Regarding the issuance of regulations on the use and training of vocational teachers

Pursuant to Decree No. 86/CP dated November 5, 2002 of the Government stipulating the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Pursuant to Decree No. 96/CP dated December 7, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
Pursuant to Decree No. 02/2001/NĐ-CP dated January 9, 2001 of the Government detailing the implementation of the Labor Code and the Education Law regarding vocational training;
At the proposal of the General Director of the Vocational Training Administration,
DECISION:
Article 1. This Decision promulgates the Regulations on the use and training of vocational teachers.
Article 2. This Decision shall take effect fifteen days from the date of signature.
All previous regulations on the use and training of vocational teachers that conflict with this Decision are hereby abolished.
Article 3. The Heads of the Ministry's Office, the General Director of the Vocational Training Administration, the Directors of Provincial Departments of Labor - Invalids and Social Affairs, Principals and Directors of vocational training institutions, and Heads of related units are responsible for implementing this Decision.
REGULATIONS
USE AND TRAINING OF VOCATIONAL TEACHERS

PART I
GENERAL PROVISIONS
Article 1. The purpose of these regulations on the use and training of vocational teachers is:
1. To implement standardization of vocational teacher qualifications according to current laws;
2. To employ vocational teachers in accordance with their professional qualifications and fields of study;
3. To regularly train and improve the qualifications of vocational teachers.
Article 2. 1. Meat and other products of terrestrial animals after slaughter and initial processing must be inspected and stamped with the meat inspection stamp or labeled with the hygiene inspection label for animal health before being put into circulation for domestic consumption or export;
- Vocational teachers at vocational training institutions (vocational schools, vocational centers, vocational classes, and technical colleges with vocational training functions and tasks);
- Management staff (qualified as teachers) at vocational training institutions who participate in teaching.
PART II
USE OF VOCATIONAL TEACHERS
Article 3. Teachers hired or contracted under labor contracts before this regulation takes effect but have not yet met the required standards for professional qualifications as stipulated in Article 11 and Article 20 of Decree No. 02/2001/NĐ-CP dated January 9, 2001 of the Government detailing the implementation of the Labor Code and the Education Law on vocational training must be trained or retrained to meet the required standards.
Article 4.
1. Vocational training institutions are responsible for guiding probationary or trial period teachers on the following main contents:
- The Party's viewpoints, policies, and state laws on vocational training;
- The duties of civil servants as stipulated in Article 6 of the Civil Servant Law (if the teacher is a civil servant);
- Systematic knowledge about the organizational structure, functions, and tasks of the vocational training institution; the Charter of the vocational school or the Regulation of the vocational center; internal rules of the institution; regulations on working hours for vocational school teachers...
- Practice in preparing lesson outlines, lesson plans; trial lectures and other tasks related to teaching work.
2. During the probationary or trial period, vocational training institutions need to create conditions and plan for probationary teachers to attend training courses to complete their knowledge and skills to ensure effective teaching performance.
3. Vocational training institutions must issue a written decision assigning someone to guide probationary or trial period teachers. Each probationary or trial period teacher must have one guide. The guide must have the ability, professional technical and pedagogical qualifications, reputation, and teaching experience, and must enjoy the benefits prescribed by current state regulations.
Article 5.
1. Vocational training institutions must employ vocational teachers in accordance with the professional standards for vocational teacher positions, or as agreed in the labor contract. In cases where teachers must be assigned to teach subjects or guide practical work different from those they were trained in, they must be retrained before being assigned to teach;
2. Beyond the standard number of hours, vocational training institutions may not assign more than half the standard number of hours for full-time teachers; not more than one-third of the standard number of hours for part-time teachers, and the total time exceeding the standard should not exceed 200 hours in one academic year.
CHAPTER III
TRAINING OF VOCATIONAL TEACHERS
Article 6. Organizing training for vocational teachers in three forms:
- Standardization training for teachers who have not reached the required standards or the standards of their current positions;
- Regular training for all teachers;
- Advanced training for all or a portion of teachers based on the requirements of the profession and assigned tasks.
Article 7.
1. Content of standardization training:
- Professional knowledge and skills;
- Pedagogical skills;
- Foreign languages;
- Information technology;
- Other contents specified by the position standards.
2. Content of regular training:
- Party viewpoints, policies, and state laws, regulations on vocational training;
- Professional knowledge and new scientific and technological advancements in the field taught;
- Occupational skills (including the use of modern production equipment and advanced production technologies in the occupation...);
- Teaching methods, program development methods, and the use of new teaching aids.
- Foreign languages.
- Information technology.
3. Content of advanced training includes:
- Issues arising from job requirements and occupational needs;
- Improving professional and pedagogical skills, practical abilities;
- Standards for higher positions.
Article 8.
1. Regular training is conducted annually according to the training plan of the Ministry, sector, locality, and vocational training institutions through the following organizational forms:
- Workshops on professional and technical skills, teaching methods;
- Specialized training sessions;
- Field trips, research, and practical surveys.
- Scientific seminars.
2. Standardization and advanced training are conducted through the following organizational forms:
- Centralized or self-study;
- Advanced skill practice.
Article 9. The organization and implementation of standardization and advanced training for vocational teachers are carried out at the following institutions:
1. Technical pedagogical training is organized at technical teacher training colleges and technical universities.
2. Professional training in new specialities, techniques, and technologies shall be organized at universities, colleges, technical research institutes, and enterprises with advanced production equipment, technology.
3. Vocational skill training for vocational teachers shall be organized at vocational schools, production, business, and service establishments meeting the required conditions.
4. Foreign language and computer training for vocational teachers shall be organized at entities with legal personality and the necessary conditions to ensure quality and facilitate implementation.
Article 10. Vocational teachers at public and semi-public institutions (teachers receiving salary from the state budget) who are sent for further education and professional training shall enjoy their salary and other benefits as stipulated by current laws; contractual teachers sent for training shall benefit according to the terms agreed upon in their labor contracts.
Article 11. Annually, vocational teachers must develop and implement plans for self-training.
Vocational training institutions have the responsibility to inspect and evaluate the results of teachers' self-training.
PART IV
IMPLEMENTATION
Article 12. The General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs, and vocational training management agencies of ministries, sectors, and localities have the responsibility to:
1. Guide public and private vocational training institutions within their jurisdiction to implement this Regulation;
2. Develop plans and budget estimates for teacher training programs to be submitted for approval by competent authorities; effectively utilize resources and promote socialization in teacher training activities;
3. Monitor, inspect, and audit the implementation of regulations on the use and training of vocational teachers, and handle violations of these regulations by training institutions.
Article 13. Management agencies of vocational training of ministries, sectors, and localities are responsible for managing, directing, and implementing training plans, building teaching staff teams for vocational training institutions within their jurisdiction. They shall report on the implementation of teacher utilization and training activities to the General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs as prescribed by current laws.
Article 14. Vocational training institutions shall base their plans for training teaching staff on the requirements for development, the current level of the teaching staff, and proactively develop training plans for teaching staff for each phase and academic year. Ensuring that teachers undergo specialized and vocational training every five years, and new technology training every two years; they shall also receive advanced training based on job requirements; implement and report on the implementation to the supervising authority and the General Department of Vocational Training.
Article 15. Each vocational training institution may organize classes or collaborate with other vocational training institutions in the area, region, or field to organize advanced training classes or send teachers to attend training classes assigned to implement such tasks.
Article 16. Vocational training institutions need to rationally utilize the teaching staff, create favorable conditions and support for teachers to participate in training as stipulated; complete the standardization of the existing teaching staff by 2007./.
