CIRCULAR

Amending and supplementing certain Articles of the TCircular stipulating regulations on

inspection of inland waterway vessels

 Pursuant to the Law on Inland Waterway Transport dated June 15, 2004;

BASED ON THE LAW AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE LAW ON INLAND WATERWAY TRANSPORT dated June 17, 2014;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Science, Technology and Environment Department and the Director of the Vietnam Vehicle Inspection Agency,

The Minister of Transport hereby promulgates this Circular amending and supplementing certain Articles of theTCirculars stipulating regulations on inspection of inland waterway vessels.

Article 1. Amending and supplementing certain Articles ofCircularnumber48/2015/TT-BGTVT dated September 22, 2015 of the Minister of Transport stipulating regulations on inspection of inland waterway vessels (hereinafter referred to as Circular No. 48/2015/TT-BGTVT) and Circular No. 16/2022/TT-BGTVT dated June 30, 2022 of the Minister of Transport amending and supplementing certain Articles of Circulars in the field of inspection (hereinafter referred to as Circular No. 16/2022/TT-BGTVT).

1. Amending and supplementing Clause 3 of Circular No. 48/2015/TT-BGTVT as follows:

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Industrial products used for inland waterway vessels (hereinafter referred to as industrial products) include: materials, machines, and equipment installed on inland waterway vessels.

2. Safety technical inspection and environmental protection label for inland waterway vessels (hereinafter referred to as Inspection Label) is a symbol issued to inland waterway vessels that have been certified by the inspection authority to meet safety technical quality standards and environmental protection requirements, and are permitted to participate in inland waterway transport according to the period indicated on the Inspection Label.

3. Design documents are technical files established in accordance with national technical regulations and national standards to serve the construction, conversion, repair, importation, and operation of inland waterway vessels. Design documents include the following types:

a) Design documents for new construction, conversion, and modification;

b) Design documents for imported vessels (excluding motorboats imported for sports and recreational purposes) or vessels constructed without supervision by the inspection authority (including vessels converted from fishing boats to inland waterway vessels);

c) Design documents for domestically produced and manufactured industrial products;

d) Design documents for standardized models;

e) Design documents for vessels not originally intended for inland waterway use but converted to such use.

4. Guidance documents are materials established in accordance with national technical regulations and national standards to be used on inland waterway vessels to provide information to captains and crew members regarding the operation and maintenance of vessels and their machinery and equipment in compliance with safety technical and environmental protection requirements.

5. Reviewing design documents and guidance documents involves checking and examining these documents to conclude whether they comply with the requirements set forth in the national technical regulations specified in Appendix I attached to this Circular.

6. Series-built vessels are inland waterway vessels newly constructed based on the same design document approved by the same inspection unit for the same user-designer at the same shipyard and under the technical supervision of the same inspection unit.

7. Motorboat refers to a watercraft used for sports and recreational purposes with a length of less than 4 meters, powered by a jet propulsion engine operated by a person sitting, standing, or kneeling on the craft without being inside a closed space.

8. Foreign inspection organizations include members of the International Association of Classification Societies (IACS) or certification organizations recognized by advanced quality standard countries (countries belonging to G7, EU, UK, Australia, New Zealand, China, South Korea, Russia).

9. Inspection units are Branches of the Vietnam Marine Inspection Agency under the Vietnam Marine Inspection Department or inspection units under Provincial Departments of Transport.”

2. Amending Clause 8 of Article 4 of Circular No. 48/2015/TT-BGTVT as follows:

“8. Copy and review standardized models.”

3. Amending Article 5 of Circular No. 48/2015/TT-BGTVT as follows:

“Article 5. Basis for assessing the quality, safety technical standards, and environmental protection of vessels and industrial products

The inspection work stipulated in Article 4 of this Circular must be conducted in accordance with the provisions of the national technical regulations specified in Appendix I attached to this Circular.”

4. Amending and supplementing Article 6 of Circular No. 48/2015/TT-BGTVT as follows:

“Article 6. Types of vessel inspections

1. Types of vessel inspections include:

a) Initial inspection, including: inspection of newly built vessels, imported vessels, and vessels constructed without inspection supervision;

b) Periodic inspection, including: regular inspection; annual inspection; dock inspection; intermediate inspection;

c) Unusual inspection;

c) Conversion inspection.

2. The contents and deadlines for each type of inspection shall be carried out in accordance with the provisions of the national technical regulations specified in Appendix I attached to this Circular.”

5. Amending and supplementing Clause 2 of Article 7 of Circular No. 48/2015/TT-BGTVT as follows:

“2. Vessels newly built, converted, repaired, or imported in a specific area shall be inspected and issued certificates of safety technical standards and environmental protection by the inspection unit having sufficient capacity and jurisdiction over that area.”

6. Supplementing Article 7a after Article 7 of Circular No. 48/2015/TT-BGTVT as follows:

“Article 7a. Principles for inspecting and issuing certificates for industrial products used in inland waterway vessels

1. Industrial products that have been inspected and certified by the Vietnam Marine Inspection Department for use in marine vessels may also be used in inland waterway vessels.

2. Industrial products that have been recognized for type approval for use on ships by the Vietnam Maritime Administration or foreign registration organizations shall be subject to inspection and issuance of certificates for industrial products suitable for inland waterway vessels according to the type approval certificate.

3. For other industrial products not covered by paragraphs 1 and 2 of this Article, inspections and issuance of certificates for industrial products shall be carried out in accordance with the national technical regulations applicable to such products.

7. Amend and supplement Article 8 of Circular No. 48/2015/TT-BGTVT, which has been amended and supplemented by paragraph 1 of Article 9 of Circular No. 16/2022/TT-BGTVT, as follows:

"Article 8. Documents for Requesting Design Review and Operating Instructions

1. For new construction, modification, alteration design documents for vessels that were constructed without supervision by a classification society, one set of design documents shall be prepared including:

a) One original or electronic form of the Application for Design Review according to the model prescribed in Appendix II attached hereto;

b) One electronic copy with legal effect (in case of submission through the online public service portal) or three originals (in case of direct submission or through the postal system or other appropriate means) of the following documents: specifications, drawings, descriptions, and technical documents (if any) as stipulated by national technical regulations and national standards applicable to the vessel. The language used in the description and specifications may be Vietnamese or English accompanied by a Vietnamese translation; in the drawings, it may be Vietnamese or English;

c) A certified copy or an electronic copy with legal effect of the Contract for New Construction of Vessels or documents proving that the vessel is legally owned by the owner and is responsible for the legality of the property before the law (for design documents of vessels that were constructed without supervision by a classification society);

d) In the case of modification design documents for imported vessels retaining their original function or carrying up to twelve passengers, which have been inspected and certified for technical safety by foreign classification organizations, depending on the content of the modification design, the submitted documents shall include: one certified copy or an electronic copy with legal effect from the importing organization of the technical safety certification documents issued by foreign classification organizations for the vessel, operating instructions; one electronic copy with legal effect (in case of submission through the online public service portal) or three originals (in case of direct submission or through the postal system) of the following documents: general layout drawings of the vessel, dry side, signals, life-saving equipment, fire-fighting equipment; descriptions about the vessel's engine system, electrical system, and safety equipment according to national technical regulations and national standards applicable to the vessel.

2. For standardized design documents, one set of design documents shall be prepared including:

a) One original or electronic form of the Application for Standardized Design Review of Inland Waterway Vessels according to the model prescribed in Appendix III attached hereto;

b) One electronic copy with legal effect (in case of submission through the online public service portal) or three originals (in case of direct submission or through the postal system or other appropriate means) of the following documents: specifications, drawings, descriptions according to national technical regulations and national standards applicable to the vessel.

3. For standardized design documents and their review, the documents shall include: one original or electronic form of the Application for Using Standardized Design of Inland Waterway Vessels according to the model prescribed in Appendix IV attached hereto.

4. For design documents for imported vessels (excluding imported water scooters for sports, recreational purposes), one set of design documents shall be prepared including:

a) One original or electronic form of the Application for Design Review according to the model prescribed in Appendix II attached hereto;

b) One electronic copy with legal effect (in case of submission through the online public service portal) or three originals (in case of direct submission or through the postal system) of the following documents: specifications, drawings, descriptions, and other technical documents (if any) as stipulated by national technical regulations, national standards, and legal regulatory documents applicable to the vessel; technical documents issued by foreign organizations for the vessel (if any). The language used in the description and specifications may be Vietnamese or English accompanied by a Vietnamese translation; in the drawings, it may be Vietnamese or English;

c) In the case of imported vessels retained in Vietnam for their original function or carrying up to twelve passengers, which have been inspected and certified for technical safety by foreign classification organizations, the submitted documents shall include: one certified copy or an electronic copy with legal effect from the importing organization of the technical safety certification documents issued by foreign classification organizations for the vessel, operating instructions; one electronic copy with legal effect (in case of submission through the online public service portal) or three originals (in case of direct submission or through the postal system) of the following documents: general layout drawings of the vessel, dry side, signals, life-saving equipment, fire-fighting equipment; descriptions about the vessel's engine system, electrical system, and safety equipment according to national technical regulations and national standards applicable to the vessel;

d) A certified copy or an electronic copy with legal effect of the documents determining the age of the vessel (reflected in the registration documents or on the Certificate of Origin (CO) issued by the national management agency or an organization authorized by the national management agency or the International Chamber of Commerce or other documents issued by the management agency of the country where the vessel was built for the vessel).

5. For design documents for domestically produced industrial products, one set of design documents shall be prepared including:

a) One original or electronic form of the Application for Design Review according to the model prescribed in Appendix II attached hereto;

b) One (01) electronic copy with legal validity (for cases submitted through the online public service portal) or three (03) original copies (for cases submitted directly or via the postal system) of the following documents: technical specifications, drawings, descriptions, and technical documents (if applicable) in accordance with national technical regulations and national standards applicable to the product.

6. For design files of vessels that are not inland waterway craft but are converted into inland waterway craft, prepare one (01) set of design files including:

a) One (01) original or electronic form of the Design Review Request Form according to the model prescribed in Appendix II issued together with this Circular;

b) One (01) electronic copy with legal validity (for cases submitted through the online public service portal) or three (03) original copies (for cases submitted directly or via the postal system or other appropriate methods) of the following documents: technical specifications, drawings, descriptions, and technical documents (if applicable) in accordance with national technical regulations and national standards applicable to the vessel.

7. For guidance documents, the file includes:

a) One (01) original or electronic form of the Guidance Document Review Request Form according to the model prescribed in Appendix II issued together with this Circular;

b) One (01) electronic copy with legal validity (for cases submitted through the online public service portal) or three (03) original copies (for cases submitted directly or via the postal system or other appropriate methods) of the guidance document.”

8. Amend and supplement Article 9 of Circular No. 48/2015/TT-BGTVT, which has been amended by Clause 2 and Clause 3 of Article 9 of Circular No. 16/2022/TT-BGTVT as follows:

“Article 9. Procedures for reviewing designs and guidance documents

1. Organizations and individuals submit directly or via the postal system or through the online public service portal to the Vietnam Maritime Administration or Branch Maritime Administration the application file for review of design and guidance documents in accordance with Article 8 of this Circular.

2. The Vietnam Maritime Administration or Branch Maritime Administration receives and checks the file; if the file is incomplete according to the regulations, they guide completion on the same working day (for direct submission) or guide completion within two (02) working days (for submission via the postal system or through the online public service portal); if the file is complete, they schedule the time to issue the result.

3. From the date of receipt of the complete file according to the regulations, within twenty (20) working days (for designs of new material, new purpose vessels or inland waterway transport vessels along the coast, from shore to islands, between islands; liquefied gas carriers, dangerous chemical tankers; oil tankers with flash point temperature not exceeding 60°C, with total deadweight of 500 tons or more; high-speed passenger ferries, air-cushion vehicles; floating restaurants, floating hotels, overnight cruise ships, passenger ships with capacity of 100 passengers or more) or within five (05) working days (for designs not mentioned above and guidance documents), the Vietnam Maritime Administration or Branch Maritime Administration completes the review of the design and guidance documents, issues the design review certificate if it meets the requirements, issues the guidance document review notification according to the model prescribed in Appendix VI issued together with this Circular (if applicable); if it does not meet the requirements, they notify the organization or individual in writing to rectify the deficiencies.04. Within two (02) working days from the date of receipt of the corrected design file, if it meets the requirements, issue the design review certificate according to Clause 3 of this Article; if it does not meet the requirements, reply to the organization or individual to rectify the deficiencies again.

5. Organizations and individuals who request the review of design and guidance documents pay the service fee and registration fee according to the regulations and collect the results directly at the Vietnam Maritime Administration or Branch Maritime Administration or via the postal system or through the online public service portal.”

9. Amend and supplement Article 10 of Circular No. 48/2015/TT-BGTVT as follows:

“Article 10. Procedures for inspection and issuance of certificates of technical safety and environmental protection for inland waterway craft

1. Organizations and individuals submit the file directly or send it via the postal system or through the online public service portal or other appropriate methods to the inspection unit, the file includes:

a) For inspection and issuance of certificates of technical safety and environmental protection for newly built, converted, or repaired vessels (including non-inland waterway vessels converted into inland waterway vessels); vessels already built without supervision by the inspection unit (including defense and security vessels, fishing vessels converted into inland waterway vessels): Inspection Request Form according to the model prescribed in Appendix V issued together with this Circular, certified copy of deregistration paper (for sea vessels, fishing vessels converted into inland waterway vessels), approval document for design usage from the design unit (for series-built vessels);

b) For inspection and issuance of certificates of technical safety and environmental protection for operating vessels: Inspection Request Form according to the model prescribed in Appendix V issued together with this Circular, certified copy of the purchase and sale contract (for changes in ownership).

2. The inspection unit receives and checks the file, if the file is incomplete according to the regulations, they guide completion on the same working day (for direct submission) or guide completion within two (02) working days (for submission via the postal system or through the online public service portal or other appropriate methods); if the file is complete, they agree on the inspection time and location.

2. The inspection unit receives, examines the file; in cases where the file is not complete as prescribed, it shall guide to complete immediately on the same working day (for cases submitted directly) or guide to complete within two (2) working days (for cases submitted through the postal system or through the online public service gateway or other appropriate methods); if the file is complete, it shall agree on the time and place for examination.

3. The inspection unit shall conduct the examination within one working day (for vehicles located less than 70 kilometers from the office) and two working days (for vehicles located 70 kilometers or more from the office or examined at sea or island areas), starting from the end of on-site inspection. If the examination results meet the national technical regulations and national standards, the inspection unit shall issue a certificate of technical safety and environmental protection for inland waterway vessels as prescribed. In case the examination results do not meet the requirements, the organization or individual requesting the examination shall be notified.

4. Organizations and individuals requesting the examination shall pay the service fee and registration fee as prescribed and may collect the results directly from the inspection unit or through the postal system or the online public service portal or other appropriate methods.

10. Amend and supplement Article 11 of Circular No. 48/2015/TT-BGTVT as follows:

"Article 11. Procedures for inspecting and issuing certificates of technical safety and environmental protection for imported vessels

1. Organizations and individuals shall submit the application directly or via the postal system or the online public service portal or other appropriate methods to the inspection unit. The application shall include: one original or electronic form of the Application for Inspection according to the model attached as Appendix V of this Circular; a certified copy or legally valid electronic copy of the age determination document of the vessel (as shown in the inspection record or on the Certificate of Origin (CO) issued by the national management agency or an organization authorized by the national management agency or the International Chamber of Commerce or other documents issued by the management agency of the country where the vessel was built), relevant documents under specialized inspection laws for imported goods, and technical documentation of the imported vessel. Technical documentation of the imported vessel is specified as follows:

a) For vessels that have been inspected and certified for technical safety by an overseas inspection organization: related technical documents (if available), certification documents issued by the overseas inspection organization (a certified copy by the importing entity);

b) For vessels that have not been inspected and certified for technical safety by an overseas inspection organization: a certified copy by the importing entity of related technical documents (if available);

c) For water scooters: a certified copy by the importing entity of the operation manual and other related technical documents (if available).

2. The inspection unit shall accept the application and confirm it on the form according to the model attached as Appendix XIII of this Circular. In case the application is incomplete, the unit shall guide the completion immediately on the same working day (for direct submission) or within two working days (for submission via the postal system or the online public service portal or other appropriate methods). If the application is complete, the unit shall agree on the actual inspection time at the location requested by the applicant.

3. The inspection unit shall carry out the inspection as follows:

a) For vessels specified in point a, Clause 1 of this Article, an actual inspection shall be conducted to confirm that the technical condition of the vessel is consistent with the certification documents issued by the overseas inspection organization and the reviewed design documents;

b) For vessels specified in point b, Clause 1 of this Article, an initial type inspection shall be carried out according to the reviewed design documents;

c) For vessels specified in point c, Clause 1 of this Article, an operational inspection shall be carried out according to the operation manual.

4. Within one working day (for vessels located less than 70 kilometers from the office) and two working days (for vessels located 70 kilometers or more from the office or inspected at sea or island areas), starting from the end of on-site inspection, if the examination results meet the national technical regulations and national standards, the inspection unit shall issue a certificate of technical safety and environmental protection for inland waterway vessels as prescribed. In case the examination results do not meet the requirements, the organization or individual requesting the examination shall be notified.

5. Organizations and individuals requesting the examination of imported vessels shall pay the service fee and registration fee as prescribed and may collect the results directly from the inspection unit or through the postal system or other appropriate methods.

11. Amend and supplement Article 12 of Circular No. 48/2015/TT-BGTVT as follows:

"Article 12. Procedures for inspecting and issuing certificates for industrial products used in inland waterway vessels

1. Organizations and individuals shall submit the application directly or via the postal system or the online public service portal or other appropriate methods to the inspection unit. The application for inspection shall include:

a) One original or electronic form of the Application according to the model attached as Appendix V of this Circular; relevant documents under specialized inspection laws for imported goods;

b) One copy or electronic copy of the technical dossier including technical specifications and reports on testing industrial products (if available).

2. The inspection unit shall accept the application, check the components of the application, and in case of imported industrial products, confirm it on the form according to the model attached as Appendix XIII of this Circular: if the application is incomplete, the unit shall guide the completion immediately on the same working day (for direct submission) or within two working days from the date of receipt of the application (for submission via the postal system or the online public service portal or other appropriate methods); if the application is complete, the unit shall agree on the actual inspection time at the location requested by the applicant.

3. The inspection unit shall conduct on-site inspections at locations requested by the applicant. Within one working day from the completion of the on-site inspection for industrial products within 70 kilometers from the office, and two working days for industrial products beyond 70 kilometers or inspections in coastal and island areas, the inspection unit shall issue a certificate of industrial product use for inland waterway vessels if the inspection results comply with national technical regulations or notify the organization or individual requesting the inspection if the results do not meet the requirements.

4. Organizations and individuals requesting the inspection of industrial products shall pay service fees and registration fees as prescribed and collect the results directly from the inspection unit or through the postal system or via the online public service portal or other appropriate methods.

12. Amend and supplement Clause 1 of Article 13 of Circular No. 48/2015/TT-BGTVT as follows:

“1. Vessels that have been inspected and found to be in compliance with the technical safety and environmental protection regulations set forth in national technical standards and national standards shall be issued the following documents:

  1. Certificate of Technical Safety and Environmental Protection for Inland Waterway Vessels;

  2. Various inspection reports and technical inspection reports;

c) Logbook of cargo handling equipment inspection for vessels equipped with such equipment;

d) Certificates of industrial products used for inland waterway vessels.

đ) Logbook of vessel water displacement capacity upon request of the vessel owner.”

13. Amend and supplement Article 14 of Circular No. 48/2015/TT-BGTVT as follows:

“Article 14. Inspection Units

1. The Vietnam Registration Agency, Branches of the Registration Agency shall review design documents and guidance materials of ships in accordance with the capabilities of the design inspectors of the units.

2. Inspection units that have been confirmed and notified of their inspection unit category shall carry out the inspection tasks specified in Clauses 2, 3, 4, 5, and 8 of Article 4 of this Circular in accordance with the inspection unit category as stipulated in Clause 3 of this Article.

3. Inspection units are categorized into Class I, Class II, and Class III based on the capability requirements set forth in Appendix X attached to this Circular and shall perform the following inspection tasks:

a) Class III inspection units shall conduct inspections for inland waterway vessels with a total volume under 500 GT, inland waterway vessels with main engine power under 300 horsepower, and inland waterway vessels with passenger capacity under 50 people (excluding VR-SB class oil tankers, multi-hull vessels, container ships, high-speed passenger ferries, hovercrafts, hydrofoil boats, oil tankers, dangerous chemical carriers, liquefied gas carriers, and dangerous goods carriers).

b) Class II inspection units shall conduct inspections for all types of inland waterway vessels (excluding oil tankers with a total volume of 3000 GT or more, VR-SB class cargo vessels with a total volume of 3000 GT or more, or VR-SB class passenger vessels with a passenger capacity of 100 or more, dangerous chemical carriers, liquefied gas carriers, and dangerous goods carriers).

c) Class I inspection units shall conduct inspections for all types of inland waterway vessels.”

14. Amend and supplement Clause 1a, Clause 7, and Clause 11 of Article 15 of Circular No. 48/2015/TT-BGTVT as follows:

a) Add Clause 1a after Clause 1 of Article 15 as follows:

“1a. Organizations shall implement the inspection contents prescribed in Article 4 of this Circular.”

b) Amend and supplement Clause 7 of Article 15 as follows:

“7. Inspect the inspection activities of inspection units. Handle or propose to handle violations of individuals and inspection units according to regulations.”

c) Amend and supplement Clause 11 of Article 15 as follows:

“11. Collect service fees and registration fees as prescribed.”

15. Amend and supplement Point b of Clause 2 of Article 16 of Circular No. 48/2015/TT-BGTVT as follows:

“b) Coordinate with Branches of the Registration Agency to conduct inspections of vessels as provided for in Clause 1 of Article 17 of this Circular.”

16. Amend and supplement Clause 1, Clause 3, Clause 7, and Clause 12 of Article 17 of Circular No. 48/2015/TT-BGTVT as follows:

a) Amend and supplement Clause 1 of Article 17 as follows:

“1. Inspection units shall be responsible for conducting inspections in accordance with the capabilities announced by the Vietnam Registration Agency. In cases where there is a request from the Department of Transport, the inspection tasks assigned to the inspection units under the Department of Transport shall be carried out by Branches of the Registration Agency.”

b) Amend and supplement Clause 3 of Article 17 as follows:

“3. Inspection units shall maintain their capabilities in accordance with the announced category; notify the Vietnam Registration Agency and the Department of Transport if they fail to meet the requirements for inspection unit capabilities as prescribed.”

c)  Amend and supplement Clause 7 of Article 17 as follows:

“7. Publicize procedures, formalities, content of processes, prices, registration fees, and working hours.”

d) Amend and supplement Clause 12 of Article 17 as follows:

“12. Pay service fees and registration fees as prescribed.”

17. Amend and supplement Clause 3, and add Clause 4 of Article 18 of Circular No. 48/2015/TT-BGTVT as follows:

a) Amend and supplement Clause 3 of Article 18 as follows:

“3. Pay service fees and registration fees as prescribed.”

b) Add Clause 4 of Article 18 as follows:

“4. Be responsible for the legality and validity of the documents and materials provided to the Vietnam Registration Agency and inspection units.”

Article 2. Supplementing, replacing, and abolishing certain provisions of Circular No. 48/2015/TT-BGTVT

1. Supplementing Appendix XIII issued together with Circular No. 48/2015/TT-BGTVT with Appendix V issued together with this Circular.

2. Replacing Appendix I, Appendix II, Appendix V, and Appendix VI issued together with Circular No. 48/2015/TT-BGTVT respectively with Appendix I, Appendix II, Appendix III, and Appendix IV issued together with this Circular.

3. Abolishing Clause 6 and Clause 7 of Article 4; Clause 2 of Article 13; Clause 6 of Article 15; Clause 2 of Article 17 of Circular No. 48/2015/TT-BGTVT.

4. Abolishing Appendix XI issued together with Circular No. 48/2015/TT-BGTVT.

Article 3. Clause to be implemented

1. This Circular takes effect from August 15, 2023.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Motor Vehicle Inspection Agency, Heads of agencies and units under the Ministry of Transport, relevant organizations and individuals are responsible for implementing this Circular./.
