Regulations on sample certification procedures

Pursuant to the Law on Electronic Transactions dated June 22, 2023;
BASED ON Decree No. 23/2025/NĐ-CP dated February 21, 2025 of the Government on electronic signatures and trusted services;
Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
AT THE SUGGESTION OF THE DIRECTOR OF THE NATIONAL ELECTRONIC CERTIFICATION CENTER;
The Minister of Science and Technology issues this Circular to provide detailed regulations on sample certification procedures pursuant to Clause 2 of Article 29 of the Government Decree No. 23/2025/NĐ-CP dated February 21, 2025, concerning electronic signatures and trust services.
Article 1. Regulations on sample certification procedures
This Circular provides detailed regulations for Clause 2 of Article 29 of the Government Decree No. 23/2025/NĐ-CP dated February 21, 2025, concerning electronic signatures and trust services, including:
1. Sample certification procedures for organizations providing national electronic authentication services (National Electronic Authentication Center), and organizations providing public digital signature services as set out in Appendix I attached hereto.
2. Sample certification procedures for organizations providing trust services for time stamping services as set out in Appendix II attached hereto.
3. Sample certification procedures for organizations providing trust services for data message authentication services as set out in Appendix III attached hereto.
4. Sample certification procedures for organizations establishing specialized electronic signatures ensuring security as set out in Appendix IV attached hereto.
Article 2. Implementation clause
1. This Circular takes effect from the date of issuance.
2. The Circular No. 31/2020/TT-BTTTT dated October 30, 2020, issued by the Minister of Information and Communications, providing certification procedures for organizations providing national digital signature services shall cease to be effective from the date this Circular takes effect, except as provided in Clause 3 of this Article.
3. Except where they choose to apply the provisions of this Circular, organizations providing public digital signature services that have been legally operating and have certification procedures in accordance with Circular No. 31/2020/TT-BTTTT must, within two years from the date the Government Decree No. 23/2025/NĐ-CP dated February 21, 2025, concerning electronic signatures and trust services comes into force, take responsibility for reviewing, amending, supplementing, or replacing their certification procedures to comply with the provisions of this Circular.
Article 3. Implementation Organization
1. The Director of the Office, the Heads of the Department of Economy and Society, the Director of the National Electronic Authentication Center, the Heads of relevant units under the Ministry of Science and Technology, and related organizations and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, if there are difficulties or obstacles, organizations and individuals should submit their opinions to the Ministry of Science and Technology (through the National Electronic Authentication Center) for timely guidance and resolution./.
