the Board of Management, General Director of the Ho Chi Minh City Stock Exchange, Hanoi Stock Exchange, and Vietnam Securities Depository.
- Bureau Chiefs of the General Bureau in provinces and centrally-administered cities.
- Trade Union Chairman, Youth League Secretary.
2.3. Procedure and Content of the Meeting:
a) Before the meeting, the Cadre and Civil Servant Organization Department of the General Bureau distributes a list with information about the planned cadres for the meeting participants to study.
b) Content of the meeting:
- Emphasizing the purpose, requirements, number, and criteria for planned officials.
- Announce the comments and evaluations of the General Bureau's collective leadership on the nominated planning cadres.
- Participants attending the meeting provide observations and evaluations on the planned officials.
- Conduct a secret ballot to collect nominations for planning. In addition to the prepared list, participants can introduce additional sources of planning cadres (if any) and record directly on the nomination form.
Cases where the nomination vote ratio reaches over 50% of the total number of meeting participants will be discussed at the General Bureau's collective leadership meeting at step 3.
3. Step 3: Approving the list of proposed planning at the General Bureau level
3.1. The General Bureau Director organizes a meeting of the collective leadership of the General Bureau.
Content of the Meeting:
- Analyzing the summary of the opinion solicitation forms for introducing planning from the meeting at Step 2.
- Evaluating the proposed planned officials according to the provisions set out in Article 5 of Chapter II of this Regulation.
- Conducting a secret ballot to introduce planning.
3.2. Cases where the nomination vote ratio reaches over 50% of the total number of General Bureau leaders attending the meeting will be selected to be proposed for inclusion in the planning.
3.3. For cadres who participate in the Party at Departments and equivalents under the General Bureau, before submitting to the Ministry, the General Bureau must seek the concurrence opinion of the General Bureau's Party Committee Standing Committee.
4. Step 4: Approving the planning
4.1. The General Bureau compiles and completes the planning file to report to the Ministry (through the Cadre and Civil Servant Organization Department of the Ministry).
The planning proposal file includes:
- Report requesting approval of planning.
- Minutes of the meetings and minutes of the vote counts from the meetings at Steps 2 and 3.
- Concurrence opinion of the General Bureau's Party Committee Standing Committee (for cadres participating in the Party at the General Bureau).
- Copies of educational certificates and training certificates (if any).
4.2. Based on the General Bureau's proposal, the Cadre and Civil Servant Organization Department (Ministry of Finance) implements the following tasks:
- Submit to the Ministry's leadership (the Deputy Minister in charge of the sector, the Deputy Minister in charge of organizational and personnel affairs, the Minister) for comments on the proposed cadres for planning and approve the letter soliciting opinions from the Standing Committee of the Party Central Committee of the Ministry of Finance (for cases where party activities take place at the General Department) or the Standing Committee of the Provincial Party Committee, Municipal Party Committee (for cases where party activities take place at provincial or municipal levels).
- Based on the joint approval results, the Department of Organization and Cadres prepares a report for the secret ballot of the members of the Cadre Management Board.
The Department of Organization and Cadres chairs, coordinating with the Standing Committee of the Party Committee of the Ministry of Finance to prepare the minutes of the vote count.
- The Department of Organization and Cadres submits to the Cadre Management Board of the Ministry of Finance, the Minister of Finance for approval of planning for cases where the introduction rate exceeds 50% of the total number of Cadre Management Board members.
Article 16. Planning for Leadership Positions at the Department, Bureau, Inspectorate, Office, and Public Service Units of the General Department
1. Step 1: Proposing planning policy
1.1. The head of the unit shall convene a meeting of the collective leadership of the unit (collective leadership of the Department, Bureau, Inspectorate, Office, public service units) to propose the number and list of cadres expected to be added to the planning.
Content of the Meeting:
- Review and evaluate the current cadre planning situation and predict the additional number of cadres needed for planning.
- Discuss and propose a list of cadres for planning (cadres proposed for supplementary planning must be agreed upon by more than 50% of the total number of unit leaders attending the meeting).
1.2. Based on the meeting results, the unit shall submit a report to the General Department (through the Personnel Organization Department of the General Department) proposing the planning policy.
The proposal file includes:
- Report on reviewing and proposing policies to supplement planning.
- Minutes of the meeting of the collective leadership of the unit.
1.3. Based on the proposal of the unit, the Personnel Organization Department of the General Department shall submit to the General Department's leadership (Deputy General Director in charge of the sector, Deputy General Director in charge of organizational and personnel affairs - if applicable, the General Director) for comments on the number and list of proposed planning. Based on the approval opinion of the General Department's leadership, the Personnel Organization Department of the General Department shall notify the unit to implement.
For the position of Department Head and equivalent positions, the General Department shall submit a report to the Ministry (through the Personnel Organization Department) to confirm cases that continue to be maintained in the planning list and cases removed from the planning list.
2. Step 2: Organize a full meeting of the unit's officials and civil servants.
2.1. Chairing the Meeting: A representative of the General Department's leadership or delegate the Personnel Organization Department of the General Department to chair the meeting.
2.2. Participants:
- For units with less than 100 participants eligible to vote, the participants include all civil servants and officers of the Departments; Heads and Deputies of subordinate public service units.
For Departments and Bureaus with subordinate units located far from Hanoi (such as Hai Phong, Da Nang, Ho Chi Minh City, etc.), the participants include Heads and Deputies of these units.
- For units with 100 or more participants eligible to vote, the participants include: Leaders of Departments and equivalent positions, senior specialists and equivalent positions, Chairman of the Trade Union, Secretary of the Youth League.
2.3. Content of the Meeting:
- Emphasizing the purpose, requirements, number, and criteria for planned officials.
- Announce the collective leadership's comments and evaluations on the cadres introduced for planning.
- Participants attending the meeting provide observations and evaluations on the planned officials.
- Conduct a secret ballot to introduce planning candidates. In addition to the prepared list, participants may introduce additional sources of planning cadres (if any) and record directly on the introduction form.
Cases where the percentage of votes introducing planning reaches over 50% of the total number of participants will be discussed at the meeting of the Collective Leadership and Unit Party Committee at Step 3.
3. Step 3: Approving the list of proposed planning at the unit level.
3.1. The head of the unit shall organize a joint meeting between the collective leadership and the unit's Party Committee to implement the following tasks:
- Analyzing the summary of the opinion solicitation forms for introducing planning from the meeting at Step 2.
- Evaluating the proposed planned officials according to the provisions set out in Article 5 of Chapter II of this Regulation.
- Conducting a secret ballot to introduce planning.
3.2. Cases where the percentage of votes introducing planning exceeds 50% of the total number of leaders and members of the unit's Party Committee attending the meeting will be selected for inclusion in the planning.
4. Step 4: Approving the planning
4.1. The unit shall compile and complete the planning file to report to the General Department (through the Personnel Organization Department of the General Department).
The planning proposal file includes:
- Report requesting approval of planning.
- Minutes of the meetings and minutes of the vote counts from the meetings at Steps 2 and 3.
- Curriculum vitae of officials (with photo).
4.2. Based on the unit's proposal, the Personnel Organization Department of the General Department shall implement the following tasks:
- Submit to the General Department's leadership (Deputy General Director in charge of the sector, Deputy General Director in charge of organizational and personnel affairs - if applicable, the General Director) for comments on the list of planning cadres and approve the letter soliciting opinions from the Standing Committee of the Party Central Committee of the General Department (for cases where party activities take place at the General Department) or the Standing Committee of the Provincial Party Committee, Municipal Party Committee (for cases where party activities take place at provincial or municipal levels).
- Based on the consensus result, the Personnel Organization Department of the General Department shall submit for a secret ballot vote by members of the General Department's Collective Leadership. The Personnel Organization Department shall prepare minutes of the vote count.
- Based on the voting results, the Personnel Organization Department of the General Department shall implement the following tasks:
+ Submit to the General Director for approval of planning for the position of Deputy Department Head and equivalent positions for cases where the percentage of votes introducing planning exceeds 50% of the total number of members of the General Department's Collective Leadership. The decision approving the planning of the General Department shall be sent to the Ministry of Finance (through the Personnel Organization Department) for monitoring and management.
+ Submit to the General Director to report to the Ministry of Finance for approval of planning for the position of Department Head and equivalent positions for cases where the percentage of votes introducing planning exceeds 50% of the total number of members of the General Department's Collective Leadership. The planning proposal file includes:
* Proposal letter requesting approval of planning.
* Minutes of meetings and minutes of vote counts.
* Opinion of the Party Committee's consensus.
* Resume of the cadre (with photo).
* Copies of educational certificates and training certificates (if any).
4.3. Based on the General Department's proposal, the Personnel Organization Department (Ministry of Finance) shall submit to the Deputy Minister in charge of the sector, Deputy Minister in charge of organizational and personnel affairs, Minister for approval of planning for the position of Department Head and equivalent positions.
Article 17. Planning for Leading Positions at the Department Level and Equivalent within Bureaus, Inspectorates, Offices, and Affiliated Units of the General Department
1. Step 1: Proposing planning policy
1.1. The proposal to supplement planning shall be carried out as prescribed in Point 1.1 and Point 1.2, Clause 1, Article 16 of this Regulation.
1.2. Based on the report from the unit, the Personnel Department of the General Department shall submit to the General Department Leadership (Deputy General Department Director responsible for the sector, Deputy General Department Director responsible for personnel – if applicable, General Department Director) for comments on the proposal and list of candidates for planning. Based on the approval opinion of the General Department Leadership, the Personnel Department of the General Department shall notify the unit to implement.
2. Step 2: Organize a meeting of all cadres and civil servants in the Department where there are proposed planning cadres.
2.1. Chairing the Meeting: A representative of the unit's leadership.
2.2. Participants: All civil servants in the Department.
2.3. Content of the Meeting: To be implemented as prescribed in Point 2.3, Clause 2, Article 16 of this Regulation.
3. Step 3: Approving the list of proposed planning at the unit level.
The head of the unit shall organize a joint meeting between the collective leadership and the party committee of the unit to review, evaluate, and collect nominations for planning for cadres according to Clause 3, Article 16 of this Regulation.
4. Step 4: Approving the planning
4.1. The unit shall compile and complete the planning file to report to the General Department (through the Personnel Department of the General Department). The planning proposal file shall be implemented as prescribed in Point 4.1, Clause 4, Article 16 of this Regulation.
4.2. Based on the proposal of the unit, the Personnel Department of the General Department shall submit to the General Department Leadership (Deputy General Department Director responsible for the sector, Deputy General Department Director responsible for personnel – if applicable) for comments and submit to the General Department Director for consideration and decision to approve the planning.
Article 18. Planning for Leadership Positions at the Bureau Level and Equivalent in Provinces and Cities
Step 1: Proposing planning policy
1.1. The Bureau Director shall organize a meeting of the collective Bureau leadership to propose the number and list of candidates for supplementary planning.
Content of the Meeting:
- Review and evaluate the current cadre planning situation and predict the additional number of cadres needed for planning.
- Discussion and proposal of the list of planning cadres (cadres proposing supplementary planning must be agreed upon by more than 50% of the total number of Bureau leaders attending the meeting).
1.2. Based on the meeting results, the unit shall issue a report to the General Department (through the Personnel Department) to propose the planning policy.
The proposal file includes:
- Report on reviewing and proposing policies to supplement planning.
- Minutes of the meeting of the collective Bureau leadership.
- Curriculum vitae of officials (with photo).
1.2. Based on the report of the unit, the Personnel Department of the General Department shall submit to the General Department Leadership (Deputy General Department Director responsible for the sector, Deputy General Department Director responsible for personnel – if applicable, General Department Director) for comments on the number and list of planning and approval of the notification letter to inform the Bureaus to implement.
For the positions of Bureau Director and Deputy Bureau Director in Hanoi City and Ho Chi Minh City, the General Department shall issue a report to the Ministry (through the Personnel Department) to confirm cases to continue maintaining in the planning list and cases to be removed from the planning list.
2. Step 2: Organize a meeting of key cadres of the Bureau to review, evaluate, and collect nominations for planning cadres.
2.1. Chairing the Meeting: A representative of the General Department's leadership or authorized by the General Department's Personnel Department's leadership or the Bureau's leadership to chair.
2.2. Participants:
- Bureau leadership.
- Heads and Deputy Heads of Departments equivalent to the Bureau.
- Heads of Sub-offices and equivalents.
- Chairman of the Trade Union, Secretary of the Youth League of the Bureau.
2.3. Content of the Meeting:
- Emphasizing the purpose, requirements, number, and criteria for planned officials.
- Announce the opinions of the collective Bureau leadership on the nominated cadres for planning.
- Participants attending the meeting provide observations and evaluations on the planned officials.
- Conduct a secret ballot to collect nominations for planning. In addition to the prepared list, participants can introduce additional sources of planning cadres (if any) and record directly on the nomination form.
Cases with over 50% nomination votes from the total number of participating cadres will be discussed at the Bureau leadership and Bureau Party Committee meetings at Step 3.
3. Step 3: Approve the proposed planning list at the Bureau level.
3.1. The Bureau Director shall organize a joint meeting between the collective Bureau leadership and the Bureau Party Committee to implement tasks.
- Analyzing the summary of the opinion solicitation forms for introducing planning from the meeting at Step 2.
- Evaluating the proposed planned officials according to the provisions set out in Article 5 of Chapter II of this Regulation.
- Conducting a secret ballot to introduce planning.
3.2. Cases with over 50% nomination votes from the total number of Bureau leadership and Party Committee members attending the meeting will be selected to propose inclusion in the planning.
4. Step 4: Approving the planning
4.1. The unit shall compile and complete the planning file to report to the General Department (through the Personnel Organization Department of the General Department).
The planning proposal file includes:
- Report requesting approval of planning.
- Minutes of the meetings and minutes of the vote counts from the meetings at Steps 2 and 3.
- Copies of educational certificates and training certificates (if any).
4.2. Based on the unit's proposal, the Personnel Organization Department of the General Department shall implement the following tasks:
- Submit to the General Department Leadership (Deputy General Department Director responsible for the unit, Deputy General Department Director responsible for personnel – if applicable, General Department Director) for comments on the proposed planning cadres and approval of the notification letter to seek endorsement from the Provincial Party Standing Committee and Municipal Party Standing Committee according to regulations.
- Based on the consensus result, the Personnel Organization Department of the General Department shall submit for a secret ballot vote by members of the General Department's Collective Leadership. The Personnel Organization Department shall prepare minutes of the vote count.
- Based on the voting results, the Personnel Organization Department of the General Department shall implement the following tasks:
+ Submit to the General Department Director for approval of planning for the position of Deputy Bureau Director (except Deputy Bureau Directors in Hanoi City and Ho Chi Minh City) for cases with over 50% nomination votes from the total number of General Department Collective Leadership members. The General Department's approval decision on planning shall be sent to the Ministry of Finance (through the Personnel Department) for monitoring and management.
+ Submit to the General Department Director for reporting to the Ministry of Finance for approval of planning for the positions of Bureau Director and Deputy Bureau Director in Hanoi City and Ho Chi Minh City for cases with over 50% nomination votes from the total number of General Department Collective Leadership members. The planning proposal file includes:
* Proposal letter requesting approval of planning.
* Minutes of meetings and minutes of vote counts.
* Opinion of the Party Committee's consensus.
* Resume of the cadre (with photo).
* Copies of educational certificates and training certificates (if any).
4.3. Based on the proposal of the General Department, the Personnel Department (Ministry of Finance) shall implement tasks.
- Submit to the Ministry Leadership (Deputy Minister responsible for the sector, Deputy Minister responsible for personnel, Minister) for comments on the proposed planning cadres.
- Based on the comments of the Ministry Leadership, the Personnel Department shall prepare a report to seek secret ballot voting from the members of the Cadre Affairs Board. The Personnel Department shall coordinate with the Standing Committee of the Party Committee of the Ministry of Finance to record the vote count.
- The Personnel Department shall submit to the Cadre Affairs Board of the Ministry of Finance, the Minister of Finance for approval of planning for cases with over 50% votes from the total number of Cadre Affairs Board members.
Article 19. Leadership planning for Departments at provincial level and equivalent under Bureaus
1. Step 1: Approving the planning proposal
The Bureau Director convenes a meeting of the Bureau's leadership team to agree on the number and list of officers expected to be added to the planning. The content of the meeting follows the provisions set out in Point 1.1, Clause 1, Article 18 of this Regulation.
2. Step 2: Convening a full meeting of staff and civil servants of the Department.
2.1. Chairing the meeting: A representative of the Bureau's leadership.
2.2. Participants: All civil servants in the Department.
2.3. Content of the meeting: Follows the provisions set out in Point 2.3, Clause 2, Article 18 of this Regulation.
3. Step 3: Approving the planning list
3.1. The Bureau Director convenes a joint meeting between the Bureau's leadership team and the Bureau's Party Committee to review, assess, and collect recommendations for the planning, following the provisions set out in Point 3.1, Clause 3, Article 18 of this Regulation.
3.2. Cases where the proportion of recommendation votes exceeds 50% of the total number of Bureau leaders and Party Committee members attending the meeting will be selected for inclusion in the planning.
4. Step 4: Approving the planning
The Bureau Director approves the planning and reports to the General Department (through the Personnel Organization Department of the General Department) for monitoring and management.
Article 20. Leadership planning for Branches and equivalent levels
1. Step 1: Approving the planning proposal
1.1. The Branch Director convenes a meeting of the Branch's leadership team to agree on the number and list of officers expected to be added to the planning.
The content of the meeting follows the provisions set out in Point 1.1, Clause 1, Article 18 of this Regulation.
1.2. The Branch submits to the Bureau (through the personnel organization department) for comments on the number and list of officers expected to be added to the planning for Branch leadership positions. After obtaining the Bureau's approval on the number and list of officers expected to be added to the planning, the unit proceeds with step 2.
2. Step 2: Convening a full meeting or a meeting of key staff and civil servants of the Branch.
2.1. Chairing the meeting: A representative of the Bureau's leadership or delegated authority to the Bureau's organizational department leader or the Branch's leadership.
2.2. Participants:
- For Branches with fewer than 100 employees participating in voting, the participants are all civil servants of the Branch.
- For Branches with 100 or more employees participating in voting, the participants include: Branch leadership, leadership of Departments (if any), team leaders, chief specialists and equivalent or higher, Trade Union Chairman, Youth League Secretary.
2.3. Content of the meeting: Follows the provisions set out in Point 2.3, Clause 2, Article 18 of this Regulation.
3. Step 3: Approving the proposed planning list at the Branch level
3.1. The Branch Director convenes a joint meeting between the Branch's leadership team and the Branch's Party Committee to review, assess, and collect recommendations for the planning, following the provisions set out in Point 3.1, Clause 3, Article 18 of this Regulation.
3.2. Cases where the proportion of recommendation votes exceeds 50% of the total number of Branch leaders and Party Committee members attending the meeting will be selected for consideration and inclusion in the planning.
4. Step 4: Approving the planning
4.1. The Branch compiles and completes the planning file to report to the Bureau (through the department responsible for personnel organization work). The proposed planning file follows the provisions set out in Point 4.1, Clause 4, Article 18 of this Regulation.
4.2. Based on the proposals from the Branches, the Bureau's personnel organization department implements the procedures as follows:
- Submitting to the Bureau's leadership (Deputy Bureau Director responsible for the unit, Deputy Bureau Director responsible for personnel organization - if any, Bureau Director) for comments on the proposed planning list and approval of the letter seeking endorsement from the local Party Committee (if applicable).
- Based on the results of the endorsement, the Bureau's personnel organization department seeks the vote of approval from the members of the Bureau's leadership team through secret ballot. The personnel organization department prepares minutes of the vote count.
- The Bureau's personnel organization department submits to the Bureau Director for approval of the planning for cases where the proportion of recommendation votes exceeds 50% of the total number of members of the Bureau's leadership team.
4.3. The Bureau Director's decision approving the planning is sent to the General Department (through the Personnel Organization Department of the General Department) for monitoring and management.
Article 21. Planning for remaining leadership positions of the Agency and equivalent units
For the remaining leadership positions of the Agency and equivalent units, based on the guidance procedures mentioned above, the Director of the General Department shall provide specific guidance to ensure uniform implementation throughout the system.
Chapter IV
PLANNING AT ENTERPRISE UNITS
UNDER THE MINISTRY OF FINANCE
Article 22. Planning for the heads and deputy heads of enterprise units
1. Step 1: Proposing planning policy
1.1. The head of the enterprise unit shall convene a meeting of the collective leadership of the unit to propose the number and list of cadres expected to be added to the planning.
Content of the Meeting:
- Reviewing and evaluating the current situation of planned officials and predicting the additional number of planned officials needed.
- Discuss and propose the list of cadres to be supplemented to the planning (cadres proposing the supplementation plan must be agreed upon by more than 50% of the total number of leaders attending the meeting).
1.2. Based on the results of the meeting, the unit shall submit a report to the Ministry of Finance (through the Personnel Organization Department) proposing the planning policy.
The proposal file includes:
- Report on reviewing and proposing policies to supplement planning.
- Minutes of the meeting of the collective leadership of the unit.
- Curriculum vitae of officials (with photo).
1.3. Based on the unit's report, the Department of Organization and Cadres submits to the Ministry Leadership (Deputy Minister responsible for the sector, Deputy Minister responsible for organization and cadres, Minister) for comments on the number and list of proposed planning. Based on the approved comments from the Ministry Leadership, the Department of Organization and Cadres informs the unit to proceed with implementation.
2. Step 2: Convene a meeting of the key cadres of the unit.
2.1. Chairing the meeting: A representative from the Personnel Organization Department or the leader of the main unit.
2.2. Participants:
- The head and deputy head of the unit.
- Leaders of Departments and equivalent units, Faculties and equivalent units; team leaders of subject teams and equivalent units.
- Leaders of subordinate units (Institutes, centers, etc.).
- Senior specialists, senior lecturers and equivalent or higher.
- Associate Professors, Professors, Doctors, People's Teachers, Distinguished Teachers.
- Chairman of the Trade Union, Secretary of the Youth League.
- The School Science Council (if any).
2.3. Content of the Meeting:
- Emphasizing the purpose, requirements, number, and criteria for planned officials.
- Announcing observations and evaluations of the unit's collective leadership regarding proposed planned officials.
- Participants attending the meeting provide observations and evaluations on the planned officials.
- Conduct a secret ballot to introduce planning candidates. In addition to the prepared list, participants can introduce additional sources of planning cadres (if any).
Cases where the proportion of introduction ballots exceeds 50% of the total number of cadres attending the meeting will be discussed at the collective leadership meeting of the unit and the Party Committee at step 3.
3. Step 3: Approve the proposed planning list at the unit level.
3.1. The head of the unit shall convene a joint meeting between the collective leadership and the Party Committee of the unit to implement the following tasks:
- Analyzing the summary of the opinion solicitation forms for introducing planning from the meeting at Step 2.
- Evaluating the proposed planned officials according to the provisions set out in Article 5 of Chapter II of this Regulation.
- Conducting a secret ballot to introduce planning.
3.2. Cases where the proportion of introduction ballots exceeds 50% of the total number of leaders and Party Committee members attending the meeting will be selected to be proposed for inclusion in the planning.
4. Step 4: Approving the planning
4.1. The unit compiles and completes the planning file to report to the Ministry (through the Department of Organization and Cadres).
The planning proposal file includes:
- Report requesting approval of planning.
- Minutes of the meetings and minutes of the vote counts from the meetings at Steps 2 and 3.
- Copies of educational certificates and training certificates (if any).
4.2. Based on the unit's proposal, the Department of Organization and Cadres (Ministry of Finance) implements the following tasks:
- Submitting to the Ministry Leadership (Deputy Minister responsible for the sector, Deputy Minister responsible for organization and cadres, Minister) for comments on the proposed planned officials and approving the document soliciting opinions for joint approval from the Standing Committee of the Party Committee of the Ministry of Finance.
- For the head of the enterprise unit:
+ Based on the consensus results, the Personnel Organization Department shall prepare a report to seek the approval vote of the members of the Cadre Affairs Board through a secret ballot. The Personnel Organization Department shall take the lead and coordinate with the Standing Committee of the Party Central Committee of the Ministry of Finance to record the vote tally.
+ The Personnel Organization Department shall submit to the Cadre Affairs Board of the Communist Party of Vietnam, the Minister of Finance for approval of the decision on planning for cases where the proportion of introduction ballots exceeds 50% of the total number of Cadre Affairs Board members.
- For deputy heads: Based on the consensus results, the Personnel Organization Department shall submit to the Deputy Minister responsible for the sector, the Deputy Minister responsible for personnel organization, and the Minister for consideration and approval of the decision on planning.
Article 23. Planning for positions decided by the head of the enterprise unit
1. Step 1: Approving the planning proposal
The head of the unit shall convene a meeting of the collective leadership of the unit to unify the number and list of cadres expected to be added to the planning.
The content of the meeting shall be implemented according to the provisions of Point 1.1, Clause 1, Article 22 of this Regulation.
2. Step 2: Convene a full meeting of all staff of the Department.
2.1. Chairing the Meeting: A representative of the unit's leadership.
2.2. Participants: All civil servants and employees in the Department.
2.3. Content of the meeting: Implemented according to the provisions of Point 2.3, Clause 2, Article 22 of this Regulation.
3. Step 3: Approving the planning list
3.1. The head of the unit shall convene a joint meeting between the collective leadership and the Party Committee of the unit to review, evaluate, and conduct a secret ballot to introduce planning candidates, similar to the provisions of Point 3.1, Clause 3, Article 22 of this Regulation.
3.2. Cases where the proportion of introduction ballots exceeds 50% of the total number of leaders and Party Committee members attending the meeting will be selected for inclusion in the planning.
4. Step 4: Approving the planning
The head of the unit shall approve the planning and report to the Ministry (through the Personnel Organization Department) for monitoring and management.
Chapter IV
REGULATIONS ON REMOVING CANDIDATES
FROM THE PLANNING
Article 24. Cases for Removal from Planning
1. The removal of cadres from the planning list shall be applied in the following cases:
a) Cadres are subject to administrative disciplinary action at or above the level of reprimand;
b) Failure to complete assigned tasks, except in cases where cadres take maternity leave according to regulations or are sent for study pursuant to a decision of the competent authority and are not subject to annual commendation review;
c) No longer meeting the planning criteria as stipulated in Chapter II of this Regulation;
d) Cadres have transferred jobs out of the unit.
2. Cadres implementing rotation pursuant to a decision of the competent authority shall not be removed from the planning list if they still meet the prescribed standards. For cadres who have been decided to be transferred to a new unit (but still belong to the internal unit or units within the same sector), the leadership collective of the unit shall consider and decide or submit to the competent authority for decision on whether to continue maintaining the planning or not at the old unit (before deciding or proposing to continue the planning, opinions and evaluations of the unit where the cadre is currently working must be solicited).
Article 25. Procedure for Removing Cadres from Planning
1. Annually, concurrently with reviewing and proposing to maintain and supplement planning, the leadership collective of the unit shall consider and propose the competent authority to decide or decide within its jurisdiction on not maintaining cadres in the planning list.

Chapter V
PUBLICIZING PLANNING
Article 26. Content for Publicizing
1. Documents stipulating cadre planning of the Party and state agencies with competent authority.
2. General and specific criteria for each planned position.
3. List of planned cadres approved by the competent authority.
Article 27. Scope of Publicizing
1. The contents specified in Clause 1 and Clause 2 of Article 26 shall be publicized to all cadres and party members at all levels of the Ministry of Finance.
2. The list of planned cadres as specified in Clause 3 of Article 26 shall be publicized to:
a) Leadership collectives and party committees where there are planned cadres.
b) Individuals whose names appear in the planning list.
Chapter VI
IMPLEMENTATION
Article 28. Supplementing Planning in Special Cases
In special cases, due to the need to immediately supplement the cadre planning source, the heads of units or organizational cadre advisory departments may propose to the competent planning authority to immediately supplement the planning (without waiting until the annual review and supplementation time) in accordance with the procedures stipulated in this Regulation.
Article 29. Responsibility for Implementation
1. The organizational cadre advisory department at all levels of the Ministry of Finance shall be responsible for advising and assisting the heads of units in organizing the implementation of planning work; preparing and providing information about planned cadres; guiding units in organizing the implementation; and simultaneously reporting to the heads of units to promptly address difficulties and obstacles during the implementation of planning work.
2. Heads of units authorized to decide on planning shall be fully responsible before the Minister of Finance and the superior unit's head regarding the implementation of planning work as stipulated in this Regulation.
During the implementation process, if there are difficulties or obstacles, units shall promptly reflect them to the Ministry of Finance (through the Department of Organizational Cadre) for consideration and resolution.
