Detailed regulations on certain provisions and implementation measures

of the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Zone

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Zone dated March 13, 2025;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree detailing certain provisions and implementation measures of the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Zone.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree details certain provisions and implementation measures of the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Zone (hereinafter referred to as the Ordinance), including:

1. Clause 5, Article 14 regarding the content and management measures to ensure technical aspects of construction works within the Ho Chi Minh Mausoleum Relic Zone.

2. Point a, Clause 1, Article 17 concerning State-level Ho Chi Minh Chairman mourning ceremonies and point b, Clause 1, Article 17 concerning mourning ceremonies for foreign high-ranking guests.

3. Point a, Clause 1, Article 18 concerning State-level memorials for Heroes and Martyrs and point b, Clause 1, Article 18 concerning memorials for Heroes and Martyrs for foreign high-ranking guests.

4. Article 26 regarding the content of protecting the Ho Chi Minh Mausoleum Relic Zone.

5. Article 31 regarding the system of policies for forces directly managing and protecting the Ho Chi Minh Mausoleum Relic Zone.

6. Responsibilities of central ministries, agencies, local authorities, organizations in coordinating to fulfill tasks of managing and protecting the Ho Chi Minh Mausoleum Relic Zone.

Article 2. Applicability

1. Officers, professional soldiers, non-commissioned officers, soldiers, defense civil servants, defense staff members, defense workers, and contractual laborers under the Ho Chi Minh Mausoleum Command.

2. Agencies, organizations, individuals who are Vietnamese citizens; international organizations and foreign organizations, individuals related to the management and protection of the Ho Chi Minh Mausoleum Relic Zone.

Chapter II

CONTENTS AND MEASURES FOR TECHNICAL MANAGEMENT AND ENSURING TECHNICAL ASPECTS OF CONSTRUCTION WORKS WITHIN THE HO CHI MINH MAUSOLEUM RELIC ZONE

Article 3. Contents and measures for technical management of the technical systems and architectural structures of construction works within the Ho Chi Minh Mausoleum Relic Zone

1. Technical management contents include:

a) Management of technical systems;

b) Management of architectural structures of construction works.

2. Measures for technical management include:

a) Management of quantity, quality, type, degree of synchronization, and documentation of technical systems and architectural structures of construction works within the Ho Chi Minh Mausoleum Relic Zone in accordance with regulations;

b) Management and operation of technical systems of construction works within the Ho Chi Minh Mausoleum Relic Zone (hereinafter referred to as construction works within the Mausoleum) to ensure technical parameters in compliance with regulations for medical work, visits, and combat readiness tasks;

c) Implementation of preservation work for architectural structures, ensuring environmental aesthetics within the Ho Chi Minh Mausoleum Relic Zone for Ho Chi Minh Chairman mourning ceremonies, memorials for Heroes and Martyrs, and other activities in the area.

Article 4. Contents and measures for ensuring technical aspects of technical systems and architectural structures of construction works within the Ho Chi Minh Mausoleum Relic Zone

1. Technical assurance contents include:

a) Preservation, maintenance, and repair of technical systems and architectural structures;

b) Sealing and unsealing of technical equipment;

c) Extending the service life of technical equipment.

2. Measures for technical assurance include:

a) Establishing, issuing, and strictly implementing procedures and guidelines for operating, maintaining, servicing, repairing, inspecting, and calibrating technical systems and architectural structures within the Ho Chi Minh Mausoleum Relic Zone;

b) Establishing and issuing economic and technical standards for technical equipment and architectural structures within the Ho Chi Minh Mausoleum Relic Zone;

c) Establishing and organizing the implementation of technical assurance work plans; carrying out procurement, acceptance, sealing, installation, testing, and completion to put new technical systems and architectural structures into operation; removing from inventory and organizing disposal of technical systems and architectural structures that have exceeded their operational lifespan or are damaged in accordance with regulations;

d) Preserving, maintaining, inspecting, calibrating, and regularly repairing technical equipment in inventory to maintain stable and continuous operational capacity according to the functions and tasks of technical systems of construction works, ensuring redundancy factors as designed for the Mausoleum and supporting construction works for long-term preservation and absolute safety of Ho Chi Minh Chairman's remains;

đ) Annually establishing and organizing the implementation of repair and regular maintenance plans for technical systems and architectural structures of the Mausoleum and the Memorial to Heroes and Martyrs during visitation breaks. After completing annual repair and regular maintenance, technical systems must operate stably and reliably with design redundancy factors; architectural structures must be neat and clean.

3. The Ministry of National Defense decides on investment for replacement, upgrading, and renovation of technical systems and architectural structures of the Mausoleum and supporting construction works for long-term preservation and absolute safety of Ho Chi Minh Chairman's remains, ensuring stable and reliable operation of the systems with design redundancy factors. Priority should be given to using advanced science, technology, and equipment in replacing, upgrading, and modernizing technical systems of the Mausoleum and supporting construction works for long-term preservation and absolute safety of Ho Chi Minh Chairman's remains.

Chapter III

HO CHI MINH CHAIRMAN MOURNING CEREMONIES AND MEMORIALS FOR HEROES AND MARTYRS AT STATE LEVEL AND FOREIGN HIGH-RANKING GUESTS' MOURNING CEREMONIES

NATIONAL HEROES AND MARTYRS, AND VISITING THE PRESIDENT HÔ CHIÊM MINH, REMEMBRANCE OF NATIONAL HEROES AND MARTYRS FOR HIGH-RANKING FOREIGN GUESTS

CHAIRMAN HO CHI MINH, COMMEMORATION OF HEROIC VICTIMS FOR HIGH-RANKING FOREIGN GUESTS

REMEMBRANCE OF HEROES AND MARTYRS FOR HIGH-RANKING FOREIGN DELEGATIONS

Article 5. State-level mourning ceremonies for President Ho Chi Minh on holidays, festivals, and commemorative days

1. On holidays, festivals, and commemorative days specified from point a to point g of Clause 4, Article 17 of the Ordinance, the Government Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize delegations of Party and State leaders, former leaders, and the Central Committee of the Vietnam Fatherland Front to visit the Mausoleum to pay respects to President Ho Chi Minh.

2. The Ministry of National Defense shall prepare five wreaths, each with a red ribbon bearing gold lettering reading "Eternal gratitude to the great President Ho Chi Minh," presented by the Central Committee of the Communist Party of Vietnam, the President of the Socialist Republic of Vietnam, the National Assembly of the Socialist Republic of Vietnam, the Government of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front.

3. The Ministry of National Defense shall organize an honor guard formation.

4. The welcoming and guiding of the delegation shall be carried out by the Commander of the Ho Chi Minh Mausoleum Command or authorized personnel.

5. During the mourning ceremony, military bands shall play the musical pieces "Praising Uncle Ho" by composer Van Cao, "Leader's Song" by composer Luu Huu Phuoc, and "The Person Is Our Unshakable Faith" by composer Chu Minh.

6. The Ministry of National Defense shall ensure security and safety.

7. The state-level mourning ceremony for President Ho Chi Minh shall be conducted before the memorial ceremony for national heroes and martyrs. However, the state-level mourning ceremony for President Ho Chi Minh on the occasion of Martyrs' and War Invalids' Day shall be held after the national memorial ceremony for heroes and martyrs.

8. After the state-level mourning ceremony for President Ho Chi Minh organized for the delegations specified in Clause 1 of this Article, delegations from central ministries and agencies and the city of Hanoi shall visit the Mausoleum in the following order:

a) Central Military Commission - Ministry of National Defense;

b) Central Public Security Party Committee - Ministry of Public Security;

c) Hanoi Municipal Party Committee, People's Council, People's Committee, and Central Committee of the Vietnam Fatherland Front in Hanoi;

d) Ministry of Home Affairs (on the occasion of Martyrs' and War Invalids' Day as specified in point e of Clause 4, Article 17 of the Ordinance);

đ) Ministry of Foreign Affairs (on the occasion of National Day as specified in point g of Clause 4, Article 17 of the Ordinance);

e) Diplomatic Corps in Hanoi (on the occasion of National Day as specified in point g of Clause 4, Article 17 of the Ordinance);

g) Ba Dinh Historical and Cultural Relics Complex.

Article 6. State-level mourning ceremonies for President Ho Chi Minh during the National Congress of the Communist Party of Vietnam

1. During the National Congress of the Communist Party of Vietnam as specified in point h of Clause 4, Article 17 of the Ordinance, the Central Party Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize delegations attending the National Congress of the Communist Party of Vietnam to visit the Mausoleum to pay respects to President Ho Chi Minh.

2. The Ministry of National Defense shall prepare one wreath for the delegation, with a red ribbon bearing gold lettering reading "Eternal gratitude to the great President Ho Chi Minh."

3. Other contents shall be implemented according to the provisions of Clause 3, 4, 5, and 6 of Article 5 of this Decree.

Article 7. State-level mourning ceremonies for President Ho Chi Minh during the National Assembly session

1. During the National Assembly session as specified in point i of Clause 4, Article 17 of the Ordinance, the National Assembly Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize delegations attending the National Assembly session to visit the Mausoleum to pay respects to President Ho Chi Minh.

2. The Ministry of National Defense shall prepare one wreath for the delegation, with a red ribbon bearing gold lettering reading "Eternal gratitude to the great President Ho Chi Minh."

3. Other contents shall be implemented according to the provisions of Clause 3, 4, 5, and 6 of Article 5 of this Decree.

Article 8. National Memorial Ceremony for Heroes and Martyrs on Festivals, Holidays, and Commemorative Days

1. On festivals, holidays, and commemorative days specified from point a to point g Clause 4 Article 17 Ordinance, the Government Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize a delegation of Party and State leaders, former leaders, and the Central Committee of the Vietnam Fatherland Front to pay tribute to Heroes and Martyrs at the Monument to Heroes and Martyrs.

2. The Ministry of National Defense shall prepare five wreaths, each with a red ribbon bearing gold lettering reading "Forever Remember the Heroes and Martyrs" from the Central Committee of the Communist Party of Vietnam, the President of the Socialist Republic of Vietnam, the National Assembly of the Socialist Republic of Vietnam, the Government of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front.

3. The Ministry of National Defense shall organize an honor guard formation.

4. The person receiving and guiding the delegation:

a) An officer from the Ho Chi Minh Mausoleum Command designated by the Commander of the Ho Chi Minh Mausoleum Command;

b) For the Memorial Ceremony for Heroes and Martyrs on the occasion of the War Invalids and Martyrs Day: the Commander of the Ho Chi Minh Mausoleum Command or an authorized officer.

5. When conducting the Memorial Ceremony, military bands play the music "Soul of the Fallen Soldiers" by composer Luu Huu Phuoc and "Funeral March" by composer Do Nhu.

6. The Ministry of National Defense shall ensure security and safety.

7. After the Memorial Ceremony for Heroes and Martyrs stipulated in Clause 1 of this Article, delegations of central ministries and departments and the city of Hanoi shall pay tribute to Heroes and Martyrs at the Monument to Heroes and Martyrs in accordance with the order prescribed in Clause 8 Article 5 Decree.

Article 9. Memorial Ceremony for Heroes and Martyrs during the National Congress of the Communist Party of Vietnam

1. During the National Congress of the Communist Party of Vietnam specified in point h Clause 4 Article 17 Ordinance, the Central Party Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize a delegation attending the National Congress of the Communist Party of Vietnam to pay tribute to Heroes and Martyrs at the Monument to Heroes and Martyrs.

2. The Ministry of National Defense shall prepare one wreath for the delegation, with a red ribbon bearing gold lettering reading "Forever Remember the Heroes and Martyrs."

3. Other contents shall be implemented according to the provisions in Clause 3, point a Clause 4, Clause 5, and Clause 6 Article 8 Decree.

Article 10. Memorial Ceremony for Heroes and Martyrs during the Opening Session of the First Term of Each National Assembly

1. On the day of opening the first session of each term of the National Assembly, the National Assembly Office shall take the lead and coordinate with the Ministry of National Defense and relevant agencies to organize a delegation attending the National Assembly session to pay tribute to Heroes and Martyrs at the Monument to Heroes and Martyrs.

2. The Ministry of National Defense shall prepare one wreath for the delegation, with a red ribbon bearing gold lettering reading "Forever Remember the Heroes and Martyrs."

3. Other contents shall be implemented according to the provisions in Clause 3, point a Clause 4, Clause 5, and Clause 6 Article 8 Decree.

Article 11. Memorial Ceremony for Foreign High-Level Guests Visiting Chairman Ho Chi Minh

1. The classification of the Memorial Ceremony for foreign high-level guests visiting Chairman Ho Chi Minh is as follows:

a) Class A: Memorial Ceremony for Head of State;

b) Class A1: Memorial Ceremony for Minister and equivalent;

c) The classification and upgrading of the Memorial Ceremony for Chairman Ho Chi Minh shall be carried out according to the requirements of the Ministry of Foreign Affairs or the protocol agency of central ministries and departments based on the position of foreign high-level guests and the purpose of their visit to Vietnam;

d) In special cases, upon the request of the Ministry of Foreign Affairs, the Memorial Ceremony for Chairman Ho Chi Minh at Class A may be organized outside the time specified in Clause 2 Article 17 Ordinance.

2. The Ministry of National Defense shall coordinate with the Ministry of Foreign Affairs or the protocol agency of central ministries and departments to guide the delegation in preparing wreaths.

3. For the Memorial Ceremony for Chairman Ho Chi Minh at Class A, the Ministry of National Defense shall implement the following contents:

a) Arranging an honor guard formation;

b) The person receiving and guiding the delegation: the Commander of the Ho Chi Minh Mausoleum Command or an authorized officer;

c) Ensuring military band performance during the Memorial Ceremony for Chairman Ho Chi Minh at Class A as stipulated in Clause 5 Article 5 Decree for the Memorial Ceremony for Chairman Ho Chi Minh at the State level;

d) Ensuring security and safety.

4. For the Memorial Ceremony for Chairman Ho Chi Minh at Class A1, the Ministry of National Defense shall implement the following contents:

a) The person receiving and guiding the delegation: an officer from the Ho Chi Minh Mausoleum Command designated by the Commander of the Ho Chi Minh Mausoleum Command;

b) Ensuring security and safety;

c) The Memorial Ceremony for Chairman Ho Chi Minh for the delegation led by the leadership of the Ministry of National Defense (the Minister of National Defense, the Director of the General Political Department of the Vietnam People's Army, the Chief of the General Staff of the Vietnam People's Army) shall be arranged with military band performance and honor guard formation according to the regulations of the Ministry of National Defense.

Article 12. Memorial Ceremony for Heroes and Martyrs for Foreign High-Level Guests

1. The classification of the Memorial Ceremony for Heroes and Martyrs for foreign high-level guests shall be carried out according to Clause 1 of Article 11 of this Decree.

2. The Ministry of National Defense shall coordinate with the Ministry of Foreign Affairs or the diplomatic reception agency of central ministries and sectors to guide the memorial delegation in preparing wreaths.

3. For the Class A Memorial Ceremony for Heroes and Martyrs, the Ministry of National Defense shall implement the following contents:

a) Arranging an honor guard formation;

b) The person receiving and guiding the delegation: An officer from the Ho Chi Minh Mausoleum Command designated by the Commander of the Ho Chi Minh Mausoleum Command;

c) Ensuring military music at the Class A Memorial Ceremony for Heroes and Martyrs shall be conducted in accordance with the regulations for the State-level Memorial Ceremony for Heroes and Martyrs stipulated in Clause 5 of Article 8 of this Decree;

d) Ensuring security and safety.

4. For the Class A1 Memorial Ceremony for Heroes and Martyrs, the Ministry of National Defense shall implement the following contents:

a) The person receiving and guiding the delegation: an officer from the Ho Chi Minh Mausoleum Command designated by the Commander of the Ho Chi Minh Mausoleum Command;

b) Playing the song "Hồn tử sĩ" by composer Luu Huu Phuooc on the sound system at the Heroes and Martyrs Memorial;

c) Ensuring security and safety;

d) The Memorial Ceremony for Heroes and Martyrs for delegations that are guests of the leadership of the Ministry of National Defense (the Minister of National Defense, the Director of the Political General Department of the Vietnam People's Army, the Chief of the General Staff of the Vietnam People's Army) shall be arranged with military music and honor guards according to the regulations of the Ministry of National Defense.

Article 13. Forces, Uniforms, Equipment in Organizing the Memorial Ceremony for President Ho Chi Minh and the Memorial Ceremony for Heroes and Martyrs

1. The composition of forces in organizing the Memorial Ceremony for President Ho Chi Minh and the Memorial Ceremony for Heroes and Martyrs shall be implemented according to the regulations of the Ministry of National Defense, including:

a) The commander of the memorial ceremony organization;

b) The welcoming and guiding force;

c) The honor guard force, gate guard force, coffin guard force, and memorial guard force;

d) The military band force;

đ) The reception and propaganda force;

e) The security and safety assurance force in the area;

g) The technical support force.

2. The uniforms and equipment of the forces serving the Memorial Ceremony for President Ho Chi Minh and the Memorial Ceremony for Heroes and Martyrs shall be implemented according to the regulations of the Ministry of National Defense.

Chapter IV

PROTECTION OF THE HO CHI MINH MAUSOLEUM COMPLEX

Article 14. Protection and Prevention of Acts of Harm to the Ho Chi Minh Mausoleum Complex

1. Protection and prevention of acts of harm to the Ho Chi Minh Mausoleum Complex include all activities aimed at ensuring the safety, sustainability, and effective use of structures and areas within the Ho Chi Minh Mausoleum Complex; protecting state, military, and people's property; preventing acts of encroachment and damage to structures, architecture, and forests within the Ho Chi Minh Mausoleum Complex; contributing to maintaining social order and national defense and national security.

2. Enhance vigilance and proactively prevent the following acts of harm:

a) Destroying or damaging structures or auxiliary components thereof;

b) Encroaching upon or using land within the protected area of structures and zones without authorization;

c) Changing the structure or purpose of use of structures without authorization;

d) Destroying or damaging landscapes, forests, and causing environmental pollution in the area.

3. The Ministry of National Defense shall take the lead and coordinate with central ministries and sectors to advise the Government on protection and prevention of acts of harm to the Ho Chi Minh Mausoleum Complex, and organize the implementation of the following contents:

a) Proactively collecting information, analyzing, evaluating, and forecasting situations related to ensuring absolute safety of the Ho Chi Minh Mausoleum Complex;

b) Arranging surveillance systems, warning signs, and protective barriers in the area;

c) Inspecting security and safety for persons, objects, and vehicles entering and exiting the protected target area within the management scope;

d) Assigning dedicated protection forces to stand guard and patrol regularly;

đ) Propaganda and education on laws to the people regarding their responsibility to protect structures;

e) Coordinating with the People's Public Security Force, local authorities, and competent agencies to handle violations;

g) Other professional measures in accordance with the law.

4. Responsibilities of relevant parties:

a) The Ministry of National Defense: To build and implement protection plans;

b) The People's Public Security Force and local authorities: To coordinate in organizing supervision, propaganda, and handling violations;

c) The people: To have a sense of protection, actively and positively detect and report to competent agencies about acts of harm to structures and areas within the Ho Chi Minh Mausoleum Complex.

Article 15. Ensuring security and safety for political and cultural activities organized at the Ho Chi Minh Mausoleum Historical Site

1. Ensuring security and safety for political and cultural activities organized at the Ho Chi Minh Mausoleum Historical Site is a comprehensive set of activities aimed at ensuring the security and safety of political and cultural activities as stipulated in Section 2, Chapter III of the Ordinance.

2. For political and cultural events that are particularly important subjects of protection: The content of ensuring security and safety shall be carried out in accordance with the laws on protection and the Government's regulations on coordination between the Ministry of Public Security and the Ministry of National Defense.

3. For flag-raising and flag-lowering ceremonies (as provided for in Article 19 of the Ordinance): The content of ensuring security and safety shall be carried out in accordance with the provisions of the Minister of National Defense.

4. For other political and cultural activities not specified in Clause 2 and Clause 3 of this Article, the Ministry of National Defense shall implement the following contents:

a) Organizing armed patrols and guard duties, conducting surveillance to grasp the situation in the area and targets;

b) Inspecting, controlling, and supervising people and means of transportation entering and exiting the Ho Chi Minh Mausoleum Historical Site;

c) Arranging security monitoring and control systems, warning signs, and protective barriers in the area;

d) Cooperating with the People's Public Security forces and local authorities to ensure political security, traffic order and safety; guiding and regulating visitors to maintain public order; preventing illegal gatherings.

5. Propaganda and education work:

a) Enhancing the sense of responsibility of cadres, staff, soldiers, citizens, and international guests in protecting the Ho Chi Minh Mausoleum Historical Site;

b) Organizing political and ideological education activities, building a civilized style when visiting the Ho Chi Minh Mausoleum Historical Site;

c) Promoting rules for sightseeing, proper behavior, and environmental protection within the Ho Chi Minh Mausoleum Historical Site and its surrounding areas.

Article 16. Building the Ho Chi Minh Mausoleum Historical Site Area to Ensure Political Security and Social Order and Safety

1. Building the Ho Chi Minh Mausoleum Historical Site Area to ensure political security and social order and safety is a comprehensive set of activities aimed at maintaining political stability and social order and safety in localities where works and areas belong to the Ho Chi Minh Mausoleum Historical Site; mobilizing the participation of the people in managing and protecting the Ho Chi Minh Mausoleum Historical Site; promptly detecting, preventing, and handling acts threatening the security and safety of the Ho Chi Minh Mausoleum Historical Site.

2. Views and principles in building the Ho Chi Minh Mausoleum Historical Site Area:

a) Proactive - Comprehensive - Firm - Long-term;

b) Close cooperation among military, public security forces, local authorities, and the masses;

c) Combining the construction of the people's hearts and minds defense posture with the national defense posture of the entire people and the public security posture of the entire people.

3. The Ministry of National Defense shall take the lead and coordinate with central agencies and local authorities to ensure political security, social order and safety, and build a strong national defense posture and public security posture in the area:

a) Grasping and strictly managing internal and external situations, promptly detecting and tracking suspicious individuals;

b) Proactively preventing and detecting hostile forces' plots and activities against the site;

c) Strengthening rapid response forces, developing plans and scenarios for combat readiness and handling situations;

d) Maintaining ideological positions, intensifying propaganda and political education for cadres, staff, soldiers, and the people;

đ) Cooperating to ensure traffic order and safety, regulating visitors to the area, and preventing illegal gatherings from early stages;

e) Cooperating to prevent and strictly handle acts of disruption, theft, selling goods illegally, and deceiving visitors;

g) Cooperating in regular and surprise inspections to ensure there are no hotspots for social evils;

h) Strengthening mass mobilization work, leveraging the role of the people in discovering and reporting crimes;

i) Organizing and consolidating security and order forces in residential areas adjacent to the site, creating a security belt around the protected area;

k) Cooperating in propaganda to enhance the sense of responsibility of the people and tourists when visiting the Ho Chi Minh Mausoleum Historical Site.

4. Roles of forces in building the area:

a) The Ministry of National Defense: The core force in security protection and combat readiness;

b) The Ministry of Public Security: Directing subordinate forces to ensure social order and safety and handle violations;

c) The People's Committee of Hanoi City and the People's Committees of provinces where the works specified in Point d, Clause 1, Article 2 of the Ordinance are located: Implementing functions and tasks assigned within their authority, closely coordinating and supporting specialized forces, managing residential areas;

d) The people in the area: Actively discovering and reporting acts that harm the Ho Chi Minh Mausoleum Historical Site, cooperating with functional forces to manage and protect the Ho Chi Minh Mausoleum Historical Site.

Chapter V

REGIME AND POLICY FOR FORCES DIRECTLY MANAGING AND PROTECTING THE HO CHI MINH MAUSOLEUM HISTORICAL SITE

Article 17. Principles for Application and Assurance of Treatment and Policies for Forces Directly Managing and Protecting the Ho Chi Minh Mausoleum Relic Zone

1. The subjects specified in Clause 1, Article 2 of this Decree shall enjoy special allowances, subsidies, and support as stipulated in this Decree and other Government regulations when directly performing tasks to manage and protect the Ho Chi Minh Mausoleum Relic Zone.

2. The special allowance prescribed in this Decree shall be paid together with the monthly salary and shall not be used to calculate contributions or benefits under social insurance, health insurance, unemployment insurance (if applicable), and shall not be considered as income subject to personal income tax.

3. The subjects specified in Clause 1, Article 2 of this Decree shall enjoy special allowances corresponding to their positions when performing tasks at those positions. When authorized bodies transfer them to new positions or appoint them to new ranks, the corresponding special allowances shall apply from the month the transfer or appointment decision takes effect. When they cease to perform direct management and protection tasks for the Ho Chi Minh Mausoleum Relic Zone, they shall stop enjoying special allowances from the following month after the cessation decision by the authorized body takes effect.

4. The subjects specified in Clause 1, Article 2 of this Decree shall not enjoy special allowances prescribed in this Decree if they fall into any of the following cases:

a) Going on overseas assignments, study, or work continuously for three months or more;

b) Attending concentrated training within the country continuously for three months or more;

c) Taking personal leave or sick leave without pay for one month or more;

d) Taking maternity leave;

đ) Being suspended from duty, detained, or serving a criminal sentence.

5. Other treatments and policies for forces under the Ho Chi Minh Mausoleum Command that are not prescribed in this Decree shall be implemented according to the Law on Officers of the Vietnam People's Army, the Law on Professional Military Personnel, Workers, and Defense Civil Servants, the Law on Military Service, and other relevant laws.

Article 18. Special Allowances for Forces Directly Managing and Protecting the Ho Chi Minh Mausoleum Relic Zone

1. The subjects specified in Clause 1, Article 2 of this Decree shall enjoy special allowances as follows:

a) A rate of 40% shall apply to officers, professional military personnel, and persons with medical or pharmaceutical expertise or other relevant expertise assigned by authorized bodies to directly handle the preservation of President Ho Chi Minh's remains;

b) A rate of 30% shall apply to officers, professional military personnel, and persons assigned by authorized bodies to directly perform tasks related to operating, maintaining, repairing technical equipment and coffins;

c) A rate of 25% shall apply to officers performing command and combat shift duties; persons directly managing, operating, maintaining, servicing, and repairing technical equipment systems, architectural structures within the Ho Chi Minh Mausoleum Relic Zone; honor guards, sentries at the Ho Chi Minh Mausoleum, special reconnaissance personnel; reception, propaganda, and environmental maintenance in the Ho Chi Minh Mausoleum area;

d) A rate of 15% shall apply to persons not falling under the categories specified in points a, b, and c of this clause.

2. Calculation of Special Allowances:

a) For those receiving salaries, the basis for calculating special allowances shall be the monthly salary based on rank, position, grade, level, military rank, and additional allowances for position, years of service, exceeding the quota, and retained differential coefficients (if applicable);

b) For non-commissioned officers and soldiers, it shall be calculated based on the current military rank allowance.

Article 19. Uniform System for Forces Directly Managing and Protecting the Ho Chi Minh Mausoleum Relic Zone

In addition to the uniform system prescribed generally for the military, officers, professional soldiers, defense civil servants, defense staff members, defense workers, contractual laborers, non-commissioned officers, and soldiers under the Ho Chi Minh Mausoleum Command shall be provided with uniforms and occupational attire according to regulations of the Ministry of National Defense, including:

1. The standards for occupational uniforms of forces performing honor guard duties, welcoming and guiding guests, and guarding the Ho Chi Minh Mausoleum.

2. The standards for occupational uniforms of forces implementing flag-raising and flag-lowering ceremonies on Ba Dinh Square.

3. The standards for occupational uniforms of command duty and combat shift personnel under the Ho Chi Minh Mausoleum Command.

4. The standards for occupational attire and protective gear for forces performing technical tasks and ensuring landscape and environmental conditions at facilities and areas within the Ho Chi Minh Mausoleum Relic Zone.

5. The standards for occupational uniforms of forces performing reception and propaganda duties at the Ho Chi Minh Mausoleum Relic Zone.

6. The standards for occupational uniforms of special mission reconnaissance forces performing protection duties at the Ho Chi Minh Mausoleum Relic Zone.

7. The cold weather uniform standards for forces performing medical duties to maintain the remains of President Ho Chi Minh.

8. The common occupational uniform standards for sentry forces performing guard duties at agencies and units under the Ho Chi Minh Mausoleum Command.

9. The standard quantities of soap, laundry chemicals, electricity, and water for the centralized laundry station under the Ho Chi Minh Mausoleum Command.

Article 20. Recruitment and Hiring of Talented Personnel

1. The Minister of National Defense decides or delegates competent authorities to recruit, hire, and transfer cadres and staff members who meet political, moral, health, and outstanding professional qualifications required for work at the Ho Chi Minh Mausoleum Command.

2. Priority should be given to applying and fully utilizing preferential policies to attract and utilize talented individuals in the Vietnam People's Army for recruitment and hiring into forces directly managing and protecting the Ho Chi Minh Mausoleum Relic Zone.

Article 21. Funding to Ensure Implementation of Systems and Policies for Forces Directly Managing and Protecting the Ho Chi Minh Mausoleum Relic Zone

1. Funding for implementing systems and policies stipulated in this Decree shall be balanced and allocated in the annual regular budget estimate of the Ministry of National Defense according to current state budget classification.

2. Management and utilization of funding from the state budget shall be carried out in accordance with the State Budget Law and detailed regulations and guidance documents.

Chapter VI

RESPONSIBILITIES OF STATE ORGANIZATIONS,

ORGANIZATIONS AND INDIVIDUALS

Article 22. Responsibilities of the Ministry of National Defense

1. Issuing by authority or submitting to competent authorities for issuance and implementation of legal normative documents on management and protection of the Ho Chi Minh Mausoleum Relic Zone.

2. Implementing management and ensuring technical maintenance, replacement, repair, upgrading of the technical and architectural systems of the Ho Chi Minh Mausoleum and supporting facilities for long-term preservation and absolute security of President Ho Chi Minh's remains.

3. Organizing propaganda and promoting the political, historical-cultural significance of the Ho Chi Minh Mausoleum Relic Zone; disseminating and educating laws on management and protection of the Ho Chi Minh Mausoleum Relic Zone.

4. Inspecting, auditing, handling violations, resolving complaints and denunciations, summarizing and concluding, rewarding in management and protection of the Ho Chi Minh Mausoleum Relic Zone within its authority.

5. Organizing, building, ensuring, and directing the Ho Chi Minh Mausoleum Command to implement tasks prescribed in the Ordinance and this Decree.

6. Taking the lead and coordinating with the Ministry of Public Security and central ministries, sectors, and localities to implement preventive measures against activities that expose secrets, sabotage, and cause political instability and social disorder in the Ho Chi Minh Mausoleum Relic Zone.

Article 23. Responsibilities of the Ministry of Public Security

1. Coordinating with the Ministry of National Defense to develop and implement plans to prevent, detect, combat, and stop activities that expose secrets, sabotage, and cause insecurity and disorder in the Ho Chi Minh Mausoleum Relic Zone.

2. Directing functional units under its jurisdiction and local public security organs to collect information, analyze, assess, forecast national security situations and social order and safety; closely coordinating with military units stationed in the area and local authorities of the Ho Chi Minh Mausoleum Relic Zone to build safe areas.

3. Leading the guidance, inspection, and supervision of the implementation of state secret protection work related to the Ho Chi Minh Mausoleum Relic Zone for organizations and individuals not under the management of the Ministry of National Defense.

Article 24. Responsibilities of the Ministry of Culture, Sports and Tourism

Implementing state management functions within its authority; coordinating with the Ministry of National Defense in organizing services and ensuring the participation of the people and international visitors in activities at the Ho Chi Minh Mausoleum Relic Zone, propagating and promoting the political, historical-cultural significance of the Ho Chi Minh Mausoleum Relic Zone.

Article 25. Responsibilities of the Ministry of Foreign Affairs

Implement state management tasks within its authority; coordinate with the Ministry of National Defense to organize services and ensure the State Funeral of President Ho Chi Minh and the Commemoration Ceremony for Martyrs for foreign high-level delegations, carry out international cooperation and defense diplomacy activities related to the management and protection of the Ho Chi Minh Mausoleum.

Article 26. Responsibilities of the Ministry of Science and Technology

Implement state management tasks within its authority; coordinate with the Ministry of National Defense to organize scientific and technological activities for long-term preservation and absolute safety of President Ho Chi Minh's body, develop science and technology, innovation, and digital transformation in managing and protecting the Ho Chi Minh Mausoleum.

Article 27. Responsibilities of the Ministry of Construction

Advise the Prime Minister on planning work for the Ba Dinh Central Administrative Area, with the Ho Chi Minh Mausoleum as the center. Implement state management tasks within its authority; coordinate with the Ministry of National Defense to manage landscape and architecture within the Ho Chi Minh Mausoleum.

Article 28. Responsibilities of the Ministry of Finance

Implement state management tasks within its authority; coordinate with the Ministry of National Defense to ensure the budget for managing and protecting the Ho Chi Minh Mausoleum.

Article 29. Responsibilities of the Ministry of Health

Implement state management tasks within its authority; coordinate with the Ministry of National Defense to prevent and control diseases among the people and international visitors participating in political and cultural activities at the Ho Chi Minh Mausoleum, train and enhance health staff to perform long-term preservation of President Ho Chi Minh's body.

Article 30. Responsibilities of the People's Committee of Hanoi City

1. Implement state management tasks within its authority, ensuring all favorable conditions for the people and international visitors to visit the Mausoleum of President Ho Chi Minh and participate in activities at the Ho Chi Minh Memorial sites.

2. Ensure planning, architectural, and construction activities on the territory are consistent with the landscape, architectural requirements, management and protection needs, and respect the solemnity of the Ho Chi Minh Mausoleum.

3. Preserve cultural space, ensure environmental sanitation, greenery, cleanliness, and beauty within the Ho Chi Minh Mausoleum area.

4. Invest in building and upgrading transportation infrastructure to serve activities at the Ho Chi Minh Mausoleum.

5. Promote, disseminate, and educate civil servants, employees, workers under its jurisdiction, the people, and international visitors to comply with legal regulations on managing and protecting the Ho Chi Minh Mausoleum.

6. Coordinate with the Ministry of National Defense to develop and implement plans to ensure security, safety, landscape, environmental sanitation, reception, propaganda, and promote the political, historical-cultural significance, serving the people and international visitors visiting the Mausoleum of President Ho Chi Minh and participating in activities at the Ho Chi Minh Mausoleum.

Article 31. Responsibilities of central ministries, sectors, and local authorities

1. Within their respective functions and tasks, guide the implementation of management and protection tasks of the Ho Chi Minh Mausoleum in accordance with the provisions of the law.

2. Coordinate with the Ministry of National Defense to implement management and protection tasks of the Ho Chi Minh Mausoleum in accordance with the provisions of the law and this Decree.

3. Propagate, disseminate, and educate cadres, civil servants, public officials, and employees under their jurisdiction to comply with the legal provisions on the management and protection of the Ho Chi Minh Mausoleum.

4. Organize delegations to visit the Ho Chi Minh Mausoleum and participate in political and cultural activities at the Ho Chi Minh Mausoleum; prioritize people who have rendered meritorious service to the country, policy families, ethnic minorities, reputable individuals in the community, and those with outstanding achievements in study, work, combat, and service.

Article 32. Responsibilities of agencies and organizations

1. Propagate and promote the political, historical, and cultural significance of the Ho Chi Minh Mausoleum.

2. Provide necessary information for forces responsible for managing and protecting the Ho Chi Minh Mausoleum.

3. Comply with decisions, requests, and guidance of forces responsible for managing and protecting the Ho Chi Minh Mausoleum.

4. Business operations and service provision shall not affect the security, safety, environment, and solemnity of the Ho Chi Minh Mausoleum.

Chapter VII

IMPLEMENTING PROVISIONS

Article 33. Effective Date

1. This Decree takes effect from the date of issuance.

2. The Decree No. 276/HĐBT dated December 7, 1985 of the Council of Ministers on the responsibilities of sectors in ensuring the long-term preservation of the body of President Ho Chi Minh, management of the Ho Chi Minh Mausoleum, and Ba Dinh Square shall cease to be effective from the date this Decree takes effect.
