DECREE
Regulations on standards and norms for the use of office premises and activity bases of public institutions
On the basis of The Government Organization Law 2025;
On the basis of The Local Government Organization Law 2025;
On the basis of Law on Management and Use of State Assets dated June 21, 2017;
On the basis of Law amending and supplementing certain articles of the Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Law on Management and Use of State Assets, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Administrative Violation Handling Law dated November 29, 2024;
At the proposal of the Minister of Finance;
The Government promulgates this Decree to stipulate standards and norms for the use of office premises and activity bases of public institutions.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Decree stipulates standards and norms for the use of office premises and activity bases of public institutions at agencies, organizations, and units specified in Clause 1 of Article 2 of this Decree, including:
a) Land area belonging to office premises and activity bases;
b) Working space serving job functions, common usage areas, specialized usage areas within office premises at agencies and organizations;
c) Working space serving job functions, common usage areas, specialized usage areas, and public works areas within activity bases of public institutions at public institution units.
2. Standards and norms for the use of office premises and activity bases of Vietnamese agencies abroad shall be implemented according to separate regulations of the Government.
3. Standards and norms for the use of special assets, dedicated assets, and management service assets at people's armed forces units shall be implemented according to separate regulations prescribed by competent authorities.
Article 2. Applicability
1. The objects subject to this Decree include:
a) State agencies, Communist Party of Vietnam agencies, Vietnam Fatherland Front (including political-social organizations), public institution units, project management boards using state capital (hereinafter referred to as agencies, organizations, and units);
b) Organizations and individuals related to determining, deciding, and applying standards and norms for the use of office premises and activity bases.
2. State financial organizations outside the budget that apply the financial mechanism and asset management mechanism of public institution units shall implement standards and norms for the use of activity bases according to this Decree.
Article 3. Principles for Applying Standards and Norms
1. Standards and norms for the use of office premises and activity bases stipulated in this Decree shall be used as one of the bases for planning and preparing budget estimates; allocating, constructing, purchasing, leasing, managing, using, and disposing of office premises and activity bases.
2. Standards and norms for the use of working space serving job functions shall be determined based on each job function and position. In cases where a person holds multiple job functions and positions, the highest standard shall be applied.
A Central Committee member of the Communist Party who is concurrently holding a position shall be subject to standards and norms for the use of working space according to their current position.
For job functions and positions not specifically provided for in Appendix I and Appendix II attached to this Decree, the standards and norms shall be determined based on the regulations of competent authorities regarding such job functions and positions, which are equivalent to those specified in Appendix I and Appendix II attached to this Decree, or by determining equivalent job functions and positions based on the salary level or job function allowance equivalent to those specified in Appendix I and Appendix II attached to this Decree.
3. Working space serving job functions, common usage areas, specialized usage areas, and public works areas stipulated in this Decree shall be calculated based on clear dimensions as prescribed by law, excluding staircases, elevators, emergency exits, ramps, parking lot areas, perimeter walls, room partition walls, columned floor areas, technical duct areas, and technical duct wall areas (if any) inside rooms.
4. The working rooms stipulated in this Decree are rooms designed for office premises and activity bases (not organizational structure rooms of agencies, organizations, and units).
5. For existing office premises and activity bases currently under management and use, or undergoing allocation, transfer, or disposal following mergers, consolidations, divisions, dissolutions, or cessation of operations, the agencies, organizations, and units currently managing and using or receiving such premises and bases shall manage and use the areas according to the standards and norms stipulated in this Decree.
For areas larger than the standards and norms (if any), the competent authority responsible for allocation and transfer under the Law on Management and Use of State Assets shall decide to allocate or transfer these areas to other agencies, organizations, and units for management and use if they meet the standards and norms and the needs of such agencies, organizations, and units; during the time the competent authority has not allocated or transferred them, the agencies, organizations, and units currently managing and using or receiving the assets shall be responsible for managing, preserving, and protecting these areas. If there is no suitable agency, organization, or unit to allocate or transfer to, the competent authority responsible for allocation and transfer under the Law on Management and Use of State Assets shall decide to allocate or transfer these areas to the agencies, organizations, and units currently managing and using or receiving the office premises and activity bases for management and use in a thrifty and efficient manner.
Chapter II
STANDARDS AND NORMS FOR THE USE OF OFFICE PREMISES OF AGENCIES AND ORGANIZATIONS
Article 4. Standards and quotas for the use of office premises by agencies and organizations
1. The area of office buildings within the office premises includes the following types of areas:
a) Working area serving the work of positions specified in Article 5 of this Decree;
b) Common usage area as stipulated in Article 6 of this Decree;
c) Specialized usage area as stipulated in Article 7 of this Decree.
2. The land area within the office premises of agencies and organizations shall be determined based on the area of office buildings as specified in Clause 1 of this Article, land use planning, construction planning according to laws on land, laws on construction, and other relevant laws.
Article 5. Working area serving the work of positions
1. The standards and quotas for the use of working area serving the work of positions at central and local levels are prescribed in Appendix I and Appendix II attached to this Decree.
2. The total working area serving the work of positions shall be determined based on the number of authorized personnel or the number of employees assigned, approved, or according to the job position plan approved by the competent authority, the number of employees under indefinite-term labor contracts decided by the competent authority in accordance with the law, or the staffing orientation, the number of employees determined in the development orientation of the industry or field approved by the competent authority (if any) at the time of determining the standards and quotas.
3. Based on the design and current status of the office premises, the head of the agency or organization decides to allocate specific working areas for positions in accordance with the actual situation, which may be higher or lower than the areas stipulated in the standards and quotas in Appendix I and Appendix II attached to this Decree, but ensuring that the total allocated area for positions does not exceed the total working area determined according to the provisions in Appendix I and Appendix II attached to this Decree.
Article 6. Common usage area
1. The common usage area is the area used to serve general activities within the office premises of agencies and organizations, including:
a) Reception and document submission room (one-stop service counter); public reception room; secretarial, typing, administrative, and management rooms; document duplication room;
b) Guest reception room (domestic, international);
c) Auditorium, meeting room;
d) Archive room, file room, reference material and book room;
đ) Data center room, computer room, network management room, equipment installation and building management room;
e) Standing duty room, security room or security room requiring night duty; traditional room; health room; dining hall; equipment and supplies warehouse; entrance hall, corridor; balcony, veranda; paper recycling and waste collection area; vehicle team office space; restroom; fire prevention and firefighting service area;
g) Other common usage areas not included in the areas specified in points a, b, c, d, đ, and e of this clause.
2. The common usage area as specified in Clause 1 of this Article shall be determined at a maximum of no more than 85% of the total working area serving the work of positions of the agency or organization and shall be allocated to each specific type of area as specified in points a, b, c, d, đ, e, and g of Clause 1 of this Article.
In cases where, after allocation to each specific type of area as specified in Clause 1 of this Article, the area of rooms/departments specifically provided for in the Vietnam Construction Standard (government administrative office) is lower than the minimum level stipulated in the Vietnam Construction Standard, the area of such rooms/departments shall be applied according to the minimum level stipulated in the Vietnam Construction Standard. The difference in area between the allocated area and the minimum area according to the Vietnam Construction Standard shall be supplemented to the common usage area of the agency or organization.
Article 7. Special-purpose area
1. Special-purpose area is the area used to serve the special activities of agencies and organizations, including:
a) The area used for prosecution, trial, interrogation activities within the headquarters of judicial agencies; the transaction area of the state-owned banking system, state treasury;
b) Specialized warehouses such as: National reserve warehouse, currency, gold, silver, precious stones, precious metals, valuable documents warehouse, evidence storage warehouse, special evidence storage warehouse, other asset storage warehouse according to the requirements of special tasks of the sector;
c) Special-purpose archive storage (if any);
d) Official accommodation serving special business activities of the sector, physical training area for agency staff, civil servants, officials, workers (if any);
đ) Other special-purpose areas not included in the areas specified in points a, b, c, and d of this clause serving the special tasks of agencies and organizations (if any).
2. Based on functions, tasks, documents reflecting special tasks of agencies and organizations, actual needs for use, and related regulations, the agencies or authorized persons decide on standards and norms for special-purpose areas, specifically as follows:
a) The Secretary-General of the Central Party Committee decides or delegates authority to decide for central Party agencies;
b) The Standing Committee of the Vietnam Fatherland Front Central Committee decides or delegates authority to decide for agencies and organizations under its management;
c) The Minister, Head of a ministry-level agency, government agency, other central agency (hereinafter referred to as the Minister, Head of a central agency) decides or delegates authority to decide for agencies and organizations under their management;
d) The Provincial Party Committee Standing Committee, Municipal Party Committee Standing Committee decides or delegates authority to decide for local Party agencies;
đ) The People's Committees of provinces, centrally governed cities (hereinafter referred to as provincial People's Committees) decide or delegate authority to decide according to the Law on Local Administration Organization, other relevant laws for local agencies and organizations; except for cases stipulated in point d of this clause.
3. In cases where specialized ministries or ministry-level agencies have detailed guidelines on standards and norms for special-purpose areas within their administrative supervision, the special-purpose area shall be determined based on the detailed guidelines of the specialized ministries or ministry-level agencies.
4. The decision on standards and norms for special-purpose areas prescribed in Clause 2 of this Article shall be publicly disclosed on the Central Party Office's electronic information portal, the Vietnam Fatherland Front Central Committee's electronic information portal, ministries, central agencies, provincial, centrally governed city portals.
Chapter III
STANDARDS AND QUANTITIES FOR THE USE OF BUSINESS FACILITIES OF PUBLIC INSTITUTIONS
Article 8. Standards and quantities for the use of business facilities of institutions
1. The working area, public works within the business facility of institutions include the following types of areas:
a) Working area serving the work of positions specified in Article 9 of this Decree;
b) Commonly used area specified in Article 10, special-purpose area specified in Article 11 of this Decree;
c) Public works area specified in Article 12 of this Decree.
2. The land area within the business facility of the institution is determined based on the working area, public works area specified in Clause 1 of this Article, land use planning, construction planning according to the laws on land, construction laws, and other relevant laws.
Article 9. Area for work serving the duties of positions
1. The standards and quotas for area for work serving the duties of positions shall be implemented in accordance with the provisions of Article 5 of this Decree.
2. For positions working in certain fields such as lecturers, teachers, doctors, nurses, technicians, nursing assistants, scientists, and other positions of units, the area for work of these positions shall be arranged appropriately with the nature of work within the area of public works as prescribed in Article 12 of this Decree or the area for work serving the duties of positions as prescribed in Clause 1 of this Article.
Article 10. Common usage area
The common usage area shall be implemented in accordance with the provisions of Article 6 of this Decree.
Article 11. Specialized area
1. The specialized area shall be implemented in accordance with the provisions of Clause 1 of Article 7 of this Decree.
2. Based on functions, tasks, documents reflecting special tasks of the unit, actual needs for use, and related regulations, the competent authority or person with decision-making power shall determine the standards and quotas for specialized areas specifically as follows:
a) The Director of the Central Party Office decides or delegates the authority to decide for central Party-affiliated public service units; except for cases prescribed in point e of this clause;
b) The Standing Committee of the Central Vietnam Fatherland Front Committee decides or delegates the authority to decide for units under its management; except for cases prescribed in point e of this clause;
c) The Minister or Head of a central agency decides or delegates the authority to decide for units under their management; except for cases prescribed in point e of this clause;
d) The Provincial Party Committee Standing Committee or City Party Committee Standing Committee decides or delegates the authority to decide for local Party-affiliated public service units; except for cases prescribed in point e of this clause;
đ) The People's Committee of a province decides or delegates the authority to decide according to the Law on Organization of Local Administration and other relevant laws for units at the provincial level; except for cases prescribed in points d and e of this clause;
e) The Management Board or head of a public service unit that self-funds regular expenses and investment (in case the public service unit does not have a Management Board) decides for their own unit.
3. In cases where specialized ministries or ministry-level agencies have detailed guidelines on standards and norms for special-purpose areas within their administrative supervision, the special-purpose area shall be determined based on the detailed guidelines of the specialized ministries or ministry-level agencies.
4. The decision on standards and norms for special-purpose areas prescribed in Clause 2 of this Article shall be publicly disclosed on the Central Party Office's electronic information portal, the Vietnam Fatherland Front Central Committee's electronic information portal, ministries, central agencies, provincial, centrally governed city portals.
Article 12. Public Works Area
1. The public works area includes:
a) Public works area in the fields of health care, education, and training;
b) Other public works area outside the public works area prescribed in point a of this clause, including: public works area in the fields of culture, sports, tourism, information, communication, science, technology, innovation, diplomacy, agriculture, environment, and other fields.
2. The public works area prescribed in point a of Clause 1 of this Article
a) Within twelve months from the date this Decree takes effect, the Minister of Health and the Minister of Education and Training shall provide detailed guidance on the standards and quotas for public works area in the fields of health care, education, and training under their respective administrative supervision;
b) Based on the detailed guidance provided by the Minister of Health and the Minister of Education and Training as prescribed in point a of this clause, the competent authority or person with decision-making power as prescribed in Clause 2 of Article 11 of this Decree shall determine the standards and quotas for public works area in the fields of health care, education, and training for the units prescribed in Clause 2 of Article 11 of this Decree;
c) In case the Minister of Health and the Minister of Education and Training have not provided detailed guidance or have not provided detailed guidance fully as prescribed in point a of this clause, the competent authority or person with decision-making power as prescribed in Clause 2 of Article 11 of this Decree shall determine the standards and quotas for public works area in the fields of health care, education, and training for the units prescribed in Clause 2 of Article 11 of this Decree. After the Minister of Health and the Minister of Education and Training provide detailed guidance as prescribed in point a of this clause, the competent authority or person with decision-making power as prescribed in Clause 2 of Article 11 of this Decree shall review and issue new decisions or replace or amend and supplement the decisions on standards and quotas for public works area in the fields of health care, education, and training for the units prescribed in Clause 2 of Article 11 of this Decree to comply with the detailed guidance provided by the Minister of Health and the Minister of Education and Training.
3. Other public works area prescribed in point b of Clause 1 of this Article
Based on the regulations regarding the functions, tasks, and special activities of the unit and other related regulations, the competent authority or person with decision-making power as prescribed in Clause 2 of Article 11 of this Decree shall determine the standards and quotas for other public works area for the units prescribed in Clause 2 of Article 11 of this Decree.
4. The decisions on standards and quotas for public works area prescribed in Clauses 2 and 3 of this Article shall be publicly disclosed on the Central Party Office’s electronic portal, the Central Vietnam Fatherland Front Committee’s electronic portal, the Ministry’s electronic portal, the central agency’s electronic portal, the provincial electronic portal, and the municipal electronic portal directly under the central government.
Chapter IV
IMPLEMENTING PROVISIONS
Article 13. Implementation Provisions
1. This Decree takes effect from July 1, 2025.
The Central Party Office, the Central Vietnam Fatherland Front Committee, the Ministry, the central agency, the provincial People's Committee, and the central and local agencies, organizations, and units may use the standards and quotas prescribed in this Decree to develop plans, make decisions, and organize the allocation, arrangement, and handling of office premises and public service activity bases when implementing streamlined organizational structures of the political system and building and implementing two-level (02) local administration models from the date this Decree is signed and issued.
2. Decision No. 152/2017/NĐ-CP dated December 27, 2017 of the Government prescribing standards and quotas for the use of office premises and public service activity bases shall cease to be effective from the date this Decree takes effect.
3. In case the normative legal documents cited in this Decree are amended, supplemented, or replaced by other normative legal documents, they shall be implemented in accordance with the provisions of those amended, supplemented, or replacing documents.
Article 14. Transitional Provisions
1. For tasks, investment projects for new construction, renovation, and upgrading of workplaces and operational facilities that have been approved by competent authorities in accordance with regulations prior to the effective date of this Decree, the competent authority deciding on the approval of such tasks and projects shall decide whether to adjust or not adjust according to the standards and norms prescribed in this Decree.
2. For standards and norms for the use of specialized area and facility area of operational activities that have been issued by competent authorities before the effective date of this Decree and remain appropriate, they shall continue to be implemented according to the issued documents until the competent authorities specified in Articles 7, 11, and 12 of this Decree determine new standards and norms for specialized area and facility area. In this case, the competent authority shall issue a notification to the agencies, organizations, and units under its management to implement.
3. For existing workplaces and operational facilities currently being managed, used, or undergoing transfer or disposal after implementation of mergers, consolidations, divisions, dissolution, or cessation of operations before the effective date of this Decree, they shall be implemented in accordance with Clause 5 of Article 3 of this Decree and laws on the management and use of public assets.
4. For leadership and managerial positions in agencies, organizations, and units specified in Appendices I and II attached to this Decree, if they are currently receiving higher position salary levels or allowances than those specified in Appendices I and II, the standards and norms shall be determined based on the positions receiving higher salary levels or allowances.
5. For non-professional staff at the commune level during the extended period as concluded by the competent authority and stipulated by the regulations of the competent authority, the People's Committee of the commune shall be responsible for arranging suitable working areas for these positions.
Article 15. Responsibility for Implementation
1. The Minister of Health and the Minister of Education and Training shall be responsible for detailing and guiding the standards and norms for the use of facility area in the fields of health and education and training as prescribed in point a, Clause 2, Article 12 of this Decree.
2. During the process of streamlining the organizational structure of the political system and building and implementing a two-level local government model, the competent authority deciding on the allocation and transfer of workplaces and operational facilities as stipulated in laws on the management and use of public assets shall decide to allocate or transfer one or more workplaces and operational facilities to one or more agencies, organizations, and units managing and using them.
3. The Central Party Office, the Vietnam Fatherland Front Central Committee, ministries, central agencies, provincial People's Committees, and agencies, organizations, and units at the central and local levels shall be responsible for:
a) Organizing inspections and supervision of compliance with standards and norms for the use of workplaces and operational facilities and the implementation of this Decree; handling violations within their authority or reporting to the competent authority for handling violations in the management and use of workplaces and operational facilities in accordance with the law;
b) Fulfilling other responsibilities as prescribed in this Decree and related laws.
4. The Government Inspectorate and other inspection agencies shall be responsible for:
a) Organizing inspections of compliance with standards and norms for the use of workplaces and operational facilities and the implementation of this Decree;
b) Fulfilling the tasks prescribed in Clause 3 of this Article.
5. Ministers, heads of ministerial-level agencies, central agencies, other central agencies, Chairpersons of provincial People's Committees, heads of agencies, organizations, and units, and relevant individuals shall be responsible for implementing this Decree.
