Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Considering the proposal of the Director of the Anti-Corruption Bureau and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Issuing together with this Decision the "Regulations on the Functions, Tasks, Powers, and Organization and Activities of the Anti-Corruption Bureau."

Article 2. This Decision takes effect from the date of issuance and replaces Decision No. 2222/2006/QĐ-TTCP dated November 23, 2006 of the Chief Inspector regarding the regulations on the functions, tasks, powers, and organizational structure of the Anti-Corruption Bureau, and Decision No. 2353/QĐ-TTCP dated October 31, 2007 of the Chief Inspector regarding the establishment of the Anti-Corruption Data Management Office.

Article 3. The Heads of the Office, the Head of the Cadre and Civil Servant Organization Department, the Director of the Anti-Corruption Bureau, and the Heads of units under the Government Inspectorate shall implement this Decision.

REGULATIONS

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND ACTIVITIES OF THE ANTI-CORRUPTION BUREAU

Chapter I.

FUNCTIONS, TASKS, POWERS, PRINCIPLES OF OPERATION

Article 1. Position and Functions

The Anti-Corruption Bureau (hereinafter referred to as Bureau IV) is an entity under the Government Inspectorate, having the function of assisting the Chief Inspector in managing state administrative work on anti-corruption; performing inspection and anti-corruption tasks within the authority of the Government Inspectorate.

The Bureau has its own seal; its main office is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. The Bureau assists the Chief Inspector in carrying out state management tasks:

a) Drafting and submitting to the Prime Minister proposals, strategies, programs, and annual plans for long-term and five-year periods on anti-corruption work;

b) Directing, guiding, inspecting, and organizing the implementation of legal normative documents, proposals, strategies, programs, and plans that have been approved concerning anti-corruption work;

c) Organizing, directing, and guiding inspections and audits of the responsibilities of ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees, and centrally-administered city people's committees in implementing laws on anti-corruption.

2. Receiving, collecting, processing complaints and information reflecting corruption cases; managing the common database and anti-corruption portal according to the regulations of the Government Inspectorate.

3. Inspecting corruption cases within the jurisdiction of the Government Inspectorate; monitoring, inspecting, and urging the implementation of inspection conclusions, recommendations, and post-inspection decisions, and other cases primarily handled by the Bureau.

4. Organizing, monitoring, and inspecting the activities of inspection teams led by the Bureau or by Bureau staff serving as team leaders; compiling results and drafting comprehensive reports on wide-scale inspections assigned.

5. Summarizing and reporting on the results of anti-corruption work; conducting mid-term and final reviews, drawing lessons learned from anti-corruption work.

6. Implementing administrative reform tasks, international cooperation, and scientific research as assigned by the Chief Inspector.

Article 3. Principles of Operation

1. The Anti-Corruption Bureau operates under the head system, ensuring democratic centralism, transparency, and openness in accordance with the law; emphasizing individual responsibility and discipline, promoting the strengths and initiative of cadres and civil servants, and enhancing efficiency in Bureau operations.

2. When participating in inspection teams, Bureau cadres and civil servants must also comply with the "Regulations on the Organization and Operation of Inspection Teams" issued by the Chief Inspector.

Chapter II.

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, SCOPE OF WORK RESOLUTION

Article 4. Organizational Structure and Staffing

1. The organizational structure of the Bureau includes:

a) The leadership of the Bureau consists of the Director and Deputy Directors.

b) Units under the Bureau:

+ General Affairs Office;

+ Anti-Corruption Inspection Office for Region 1 and Sectoral Economy (referred to as Office I);

+ Anti-Corruption Inspection Office for Region 2 and Internal Affairs, Comprehensive Economy (referred to as Office II);

+ Anti-Corruption Inspection Office for Region 3 and Cultural, Social Sectors (referred to as Office III).

2. The tasks and authorities of the offices shall be defined by the Director.

3. The staffing of the Anti-Corruption Bureau shall be decided by the Chief Inspector based on the proposal of the Director of the Anti-Corruption Bureau and the Head of the Cadres and Civil Servants Organization Department.

Article 5. Responsibilities and Scope of Work of the Director

1. Lead, direct, and organize the implementation of the tasks of the Bureau as stipulated in Article 2 of this Regulation; bear responsibility before the law and the Chief Inspector for the results of the assigned work.

2. Assign tasks, coordinate activities, and monitor the performance of Deputy Directors, subordinate offices, and civil servants within the Bureau.

3. Direct the drafting of inspection plans and proposals for the allocation of staff to inspection teams upon consultation with the Head of the Cadres and Civil Servants Organization Department; personally serve as the head of inspection teams for large-scale, complex inspections when assigned by the Chief Inspector.

4. Assist the Chief Inspector in overseeing, urging, and inspecting the activities of inspection and audit teams assigned to the Bureau to ensure compliance with approved schedules and progress; participate in the preparation of reports and conclusions for inspection and audit teams led by Bureau staff or by civil servants from the Bureau serving as team leaders.

5. Carry out tasks delegated by the Chief Inspector; sign on behalf of the Chief Inspector for certain documents within the Chief Inspector's authority as prescribed in the Government Inspectorate's Working Regulations.

6. The Director may issue documents introducing, appointing working groups to survey and understand situations at ministries, sectors, localities, and related agencies to support the development of inspection programs and plans; urge the implementation of inspection conclusions; provide professional guidance and exchange with sectoral and local inspectorates; sign internal management and operation documents of the Bureau.

7. Bear responsibility for the management and use of the Bureau's seal; manage cadres and civil servants, assets allocated according to laws and the Chief Inspector's delegation; maintain discipline, evaluate, and implement commendation and reward systems for Bureau staff; develop and implement cadre planning and training programs for Bureau staff.

8. Coordinate with department heads, bureau directors, and unit chiefs under the Government Inspectorate to handle issues related to the Bureau's functions and tasks, and perform common agency tasks as prescribed in the Government Inspectorate's Working Regulations.

9. Fully comply with information and reporting requirements as stipulated by the Government Inspectorate; promptly report to the Government Inspectorate leadership on the results of assigned tasks and propose issues requiring resolution, mechanisms, policies, programs, and plans that need adjustment to meet the Government Inspectorate's and government's requirements.

10. Perform other tasks assigned by the Chief Inspector.

Article 6. Responsibilities and Scope of Work of Deputy Directors

1. Deputy Directors assist the Director in managing and directing certain areas of work as assigned by the Director; bear responsibility before the law, the Chief Inspector, and the Director for the results of the assigned work. When necessary, a Deputy Director may be authorized by the Director to oversee Bureau operations.

2. Carry out tasks and exercise powers within the scope assigned and delegated by the Director.

3. Report to the Director on the situation and results of assigned tasks and powers.

4. Assist the Director in overseeing, urging, and inspecting the activities of inspection and audit teams assigned to the Bureau when tasked by the Director; personally serve as the head of inspection and audit teams when assigned by the Chief Inspector.

5. Sign on behalf of the Director for documents assigned and delegated by the Director; bear personal responsibility before the Director, Government Inspectorate leadership, and the law for proposed opinions, progress, quality, and effectiveness of assigned tasks; for the content, form, procedure, and process of issuing documents and handling assigned work within the delegated area.

Article 7. Responsibilities and Scope of Work of Office Heads and Deputy Office Heads

1. The Office Head directly leads, directs, manages, and oversees office activities and bears responsibility before the Director and the law for all office activities and the completion of assigned tasks.

2. Deputy Office Heads assist the Office Head and bear responsibility before the Office Head, Bureau leadership, and the law for the assigned field of work; carry out other tasks directly assigned by Bureau leadership. When necessary, they may be authorized by the Office Head to oversee office activities.

3. Specific duties and authorities of Office Heads and Deputy Office Heads in the Bureau IV shall be defined by the Director.

Article 8. Responsibilities and scope of work for professional and specialized civil servants

1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Anti-Corruption Department.

2. Proactively study and advise on the assigned professional field; handle assigned tasks according to prescribed procedures, formalities, and deadlines. Report promptly to the direct supervisor when encountering difficulties or new issues arising during task execution.

3. Adhere to speech discipline, conduct rules for civil servants in the Inspectorate sector, internal work regulations, office culture rules of the Government Inspectorate, and other regulations concerning civil servants; implement reporting systems and file management as prescribed. Bear personal responsibility for proposed opinions, progress, quality, effectiveness of task implementation, content, form, format, procedure, and formalities of issued documents and assigned task resolution processes.

4. Civil servants assigned as heads of inspection teams by the Department shall be responsible for directing, monitoring, urging, and inspecting the activities of team members under their leadership; report to the Director of the Department on inspection progress and results; regularly inform the Head of the Department about the situation of civil servants from their department participating in inspection teams.

Chapter III.

WORK RELATIONSHIPS

Article 9. Implementation of Leadership Directives of the Government Inspectorate

The Anti-Corruption Department is subject to the leadership and directives of the Chief Inspector and Deputy Chief Inspectors authorized by the Chief Inspector; it is responsible for strictly implementing assigned tasks and reporting to the Leadership of the Government Inspectorate on the results of its work as prescribed.

Article 10. Relations with Departments and Units under the Government Inspectorate

Relations between the Department and other units under the Government Inspectorate are cooperative, exchange-based, and supportive to complete tasks and operate under centralized and unified leadership of the Government Inspectorate's Leadership; implemented in accordance with the Working Regulations of the Government Inspectorate.

Article 11. Relationship with Sectoral, Ministry, and Local Inspectors

1. Regularly monitor, urge, guide, and grasp the anti-corruption efforts of ministry-level inspectorates, sectoral inspectorates, and local inspectorates.

2. Timely reflect the requirements and recommendations of ministry-level inspectorates, sectoral inspectorates, and local inspectorates regarding anti-corruption efforts for the Government Inspectorate's Leadership to consider and resolve.

Article 12. Relations with specialized anti-corruption units

Relations between the Department and the Criminal Police Investigation Bureau for Corruption Crimes under the Ministry of Public Security, the Prosecution and Supervision of Corruption Cases Unit under the Supreme People's Procuracy, and units under the Office of the Central Steering Committee for Preventing and Combating Corruption are based on the Cooperation Regulations between the Government Inspectorate and the Ministry of Public Security, the Supreme People's Procuracy, and the Office of the Central Steering Committee for Preventing and Combating Corruption, as well as the directives of the Government Inspectorate's Leadership, adhering to principles of close cooperation, proactivity, and creating the best conditions for specialized units to perform their duties and responsibilities as prescribed by law.

Article 13. Work relations between the Leadership of the Bureau and the Party Branch and mass organizations within the Bureau

1. The Bureau Leadership shall create conditions for the Party organization and mass organizations to operate in accordance with their Statutes, purposes, and objectives; coordinate with the Party Branch to create conditions for Party members, officials, and civil servants in the Bureau to study and improve their political, professional, and vocational levels, work effectively and at high quality, ensure democratic regulations in agency activities, build civilized workplace habits, and enforce administrative discipline.

2. The Bureau Leadership shall be responsible for providing full and timely information on the Bureau's activities and the legitimate rights of officials and civil servants to assist the Party Committee, the Leadership of mass organizations in educating political ideology, protecting internal affairs, strengthening unity, caring for the living standards of officials and civil servants, and implementing personnel policies and organizational work of the Bureau.

Chapter IV.

IMPLEMENTATION

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

1. The Director, Deputy Directors, Heads of Departments, Deputy Heads of Departments, and all officials and civil servants of the Anti-Corruption Bureau shall be responsible for implementing this Regulation. The Director of the Anti-Corruption Bureau shall be responsible for disseminating this Regulation to all officials and civil servants under the Bureau to organize its implementation.

2. Any other contents related to the functions, tasks, powers, and organization of the Bureau that are not covered in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws and legal documents regarding inspection, complaints, denunciations, and anti-corruption.

3. Based on current regulations and this Regulation, the Director of the Anti-Corruption Bureau shall be responsible for drafting and promulgating the Working Regulations of his unit to fulfill assigned functions and tasks.

Article 15. Amendment and Supplement to the Regulation

The Director of the Anti-Corruption Bureau and the Head of the Cadre and Civil Servant Organization Department shall be responsible for monitoring, inspecting, and urging the implementation of this Regulation; compiling opinions and promptly researching proposals for supplementing and amending the Regulation in accordance with the requirements of the Bureau and the Government Inspectorate./.
