ON THE REGIME OF SUBSIDY FOR PERSONS RECEIVING SALARIES AND ALLOWANCES FROM THE STATE BUDGET WHO DIRECTLY PERFORM MISSIONS OF SURVEYING AND CLEARING BOMBS, MINES, AND EXPLOSIVES AFTER WAR

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Decree No. 18/2019/NĐ-CP dated February 1, 2019 of the Government on management and implementation of activities to mitigate the consequences of bombs, mines, and explosives after war;

"Based on the proposal of the Minister of National Defense;"

The Prime Minister issues this Decision on the regime of subsidy for persons receiving salaries and allowances from the state budget who directly perform missions of surveying and clearing bombs, mines, and explosives after war.

Article 1. Scope of Regulation

This Decision stipulates the regime of subsidy for persons receiving salaries and allowances from the state budget who directly perform missions of surveying and clearing bombs, mines, and explosives after war as prescribed in Decree No. 18/2019/NĐ-CP dated February 1, 2019 of the Government on management and implementation of activities to mitigate the consequences of bombs, mines, and explosives after war.

Article 2. Applicability

1. Officers, professional military personnel, non-commissioned officers, soldiers, defense workers, defense civil servants, officials, civil servants, and staff assigned by competent authorities to directly perform missions of surveying and clearing bombs, mines, and explosives.

2. Organizations and individuals related to the performance of missions of surveying and clearing bombs, mines, and explosives after war.

Article 3. Subsidy Regime for Persons Directly Performing Missions of Surveying and Clearing Bombs, Mines, and Explosives After War

The subjects specified in Clause 1, Article 2 of this Decision, in addition to their salary and allowance (if applicable) and other benefits and policies according to the law, shall be entitled to a subsidy of 350,000 VND per person per day, calculated based on actual days working directly performing missions at the surveying and clearing area of bombs, mines, and explosives.

On the actual working day, if the time spent directly performing missions at the surveying and clearing area of bombs, mines, and explosives is less than four hours, it will be counted as half a day; from four hours and above, it will be counted as one full day.

Article 4. Source of Funds

The source of funds for paying the subsidy for persons directly performing missions of surveying and clearing bombs, mines, and explosives after war as stipulated in Article 3 of this Decision shall be included in the project cost according to the labor unit price per one hectare of the designated area for surveying and clearing bombs, mines, and explosives approved by the competent authority.

Article 5. Effective Date

1. This Decision takes effect from December 1, 2024.

2. Decision No. 122/2007/QĐ-TTg dated July 27, 2007 of the Prime Minister on certain regimes for military personnel, defense workers, and defense civil servants directly performing missions of clearing bombs, mines, and explosives and Decision No. 30/2013/QĐ-TTg dated May 21, 2013 of the Prime Minister amending Clause 2, Article 1 of Decision No. 122/2007/QĐ-TTg dated July 27, 2007 of the Prime Minister on certain regimes for military personnel, defense workers, and defense civil servants directly performing missions of clearing bombs, mines, and explosives shall cease to be effective from the date this Decision takes effect.

Article 6. Responsibility for Implementation

1. Agencies and units assigned to perform missions of surveying and clearing bombs, mines, and explosives have the responsibility to pay the subsidy regime to the subjects under their direct management who actually perform missions of surveying and clearing bombs, mines, and explosives on a daily basis or together with monthly salaries.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial People's Committees, and cities directly under the central government, and units participating in projects to clear bombs, mines, and explosives after war are responsible for implementing this Decision.
