On the selling price of gasoline and diesel
THE MINISTER OF TRADE
Pursuant to the Government Decree No. 29/2004/NĐ-CP dated January 16, 2004, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;
Pursuant to Decision No. 187/2003/QĐ-TTg dated September 15, 2003, of the Prime Minister on the issuance of the Management Regulation for Gasoline and Diesel Business;
Pursuant to the conclusion of the Prime Minister in Official Letter No. 162/TB-VPCP dated August 19, 2004, of the Government Office on measures to stabilize the gasoline and diesel, construction steel, fertilizer markets, and Official Document No. 1447/CP-KTTH dated October 4, 2004, of the Prime Minister on managing the gasoline and diesel, fertilizer business; after reaching consensus with the Ministry of Finance;
DECISION:
Article 1. Permitting enterprises engaged in the importation of gasoline and diesel at the wholesale level to add VND 500 per liter for each type of gasoline compared to the guiding price set forth in Decision No. 56/2004/QĐ-BTC dated June 18, 2004, of the Minister of Finance on adjusting the guiding selling price of gasoline and diesel in 2004; the new retail price (including VAT at actual temperature) shall be uniformly stipulated throughout the country for each type of gasoline and diesel, specifically as follows:
- Unleaded gasoline RON 92: VND 7,500 per liter,
- Unleaded gasoline RON 90: VND 7,300 per liter,
- Unleaded gasoline RON 83: VND 7,100 per liter,
- For other types of gasoline, the enterprise engaged in the importation of gasoline and diesel at the wholesale level shall determine the price based on the actual selling price of standard types of gasoline on the same market and the quality difference compared to the aforementioned types of gasoline and diesel.
Article 2. Place of sale:
- Wholesale: goods are delivered at the provincial or municipal central warehouse on the buyer's means of transport
- Retail: goods are sold at gas stations and retail agency stores in provinces and cities on the buyer's means of transport.
Article 3. Responsibilities of ministries, sectors, localities, and production and business units:
- In accordance with the Prime Minister's directive, although various types of gasoline are permitted to have a price range (adding VND 500 per liter), products such as electricity, coal, cement must not increase their selling prices.
- Enterprises engaged in the importation of gasoline and diesel at the wholesale level: inventory the quantity of each type of gasoline according to current regulations before implementing the price range to ensure that negative practices do not occur and to maintain smooth business operations. They must jointly bear legal responsibility for the actions of member enterprises and distribution systems under their management that violate gasoline selling prices.
- Provincial and municipal Departments of Commerce shall cooperate with the Department of Finance to monitor the implementation of gasoline and diesel selling prices in their locality, promptly identify any violations, and handle them within their authority as prescribed by law, or report to competent authorities for handling.
Article 4. This Decision takes effect from 19:00 hours on November 1, 2004. All previous pricing decisions inconsistent with this Decision are hereby abolished./.
