Guidelines for Implementing Decree No. 168/2004/NĐ-CP dated September 20, 2004 of the Government
amending and supplementing certain articles of Decree No. 07/2000/NĐ-CP dated March 9, 2000
of the Government on social assistance policies

Pursuant to Decree No. 168/2004/NĐ-CP dated September 20, 2004 of the Government amending and supplementing certain articles of Decree No. 07/2000/NĐ-CP dated March 9, 2000 of the Government on social assistance policies; the Ministry of Labor, Invalids and Social Affairs hereby issues guidelines for implementing this Decree as follows:
1. Children residing at state-run social welfare institutions, who have been diagnosed as HIV/AIDS positive by a competent health authority (as stipulated in Decision No. 3052/2000/QĐ-BYT dated August 29, 2000 of the Minister of Health on issuing standards for laboratories authorized to confirm HIV-positive cases), shall be entitled to the lowest subsistence allowance level, which is equivalent to the amount prescribed in Clause 2, Article 2 of Decree No. 168/2004/NĐ-CP dated September 20, 2004 of the Government on social assistance policies.
2. The process of reviewing, accepting children infected with HIV/AIDS into social welfare institutions shall be carried out in accordance with Circular No. 18/2000/TT-BLĐTBXH dated July 28, 2000 of the Ministry of Labor, Invalids and Social Affairs guiding the implementation of certain articles of Decree No. 07/2000/NĐ-CP dated March 9, 2000 of the Government on social assistance policies.
3. Subjects specified in Clauses 1, 2, and 3 of Article 2 of Decree No. 168/2004/NĐ-CP dated September 20, 2004 of the Government shall be issued health insurance cards and provided medical examination and treatment in accordance with Decree No. 58/1998/NĐ-CP dated August 13, 1998 of the Government on issuing the Health Insurance Regulations and Circular No. 17/1998/TT-BYT dated December 19, 1998 of the Ministry of Health on guiding the implementation of medical examination and treatment, the use of the Medical Examination and Treatment Fund, and the settlement of medical examination and treatment costs under health insurance.
4. Model No. 04/LĐTB&XH-BTXH (Decision of the People's Committee of Districts, Counties, and Towns on receiving regular social assistance allowances at communes, wards, and towns) promulgated by Circular No. 18/2000/TT-BLĐTBXH dated July 28, 2000 shall be replaced by Model No. 04/LĐ-TBXH-BTXH attached hereto (Decision of the Chairman of the People's Committee of Districts, Counties, and Towns on receiving regular social assistance allowances at communes, wards, and towns).
5. This Circular shall take effect from January 1, 2005.
Any difficulties encountered during implementation should be promptly reported to the Ministry of Labor, Invalids and Social Affairs for study and resolution./.
