THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Planning-Finance Department.

Article 1: The Planning-Finance Department is the advisory body assisting the Minister in performing state management functions over planning, finance, accounting, statistics, pricing, tariffs, fees, investment construction, and specialized economic management in the fields of postal services, telecommunications, information technology, electronics, Internet, broadcasting, radio frequency, and information infrastructure (hereinafter referred to collectively as postal services, telecommunications, and information technology).

Article 2: The Planning-Finance Department has the following tasks and powers:

1. To take the lead in drafting or participating in drafting mechanisms, policies, regulatory documents on planning, finance, accounting, statistics, pricing, tariffs, fees, and specialized investment construction in the fields of postal services, telecommunications, and information technology for submission to the Minister or competent authority for issuance; to guide and inspect implementation.

2. To guide the development, implementation, and appraisal of strategic plans, master plans, plans, and development projects in the fields of postal services, telecommunications, and information technology of the Ministry; to organize, guide, and inspect implementation after approval.

3. To appraise the sections related to postal services, telecommunications, and information technology in the master plans of ministries, sectors, provinces, cities, territories, and related enterprises.

4. To perform tasks related to foreign economic management, attracting foreign capital, and investing abroad.

5. To draft, organize the drafting, appraise, and submit to the Minister or competent authority for issuance prices and tariffs for postal, telecommunication, and information technology services and products.

6. To draft incentive mechanisms and subsidies for postal and telecommunication enterprises participating in universal service provision, serving the Party, State, national security, and defense.

7. To organize and participate with relevant sectors in drafting regulations, lists, and managing fees, taxes on production, business, export, and import activities in the fields of postal services, telecommunications, and information technology.

8. To implement financial management, accounting, budget preparation, execution, and settlement of the State Budget and other sources of funds and funds according to the provisions of the law.

9. To perform functions of reporting, statistics, compiling annual reports, and establishing databases on economic information in the fields of postal services, telecommunications, and information technology.

10. To monitor and evaluate the effectiveness of economic operations, investments, and contributions to society of postal, telecommunication, and information technology enterprises.

11. To perform tasks and powers of representing the State's ownership interest in enterprises with State capital in the fields of postal services, telecommunications, and information technology.

12. To coordinate research and implementation of corporate restructuring in the fields of postal services, telecommunications, and information technology.

13. To study and build economic mechanisms for public service organizations in the fields of postal services, telecommunications, and information technology according to the provisions of the law and direct their implementation; to manage and direct the activities of affiliated organizations under the Ministry.

14. To coordinate in implementing public financial management within the overall program of administrative reform of the Ministry according to the goals and content of administrative reform approved by the Prime Minister.

15. To perform state management over specialized investment construction in the fields of postal services, telecommunications, and information technology within the Ministry's jurisdiction.

16. To take the lead in appraising domestic investment projects, foreign investment projects, and overseas investment projects in the fields of postal services, telecommunications, and information technology of ministries and enterprises according to the provisions of the law.

17. To organize the drafting and appraisal of economic and technical norms (excluding labor norms) and basic construction unit prices in the fields of postal services, telecommunications, and information technology.

18. To perform management over investment appraisal and operating conditions of postal, telecommunication, and information technology enterprises.

19. To manage the integration of national defense and security with the economy.

20. To participate in researching and providing comments on draft regulatory documents of other ministries and sectors within the Department's management scope.

21. To manage State assets under the Ministry's control. To manage land and buildings under investment construction projects of the Ministry.

22. To manage cadres, civil servants, assets, files, and documents according to the provisions of the law and the delegation of the Minister.

23. To perform other tasks assigned by the Minister.

Article 3: The Planning-Finance Department is headed by the Director, assisted by Deputy Directors and professional staff.

The Director is responsible to the Minister for the results of performing the functions, tasks, and powers stipulated in Article 1 and Article 2 of this Decision.

Deputy Directors are responsible for assisting the Director in directing and managing all aspects of the Department's work and are accountable to the Director for assigned tasks.

The tasks and powers of professional staff in the Department are defined by the Director.

Article 4: This Decision takes effect from the date of signature. All previous provisions contrary to this Decision are abolished.

Article 5: The Director of the Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Planning-Finance Department, and the Heads of subordinate agencies and units of the Ministry are responsible for implementing this Decision.
