THE MINISTER OF PUBLIC SECURITY

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

After reaching consensus with the Minister of Industry and Trade,

DECISION:

Article 1. The list of State secrets of Confidential level in the Industry and Trade sector includes the following information:

1. Strategies, plans, and development projects for the Industry and Trade sector that have been approved by the Government and measures to ensure their implementation which have not yet been disclosed.

2. Results of national-level research projects on machinery, metallurgy, electric power, chemicals, oil and gas, mining operations and mineral processing, consumer goods industry, food industry, other processing industries, and trade that have not yet been disclosed.

3. Information, files, and documents related to bidding and tendering processes for investment projects in the Industry and Trade sector that are still under review and have not yet been disclosed.

4. Documents concerning the design and construction of key projects: machinery, metallurgy, electric power, chemicals, oil and gas, mining operations and mineral processing, consumer goods industry, food industry, other processing industries, and trade that have been approved but not yet disclosed.

5. Plans and schemes for protecting key projects in the Industry and Trade sector and reservoirs and dams.

6. Planning and design documents for dual-use industrial facilities.

7. Information on the implementation of the Chemical Weapons Convention related to security and defense that have not yet been disclosed.

8. Documents, locations, and reserves of rare metal and non-metal mines, gemstone mines, radioactive mines, and oil discoveries that have not yet been disclosed.

9. Locations where industrial explosives stored by the state and managed by the Ministry of Industry and Trade are kept and their quantities.

10. Satellite images, aerial photographs of Vietnam showing the locations of mines, factories, enterprises, and industrial zones according to national or local coordinate systems.

11. Short-term operation plans for the national power system, regional power systems, and provincial power systems.

12. High-voltage grid diagrams supplying power to important projects determined by the Chairman of the People's Committee of provinces and centrally-administered cities.

13. Information and documents on key oil exploration, development, and processing projects of the state that have not yet been disclosed.

14. Information and documents on selecting partners, negotiation processes, negotiation results, and contents of oil contracts with domestic and foreign partners that have not yet been disclosed. Economic, scientific, and technical documents transferred from foreign partners to the Oil and Gas sector that must not be disclosed to third parties at the request of the transferring party.

15. Reports on research results, evaluations of contract implementation phases, and financial budgets corresponding to each phase of oil contracts, and final reports on oil exploration activities and potential assessments of contract blocks that have not yet been disclosed.

16. Original samples collected from drilling wells for exploration and assessment that are currently being conducted and have not yet been disclosed. Exploration programs corresponding to each oil contract. Reports on reserves and deep investment plans for developing and exploiting oil fields.

17. Information and documents on investments, construction, technological processes, operational procedures, and experimental analysis results of refining and petrochemical projects that have not yet been disclosed.

18. Pricing plans for industrial products listed in the state's regulations that have not yet been disclosed.

19. Data on total supply and demand for critical items regulated by the state regarding assets and goods reserves in the Industry and Trade sector that have not yet been disclosed.

20. Plans and measures for managing imports and exports, ensuring supply-demand balance, and stabilizing the market that have not yet been disclosed.

21. Summary reports, current market status reports, trading activities between Vietnam and foreign countries, and operations of representative offices of foreign economic organizations in Vietnam that have not yet been disclosed.

22. Survey and research data on trade activities in specific regions, countries, and partner enterprises of Vietnam abroad, and foreign intelligence gathered for economic and trade purposes that have not yet been disclosed or are not intended to be disclosed.

23. Comprehensive price indices and pricing guidance plans that have not yet been disclosed.

24. Orders from competent authorities, plans, and schemes for investigating serious violations of laws in trade activities that have not yet been disclosed.

25. Information and documents on organizations and individuals (including foreigners) suspected of smuggling, selling counterfeit goods, or seriously violating market management policies and laws that are under surveillance and investigation.

26. Technical design documents for internal computer networks, encryption keys, passwords, and security protocols in the application of information technology in the Industry and Trade sector.

27. Files, documents, inspection results, and resolutions on complaints and denunciations in the Industry and Trade sector that are still under review, verification, or have concluded but not yet disclosed.

28. Organizational plans, personnel transfer and placement schemes, leadership cadre planning documents; files of leaders at the departmental level and above, and leadership cadre planning documents in the Industry and Trade sector that have not yet been disclosed.

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 584/2003/QĐ-BCA dated August 25, 2003 of the Minister of Public Security on the List of State Secrets of Confidential Level in the Trade Sector; Decision No. 1487/2004/QĐ-BCA(A11) dated December 20, 2004 of the Minister of Public Security on the List of State Secrets of Confidential Level in the Industry Sector. Competent agencies of the Ministry of Industry and Trade and the Ministry of Public Security are responsible for guiding and supervising the implementation of this Decision.

Article 3. Ministries, ministerial-level agencies, government agencies; agencies and organizations mentioned in Article 2 of the Law on Protection of State Secrets dated December 28, 2000, and People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision.
