CIRCULAR

REGULATIONS ON ECONOMIC AND TECHNICAL STANDARDS FOR SERVICES OF ORGANIZING CONTESTS, MEETINGS, AND EXHIBITIONS OF WORKS OF FINE ART AND PHOTOGRAPHY TO SERVE POLITICAL TASKS

Pursuant to Decree No. 113/2013/NĐ-CP dated October 2, 2013 of the Government on fine art activities;

Pursuant to Decree No. 72/2016/NĐ-CP dated July 1, 2016 of the Government on photography activities;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government providing for the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;

Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government providing for the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Fine Arts, Photography and Exhibition Department;

The Minister of Culture, Sports and Tourism issues this Circular regulating economic and technical standards for services of organizing contests, meetings, and exhibitions of works of fine art and photography to serve political tasks using state budget funds (hereinafter referred to as public service provision services).

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates economic and technical standards for services of organizing contests, meetings, and exhibitions of works of fine art and photography to serve political tasks using state budget funds (hereinafter referred to as public service provision services).

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

a) Agencies, organizations, and individuals using state budget funds to provide public service provision services;

b) Other agencies, organizations, and individuals related to the implementation of public service provision services using state budget funds;

c) Encourage non-state agencies, organizations, and individuals implementing public service provision services without using state budget funds to apply the economic and technical standards set forth in this Circular.

Article 2. General Provisions on Economic and Technical Standards

Article 2. The economic and technical standards stipulated in this Circular are the maximum levels, ensuring accurate and full costs to complete the provision of public service provision services.

Article 3. The economic and technical standards stipulated in this Circular shall be the basis for:

a) Determining job titles within the labor cost component, establishing the content and level of expenditure for the implementation of public service provision services using state budget funds, submitting to the competent authority for approval and annual budget allocation;

b) Determining unit prices and service fees for public service provision services using state budget funds to be ordered in accordance with Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government providing for the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure.

3. Determination of job titles:

a) Job titles within the labor cost component of the standard table shall be applied according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces; Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces; Decree No. 111/2022/NĐ-CP dated December 30, 2022 of the Government on contracts for certain types of work in administrative agencies and public institutions; Circular No. 09/2022/TT-BVHTTDL dated October 28, 2022 of the Minister of Culture, Sports and Tourism providing for job title codes, occupational standards, and salary grading for specialized fine arts staff or considering equivalent conversion according to positions approved by the competent authority;

b) In cases where the rank of job titles working at agencies and organizations does not comply with the standard table, the rank of job titles specified in the standard, equivalent grade, or actual working rank and labor cost shall be applied. In these cases, labor costs must not exceed labor costs calculated from the standard issued by the Minister of Culture, Sports and Tourism. Civil servants and public officials participating in work and receiving salaries from the state budget shall not apply the labor cost standards stipulated in this Circular.

Article 3. Content of economic and technical norms

1. The content of economic and technical norms includes:

a) Labor cost: is the direct and indirect labor time necessary for each level of average workers to complete the provision of a service. The labor cost of direct labor is the time spent on each process according to the guidance for implementing public service provision services, measured in workdays (8 hours) of workers as provided for in Article 105 of the Labor Code 2019. The labor cost of indirect labor is calculated at 15% of direct labor;

b) Machine and equipment usage cost: is the necessary time to use machines and equipment to provide public service provision services. The cost in the standard is calculated in shifts, each shift corresponding to one workday (8 hours) as provided for in Article 105 of the Labor Code 2019;

c) Material usage cost: is the specific quantity of materials required directly to provide public service provision services. The cost in the standard is calculated based on the specific quantity of each type of material. The cost of auxiliary materials is calculated at 10% of the total material cost.

2. The structure of economic and technical norms includes:

a) Name of the norm;

b) Description of work components: is the main processes to implement public service provision services;

c) Economic and technical standard table, including:

- Labor cost: job title and rank of labor, unit of labor cost measurement and standard labor cost value;

- Machine and equipment usage cost: name and type of machine and equipment, unit of labor cost measurement and standard usage cost value;

- Material usage cost: name and specification of material, unit of labor cost measurement and standard usage cost value;

- Normative value: the numerical value of actual time spent on labor, machinery and equipment usage, and material usage during the provision of public services;

- Notes: are instructions on how to calculate standards under different technical conditions (if any) or to complete a workload different from the unit of measurement in the Standard Table.

Article 4. The economic and technical standards prescribed in the attached Appendix to this Circular include:

a) Appendix I: Economic and Technical Standards for Services of Organizing Contests of Works of Fine Art and Photography to Serve Political Tasks;

b) Appendix II: Economic and technical standards for organizing exhibitions of fine arts and photography services to serve political tasks;

c) Appendix III: Economic and technical standards for organizing festivals of fine arts and photography services to serve political tasks.

Article 4. Organization of Implementation

1. Based on the economic and technical standards prescribed in this Circular, ministries, sectors, central agencies, People's Committees of provinces and centrally-run cities shall consider and decide to apply specific standards suitable to the conditions of units providing public service activities under their management jurisdiction.

2. Agencies and organizations using state budget funds to implement the provision of public service activities related to these services shall base on actual conditions and propose to competent authorities for consideration and decision on applying specific standards.

Article 5. Effective Date

1. This Circular takes effect from February 20, 2025.

2. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

3. During implementation, if any issues arise, agencies, organizations, and individuals shall promptly reflect them to the Ministry of Culture, Sports and Tourism (through the Fine Arts, Photography and Exhibition Department) for examination and resolution./.
