Issuing "National Technical Regulations on Gasoline, Diesel Fuel and Biofuel"

WHEREAS specialized agency under the People's Committee of the province/city.ứPursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Government Decree numberDecision No. 127/2007/NĐ-CP day 01 month 8 year 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations and Decree No. 78/2018/NĐ-CP of May 24, 2018 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;iPursuant to16 he recommendation of the General Director of the Standardization, Measurement and Quality Control Agency and the Director of the Legal Department;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."hereinafter referred to as the DecreeThe Minister of Science and Technology issues this Circular on the issuance of "National Technical Regulations on Gasoline, Diesel Fuel and Biofuel"Pursuant to Government Decree No. 83/2017, Pursuant to Decree No. 52/2013/NĐ-CP dated May 16, 2013 of the Government on e-commerce; Decree No. 85/2021/NĐ-CP dated September 25, 2021 of the Government amending and supplementing certain articles of Decree No. 52/2013/NĐ-CP dated May 16, 2013 of the Government on e-commerce;1 x

2. The following legal documents shall cease to be effective according to the implementation timeline set forth in Article 3 and transitional provisions in Article 4 of this Circular:nga) Circular No. 22/2015/TT-BKHCN dated November 11, 2015 of the Minister of Science and Technology on the issuance and implementation of National Technical Regulation No. 1:2015/BKHCN on Gasoline, Diesel Fuel and Biofuel;onb) Circular No. 04/2017/TT-BKHCN dated May 22, 2017 of the Minister of Science and Technology on amending National Technical Regulation No. 1:2015/BKHCN on Gasoline, Diesel Fuel and Biofuel.amend1. From June 15, 2023, products of gasoline, diesel fuel, and biofuel produced, blended, imported, and distributed must comply with the provisions of National Technical Regulation No. 01:2022/BKHCN before being circulated in the market.”.
Article 1. 2. It is encouraged that enterprises, organizations, and individuals producing, blending, importing, and distributing gasoline, diesel fuel, and biofuel apply the provisions of National Technical Regulation No. 01:2022/BKHCN from the date this Circular takes effect.
Article 2. Effective Date
1. Enterprises, organizations, and individuals may choose to apply either Amendment No. 1:2017 to National Technical Regulation No. 1:2015/BKHCN and National Technical Regulation No. 1:2015/BKHCN or National Technical Regulation No. 01:2022/BKHCN for gasoline, diesel fuel grades 2, 3, and 4 produced, blended, imported, and distributed from February 1, 2023 to June 15, 2023.
2. Products of gasoline, diesel fuel grades 2, 3, and 4 produced, blended, imported, and distributed which have been certified as compliant under National Technical Regulation No. 1:2015/BKHCN and Amendment No. 1:2017 to National Technical Regulation No. 1:2015/BKHCN and circulating in the market before June 15, 2023 may continue to circulate in the market until June 15, 2024.
1. The General Director of the Standardization, Measurement and Quality Control Agency is responsible for organizing guidance, dissemination, promotion, and implementation of this Circular.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.
Article 3. Implementation Schedule
3. During the implementation process, if any difficulties arise, relevant agencies, organizations, and individuals shall promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
2. Encourage enterprises, organizations, and individuals producing, blending, importing, and distributing gasoline, diesel fuel, and biofuels to apply the provisions of QCVN 01:2022/BKHCN from the date this Circular takes effect.
Article 4. Transitional Provisions
1. Enterprises, organizations, and individuals may choose to apply either the revised QCVN 1:2015/BKHCN with Amendment 1:2017 or QCVN 01:2022/BKHCN for gasoline and diesel fuel levels 2, 3, and 4 produced, blended, imported, and distributed from February 1, 2023 to June 15, 2023.
2. Gasoline and diesel fuel levels 2, 3, and 4 that have been certified as compliant according to QCVN 1:2015/BKHCN and its Amendment 1:2017 QCVN 1:2015/BKHCN and were circulating in the market before June 15, 2023 shall continue to be circulated in the market until June 15, 2024.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Director of the General Department of Standardization, Metrology, and Quality Control is responsible for organizing guidance, dissemination, promotion, and implementation of this Circular.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for enforcing this Circular.
3. During the implementation process, if any difficulties arise, agencies, organizations, and individuals shall promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
