Guidelines for Implementing Special Allowances for Workers Working in the Spratly Islands and Ho Chi Minh City

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants and military personnel;

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;

To implement Document No. 1633/VPCP-KGVX dated March 18, 2011 of the Government Office, after receiving comments from the Ministry of Agriculture and Rural Development and the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs hereby issues guidelines for implementing special allowances for workers directly working in the Spratly Islands and Ho Chi Minh City as follows:

Clause 4 of Article 61. Principles, criteria, and allocation standards for state budget investment capital development phase 2016-2020 serve as the basis for planning medium-term and annual investment plans from the state budget for the period 2016-2020 at the national level, at all levels, and in all sectors and units using state budget funds. 1. Level of Allowance

Workers specified in Article 1 of this Circular shall be entitled to a special allowance equal to 100% of their current salary coefficient and the position coefficient for department heads, deputy department heads, or equivalent positions according to the company's classification level, if applicable, as stipulated in the wage scales issued pursuant to Decree No. 205/2004/NĐ-CP mentioned above.

2. The special allowance shall be included in the annual payroll budget to be paid to workers but shall not be used to calculate contributions or benefits under social insurance, health insurance, or unemployment insurance.

3. Method of payment

The special allowance shall be calculated based on the actual working days of workers at the Trường Sa - DKI area and Đá Tây Island and shall be paid together with their monthly salaries, specifically:

 Where:

- The standard number of working days per month as prescribed by labor laws is the number of working days chosen and decided by the company, but it must not exceed a maximum of 26 days in a month;

- The actual number of working days is the sum of the working days at the Trường Sa - DKI area and Đá Tây Island plus the travel time confirmed by the competent authority.

Article 3. Funding for payment and settlement of special allowances

1. The funding for the special allowance system provided by the State to perform public service tasks at the Trường Sa and DKI areas according to the plan assigned by the Ministry of Agriculture and Rural Development shall be prepared by the company before December 31 each year and reported to the Ministry of Agriculture and Rural Development for consolidation into the annual budget plan of the agency to be submitted to the Ministry of Finance for consideration and resolution in accordance with regulations.

2. At the end of the fiscal year, the company shall report the settlement of the special allowance system funding along with the financial settlement report in accordance with Circular No. 111/2011/TT-BTC dated April 8, 2011, of the Ministry of Finance regarding guidelines for the implementation of public service tasks, logistics, and marine fisheries services.

Article 4. Effectiveness

1. This Circular takes effect from July 15, 2011.

2. The special allowance system stipulated in this Circular shall be implemented from July 1, 2011.

3. In case of difficulties during implementation, the Ministry of Agriculture and Rural Development and the Eastern Sea Fisheries Service Joint Stock Company Limited are requested to report to the Ministry of Labor, Invalids, and Social Affairs for research and resolution./.
