DECREE OF THE GOVERNMENT
Amending and supplementing some articles of Government Decree No. 07/2000/NĐ-CP
dated March 9, 2000 on social assistance policies
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the State Budget Law dated December 16, 2002;
Pursuant to the Ordinance on the Elderly dated April 28, 2000;
Pursuant to the Ordinance on Persons with Disabilities dated July 30, 1998;
At the proposal of the Minister of Labor, Invalids and Social Affairs,
DECREE:
Article 1. Amending and supplementing Article 10 and Article 15 of the Decree No. 07/2000/NĐ-CP dated March 9, 2000 on social assistance policies.
Article 2. Amending and supplementing Article 10 as follows:
"Article 10.
1. The lowest monthly social assistance allowance managed by communes and wards shall be VND 65,000/person/month.
2. The lowest living expense subsidy for maintenance at state social welfare facilities shall be VND 140,000/person/month; for children under 18 months old who need additional milk and for children infected with HIV/AIDS, the lowest living expense subsidy for maintenance shall be VND 210,000/child/month.
3. The lowest living expense subsidy for maintenance for chronic mental patients at state social welfare facilities shall be VND 160,000/person/month.
4. The subjects specified in Clauses 1, 2, and 3 of this Article shall be provided with health insurance cards or free medical examinations and treatments according to current regulations."
Article 3. Amending and supplementing Article 15 as follows:
"Article 15.
1. The level of social assistance for each group of subjects specified in Clauses 1, 2, 3, 4, 5, and 6 of Article 14 of Government Decree No. 07/2000/NĐ-CP dated March 9, 2000 on social assistance policies shall be decided by the Chairman of the People's Committee of the province based on the extent of damage and the ability to mobilize resources.
2. Begging persons during the period of concentration awaiting return to their place of residence shall be granted a daily allowance of VND 7,000/person/day, but not exceeding 15 days."
Article 4. Effective date
This Decree takes effect from January 1, 2005.
Article 5. Responsibilities for Implementation
Ministers, Heads of ministerial-level agencies, Heads of agencies attached to the Government, Chairmen of provincial People's Committees, and Chairmen of municipal People's Committees directly under the central government are responsible for implementing this Decree. /./
