Pursuant to the Law on Government Organization"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."pursuant to the Government's Resolution dated December 25, 2001;

Pursuant to the Law on Protection, Care, and Education of Children dated June 15, 2004;

Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,

DECISION:

Article 1. Approves the National Action Program for Children during the period 2012-2020 with the following main contents:

1. Objectives of the Program.

a) General Objective:

Building a safe, friendly, and healthy living environment to increasingly better realize children's rights. Gradually reducing the gap in living conditions between different groups of children and between regions. Improving the quality of life and creating equal opportunities for development for all children.

b) Specific objectives:

- Reducing the rate of stunting in children under five years old to below 26% by 2015 and to 23% by 2020; reducing the rate of wasting in children under five years old to below 15% by 2015 and to 10% by 2020. Maintaining over 95% of commune health stations having midwives or pediatric nurses until 2020.

- Completing the goal of universal preschool education for five-year-old children by 2015; by 2020, at least 30% of children in nursery age and 80% of children in kindergarten age will be cared for and educated in preschool educational facilities. By 2020, the enrollment rate at primary school level will be 99% and at lower secondary school level will be 95%, with particular attention given to ethnic minority children and children with disabilities.

- Reducing the proportion of children in special circumstances to below 5.5% of the total number of children by 2015 and to 5% by 2020; increasing the proportion of children in special circumstances receiving assistance and care for recovery, reintegration, and development opportunities to 80% by 2015 and to 85% by 2020; the number of children subjected to violence will decrease by 20% by 2015 and by 40% by 2020; reducing the rate of child accidents and injuries to 550/100,000 children by 2015 and to 450/100,000 children by 2020.

- Increasing the proportion of communes and wards with playgrounds meeting standards to 50% by 2015 and to 55% by 2020.

- Increasing the ratio of children participating in children's forums at all levels to 20/100,000 children by 2015 and to 25/100,000 children by 2020.

- Increasing the proportion of communes and wards reaching the standard of being child-friendly to 70% by 2015 and to 80% by 2020.

2. Subjects, scope, and implementation period of the Program.

a) Subjects: Children, prioritizing children in special circumstances and ethnic minority children.

b) Scope: Implementation nationwide.

c) Time frame: Implementation from 2012 to 2020. In 2015, organize a midterm review of the Program's implementation; in 2020, organize a final evaluation of the Program.

3. Main activities of the Program:

a) Communicating, educating, and mobilizing society to raise awareness and change behavior in realizing children's rights.

- Organizing communication campaigns, events, and social mobilization to participate in implementing children's rights, such as Child Protection Month, National Day for Sending Children to School, National Iodine Deficiency Prevention Day, National Children's Forum; cultural and sports events. Supporting children to organize communication events and activities for children and to exercise their rights and duties.

- Organizing mass media communications on protecting, caring for, and educating children. Researching and producing high-quality and appropriate communication products for different target groups.

b) Developing and implementing programs and plans for protecting, caring for, and educating children.

- Continuing to effectively implement the following programs:

+ The National Program for Protecting Children 2011-2015 (approved by the Prime Minister through Decision No. 267/QĐ-TTg dated February 22, 2011).

+ The National Program for Preventing and Controlling Child Accidents and Injuries 2012-2015 after approval.

- Studying, developing, and implementing the following programs and plans:

+ The National Action Plan for Children Affected by HIV/AIDS 2012-2020 (assigned by the Prime Minister through Decision No. 84/2009/QĐ-TTg dated June 4, 2009).

+ The National Program for Protecting Children 2016-2020.

+ The National Program for Preventing and Controlling Child Accidents and Injuries 2016-2020.

+ The Program for Promoting Children's Participation Rights 2013-2020.

+ The National Program for Preventing and Combating Violence Against Children 2016-2020.

+ The National Program for Eliminating the Worst Forms of Child Labor 2016-2020.

- Studying and developing content on protecting, caring for, educating, playing, entertaining, sports, tourism, information, and communication for children in national target programs during the period 2016-2020.

c) Perfecting the legal system and policies related to the protection, care, and education of children and the realization of children's rights.

- Studying the supplementation and amendment of the Law on Protecting, Caring for, and Educating Children.

- Studying the amendment of certain articles of the Criminal Procedure Code to perfect the child-friendly judicial system.

- Studying the amendment of certain articles of the Civil Code and the Marriage and Family Law to strengthen the responsibility of grandparents, parents, families, and communities in protecting, caring for, and educating children.

- Continuing to study and perfect welfare policies for children towards expanding the beneficiary group of children in areas such as healthcare, education, social assistance, entertainment, sports, tourism, information, communication, and participation rights. Building and replicating some models of social services for children; models and activities for exercising children's participation rights.

d) Encourage political-social organizations, economic organizations, social organizations, occupational social organizations, families, communities, citizens, and children to participate in protecting, caring for, and educating children; provide services for protecting, caring for, educating, playing, entertainment, sports, tourism, information, and communication for children. Families, communities, schools have the responsibility to participate in implementing children's rights, create all conditions for children to study, care for their health, play, and entertain; create opportunities and favorable conditions for children to actively participate in activities to protect, care for, and educate children and other social activities appropriate to their age. Strengthen the Child Welfare Fund to enhance mobilization of resources to implement the Program, prioritizing children with special circumstances.

đ) Consolidate organizational systems, improve the capacity of cadres working with children at all levels and sectors. Improve and develop networks of volunteers and protectors for children's protection and care at the grassroots level. Enhance the quality of monitoring, supervision, and evaluation work.

- Consolidate organizational systems, improve the capacity of cadres working on child protection and care at all levels. Study and build a network of volunteers and protectors for children's protection and care at the grassroots level; organize training and research to develop appropriate incentive policies for this group.

- Study the formation of a multi-sectoral coordination organization for child protection, care, and education.

- Build and effectively utilize databases on children.

- Organize inter-sectoral inspections, thematic inspections, and evaluate the results of the Program implementation. Summarize and conclude models and stages of the Program. Evaluate and replicate effective models.

4. Implementation solutions for the Program:

a) Strengthen the leadership and guidance of Party committees and authorities at all levels for child protection, care, and education work and the implementation of children's rights.

b) Promote propaganda and education to raise awareness about the significance and importance of child protection, care, and education work and the implementation of children's rights.

c) Socialize activities for child protection, care, and education:

- Create mechanisms to encourage economic organizations, political-social organizations, social organizations, families, communities, citizens, and children to participate in child protection, care, and education; provide services for protecting, caring for, educating, playing, entertaining, sports, tourism, information, and communication for children.

- Create opportunities and favorable conditions for children to actively participate in child protection, care, and education activities, exercise their rights and duties, and other social activities appropriate to their age.

d) Scientific research and international cooperation:

- Increase scientific research activities for forecasting, policy planning, strategy formulation, and management of child protection, care, and education work. Encourage applied research and the application of child protection, care, and education service models and the implementation of children's rights.

- Expand and strengthen international cooperation, particularly with potential partners, to mobilize resources and share experiences regionally and internationally for child protection, care, and education work and the implementation of children's rights. Participate and host international and regional events on child protection, care, and education and the implementation of children's rights.

5. Funding for Program implementation.

b) Based on the tasks assigned according to this Decision, ministries, sectors, and localities shall prepare annual budget estimates to ensure the activities of the Program; link them with related Programs and Projects led by ministries and sectors and submit them to the competent authority for decision.

Article 2. Organizing the implementation of the Program

1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant ministries and sectors:

- Guide agencies, political-social organizations, related organizations, People's Committees of provinces and centrally governed cities to develop plans to implement the Program, ensuring close integration with related strategies and programs implemented by other ministries and sectors.

- Organize communication campaigns to raise awareness and change behavior in implementing children's rights and achieving related child protection goals. Build and effectively utilize databases on children. Enhance the capacity of cadres working on child protection and care.

- Continue to effectively implement approved programs and plans. Promote the implementation of Decision No. 37/2010/QĐ-TTg dated April 22, 2010, issued by the Prime Minister on standards for communes and wards suitable for children to ensure the achievement of Program goals at the commune and ward level; effectively implement the Program on preventing and controlling child accidents and injuries from 2012 to 2015 after approval.

- Research, develop, and implement programs and plans: National Action Plan for Children Affected by HIV/AIDS from 2012 to 2020; National Program on Child Protection from 2016 to 2020; Program on Preventing and Controlling Child Accidents and Injuries from 2016 to 2020; Program on Promoting Children's Participation Rights from 2013 to 2020; Program on Preventing and Controlling Violence Against Children from 2016 to 2020; Program on Eliminating the Worst Forms of Child Labor from 2016 to 2020.

- Review and amend or propose competent authorities to amend and supplement the legal system and policies on child protection, care, and education and the implementation of children's rights. Study and propose amendments and supplements to the Law on Child Protection, Care, and Education. Study and build, enhance the capacity of volunteer and protector teams participating in grassroots-level child protection and care. Guide, inspect, and urge related agencies and units to implement policies on child protection, care, and education and the implementation of children's rights.

- To take the lead and coordinate with the Ministry of Finance to inspect and supervise the use of funds for the implementation of the Program to ensure compliance with its objectives and prescribed regulations; monitor the implementation of the Program's goals, regularly compile and report to the Prime Minister. Organize a mid-term review of the Program at the end of 2015 and a final assessment of the Program's implementation at the end of 2020.

2. The Ministry of Justice shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs and relevant agencies to develop and improve a child-friendly judicial system; guide and regularly inspect organizations providing legal aid to children; develop programs and projects related to children under their management; perform state management functions regarding adoption, registration of household records, nationality, and birth certificates for children; study and propose amendments and supplements to the Law on Marriage and Family; promote, disseminate, and educate about laws concerning the protection, care, and education of children.

3. The Ministry of Public Security shall take the lead and coordinate with ministries and sectors to publicize and implement preventive measures and combat acts of harm against children and juveniles who violate the law; develop programs and projects related to children under their management; establish emergency intervention mechanisms to prevent and promptly address cases of harm and violence against children; organize training to enhance the capacity of staff involved in prevention, intervention, investigation, and handling of acts of harm against children and juveniles who violate the law; direct the implementation of state management over residence to create conditions for children to exercise their rights at their place of residence; effectively implement the National Target Programs from 2012 to 2015 on crime prevention and suppression (approved by the Prime Minister under Decision No. 1217/QD-TTg dated September 6, 2012) and the Action Plan on Crime Prevention and Suppression of Human Trafficking from 2011 to 2015 (approved by the Prime Minister under Decision No. 1427/QD-TTg dated August 18, 2011).

4. The Ministry of Health shall take the lead and coordinate with ministries, sectors, and localities to publicize and implement targets related to nutrition and health care for children; develop programs and projects related to children under their management; develop nutrition and health care programs for children; direct the effective implementation of policies for medical examination and treatment for children under six years old, children in special circumstances, and children from poor households; restore functions for disabled children; pilot special types of healthcare services for children; effectively implement the National Nutrition Strategy from 2011 to 2020 and vision to 2030 (approved by the Prime Minister under Decision No. 226/QD-TTg dated February 22, 2012), the National Target Programs from 2012 to 2015 on population and family planning (approved by the Prime Minister under Decision No. 1199/QD-TTg dated August 31, 2012), health (approved by the Prime Minister under Decision No. 1208/QD-TTg dated September 4, 2012), and HIV/AIDS prevention and control (approved by the Prime Minister under Decision No. 1202/QD-TTg dated August 31, 2012); consolidate and strengthen the network of child health care services from central to grassroots levels.

5. The Ministry of Education and Training shall take the lead and coordinate with relevant ministries and sectors:

- Implement the Program's educational goals together with the implementation of the Education Development Strategy from 2011 to 2020 (approved by the Prime Minister under Decision No. 711/QD-TTg dated June 13, 2012), the National Target Program from 2012 to 2015 on education and training (approved by the Prime Minister under Decision No. 1210/QD-TTg dated September 5, 2012), and other programs and plans of the sector. Direct educational and training agencies at all levels to publicize and supplement content on children's rights and duties, civic responsibilities, and life skills in appropriate educational programs based on age groups.

- Continue to effectively implement Decree No. 82/2010/ND-CP dated July 15, 2010 of the Government on teaching and learning ethnic minority languages and scripts in general education schools and regular education centers; Decision No. 239/QD-TTg dated February 9, 2010 of the Prime Minister approving the Project on Universalizing Preschool Education for Five-Year-Old Children from 2010 to 2015; Decision No. 2123/QD-TTg dated November 22, 2010 of the Prime Minister approving the Project on Developing Education for Ethnic Minorities from 2010 to 2015; Decision No. 60/2011/QD-TTg dated October 26, 2011 of the Prime Minister on certain policies for preschool education development from 2011 to 2015.

6. The Ministry of Culture, Sports and Tourism shall take the lead and coordinate with relevant ministries and sectors to develop programs and projects related to children under their management; direct the implementation of the Program's cultural, recreational, and physical fitness goals for children; plan the network of cultural facilities and venues for children's recreation; direct, publicize, and guide the organization of cultural, artistic, recreational, sports, and tourism activities for children; effectively implement the Vietnam Family Development Strategy until 2020 and vision to 2030 (approved by the Prime Minister under Decision No. 629/QD-TTg dated May 29, 2012), the National Target Program from 2012 to 2015 on culture (approved by the Prime Minister under Decision No. 1211/QD-TTg dated September 5, 2012), and the Comprehensive Planning and Support Policies for Cultural Facilities for Children's Recreation from 2012 to 2015 and up to 2020 after approval.

7. The Ministry of Information and Communications shall direct news agencies and mass media organizations to develop programs and plans and allocate reasonable time slots, columns, and pages for promoting the implementation of children's rights and the Program; direct and guide mass media organizations to intensify and innovate activities to disseminate Party policies and State laws on protecting, caring for, and educating children and implementing children's rights; effectively implement the National Target Program for the period 2012-2015 on bringing information to grassroots, mountainous, remote, border, and island areas (approved by the Prime Minister under Decision No. 1212/QĐ-TTg dated September 5, 2012); inspect and audit activities, products, and means of communication intended for children and related to their protection, care, and education.

8. The Vietnam News Agency, Voice of Vietnam, Vietnam Television, and other mass media organizations shall enhance the quality and allocation of news items, articles, special features, airtime, and promotional periods suitable for channels, programs, and contents on protecting, caring for, and educating children and implementing children's rights.

9. The Ministry of Planning and Investment, in coordination with relevant ministries and sectors, shall direct and guide the incorporation of the Program's objectives into national and local socio-economic development plans and those of ministries and sectors.

10. The Ministry of Finance, in coordination with ministries, sectors, and localities, shall arrange funds for activities aimed at achieving the Program's objectives.

11. Relevant ministries and sectors, based on their assigned functions, tasks, and authorities, shall be responsible for incorporating the Program's objectives and contents into their annual and five-year work plans; direct and organize the implementation at all levels.

12. Provincial People's Committees shall develop local action programs for children, allocate funds, and direct competent local agencies to implement the Program; incorporate the Program's objectives and contents into local socio-economic development plans; inspect, audit, evaluate, and periodically review and summarize the implementation of the Program locally, and report to the Prime Minister and relevant ministries and sectors.

13. It is requested that the Vietnam Fatherland Front Central Committee, the Vietnam Women's Union Central Committee, the Ho Chi Minh Communist Youth Central Committee, and other affiliated organizations, the Vietnam Children's Rights Protection Association, within their respective functions and tasks, participate in implementing the Program:

- Launching the "All-People Protecting, Caring for, and Educating Children" movement with the goal of creating a safe, friendly, and healthy living environment for children, ensuring that all children have opportunities for comprehensive physical, intellectual, mental, and moral development. Intensifying propaganda and education efforts to raise awareness and skills regarding the protection, care, and education of children and the implementation of children's rights.

- Participating in formulating policies and laws on children's rights and the protection, care, and education of children.

- Participating in monitoring the implementation of laws and policies on the protection, care, and education of children.

- Conducting research and arranging members to serve as volunteers and assistants in the protection, care, and education of children at the grassroots level.

- Families, communities, schools, the Ho Chi Minh Communist Youth Union, and the Ho Chi Minh Young Pioneer Organization shall be responsible for providing all conditions for children to study, maintain health, play, entertain, and fully exercise their basic rights and fulfill their duties.

Article 3. This Decision takes effect from the date of issuance.

Article 4. The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Heads of related agencies and organizations, Chairmen of Provincial People's Committees directly under the Central Government shall be responsible for enforcing this Decision./.
