Regulations on criteria and indicators for evaluating the quality of public services in the construction of national standards and national technical regulations under the responsibility of the Ministry of Natural Resources and Environment

Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing certain provisions of the Law on Standards and Technical Regulations amended and supplemented by Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government; Decision No. 1990/QĐ-TTg dated December 11, 2017 of the Prime Minister

On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to promulgating the List of public services funded by the State budget under the management of the Ministry of Natural Resources and Environment; At the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular regulating criteria and indicators for evaluating the quality of public services

in the construction of national standards and national technical regulations under the responsibility of the Ministry of Natural Resources and Environment. Article 1. This Circular regulates criteria and indicators for evaluating the quality of public services in the construction of national standards and national technical regulations under the responsibility of the Ministry of Natural Resources and Environment (hereinafter referred to as public services in the construction of standards and technical regulations).

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. This Circular does not regulate the construction, review, and examination of national standards and national technical regulations under the responsibility of the Ministry of Natural Resources and Environment, which shall be carried out by competent state management agencies.

2. Public service units, organizations, and individuals involved in providing public services in the construction of standards and technical regulations under the responsibility of the Ministry of Natural Resources and Environment using the State budget.

1. The quality of public services in the construction of standards and technical regulations is the result of assessing the level of satisfaction of state management agencies with such services through evaluation criteria.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

2. Evaluation criteria for the quality of public services in the construction of standards and technical regulations are contents and requirements used to assess the quality of services at each stage of the service.

3. Indicators for evaluating the quality of public services in the construction of standards and technical regulations are tools for measuring specific parts of evaluation criteria, expressed in numerical values or ratios.

CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF PUBLIC SERVICES IN THE CONSTRUCTION OF NATIONAL STANDARDS AND NATIONAL TECHNICAL REGULATIONS UNDER THE RESPONSIBILITY OF THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

Chapter II

1. Criterion 1: Information, data, and technical facilities serving the construction of standards and technical regulations.

1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.

2. Criterion 2: Human resources for the construction of standards and technical regulations.

3. Criterion 3: Drafting standard and technical regulation proposals.

4. Criterion 4: Documentation for requesting review of draft standards and technical regulations and incorporating feedback after review.

5. Criterion 5: Documentation submitted to the Ministry of Natural Resources and Environment to request competent authorities to examine draft standards and technical regulations.

6. Criterion 6: Completing documentation for draft standards and technical regulations to request competent authorities to publish standards and include technical regulations in the program for issuing regulatory documents.

7. Criterion 7: Compliance with laws on standards and technical regulations.

a) Information and data serving the construction of standards and technical regulations;

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

b) Systems of machinery, equipment, and laboratories serving the construction of standards and technical regulations.

a) Reports on current status, project proposals, and reference materials for drafting explanations for constructing standards and technical regulations;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

b) Statistical reports and reports on the current status of machinery, equipment, and laboratories suitable for constructing standards and technical regulations.

a) Number of personnel directly involved in constructing standards and technical regulations;

Article 6. Indicators and Basis for Evaluating Criterion 2

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

b) Quality of personnel directly involved in constructing standards and technical regulations.

b) Organizational and individual capacity in constructing standards and technical regulations (credentials, relevant expertise); years of experience in constructing standards and technical regulations; allocation of personnel.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Statistical data, personnel files, and labor contracts, expert hiring contracts of the service provider organization;

a) Procedures for establishing the drafting team for standards and technical regulations;

Article 7. Indicators and Basis for Evaluating Criterion 3

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

b) Drafting process for standards and technical regulations;

c) Procedures for soliciting opinions from organizations and individuals and completing reports;

d) Time taken to prepare draft documentation for standards and technical regulations from the time of soliciting draft opinions.

a) Documentation for establishing the drafting team for standards and technical regulations;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

b) Reports on the drafting process for standards and technical regulations;

c) Reasonableness of the list of organizations and individuals solicited for opinions; reports explaining and incorporating feedback;

d) Quality of drafts during the construction process, degree of incorporation and completion of drafts for standards and technical regulations.

a) Documentation for requesting review of draft standards and technical regulations;

Article 8. Indicators and Basis for Evaluating Criterion 4

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

b) Time taken to request review of standards and technical regulations from the time of completing draft opinions (counted from the date of submitting documentation to the General Department or Department under the Ministry); number of times revised after receiving comments from the General Department or Department under the Ministry;

c) Time taken to revise draft standards and technical regulations after receiving review comments;

d) Completed documentation for draft standards and technical regulations after review according to the Law on Standards and Technical Regulations; Decree No. 127/2007/NĐ-CP; Decree No. 78/2018/NĐ-CP.

b) Compliance with procedures and formalities for requesting review of standards and technical regulations;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

b) Time taken to request review of standards and technical regulations from the time of completing draft opinions (counted from the date of submitting documentation to the General Department or Department under the Ministry); number of times revised after receiving comments from the General Department or Department under the Ministry;

c) Compliance with deadlines for submitting documentation for requesting review of standards and technical regulations;

d) Explanation and completion after review;

e) Time taken to complete documentation for draft standards and technical regulations after review to submit to the Ministry of Natural Resources and Environment before submission to competent authorities for examination.

đ) Time to complete the draft technical standards and regulations file after review to be submitted to the Ministry of Natural Resources and Environment before the Ministry submits it to the competent authority for examination.

Article 9. Indicators and Basis for Evaluating Criterion 5

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Documents for the draft technical standards and regulations submitted to the Ministry of Natural Resources and Environment to request the competent authority to review;

b) Compliance with the procedures, formalities, and requirements for the agency building technical standards and regulations regarding the request for review of technical standards and regulations;

c) Completion and revision report documents for the draft technical standards and regulations after receiving comments from the competent authority as prescribed;

d) Timeframe for completing the draft technical standards and regulations after review;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Documents for the draft technical standards and regulations submitted to the Ministry of Natural Resources and Environment to request the competent authority to review;

b) Compliance with the procedures, formalities, and requirements for the agency building technical standards and regulations regarding the review of technical standards and regulations;

c) Compliance with the timeframe for completing and revising the draft technical standards and regulations after receiving comments on the review of technical standards and regulations;

d) The rationality and accuracy of the explanation and adoption of review comments;

đ) Compliance with the timeframe for completing the documents to request the competent authority to publish the standards, propose inclusion in the program for promulgating regulatory legal documents for technical regulations;

Article 10. Indicators and Basis for Evaluating Criterion 6

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Documents for the draft technical standards and regulations requesting the competent authority to publish the standards, proposing inclusion in the program for promulgating regulatory legal documents for technical regulations;

b) The process of requesting the competent authority to publish the standards, proposing inclusion in the program for promulgating regulatory legal documents for technical regulations;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Documents for the draft technical standards and regulations requesting the competent authority to publish the standards, proposing inclusion in the program for promulgating regulatory legal documents for technical regulations;

b) The timeframe for requesting the competent authority to publish the standards, proposing inclusion in the program for promulgating regulatory legal documents for technical regulations;

Article 11. Indicators and Basis for Evaluating Criterion 7

1. The evaluation index is the level of cooperation during the process of developing technical standards and regulations with the state management agency for standard and regulation development services;

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) The degree of readiness to meet service requirements according to the state management agency's regulations for standard and regulation development services;

b) Attitude in compliance with the regulations on the development of technical standards and regulations;

Article 12. Evaluation of Quality of Public Service Activities in Technical Standards and Regulations Development

1. The quality of public service activities related to the development of technical standards and regulations shall be evaluated through scoring. The evaluation scale is 100 points. The specific evaluation scale for each criterion and index is detailed in the Appendix attached to this Circular;

2. The quality of public service activities is evaluated at four levels:

a) Excellent: achieving 80 points or more, where the total score of each criterion must reach 70% or more of the maximum score of the criterion;

b) Good: achieving from 60 to less than 80 points, where the total score of each criterion must reach 60% or more of the maximum score of the criterion;

c) Satisfactory: achieving from 50 to less than 60 points, where the total score of the criteria under Articles 7, 8, and 9 must reach 50% or more of the maximum score of the criterion;

d) Unsatisfactory when the total score is less than 50 points;

Chapter III

IMPLEMENTING PROVISIONS

Article 13. Effective Date

This Circular takes effect from December 14, 2018.

Article 14. Implementation Organization

1. The Science and Technology Department, Ministry of Natural Resources and Environment is responsible for organizing guidance on implementation and monitoring compliance with this Circular.

2. Units under the Ministry of Natural Resources and Environment and relevant organizations and individuals are responsible for implementing this Circular.

3. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for research, consideration, and appropriate amendment./.
