Regulations on commendation and emulation

at the construction site of the Lai Chau Hydropower Plant

Pursuant to the Law on Commendation and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward dated June 14, 2005;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Implementing Decision No. 819/QĐ-TTg dated June 7, 2010 of the Prime Minister approving the investment project for constructing the Lai Chau Hydropower Plant;

Implementing Decision No. 188/QĐ-TTg dated January 29, 2011 of the Prime Minister promulgating the management mechanism and implementation of the Lai Chau Hydropower Plant Project;

Implementing Circular No. 623/TTg-KTN dated May 10, 2012 of the Prime Minister regarding the reward mechanism for the emulation movement of the Lai Chau Hydropower Plant Project.

At the proposal of the Director of the Investment Department,

After reaching consensus with the Ministry of Industry and Trade, the Vietnam General Confederation of Labor, and the Vietnam Electricity Corporation, the Minister of Finance issues this Circular regulating commendation and emulation at the construction site of the Lai Chau Hydropower Plant as follows:

Part I

GENERAL PROVISIONS

Article 1. Scope and Applicability

Article 1. Scope of Application:

a) This Circular regulates commendation and emulation for the emulation movement of collaboration on the construction site of the Lai Chau Hydropower Plant (the construction project of the Lai Chau Hydropower Plant, with the Vietnam Electricity Corporation as the main investor), aiming to encourage and motivate material rewards for collectives and individuals who have outstanding achievements in the emulation movement of collaboration to accelerate the construction progress and put the project into operation according to the approved schedule or ahead of schedule.

b) In addition to the rewards stipulated in this Circular, the achievements of collectives and individuals in the emulation movement of collaboration on the construction site of the Lai Chau Hydropower Plant also serve as a basis for considering and recommending rewards in accordance with the Law on Commendation and Reward and guiding documents implementing the Law on Commendation and Reward.

Applicable to units, organizations, and individuals participating in the management and construction of the Lai Chau Hydropower Plant including:

a) Contractors participating in the construction, supply, and installation of equipment for the Lai Chau Hydropower Plant as specified in Document No. 958/TTg-KTN dated June 8, 2010 of the Prime Minister.

b) Main contractors performing consulting works for the Lai Chau Hydropower Plant.

c) The main investor of the Lai Chau Hydropower Plant, the Management Board of the Son La Hydropower Plant Project.

d) Units participating in security on the construction site of the Lai Chau Hydropower Plant.

e) Other units, organizations, and individuals related to the construction of the Lai Chau Hydropower Plant.

Article 2. Principles of Rewards, Sources of Reward Funds

1. Commendation and emulation shall be implemented when the project is completed according to or ahead of the annual construction progress milestones approved and ensuring quality; when collectives and individuals achieve outstanding results during the process of participating in the construction of the project.

2. Reward money and reward levels shall be implemented through the Commendation and Emulation Fund and must be publicly announced to workers on the construction site of the Lai Chau Hydropower Plant.

3. The source of funds for commendation and emulation shall be extracted from the 2% savings from designated bidding as per Circular No. 623/TTg-KTN dated May 10, 2012 of the Prime Minister.

Part II

SPECIFIC PROVISIONS

Article 3. Forms of Commendation and Emulation

1. Commendation based on the construction progress milestones approved for each phase.

2. Spontaneous commendation for outstanding collectives and individuals with particularly excellent achievements during the process of participating in the construction of the project.

Article 4. Timeframes for commendation and competition, launching, and summarizing the competition movement

1. Commendation timeframes;

a) The main milestones in the overall schedule of the Lai Chau Hydropower Project (construction project) approved by the competent authority as stipulated in Article 7 of Decision No. 188/QĐ-TTg dated January 29, 2011 of the Prime Minister on the issuance of management mechanisms and implementation of the Lai Chau Hydropower Project.

b) Detailed progress milestones approved annually by Vietnam Electricity Corporation and according to contracts signed between the Lai Chau Hydropower Plant Management Board and contractors (General Contractor and subcontractors).

2. Launching and summarizing the competition movement

a) Annually, based on the construction progress milestones approved, the General Confederation of Labor of Vietnam will take the lead in launching competition movements on the construction site, creating motivation for units to strive to complete the agreed competition targets committed among parties involved in building the Lai Chau Hydropower Plant.

b) At the end of each competition launch period, the Steering Committee for the Linked Construction Competition Movement of the Lai Chau Hydropower Plant (established pursuant to Decision No. 453/QĐ-TLĐ dated March 7, 2012 of the General Confederation of Labor of Vietnam) will conduct summaries, evaluations, and propose commendations for collectives and individuals with outstanding achievements.

Article 5. Authority to decide commendation and competition

The General Confederation of Labor of Vietnam will consider and decide on commendation and competition based on the proposal of the Steering Committee for the Linked Construction Competition Movement of the Lai Chau Hydropower Plant.

Article 6. Basis for determining commendation and competition

1. For construction contractors and equipment installers, it is the completion of progress milestones and agreed competition targets as committed, based on:

a) The General Contract for construction signed between the Lai Chau Hydropower Plant Management Board and the General Contractor.

b) The acceptance record of the Acceptance Committee.

c) The linked construction competition agreement for the Lai Chau Hydropower Plant.

2. For consulting contractors, it is the completion of implementation progress milestones and agreed competition targets as committed, based on:

a) The consulting service contract signed between the Lai Chau Hydropower Plant Management Board and the main design consultant.

b) The acceptance record of the consulting service.

c) The linked construction competition agreement for the Lai Chau Hydropower Plant.

3. For other units and individuals, it is:

a) The results of assigned tasks completed.

b) Active participation in competition movements launched by the Steering Committee for the Linked Construction Competition Movement of the Lai Chau Hydropower Plant.

4. For exceptional commendation, it is outstanding and sudden achievements of exemplary collectives and individuals contributing to accelerating the construction progress of the project.

Article 7. Content and amount of commendation and competition expenses

1. The content of commendation and competition expenses includes:

a) Expenses for organizing the launch ceremony, interim summary, final summary, and commendation ceremonies including venue rental; decoration; publicity (through banners, posters, slogans); embroidery of flags, printing of certificates of merit; other expenses serving meetings of the Steering Committee for the Linked Construction Competition Movement of the Lai Chau Hydropower Plant.

b) Commendation and competition expenses for units and individuals.

2. The total amount of commendation and competition expenses on the construction site of the Lai Chau Hydropower Plant shall not exceed 12 billion VND, averaging 2 billion VND per year, implemented from 2012 to 2017. Specific amounts for each organization of launch ceremonies, interim summaries, final summaries, and commendations at each milestone are decided by the General Confederation of Labor of Vietnam based on the proposal of the Steering Committee for the Linked Construction Competition Movement of the Lai Chau Hydropower Plant.

Article 8. Establishment and Management of the Commendation and Competition Fund

1. The Project Management Board of the Son La Hydropower Plant (representing the main investor of the Lai Chau Hydropower Plant) shall establish the Commendation and Competition Fund on the construction site of the Lai Chau Hydropower Plant; with an annual deduction rate of two billion VND from two percent savings from designated tender packages belonging to the Lai Chau Hydropower Plant transferred into the Commendation and Competition Fund.

2. The Project Management Board of the Son La Hydropower Plant shall open a separate account for the Commendation and Competition Fund at the place where the project payment account is opened and shall be responsible for organizing the management, accounting, and payment of commendation and competition funds according to regulations. Any remaining commendation and competition funds from the previous year that have not been used shall be carried over to the next year for continued use. After completing all works, if there are surplus funds in the Commendation and Competition Fund, the remaining commendation and competition funds shall be returned to the investment capital of the Vietnam Electricity Group.

Article 9. Payment and Final Settlement of Commendation and Competition Funds

1. The Project Management Board of the Son La Hydropower Plant shall implement payments for commendation and competition expenses according to the decision of the General Confederation of Labour of Vietnam; shall carry out final settlement of the commendation and competition budget for each year and total final settlement of the commendation and competition budget for all years, and submit them to the General Confederation of Labour of Vietnam for approval.

2. The approval time for the final settlement of the commendation and competition budget of the previous year shall be completed before January 31 of the following year. The completion of the total final settlement of the commendation and competition funds shall be completed no later than three months from the date of completion of all works.

Part III

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from November 15, 2012;

2. During implementation, if there are any difficulties, please promptly report to the Ministry of Finance for appropriate amendments and supplements./.
