Pursuant to the Law on Organization of the Government dated December 25, 2001;
CONSIDERING THE PROPOSAL OF THE DIRECTOR GENERAL OF THE VOICE OF VIETNAM AND THE MINISTER OF HOME AFFAIRS,
DECREE:
Article 1. Position and Functions
1. THE VOICE OF VIETNAM IS A NATIONAL RADIO STATION, AN ORGAN UNDER THE GOVERNMENT, PERFORMING THE FUNCTION OF PROVIDING INFORMATION AND PROPAGANDA ON THE PARTY'S POLICIES AND THE STATE'S LAWS, CONTRIBUTING TO IMPROVING THE POPULAR EDUCATION LEVEL AND SERVING THE SPIRITUAL LIFE OF THE PEOPLE THROUGH RADIO PROGRAMS, INTERNET RADIO, RADIO WITH IMAGES, AND WRITTEN REPORTS.
2. THE VOICE OF VIETNAM IS ABBREVIATED IN VIETNAMESE AS VNRT, AND ITS INTERNATIONAL NAME IN ENGLISH IS VOICE OF VIETNAM, ABBREVIATED AS VOV.
3. THE VOICE OF VIETNAM IS SUBJECT TO THE STATE MANAGEMENT OF THE MINISTRY OF INFORMATION AND COMMUNICATION REGARDING JOURNALISM ACTIVITIES, FREQUENCIES, TRANSMISSION, AND BROADCASTING.
Article 2. Tasks and Powers
The Voice of Vietnam Radio performs the following tasks and powers:
1. SUBMIT TO THE GOVERNMENT FOR THE REGULATION, AMENDMENT, AND SUPPLEMENTATION OF THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE VOICE OF VIETNAM.
2. SUBMIT TO THE PRIME MINISTER THE STRATEGIC PLAN, DEVELOPMENT PLANS FOR THE LONG TERM, FIVE-YEAR PERIOD, ANNUAL PERIOD, AND IMPORTANT PROJECTS OF THE VOICE OF VIETNAM; IMPLEMENT THE STRATEGIC PLAN, DEVELOPMENT PLANS AFTER APPROVAL BY THE PRIME MINISTER.
3. SUBMIT TO THE PRIME MINISTER FOR THE ESTABLISHMENT, REORGANIZATION, OR DISSOLUTION OF THE ORGANIZATIONS OF THE VOICE OF VIETNAM WITHIN THE AUTHORITY OF THE PRIME MINISTER.
4. PREPARE PLANS, BUILD, AND SUBMIT TO THE MINISTRY OF SCIENCE AND TECHNOLOGY FOR REVIEW AND ANNOUNCE NATIONAL STANDARDS ACCORDING TO CLAUSE 1 OF ARTICLE 17 OF THE LAW ON STANDARDS AND TECHNICAL REGULATIONS; BUILD AND ANNOUNCE FUNDAMENTAL STANDARDS ACCORDING TO ARTICLE 20 OF THE LAW ON STANDARDS AND TECHNICAL REGULATIONS; PREPARE PLANS, BUILD, AND SUBMIT TO THE MINISTER OF SCIENCE AND TECHNOLOGY FOR REVIEW AND ISSUE NATIONAL TECHNICAL REGULATIONS ACCORDING TO CLAUSE 4 OF ARTICLE 9 OF DECREE NO. 127/2007/NĐ-CP DATED AUGUST 1, 2007 OF THE GOVERNMENT GUIDING THE IMPLEMENTATION OF SOME ARTICLES OF THE LAW ON STANDARDS AND TECHNICAL REGULATIONS.
5. THE DIRECTOR GENERAL OF THE VOICE OF VIETNAM ISSUES INDIVIDUAL DOCUMENTS AND INTERNAL REGULATORY DOCUMENTS WITHIN THE SCOPE AND RESPONSIBILITY OF MANAGEMENT OF THE STATION AND SHALL NOT ISSUE LEGISLATIVE REGULATORY DOCUMENTS.
6. DECIDE ON THE PROGRAMS, AIRTIME, PRODUCTION PLANS, AND BROADCASTING LOCATIONS OF THE VOICE OF VIETNAM IN ACCORDANCE WITH THE LAWS.
7. ORGANIZE THE PRODUCTION OF PROGRAMS AND IMPLEMENT TRANSMISSION AND BROADCASTING; COLLECT NEWS, MATERIALS, AUDIO-VISUAL PRODUCTS, MULTIMEDIA COMMUNICATION PRODUCTS; IMPLEMENT THE LAWS ON NATIONAL ARCHIVING OF RADIO MATERIALS.
8. MANAGE, EXPLOIT, AND USE EFFICIENTLY THE SPECIALIZED TECHNICAL SYSTEM OF THE VOICE OF VIETNAM.
9. MANAGE THE ORGANIZATIONAL STRUCTURE, STAFFING, RECRUITMENT, AND USE; IMPLEMENT SALARY REGIMES, TRANSFERS, ROTATIONS, APPOINTMENTS, AND REAPPOINTMENTS OF OFFICIALS AND IMPLEMENT INCENTIVE POLICIES, AWARDS, AND DISCIPLINARY MEASURES FOR OFFICIALS, CIVIL SERVANTS, PUBLIC SERVICE EMPLOYEES, AND LABORERS UNDER THE AUTHORITY OF THE STATION; TRAIN AND ENHANCE PROFESSIONAL SKILLS IN RADIO.
10. BE AUTONOMOUS AND RESPONSIBLE FOR THE PERFORMANCE OF TASKS, ORGANIZATIONAL STRUCTURE, STAFFING, AND FINANCES; GRANT AUTONOMY AND SELF-RESPONSIBILITY FOR THE PERFORMANCE OF TASKS, ORGANIZATIONAL STRUCTURE, STAFFING, AND FINANCES TO ENTERPRISES WITH INCOME UNDER THE VOICE OF VIETNAM ACCORDING TO THE LAWS.
11. IMPLEMENT THE ANNUAL BUDGET ESTIMATE OF THE VOICE OF VIETNAM AFTER APPROVAL; MANAGE THE FUNDS AND ASSETS ALLOCATED ACCORDING TO THE LAWS.
12. DECIDE AND IMPLEMENT THE ADMINISTRATIVE REFORM PLAN OF THE STATION ACCORDING TO THE NATIONAL ADMINISTRATIVE REFORM PROGRAM APPROVED BY THE PRIME MINISTER.
13. ORGANIZE AND DIRECT THE STUDY OF SCIENCE, APPLICATION OF ADVANCED SCIENCE AND TECHNOLOGY IN RADIO.
14. IMPLEMENT INTERNATIONAL COOPERATION IN RADIO ACCORDING TO THE LAWS.
15. MANAGE INVESTMENT AND CONSTRUCTION PROJECTS WITHIN THE AUTHORITY ACCORDING TO THE LAWS; PARTICIPATE IN THE REVIEW OF IMPORTANT PROJECTS IN THE FIELD OF RADIO AT THE REQUEST OF THE PRIME MINISTER.
16. ORGANIZE SERVICES ACTIVITIES ACCORDING TO THE LAWS.
17. ISSUE AND GUIDE THE IMPLEMENTATION OF PROVISIONS RELATED TO PROFESSIONAL AND BUSINESS PRACTICES APPLIED WITHIN THE ORGANIZATIONS AND UNITS OF THE STATION ACCORDING TO THE LAWS.
18. INSPECT THE COMPLIANCE WITH POLICIES, LAWS, AND ASSIGNED TASKS FOR ORGANIZATIONS, INDIVIDUALS, OFFICIALS, CIVIL SERVANTS, AND LABORERS UNDER THE AUTHORITY OF THE STATION; COORDINATE IN RESOLVING COMPLAINTS AND ACCUSATIONS RELATED TO OFFICIALS AND CIVIL SERVANTS UNDER THE AUTHORITY ACCORDING TO THE LAWS; ORGANIZE THE PREVENTION OF CORRUPTION, WASTEFULNESS, BUREAUCRACY, AND HARSHNESS TOWARD INDIVIDUALS AND UNITS UNDER THE STATION.
19. REGARDING THE MANAGEMENT OF STATE ENTERPRISES UNDER THE STATION:
a) IMPLEMENT SPECIFIC TASKS AND POWERS REGARDING THE REPRESENTATION OF THE STATE CAPITAL IN STATE CAPITAL COMPANIES UNDER THE VOICE OF VIETNAM ACCORDING TO THE LAWS;
b) DIRECT THE IMPLEMENTATION OF PROPOSALS FOR THE ESTABLISHMENT, REORGANIZATION, DISSOLUTION, OR PRIVATIZATION OF STATE ENTERPRISES UNDER THE STATION AFTER APPROVAL BY THE PRIME MINISTER;
c) APPROVE CHARTERS AND APPOINT, REMOVAL OF DIRECTORS, DEPUTY DIRECTORS, AND AUDITORS FOR NON-PRIVATIZED STATE ENTERPRISES UNDER THE STATION.
20. PARTICIPATE IN THE DEVELOPMENT OF STRATEGIES AND PLANS FOR THE DEVELOPMENT OF THE VIETNAMESE RADIO SYSTEM.
21. GUIDE LOCAL RADIO AND TELEVISION STATIONS ON TRAINING AND ENHANCING PROFESSIONAL SKILLS IN RADIO; ADVISE AND APPLY RADIO TECHNOLOGY AND TECHNOLOGY.
22. REPORT TO THE GOVERNMENT, THE PRIME MINISTER, AND AUTHORITATIVE GOVERNMENT BODIES.
23. PERFORM OTHER TASKS AS ASSIGNED BY THE GOVERNMENT, THE PRIME MINISTER, OR ACCORDING TO THE LAWS.

25. Overseas permanent offices established by the General Director of Vietnam Radio upon approval by the Prime Minister.
The organizations specified from Clause 1 to Clause 6 of this Article are assisting organizations for the General Director. The organizations specified from Clause 7 to Clause 24 of this Article are program production organizations. Remaining existing organizations under Vietnam Radio shall be organized and arranged by the General Director of Vietnam Radio in accordance with the law.
The organizations specified from Clause 1 to Clause 24 of this Article shall establish departments.
The General Director of Vietnam Radio shall define the functions, tasks, authorities, organizational structure, and appoint and dismiss the heads and no more than three deputy heads of subordinate organizations.
Article 4. Leader
1. Vietnam Radio has a General Director and no more than three Deputy General Directors.
2. The General Director and Deputy General Directors are appointed and relieved from their positions by the Prime Minister in accordance with the provisions of the law.
3. The General Director is responsible before the Government, the Prime Minister, and the law for all activities of Vietnam Radio; the Deputy General Directors assist the General Director and are responsible to the General Director for the assigned areas.
Article 5. Effectiveness and responsibility for implementation
1. This Decree takes effect 15 days after its publication in the Official Gazette and replaces Decree No. 83/2003/NĐ-CP dated July 18, 2003 of the Government on the functions, tasks, authorities, and organizational structure of Vietnam Radio.
Article 2. Abolish previous provisions that conflict with this Decree.
3. The General Director of Vietnam Radio, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
