Issued to announcethe port waters within the jurisdiction of Quang Nam Province and the area managed by the Quang Nam Maritime Port Office.

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
1. Amending Clause 2 Article 2 as follows:
Based on the proposal of the Director of the Legal Affairs Department and the Director of the Vietnam Maritime Administration;
The Minister of Transport issues this Circular to announce to announcethe port waters within the jurisdiction of Quang Nam Province and the area managed by the Quang Nam Maritime Port Office.
Article 1. Announcing the port waters within the jurisdiction of Quang Nam Province
The port waters of Quang Nam Province within the jurisdiction of Quang Nam Province include:
1. The port waters of Quang Nam at Ky Ha.
2. The port waters of Quang Nam at Cu Lao Cham.
Article 2. Scope of the port waters within the jurisdiction of Quang Nam Province
The scope of the port waters of Quang Nam Province within the jurisdiction of Quang Nam Province is determined at the highest tidal water level, specified as follows:
1. The scope of the port waters of Quang Nam at Ky Ha:
a) Seaward boundary:
Limited by straight lines connecting points KH1, KH2, KH3, KH4, and KH5 with the following coordinates:
KH1: 15°30'18.1"N; 108°38'00.0"E;
KH2: 15°32'00.0"N; 108°38'00.0"E;
KH3: 15°32'00.0"N; 108°43'30.0"E;
KH4: 15°27'00.0"N; 108°43'30.0"E;
KH5: 15°27'00.0"N; 108°41'52.0"E.
b) The boundary towards the mainland:
From point KH5 running along the coastline northward through the Ky Ha Sea Light Station cape, continuing along the coast southwestward to connect with point TG1 (coordinates: 15°27'42.9"N; 108°40'03.6"E). From point TG1 connecting directly to point TG2 (coordinates: 15°27'42.9"N; 108°39'44.7"E). From point TG2 running along the coastline northwestward to connect with point TG3 (coordinates: 15°27'00.0"N; 108°38'33.0"E). From point TG3 crossing the Ben Van River to connect with point TG4 (coordinates: 15°27'00.0"N; 108°38'00.0"E). From point TG4 running along the coastline upstream to Chu Lai Port to connect with point TG5 (coordinates: 15°28'40.8"N; 108°37'12.0"E). From point TG5 connecting directly to point TG6 (coordinates: 15°28'45.2"N; 108°37'12.0"E). From point TG6 running along the coastline northeastward to connect with point TG7 (coordinates: 15°28'55.0"N; 108°37'27.8"E). From point TG7 connecting directly to point TG8 (coordinates: 15°28'57.9"N; 108°37'33.4"E). From point TG8 running along the coastline southeastward to connect with point TG9 (coordinates: 15°29'30.0"N; 108°38'30.0"E). 2. The scope of the port waters of Quang Nam at Cu Lao Cham is limited by straight lines connecting points CLC1, CLC2, CLC3, and CLC4 with the following coordinates:
CLC1: 15°53'57.6"N; 108°27'18.7"E;
CLC2: 15°54'50.7"N; 108°27'58.1"E;
CLC3: 15°53'32.6"N; 108°29'50.4"E;
CLC4: 15°52'39.5"N; 108°29'11.0"E.
3. The boundaries of the port waters of Quang Nam at Ky Ha are determined on Chart number VN-50022 published by the Northern Marine Safety Assurance Corporation on April 16, 2015. The boundaries of the port waters at Cu Lao Cham are determined on Chart number VN-50051 published by the Northern Marine Safety Assurance Corporation on June 1, 2017. The coordinates of the points specified in this Circular apply according to the WGS-84 coordinate system and are converted to the VN-2000 coordinate system in the Appendix attached to this Circular.
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and disembarkation areas, quarantine zones, anchorage areas, transshipment zones, and storm shelters for vessels entering and leaving the ports within the jurisdiction of Quang Nam Province and other waters and zones as prescribed.
Article 4. Responsibilities of the Quang Nam Maritime Port Office
1. Perform its tasks and powers as prescribed by the Vietnam Maritime Code and other relevant legal regulations concerning maritime activities at seaports and port waters within the territory of Quang Nam Province.
2. Based on actual conditions regarding weather, waves, winds, draft, tonnage of vessels, and nature of cargo, designate specific positions for vessels to pick up and drop off pilots, quarantine, anchor, transfer cargo, and avoid typhoons in accordance with regulations, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Territory of Quang Nam Province
In addition to the port waters specified in Article 2 of this Circular, the Quang Nam Maritime Port Office also has the responsibility to manage state affairs related to maritime safety, maritime security, and prevention of environmental pollution in the sea area within the territory of Quang Nam Province.
Article 6. Effectiveness
This Circular takes effect from July 1, 2019, and replaces Circular No. 51/2011/TT-BGTVT dated October 24, 2011, issued by the Minister of Transport on the announcement of port waters within the territory of Quang Nam Province and the management area of the Quang Nam Maritime Port Office.
Article 7. Implementation Organization
The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments under the Ministry, the Director General of the Vietnam Maritime Administration, the Director General of the Vietnam Inland Waterways Administration, the Director of the Quang Nam Department of Transport, the Director of the Quang Nam Maritime Port Office, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
