Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Considering the proposal of the Director of the Department for Complaint Resolution, Inspection, and Region 1 Inspection and the Head of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1. Issued herewith along with this Decision "Regulations on the functions, tasks, powers, and organization and operation of the Department for Complaint Resolution, Inspection, and Region 1 Inspection".
Article 2. This Decision takes effect from the date of signing and replaces Decision No. 910/QĐ-TTNN dated August 6, 2003 of the State Inspector General regarding the issuance of the Regulation on the organization and operation of the Citizen Reception and Letter Handling Department.
Article 3. The Heads of the Office, the Cadre and Civil Servant Organization Department, the Department for Complaint Resolution, Inspection, and Region 1 Inspection (Department I), and the Heads of units under the Government Inspectorate shall be responsible for implementing this Decision./.

REGULATIONS
FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE DEPARTMENT FOR COMPLAINT RESOLUTION, INSPECTION AND REGION 1 INSPECTION

Chapter I.
FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES
Article 1. Position and Functions
The Department for Complaint Resolution, Inspection, and Region 1 Inspection (hereinafter referred to as Department I) is an entity under the Government Inspectorate, assisting the State Inspector General in managing state affairs concerning complaint resolution, inspection, and anti-corruption activities in Region 1, which includes 25 provinces and centrally-administered cities: Lai Châu, Điện Biên, Sơn La, Lào Cai, Yên Bái, Hà Giang, Tuyên Quang, Cao Bằng, Bắc Cạn, Thái Nguyên, Lạng Sơn, Phú Thọ, Bắc Ninh, Bắc Giang, Vĩnh Phúc, Hải Dương, Hưng Yên, Hải Phòng, Quảng Ninh, Hà Nội, Hòa Bình, Hà Nam, Nam Định, Thái Bình, Ninh Bình; it is responsible for performing its duties in complaint resolution, inspection, and anti-corruption within the assigned scope; managing and coordinating the reception of citizens at the Central Party and State Citizen Reception Office in Hanoi.
Department I has its headquarters in Hanoi and possesses its own seal.
Article 2. Tasks and Authorities
1. Implementing state management functions:
a) Taking the lead or participating in building proposals, strategies, programs, and annual plans, as well as other programs and plans related to inspection, complaint resolution, and anti-corruption activities of the Government Inspectorate;
b) Cooperating with Departments, Units under the Government Inspectorate to build and submit to the State Inspector General legal documents on inspection, complaint resolution, citizen reception;
c) Assisting the State Inspector General in guiding the provinces and centrally-administered cities in Region 1 to develop and implement inspection programs and plans; directing and guiding professional and technical work in inspection, complaint resolution, and citizen reception for provincial inspectors in the region;
d) Assisting the State Inspector General in urging the Chairpersons of People's Committees of provinces and centrally-administered cities in Region 1 to conduct inspections of cases within their jurisdiction; resolving issues not agreed upon between the Heads of Inspectors of provinces and centrally-administered cities in Region 1 and the Chairpersons of People's Committees at the same level regarding inspection, complaint resolution, and citizen reception;
đ) Advising the State Inspector General to examine and recommend the Prime Minister to suspend or revoke regulations issued by People's Committees and their Chairpersons in Region 1 that contravene national laws, decrees, and regulations of the State Inspector General on inspection, complaint resolution, and citizen reception;
e) Assisting the State Inspector General in inspecting and checking the responsibility of the Chairpersons of People's Committees of provinces and centrally-administered cities in Region 1 in implementing laws on inspection, complaint resolution;
f) Cooperating with provincial inspectors in Region 1 to monitor the situation of inspection, complaint resolution, and promptly propose solutions to the State Inspector General when there are signs of complex issues arising;
g) Cooperating with the Legal Affairs Department to provide opinions on draft laws initiated by the Government Inspectorate or other ministries and sectors;
h) Summarizing practical experience; participating in theoretical and professional research, proposing amendments and supplements to improve mechanisms, policies, and laws on inspection, complaint resolution, and citizen reception.
2. Directly conducting inspections and resolving complaints and reports:
a) Implementing the annual inspection plan after approval by the State Inspector General; directly conducting inspections of the implementation of policies, laws, and tasks of the Chairpersons of People's Committees of provinces and centrally-administered cities in Region 1 according to the plan or other inspections assigned by the State Inspector General;
b) Assisting the State Inspector General in verifying and resolving complaints and reports arising in Region 1 in accordance with the law;
c) Organizing, monitoring, and inspecting the activities of inspection teams and complaint resolution teams led by the Department or its staff;
d) Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on inspection, complaint resolution, and report handling by the Government Inspectorate and the Prime Minister in the assigned area.
3. Regarding citizen reception:
a) Leading the coordination with relevant agencies in receiving citizens who come to complain, report, suggest, or reflect issues at the Central Party and State Citizen Reception Office in Hanoi; preparing necessary conditions, contents, and scheduling regular or urgent meetings for leaders of the Government Inspectorate; implementing responsibilities as stipulated in Article 10 of the Regulation on Citizen Reception issued together with Decree No. 89/CP dated August 7, 1997 of the Government;
b) Closely cooperating with leaders of ministries, sectors, provinces, and centrally-administered cities, and units under the Government Inspectorate to receive citizens when necessary at the Central Party and State Citizen Reception Office in Hanoi;
c) Receiving citizens for complaints, denunciations, reflections, and suggestions; guiding citizens to exercise their rights and fulfill their obligations in making complaints and denunciations in accordance with the law; proposing solutions to the General Inspector for complex issues arising during citizen reception; coordinating with the Office of the Government Inspector General to handle letters and documents within the jurisdiction of the General Inspector.
d) Monitoring, statistics, and reporting to the General Inspector on the results of citizen reception.
đ) During the process of receiving citizens at the Citizen Reception Office of the Party and State in Hanoi, the Bureau may use the seal of the Citizen Reception Office to guide citizens on exercising their rights and fulfilling their obligations in making complaints and denunciations in accordance with the law.
4. Implement administrative reform tasks, international cooperation, and scientific research as assigned by the General Inspector.
5. Summarizing and reporting to the Government Inspector General on the results of inspection work, complaint resolution, denunciation handling, and other tasks within its functional responsibilities as prescribed by the Government Inspector General.
6. Managing staff, civil servants, files, documents, assets, and seals assigned according to the law and regulations of the General Inspector.
7. Performing other tasks assigned by the General Inspector.
Article 3. Principles of Operation
1. The Bureau I operates under a chief system, ensuring the principle of democratic centralism, transparency, and openness as stipulated by law; emphasizing individual responsibility and discipline, promoting the capabilities, strengths, initiative, and creativity of all civil servants in their work, and enhancing the effectiveness of the Bureau's activities.
2. Civil servants of the Bureau must also comply with the "Regulations on the Organization and Operation of Inspection Teams" when participating in inspection teams, complaint resolution, and denunciation handling, as issued by the General Inspector.
Chapter II.
ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING
Article 4. Organizational Structure and Staffing
1. The organizational structure of Bureau I includes:
a) Bureau leadership consisting of a Director and Deputy Directors.
b) Units directly under the Bureau include:
+ Comprehensive Department;
+ Citizen Reception Department;
+ Complaint Resolution and Denunciation Handling and Inspection 1 Department;
+ Complaint Resolution and Denunciation Handling and Inspection 2 Department.
2. The duties and powers of each department shall be defined by the Director of Bureau I.
3. The staffing of the Bureau shall be decided by the General Inspector based on the proposal of the Head of the Cadre and Civil Servant Organization Department and the Director of Bureau I.
Article 5. Responsibilities and Scope of Work of the Bureau Director
1. Leading, directing, and organizing the implementation of the Bureau's tasks as stipulated in Article 2 of this Regulation and other tasks assigned by the Government Inspector General leadership; being responsible before the law and the General Inspector for the results of the assigned tasks.
2. Assigning and supervising the implementation of tasks by Deputy Directors, units directly under the Bureau, and civil servants within the Bureau.
3. Directing the drafting of outlines and plans for inspections, complaint resolution, and denunciation handling; coordinating with the Head of the Cadre and Civil Servant Organization Department to arrange personnel for inspection teams and complaint resolution and denunciation handling teams organized by the Bureau; personally serving as the Team Leader for large-scale inspections with complex contents upon assignment by the General Inspector.
4. Supervising and inspecting the activities of inspection teams assigned to the Bureau to ensure compliance with approved plans and schedules; participating in the preparation of reports and inspection conclusions for teams led by Bureau staff before submitting them to the General Inspector.
5. Being entrusted by the General Inspector to oversee the Central Party and State Citizen Reception Office in Hanoi.
6. Cooperating with heads of other units under the Government Inspector General to address issues related to the Bureau's functions and tasks and to perform common tasks of the agency as prescribed in the Working Regulations of the Government Inspector General.
7. Managing Bureau staff in accordance with the law and the delegation of the General Inspector; maintaining work discipline, managing, evaluating, and implementing commendation and reward systems, policies, and benefits for Bureau staff; developing and implementing cadre planning, training, and development programs for Bureau staff.
8. Being responsible for the management and use of the Bureau's seal and the Central Party and State Citizen Reception Office seal in Hanoi; managing and using assets effectively.
9. Fulfilling tasks delegated by the General Inspector to resolve; signing on behalf of the General Inspector for certain documents within his authority as prescribed in the Working Regulations of the Government Inspector General. Signing documents: introducing and appointing working groups to survey and grasp situations in areas 1, relevant agencies, and organizations to serve the construction of inspection programs and plans; supervising and urging the implementation of inspection conclusions; exchanging professional knowledge with local inspectors in area 1; internal management and operation documents of the Bureau.
10. Implementing information and reporting systems as prescribed by the Government Inspector General. Reporting promptly to the Government Inspector General leadership on the results of task performance and proposing issues requiring resolution, mechanisms, programs, and plans needing revision and supplementation to meet the requirements of the Government Inspector General.
11. Performing other tasks assigned by the General Inspector.
Article 6. Responsibilities and Scope of Work for Deputy Director
1. Assist the Director in managing and directing the work of the Bureau; directly manage and oversee certain localities and fields of work as assigned by the Director. When necessary, a Deputy Director may be authorized by the Director to direct the activities of the Bureau.
2. Carry out tasks and powers within the scope assigned and delegated by the Director. Implement reporting procedures to the Director on the situation and results of assigned tasks.
3. Assist the Director in monitoring, urging, and inspecting the activities of inspection and complaint resolution teams when assigned by the Director. Directly serve as the Head of Inspection Team when appointed by the Chief Inspector.
4. Personally bear responsibility before the Director, leadership of the Government Inspectorate, and the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned work.
5. Sign on behalf of the Director for documents assigned and delegated by the Director.
Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department
1. The Department Head is the person directly leading, directing, managing, and overseeing the activities of the Department and bears responsibility before the Director and the law for all activities of the Department and the execution of assigned tasks.
2. The Deputy Department Head assists the Department Head and bears responsibility before the Department Head, Bureau leadership, and the law for the field of work assigned; implements other tasks directly assigned by Bureau leadership. When necessary, may be authorized by the Department Head to direct the activities of the Department.
3. Specific duties and powers of the Department Heads under Bureau I shall be stipulated by the Director.
Article 8. Responsibilities and Scope of Work for Staff Members of Bureau I
1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.
2. Proactively study and advise on the specialized field assigned; handle assigned work according to prescribed procedures, formalities, and deadlines. Timely report to the immediate supervisor when encountering difficulties or new issues arising during task execution.
3. Adhere to speaking discipline, Code of Conduct for Inspectors, Working Regulations, Office Culture Rules of the Government Inspectorate, and other regulations concerning staff members; implement reporting systems and file management procedures as stipulated by the Government Inspectorate. Bear personal responsibility before the Department Head, Director, and the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned work.
4. Staff members of Bureau I assigned to lead inspection and verification teams have the responsibility to direct, monitor, urge, and inspect the activities of team members; report to the Director on the progress and results of inspections; regularly inform the Department Head about the management of staff participating in inspection and verification teams.
Chapter III.
WORK RELATIONSHIPS
Article 9. Implementing the directives of the Government Inspectorate's leadership
The Bureau is subject to leadership and direction from the Chief Inspector, Deputy Chief Inspectors; has the responsibility to strictly fulfill assigned tasks, promptly report to the leadership of the Government Inspectorate on the results of task execution as prescribed; when necessary, propose recommendations to the leadership of the Government Inspectorate on issues needing resolution during task execution.
Article 10. Quan Relations with Units under the Government Inspectorate
1. Relations between Bureau I and Departments, Bureaus, and units under the Government Inspectorate are cooperative, exchange, and mutual support to complete tasks.
2. Cooperation with other Departments, Bureaus, and units during task execution shall be carried out in accordance with the Working Regulations of the Government Inspectorate issued by the Chief Inspector.
3. Bureau I leads cooperation with Departments, Bureaus, and units tasked with joint reception, dialogue, and citizen responses at the Central Party and State Citizen Reception Office in Hanoi and reports results to the leadership of the Government Inspectorate.
Article 11. Relations with Provincial Inspectorates under Central Cities in Region 1
1. Regularly inspect, urge, guide, and grasp the implementation of work programs of provincial inspectorates under central cities in Region 1; periodically every quarter, proactively work with inspection agencies within the management area to fully understand general activities and specific inspection, complaint resolution activities; in case of emergencies, there must be a specific document requesting a meeting.
2. Timely report and reflect to the Chief Inspector or Deputy Chief Inspector in charge about the requests and recommendations of provincial inspectorates under central cities in Region 1 for the leadership of the Government Inspectorate to consider and resolve.
Article 12. Relations between the Cục Leadership and the Party Committee and Leadership of Mass Organizations within the Cục
1. The Cục leadership creates conditions for the Party organization and mass organizations to operate in accordance with their charters, purposes, and objectives; cooperate with the Party committee and leadership of mass organizations to create conditions for Party members, officials, and civil servants in the Cục to study and improve their political and professional qualifications; ensure democratic regulations in the operation of the agency, build a workplace culture, and administrative discipline.
2. The Cục leadership is responsible for providing full and timely information on the activities and rights of officials and civil servants to the Party committee and leadership of mass organizations; seek opinions from the Party committee and leadership of mass organizations before deciding on issues related to methods of leading political education, internal protection, strengthening unity, caring for the lives of officials and civil servants in the Cục; regarding organizational and personnel work in the Cục.
Chapter IV.
IMPLEMENTATION
Article 13. Responsibility for Implementation
1. The Director, Deputy Directors, Heads, Deputy Heads of all officials and civil servants of Cục I are responsible for implementing this Regulation.
2. Any other contents related to the functions, tasks, powers, and operational activities of the Cục that are not covered in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws and regulations on inspections, complaints, and denunciations.
3. Based on current regulations and this Regulation, the Director of Cục I is responsible for drafting and promulgating the Working Regulations of his unit to fulfill assigned functions and tasks.
Article 14. Amendment and Supplement to this Regulation
During the implementation of this Regulation, if any difficulties arise, the Director of Cục I will coordinate with the Director of the Cadre and Civil Servant Organization Department to promptly propose amendments and supplements to the Chief Inspector to ensure that this Regulation meets the requirements of the work of Cục I and the Government Inspectorate./.
