DECREE

Amending and supplementing certain Articles of Decree No. 27/2007/NĐ-CP
dated February 23, 2007 of the Government on electronic transactions
in financial activities

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Electronic Transactions dated November 29, 2005;

At the proposal of the Minister of Finance;

The Government promulgates this Decree amending and supplementing certain Articles of Decree No. 27/2007/NĐ-CP dated February 23, 2007 of the Government on electronic transactions in financial activities.

Article 1. Amending and supplementing Article 14 of Decree No. 27/2007/NĐ-CP dated February 23, 2007 of the Government on electronic transactions in financial activities as follows:

"Article 14. Use of digital signatures

1. Types of digital certificates used for signing in financial activities between organizations, individuals, and financial agencies: Digital certificates issued by public key infrastructure certificate authorities; digital certificates issued by specialized certificate authorities serving state agencies within the political system; foreign digital certificates recognized; foreign digital certificates accepted in Vietnam; foreign digital certificates accepted in international transactions.

Conditions, scope, and subjects using each type of digital certificate in financial activities must comply with the provisions of the law on digital signatures and certification services.

2. Financial agencies participating in electronic transactions bound by international treaties on digital signatures to which the Socialist Republic of Vietnam is a party shall implement such treaties.

3. The Ministry of Finance shall specify the mandatory use of digital signatures for electronic transactions in financial activities under its national management authority."

Article 2. Effective Date

1. This Decree takes effect from January 10, 2017.

2. Abolish the provisions at Clause 5, Article 3, Article 13, Point g and Point h Clause 1, Article 16 of Decree No. 27/2007/NĐ-CP.

3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees under the central government, relevant organizations, and individuals are responsible for implementing this Decree./.
