PLAN

IMPLEMENTATION OF THE GOVERNMENT DECREE NO. 160/2018/NĐ-CP OF NOVEMBER 29, 2018 DETAILING THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE LAW ON NATURAL DISASTER PREVENTION AND CONTROL IN NINH THUAN PROVINCE

Pursuant to Government Decree No. 160/2018/NĐ-CP dated November 29, 2018 detailing the implementation of certain provisions of the Law on Natural Disaster Prevention and Control, the People's Committee of the province promulgates this plan for implementing Decree No. 160/2018/NĐ-CP with the following contents:

I. OBJECTIVES AND REQUIREMENTS

1. To determine responsibilities and assign specific tasks to all levels and sectors to implement Decree No. 160/2018/NĐ-CP dated November 29, 2018 of the Government.

2. To clearly define that natural disaster prevention and control work is the responsibility of the entire political system, including party committees at all levels, state administrative bodies, the United Front, political and social organizations, businesses, and the people.

3. To organize comprehensive dissemination and wide-ranging publicity of the contents of the Decree to all levels, sectors, and the public in order to create a profound change in understanding the importance of natural disaster prevention and control work, and to achieve high consensus during the process of implementing the Decree.

II. OBJECTIVES

1. General Objective:

To concretize and effectively implement Decree No. 160/2018/NĐ-CP dated November 29, 2018 of the Government to enhance capacity and proactively prevent and control natural disasters, adapt to climate change, reduce losses of life and property of the people and the State; create conditions for sustainable development, contribute to ensuring national defense and security, and gradually build safe communities and societies before natural disasters in the province.

2. Specific Objectives:

a) Organizations, individuals responsible for transmitting information must be familiar with the frequency and duration of information broadcasts; the network of information and equipment serving command and control activities in response to natural disasters.

b) Organizations, individuals assigned and delegated responsibilities and have effective mechanisms for cooperation in responding to natural disasters according to the level of disaster risk.

c) Mobilize, collect, and allocate promptly and accurately to the appropriate recipients various sources of relief and support for mitigating the consequences of natural disasters.

d) Ensure the rights and obligations of foreign organizations and individuals, international organizations participating in response and mitigation activities for natural disasters in the province.

e) Complete the organizational structure and tasks of the agency in charge of natural disaster prevention and control and search and rescue operations.

III. SOME SPECIFIC TASKS

1. Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue Operations:

a) Annually, improve the Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue Operations and assign tasks to each member responsible for specific areas and fields.

b) Develop and approve annual plans for natural disaster prevention and control and search and rescue operations.

c) Coordinate with localities and units to organize propaganda on the Law on Natural Disaster Prevention and Control, Decree No. 160/2018/NĐ-CP, and other regulatory documents on natural disaster prevention and control.

d) Continuously monitor weather and hydrological conditions, natural disasters, typhoons, floods, etc., to proactively advise the Provincial People's Committee to direct relevant departments, sectors, and localities to respond to natural disasters; mobilize resources within their authority to respond promptly and appropriately to the evolution of natural disasters in the locality.

e) Command responses to natural disasters and search and rescue operations in the province.

f) Supervise and urge departments, sectors, and localities to fulfill their natural disaster prevention and control tasks.

g) Organize the dissemination and promotion of community awareness on natural disaster prevention and control.

2. Department of Agriculture and Rural Development (Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue Operations):

a) Advise and implement the tasks of the Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue Operations in a timely and effective manner.

b) Direct the Limited Liability Company for Water Resource Management to cooperate with relevant units and localities to review and assess the quality of water reservoirs and take timely measures to address any incidents before the rainy season; for water reservoirs at risk of losing safety, develop reasonable water storage plans or limit water storage; develop emergency response plans for each water reservoir; arrange personnel, equipment, materials, and funds to implement the principle of "four localities".

c) Coordinate with the People's Committees of coastal districts to inspect and review the registration and inspection of fishing vessels according to current regulations. Coordinate with the Border Guard Command of the province to inspect technical conditions and equipment ensuring safety on fishing vessels before they set sail, particularly communication equipment and lifesaving devices. (especially communication equipment and lifesaving devices)to ensure that unsafe vessels do not set sail, especially those operating far from shore.

d) Advise and propose decisions on the use of the Natural Disaster Prevention and Control Fund to mitigate the consequences of natural disasters in accordance with regulations.

3. Military Command of the Province:

a) Implement the contents stipulated in Government Decree No. 160/2018/NĐ-CP dated November 29, 2018.

b) Take the lead and coordinate with the Border Guard Command of the province, the Public Security Department, and related ministries and sectors to develop proactive plans and prepare forces and means to respond promptly and effectively to emergencies, natural disasters, and search and rescue operations; stand ready to provide support to localities and the people in responding to and mitigating the consequences of natural disasters, rescue, and evacuation as required.

c) Implement investment in equipment and facilities for responding to emergencies, natural disasters, and search and rescue operations according to Decision No. 1041/QĐ-TTg dated June 24, 2014 of the Prime Minister. Purchase and equip equipment for responding to natural disasters and rescue operations suitable to the requirements, tasks of units, and the characteristics of natural disasters in each region and locality to enhance the effectiveness of rescue operations.

d) Effectively implement the principle of "four localities" in natural disaster prevention and control; organize training, drills, and exercises in natural disaster prevention and control and search and rescue operations to draw lessons suitable to the practical situation of the locality.

4. Border Guard Command of the Province:

a) Take the initiative, coordinate with the Department of Agriculture and Rural Development, coastal localities to strictly inspect the provision of communication equipment, safety devices for fishing vessels and fishermen operating at sea as prescribed; when tropical depression or typhoon warnings are received, organize signal firing to warn and call back fishing vessels, accurately grasp the number and location of vessels at sea, guide them to move to safe areas.

b) Develop proactive plans, prepare forces and means to promptly and effectively respond to emergency situations, natural disasters, and search and rescue operations.

c) Implement investment in equipment and facilities for responding to emergencies, natural disasters, and search and rescue operations according to Decision No. 1041/QĐ-TTg dated June 24, 2014 of the Prime Minister. Purchase and equip equipment for responding to natural disasters and rescue operations suitable to the requirements, tasks of units, and the characteristics of natural disasters in each region and locality to enhance the effectiveness of rescue operations.

5. Provincial Public Security Department:

a) Direct subordinate departments and public security agencies of districts and cities to cooperate with localities and units to inspect and strictly handle violations of laws on disaster prevention and control.

b) Build and implement plans to ensure public security, rescue, traffic safety, participate in responding to and mitigating consequences when natural disasters occur.

c) Invest in purchasing equipment and facilities for disaster response and rescue; organize training, drills to enhance the capacity of public security forces in disaster prevention and control and search and rescue operations.

6. Department of Information and Communications:

a) Guide the provincial Radio and Television Station, Ninh Thuan Newspaper, and grassroots information systems to strengthen propaganda and dissemination of contents implementing Decree No. 160/2018/ND-CP to organizations, businesses, and people within the province.

b) Build and update plans to ensure communication services for command and control in responding to natural disasters.

7. Department of Education and Training:

a) Organize training and enhance awareness among lecturers, teachers, and educational management staff about disaster prevention and mitigation; train knowledge and disseminate skills on disaster prevention and mitigation, climate change adaptation in schools, especially primary and secondary levels.

b) Direct the construction of plans to ensure safety for students, learning equipment, and educational infrastructure when natural disasters such as tornadoes, floods, and typhoons occur; invest in building schools that are sturdy and safe before, during, and after the flood season, while serving as safe shelters for the community when disasters strike.

8. The Department of Planning and Investment shall take the lead, coordinate with relevant departments and localities to review, consolidate, balance, and propose investment capital for development to implement disaster prevention and damage mitigation work.

9. The Department of Finance shall take the lead, coordinate with relevant departments and localities to advise and propose the use of provincial budget reserves and other provincial resources for disaster prevention, search and rescue, and post-disaster recovery. Actively advise and propose immediately upon receiving state support resources to allocate in a timely and appropriate manner.

10. The provincial Radio and Television Station, Ninh Thuan Newspaper, Phan Rang Coastal Information Station, and provincial news agencies have the responsibility to broadcast disaster response directives and search and rescue documents issued by the People's Committee of the province and the Provincial Steering Committee for Disaster Prevention and Control and Search and Rescue.

11. People's Committees of districts and cities:

a) Implement the contents stipulated in Government Decree No. 160/2018/NĐ-CP dated November 29, 2018.

b) Annually, improve the Steering Committee for Disaster Prevention and Control and Search and Rescue at all levels; issue working regulations, assign responsibilities and coordination in disaster response according to the risk level as stipulated in Government Decree No. 160/2018/ND-CP dated November 29, 2018.

c) Establish effective coordination mechanisms between the Steering Committee for Disaster Prevention and Control and Search and Rescue at all levels and relevant agencies and units to comply with the provisions of Government Decree No. 160/2018/ND-CP and meet the requirements of disaster prevention and control work.

d) Enhance disaster prevention and control capabilities at the local level, allocate resources, invest in equipment and tools, and establish information networks to serve command and control activities in disaster response.

e) Organize propaganda and communication to raise community awareness on disaster prevention and control; build emergency response forces for disaster prevention and control, initially at the commune level with self-defense forces as the core.

f) Review, complete, and proactively allocate resources to implement disaster prevention and control and search and rescue plans at all levels; integrate disaster prevention and control into economic and social development planning; inspect and handle projects that increase disaster risks; develop disaster response plans corresponding to the risk level (large floods, flash floods, landslides, etc.) ensuring practicality.

g) Implement the principle of "four localities" in disaster prevention and control; organize drills to draw lessons suitable for local realities.

h) Implement contents related to the Disaster Prevention and Control Fund.

i) Mobilize donations and allocate relief and support resources to mitigate disaster consequences.

j) Ensure the rights and obligations of domestic organizations and individuals; the rights and obligations of foreign organizations and international organizations participating in disaster response and recovery activities in the locality as prescribed in Government Decree No. 160/2018/ND-CP.

k) Direct and organize the timely and accurate dissemination of weather forecast and warning bulletins, command and control documents for disaster response issued by the provincial People's Committee and the Provincial Steering Committee for Disaster Prevention and Control and Search and Rescue in the warned area.

l) Provide specific guidelines on the content, frequency, and duration of disaster response command broadcasts on local information systems. For places without radio or television, traditional signaling methods according to local conventions should be used to inform affected households.

m) Command and mobilize local resources to respond promptly when a disaster occurs; follow superior commands; guide and organize evacuation to safe locations; decide to enforce evacuation for organizations and individuals who do not voluntarily comply with evacuation instructions for the purpose of ensuring personal safety.

n) Direct the People's Committee of the commune to implement the contents within the commune's jurisdiction as prescribed in Decree No. 160/2018/NĐ-CP.

12. Ministries, sectors, and agencies shall organize extensive dissemination and popularization of the contents of Decree No. 160/2018/NĐ-CP dated November 29, 2018 of the Government to organizations and individuals, ensuring they are aware and implement it; annually, they shall improve and assign tasks to members of the Provincial Steering Committee for Flood Control and Search and Rescue to ensure proactive management of flood control work as prescribed.

IV. IMPLEMENTATION

1. Ministries, sectors, agencies, and localities shall concentrate on leading, directing, strengthening inspection, urging the implementation of this Plan based on their assigned tasks; report periodically each year to the Provincial People's Committee on the results of implementation (through the Standing Office of the Provincial Steering Committee for Flood Control and Search and Rescue).

2. Entrust the Standing Office of the Provincial Steering Committee for Flood Control and Search and Rescue to monitor, inspect, urge, and compile the results of implementation for the Provincial People's Committee.
