The Center for Design and Restoration of Cultural Relics
THE MINISTER OF CULTURE, SPORTS AND TOURISM
Based on Decree No. 81/CP dated November 8, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information.
Based on Decision No. 3127/TC-QĐ dated October 9, 1995 of the Minister of Culture and Information on the functions and tasks of the Center for Design and Restoration of Cultural Relics.
Considering the proposals of the Heads of the Organization and Cadres Department and the Director of the Center for Design and Restoration of Cultural Relics.
DECISION:
Article 1. Issued herewith is the Regulation on the operation of the Center for Design and Restoration of Cultural Relics.
Article 2. The Regulation issued herewith shall take effect from the date of issuance, all previous documents with contents contrary to this Regulation shall be abolished.
Article 3. The Heads of the Ministry's Office, the Heads of the Organization and Cadres Department, the Heads of the Planning Department, the Heads of the Finance and Accounting Department, the Director of the Center for Design and Restoration of Cultural Relics, and the Heads of related units shall be responsible for implementing this Decision.
REGULATIONS ON THE OPERATION
OF THE CENTER FOR DESIGN AND RESTORATION OF CULTURAL RELICS
(Issued together with Decision No. 1605 TC-QĐ dated July 25, 1996
of the Minister of Culture and Information)
The Center for Design and Restoration of Cultural Relics is a scientific research unit under the Ministry of Culture and Information, having the function of researching the preservation of cultural relics (movable and immovable properties) throughout the country.
The Center for Design and Restoration of Cultural Relics operates under the mechanism of a public service entity with income, has its own seal, and is allowed to open an account at the State Bank.
The Center for Design and Restoration of Cultural Relics is assigned the following main tasks:
Designing and restoring cultural relics according to the plan of the Ministry of Culture and Information (Heritage Conservation Department); participating in consulting and reviewing projects and the implementation process of these projects.
Researching, building, and storing scientific files on cultural relics (movable and immovable properties) to serve the work of preservation, restoration, enhancement, and introduction of cultural relics.
Surveying and developing comprehensive planning projects, investment restoration and enhancement projects for particularly important cultural relics and other cultural relics according to the plan of the Ministry.
Researching, cooperating in research and experimenting with formulas and technological processes for preserving cultural relics; researching and proposing economic and technical norms in the restoration of cultural relics; researching and experimentally constructing traditional and new techniques in the restoration of cultural relics.
Participating in postgraduate training, guiding doctoral students, training specialized staff and technical workers.
International cooperation in the fields of research, preservation, and restoration of cultural relics.
Managing assets, finances, and personnel of the center in accordance with current state policies and regulations of the Ministry of Culture and Information.
Chapter I:
ORGANIZATIONAL STRUCTURE AND FUNCTIONS AND TASKS
Article 1: The organizational structure of the center's departments:
1- Director and Deputy Directors
2- Administrative and General Affairs Department
3- Design and Documentation Department
4- Preservation Laboratory
Article 2: 5- Experimental Workshop for Preservation and Restoration
6- In addition to the quota assigned by the Ministry, the Center uses flexible staffing: consultants, scientific and technical officers, and other workers under contractual arrangements.
Functions, tasks, and relationships between departments:
1- Director:
The Director manages and oversees the entire operation of the center and is responsible to the Minister for all activities of the center, in accordance with Decision No. 3127/TC-QĐ dated October 9, 1995 of the Minister of Culture and Information, national regulatory documents, and internal regulations. The Director directly manages the planning-finance, organization, scientific-technical, and professional activities of the agency.
Deputy Directors assist the Director in managing the agency's operations, directly manage the tasks delegated by the Director, and act on behalf of the Director when authorized.
2- Administrative and General Affairs Department:
a) Personnel management: assisting the Director in recruitment and transfer; arranging, recommending promotions, salary adjustments, and resolving labor policies, wages, social welfare...
b) General affairs and planning: assisting the Director in developing work plans; compiling and analyzing the operational situation of the center; drafting contracts and monitoring their implementation.
c) Accounting and finance: responsible for financial and asset management of the agency, ensuring revenue and expenditure according to budget accounts and non-budget accounts; ensuring financial rights and obligations of officials and employees in accordance with regulations; monitoring and summarizing revenue and expenditure situations to report to the Director.
d) Administrative management: secretarial, archives, reception, property and housing management, transportation management, and security of the agency.
3- Design and Documentation Department:
a) Collecting, building, preserving, and providing scientific files and relevant materials on cultural relics; researching cultural relics from historical, cultural, architectural, and artistic perspectives to serve the development of projects and the preparation of technical design files.
b) Surveying and developing comprehensive planning projects, investment restoration and enhancement projects for cultural relics; preparing technical design files for particularly important cultural relics and other cultural relics according to the plan and contracts assigned by the Center Director.
c) Consulting and participating in the review of comprehensive planning projects and investment restoration and enhancement projects for cultural relics carried out by other units; consulting in the technical supervision of the implementation of restoration and enhancement projects for cultural relics.
d) Establishing standards and norms for the restoration and enhancement of cultural relics.
4- Preservation Laboratory:
Researching and collaborating in research and experimentation on formulas and processes for preserving cultural relics (movable and immovable properties) using chemical and physical methods. Specific tasks include:
a) Studying the preservation characteristics and conditions of artifacts and cultural relics of organic and inorganic origins; collecting samples.
b) Researching or organizing collaborative research on formulas and technical processes for preserving materials and substances of artifacts and cultural relics; producing experimental chemicals for cultural relic preservation; drafting guidelines for the preservation of artifacts and cultural relics.
a) Study and restore traditional technical processes or alternative technical processes used in the restoration of cultural relics and historical sites.
b) Implement experimental preservation and restoration of cultural relics and historical sites with special value that require high-level techniques, using artisans and technicians with corresponding qualifications.
6- Scientific and Technical Council:
The Council fulfills the role of scientific and technical advisory to the director, ensuring the effectiveness and high quality of research, consulting, and experimental projects of the center.
Composition of the Council:
Chairman: Director
Scientific Secretary
Heads of specialized departments
External experts invited
Article 3: Leadership and management relationships within the center such as the Party Committee - Trade Union Executive Board and other mass organizations participating in management but not directly deciding on tasks within the authority of the Director.
Chapter II:
REGULATIONS ON THE OPERATIONS OF THE CENTER
Article 4: Based on Decision No. 3127/TC-QĐ dated October 9, 1995 of the Minister of Culture and Information, the Center operates according to the following contents:
a) Research and develop investment projects for the repair and enhancement of historical sites.
b) Survey, assess the current status and causes of deterioration of historical sites. Design and prepare budgets for the repair and enhancement of historical sites and cultural works with historical value, works within historical site complexes, and related civil works.
c) Participate in the review of investment construction projects for the repair and enhancement of historical sites, overall planning projects, and design projects for the repair and enhancement of historical sites.
d) Advise on tendering, selecting contractors, and economic activities related to design, procurement of materials and equipment for historical sites.
đ) Develop standards, technological procedures, and economic-technical norms for the preservation and repair of historical sites.
e) Carry out architectural interior and exterior decoration with special artistic characteristics, reflecting national traditions.
g) Develop and implement scientific research topics.
h) Technically supervise and manage investment projects for the repair and enhancement of historical sites.
Tasks with public service nature are assigned to departments or directly to the project leader through work assignment forms and approved research plans. Non-public service tasks are assigned through internal contractual agreements, closely monitored and inspected by departments and the director, and settled appropriately based on the economic-technical results of the contract.
Article 5: Assignment of research tasks.
Research topics, after being approved by the Ministry (or the State...), are directly assigned by the director to the topic leader or department through work assignment forms. Other tasks are also directly assigned by the director to the implementing officers.
Chapter III:
LABOR AND SALARIES
Article 6: The center cares for, trains, and selects staff to build a compact and efficient workforce in terms of quantity, quality, and structure, capable of flexible development when necessary.
In addition to the fixed number of officials stipulated by the State and the Ministry, when necessary, the center may employ external collaborators or workers through labor contracts or economic-scientific-technical contracts, adhering to the Labor Law and relevant state regulations.
Article 7: Labor contracts or economic contracts are signed by the director or authorized person, and approved by the director.
General tasks or those involving a single research topic are directly signed by the director. Tasks requiring additional manpower (with technical skills) must be signed by the responsible officer and approved by the director.
Article 8: The center pays salaries directly to:
Officials and employees receiving public service salaries.
Other workers (when participating in economic contracts) are paid according to Government Decree No. 26/CP dated May 23, 1993 (the responsible officer cannot pay). This involves monitoring, accounting, and separate accounting... which form the basis for salary payments for contracts. For distant projects, the director may authorize the responsible officer to advance salaries to workers, but this must be consolidated and tracked centrally by the center.
Article 9: The center fully implements leave policies, overtime policies, concurrent positions, social insurance, health insurance, and other policies for civil servants and workers of the agency.
All civil servants and workers eligible for annual leave must plan their leave for the year, report to the director, the directly managing department, and the administrative department. Annual leave must be taken in the same year and cannot be carried over to the next year. Only in cases where the director requires urgent completion of a task can a civil servant take leave in the following year and this is resolved in the first quarter.
Chapter IV:
FINANCE
Article 10: The center must establish a financial plan based on quarterly and annual financial plans of departments, workshops, and divisions. The center must register its business operations and pay taxes to the tax authority as required by law.
Article 11: Advance payment for design and research costs.
Research plans approved by the director, approved by the Ministry (for Ministry-funded projects) or by the State (for State-funded projects), serve as the basis for advance payment. The director's approval of the results of each phase of the research serves as the condition for further advance payment according to the plan.
Documentation for settlement of design fees under the contract includes the acceptance record of the design documents, the approval decision of the competent authority, and confirmation of submission of the design documents (including descriptions, reference images, drawings, estimates, and related documents) by the planning and documentation department.
Article 12: Financial resources obtained from revenue-generating activities are used in accordance with Circulars No. 01/TC/HCVX dated January 4, 1994, and No. 25 TC-TCT dated March 28, 1994, issued by the Ministry of Finance.
Article 13: Every collective and individual managing fixed assets of the center must bear material responsibility; losses and damages must be compensated.
Chapter V:
SOME INTERNAL POLICIES AND REGULATIONS
Article 14: The travel allowance is only paid to civil servants, not for research project contracts or construction projects (design, construction, maintenance) under the state regulations. For civil servants traveling for research projects and design-construction contracts, travel expenses are deducted from allocated funds or approved plans.
Article 15: Transaction hospitality expenses.
General hospitality expenses of departments and workshops are specifically regulated by the administrative department.
The director's office (or authorized representative) hospitality tea is managed by the administrative department and settled monthly.
Other transaction costs must be frugal and approved by the director.
Article 16: The center and union provide assistance within their capacity to civil servants and officials facing sudden difficulties, who may be eligible for emergency hardship allowances.
Article 17: After fulfilling the budget payment obligations as stipulated in Circular No. 01/TC-HCVX and Circular No. 25/TC-TCT of the Ministry of Finance, the Center actively manages remaining revenue according to these circulars but the reward fund shall not exceed three months' basic salary.
Article 18: This Regulation takes effect from the date of issuance, all previous documents with contents contrary to this regulation are hereby abolished.
During the implementation of this regulation, if there are any unreasonable aspects, the center director will compile reports to the Ministry for timely supplementation and amendment.
