REGARDING THE NON-COLLECTION OF NOTARIZATION AND CERTIFICATION FEES
WHEN CONFIRMING CONTRACTS AND DOCUMENTS ON REAL ESTATE
OF THE MANAGEMENT BOARDS OF INDUSTRIAL ZONES, ECONOMIC ZONES, HIGH-TECH ZONES

 

Unit: Equivalent USD- Ministries, ministerial-level agencies, and government agencies;

- People's Committees of provinces and centrally governed cities.

 

Implementing Decree No. 17/2006/NĐ-CP dated January 27, 2006 of the Government on amending and supplementing certain articles of decrees guiding the implementation of the Land Law and Decree No. 187/2004/NĐ-CP on the conversion of state-owned enterprises into joint-stock companies, the Ministry of Finance has received proposals from some Management Boards of industrial zones, economic zones, and high-tech zones requesting permission to collect notarization and certification fees when confirming contracts and documents on real estate within industrial zones, economic zones, and high-tech zones according to Circular Joint No. 93/2001/TTLT-BTC-BTP dated November 21, 2001 of the Joint Ministry of Finance and Ministry of Justice guiding the collection, payment, and management of notarization and certification fees.

Pursuant to Decree No. 17/2006/NĐ-CP dated January 27, 2006 of the Government on amending and supplementing certain articles of decrees guiding the implementation of the Land Law and Decree No. 187/2004/NĐ-CP on the conversion of state-owned enterprises into joint-stock companies; Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges; Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP; Decree No. 75/2000/NĐ-CP dated December 8, 2000 of the Government on notarization and certification; and the opinion of the Ministry of Justice in Letter No. 2853/BTP-HCTP dated November 9, 2006: "The act of confirmation by the Management Boards of industrial zones, economic zones, and high-tech zones for contracts or papers when using land to implement rights of transfer, lease, sublease, mortgage, guarantee, and capital contribution with land use rights within industrial zones, economic zones, and high-tech zones as stipulated in Decree No. 17/2006/NĐ-CP dated January 27, 2006 of the Government on amending and supplementing certain articles of decrees guiding the implementation of the Land Law and Decree No. 187/2004/NĐ-CP on the conversion of state-owned enterprises into joint-stock companies is not an activity of notarization and certification." Therefore, the Management Boards of industrial zones, economic zones, and high-tech zones shall not collect notarization and certification fees when confirming contracts and documents on real estate within industrial zones, economic zones, and high-tech zones according to Circular Joint No. 93/2001/TTLT-BTC-BTP.

The Ministry of Finance hereby informs relevant agencies for their knowledge and implementation.
