Decision No. 155/2002/QĐ-TTg On Adjusting the Boundaries of Tam Dao National Park

DECISION OF THE PRIME MINISTER

Regarding the adjustment of the boundaries of Tam Dao National Park.

PRIME MINISTER

Pursuant to the Law on Organization dated December 25, 2001;

Based on the Law on Forest Protection and Development dated August 19, 1991;

Pursuant to the Land Law dated July 14, 1993, and the Law Amending and Supplementing Certain Provisions of the Land Law dated December 2, 1998, and the Law Amending and Supplementing Certain Provisions of the Land Law dated June 29, 2001;

At the proposal of the Ministry Ministry of Science and Technology Ministry of Agriculture and Rural Development (Circular No. 3750/BNN-KLCLC September 13, 2002), the opinion of the Vietnam General Confederation of Labor (Circular No. 1458/TLĐTTLĐ September 11, 2002), and Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Tuyen Quang Province (Circular No. 1867/UB-TN August 22, 2002),

DECISION:

Article 1. The boundaries of Tam Dao National Park are adjusted as follows:

Transfer an area of 1,888 hectares belonging to Tam Dao National Park to the People's Committee of Tuyen Quang Province for management and use according to the approved plan.

The above area belongs to Son Duong District, located within the following communes:

Commune Hop Thanh: 201 hectares.

Commune Khang Nhat: 1,255 hectares.

Commune Hop Hoa: 185 hectares.

Commune Thien Ke: 152 hectares.

Commune Ninh Lai: 95 hectares.

Article 2Direct the Ministry of Agriculture and Rural Development to coordinate with the People's Committee of Tuyen Quang Province to re-plan the area of Tam Dao National Park, determine specific boundary markers on maps and on-site, and transfer the aforementioned areas out of the boundaries of Tam Dao National Park to create stable production and living conditions for the people in this area and effectively protect and develop the natural resources of Tam Dao National Park.

Article 3. Implementation clause.

This Decision takes effect fifteen days from the date of signature.

2. The Ministers of the Ministries of Agriculture and Rural Development, Natural Resources and Environment, Planning and Investment, Finance, Industry, heads of relevant agencies, government bodies under the Government, and the Chairman of the People's Committee of Tuyen Quang Province are responsible for implementing this Decision./.
