Circular No. 16/2013/TT-BXD amends and supplements some articles of Circular No. 06/2013/TT-BXD dated May 13, 2013, issued by the Minister of Construction on the content of Urban Design.

CIRCULAR

Amending and supplementing certain articles of Circular No. 06/2013/TT-BXD dated May 13, 2013 issued by the Minister of Construction

on guiding the contents of Urban Design

Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to the Urban Planning Law No. 30/2009/QH12 dated June 17, 2009;

Pursuant to Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the preparation, review, approval, and management of urban planning;

At the proposal of the Department of Planning and Architecture;

The Minister of Construction issues this Circular amending and supplementing certain articles of Circular No. 06/2013/TT-BXD dated May 13, 2013 of the Minister of Construction guiding the contents of Urban Design.

Article 1. Amending and supplementing certain articles of Circular No. 06/2013/TT-BXD dated May 13, 2013 of the Minister of Construction guiding the contents of Urban Design:

"Article 2. General requirements for Urban Design

1. Clause 2 shall be amended and supplemented as follows:

1. Urban Design in master plans, sectoral plans, and detailed plans must comply with construction planning standards and related standards. Provisions of the Law on Urban Planning related to Urban Design are specified in Chapters II, III, and IV of this Circular.
2. The organization, examination, and approval of separate Urban Design projects shall be carried out according to the provisions of Clause 2 and Clause 3, Article 32 of the Law on Urban Planning.

3. Organizations and individuals participating in the preparation of separate Urban Design projects must have the necessary capacity as stipulated in Article 5 of Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the preparation, examination, approval, and management of urban planning. The chief architect of separate Urban Design projects must have experience in architectural design and heritage preservation (in areas with heritage sites, relics, old architecture).

4. Objects for which separate Urban Design projects are prepared include: Urban Design for a street; Urban Design for blocks or lots of streets."

2. Article 16 is amended and supplemented as follows.

"Article 16. Bases and requirements for preparing separate Urban Design

1. Separate Urban Design must define the scope of Urban Design, objectives, principles, and regulations regarding the content to be achieved for Urban Design and the project documentation.
2. Evaluation of current conditions and comprehensive analysis (preparation of tables, diagrams, and illustrative drawings) of: the number, proportion (%) between different types of buildings and architectural objects; setback, height, and color of architectural structures; greenery, terrain elevation, and technical infrastructure systems.
3. Content of research and design for separate Urban Design projects
a) Spatial planning, architectural, and landscape organization.
b) Urban conservation for old and historic cities (if applicable)
c) Requirements for technical infrastructure.
d) Environmental impact assessment."

Article 2. Effective Date

1. This Circular takes effect from December 3, 2013.
