ON NOVEMBER 12, 2002 REGARDING POLICIES FOR HOUSE PURCHASES ON INSTALLMENT BY HOUSEHOLDS OF ETHNIC MINORITY GROUPS IN PLACE AND HOUSEHOLDS WITH POLICY BENEFITS IN THE WESTERN HIGHLANDS PROVINCES
ETHNIC MINORITY GROUPS AT THE PLACE AND HOUSEHOLDS UNDER POLICY IN THE PROVINCES OF THE CENTRAL Highlands PURCHASE
HOUSING ON INSTALLMENT TERMS
In the provinces of Lam Dong, Dak Lak, Gia Lai, and Kon Tum, ethnic minority groups and households facing housing difficulties (without housing or with temporary, dilapidated houses) shall be supported by the State to purchase housing on installment terms using physical assets, with the aim of ensuring a stable life for the ethnic minorities, gradually improving their living standards, strengthening national solidarity, promoting economic and social development, and ensuring national defense and security in the Central Highlands, specifically as follows:

 

PRIME MINISTER

 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 10-NQ/TW dated January 18, 2002 of the Politburo;

WHEREAS, pursuant to Decision No. 168/2001/QĐ-TTg dated October 30, 2001 of the Prime Minister on long-term orientation, the five-year plan for 2001-2005, and basic solutions for economic and social development in the Western Highlands region;

CONSIDERING the proposal of the Minister of Finance, the Minister of Construction, the Minister of Labor, Invalids and Social Affairs, and the Governor of the State Bank of Vietnam;

DECISION:

 

Article 1. Households of ethnic minority groups in place and households with policy benefits in the provinces of Lam Dong, Dak Lak, Gia Lai, and Kon Tum who have difficulties with housing (without houses or with temporary, dilapidated houses) shall be supported by the State to purchase houses on installment in kind, aiming to ensure a stable life for the ethnic minorities, gradually improve their living standards, strengthen national solidarity, promote economic and social development, and ensure national defense security in the Western Highlands region, specifically as follows: For ethnic minority groups and households under policy in the provinces of Lam Dong, Dak Lak, Gia Lai, and Kon Tum who face housing difficulties (without housing or with temporary, dilapidated houses), the State shall support them to purchase housing on installment terms using physical assets, with the aim of ensuring a stable life for the ethnic minorities, gradually improving their living standards, strengthening national solidarity, promoting economic and social development, and ensuring national defense and security in the Central Highlands, specifically as follows:

1. Households residing permanently in the locality who submit an application to purchase a house, commit to repaying the debt on time, and are confirmed by the commune authority may purchase a house on installment in kind with a maximum value not exceeding 7 million VND at an interest rate of 3% per year. The portion of the house's value exceeding 7 million VND must be paid additionally by the household.

2. The maximum repayment period is 10 years, with a grace period of 5 years. Repayment begins from the sixth year after the purchase date, with a minimum annual repayment amounting to 20% of the total debt (principal and interest). The Ministry of Finance will stipulate policies to encourage early repayment.

During the period when the debt has not been fully repaid, the household is not allowed to sell or pledge the house.

 

Article 2. The investment capital for constructing houses to sell on installment to households shall be supported by the Central Government budget at 50% of the total investment cost for the Policy-Based Social Bank; the remaining 50% shall be raised by the Policy-Based Social Bank.

 

After receiving the house, households must directly sign a loan contract for purchasing a house on installment with the Policy-Based Social Bank. The Policy-Based Social Bank will pay the production unit according to the actual number of houses installed for the people. The Central Government budget will subsidize the interest rate difference and a fee of 1% per year on the outstanding balance for the Policy-Based Social Bank.

 

Article 3. Organize implementation guidance.

1. The Chairmen of the People's Committees of the Western Highlands provinces shall be responsible for:

- Specifying and publicly announcing specific criteria and lists of households eligible to purchase houses on installment in their localities, ensuring fairness and reasonableness. Directing the establishment, approval of lists of eligible households, placing orders with house production units, and informing the Policy-Based Social Bank to implement the sale of houses on installment to households.

- Managing the production of house components and materials by enterprises producing houses and roofing sheets, creating favorable conditions for enterprises to invest in production bases for house components and materials.

2. Enterprises producing complete house components and materials for sale to the public at reasonable costs and prices, ensuring that the production enterprises do not incur losses but also do not charge interest when selling houses to the public. Enterprises should produce several house models for the public to choose from based on their needs.

3. The Policy-Based Social Bank shall implement loans and recover debts for house construction in accordance with the provisions of this Decision.

4. The Ministry of Labor, Invalids and Social Affairs shall provide detailed guidance on the target households eligible to benefit under this Decision.

5. The Ministries of Finance, Planning and Investment shall coordinate to allocate the central government budget funds and subsidize the interest rate on the raised capital and fees stipulated in Article 2 of this Decision to the Policy-Based Social Bank.

6. The Ministries of Finance, Construction, Planning and Investment, Labor, Invalids and Social Affairs, and the State Bank of Vietnam shall provide detailed guidance on implementing the contents of this Decision.

Article 4. This Decision takes effect from the date of signature.

 

Article 5. The Ministers of Construction, Finance, Planning and Investment, Natural Resources and Environment, Labor - Invalids and Social Affairs, Agriculture and Rural Development, and The Chairman of the Committee for Ethnic Minorities, the Governor of the State Bank of Vietnam, the General Director of the Policy-Based Social Bank, and the Chairmen of the People's Committees of the provinces: Lam Dong, Dak Lak, Gia Lai, Kon Tum are responsible for enforcing this Decision.
