Pursuant to the Inland Waterway Traffic Law 2004;

Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Considering the proposal of the Director General of the Police General Department;

Article 1. Attached hereto is the "Regulations on job titles, accountability systems, crew staffing, and training and issuing licenses for operating motorized boats for the People's Public Security Forces".

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 835/2000/QĐ-BCA(C11) dated October 6, 2000 issued by the Minister of Public Security stipulating job titles for crew members and issuing licenses for operating motorized boats within the People's Public Security Forces.

Article 3. The Director General of the Police General Department shall be responsible for guiding, monitoring, and inspecting the implementation of this Decision.

Article 4. Directors of all Departments under the Ministry, Heads of units directly under the Minister, Directors of Public Security Departments of provinces and centrally governed cities, and Directors of Fire Prevention and Fighting Departments of Ho Chi Minh City shall be responsible for implementing this Decision.

REGULATIONS

Job titles, accountability systems, crew staffing, and training and issuing licenses for operating motorized boats for the People's Public Security Forces

(issued together with Decision No. 1612/2007/QĐ-BCA dated December 17, 2007 of the Minister of Public Security)

These regulations stipulate standards for job titles, accountability systems, crew staffing, and persons operating motorized boats; training and issuing licenses for operating motorized boats on watercraft of the People's Public Security Forces (hereinafter referred to as watercraft) for national security protection and maintaining public order and social safety.

1. These regulations apply to captains, first mates, chief engineers, second engineers, mechanics, sailors, radio technicians, and persons operating motorized boats working on watercraft as officers, non-commissioned officers, and soldiers of the People's Public Security Forces (hereinafter referred to as officers and soldiers).

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of application

2. Officers and soldiers working on vessels engaged in commercial transportation operations under public security enterprises shall comply with the provisions of the Ministry of Transport.

Article 2. Applicability

RESPONSIBILITIES OF CREW MEMBERS AND OPERATORS OF MOTORIZED BOATS OF THE PEOPLE'S PUBLIC SECURITY FORCES

Responsibilities of the captain and first mate

Chapter 2.

1. The captain is the highest-ranking officer commanding the watercraft and has the responsibilities and authorities as follows:

Article 3. a) Commanding all activities of officers and soldiers on the watercraft to implement plans, schemes, directives, and assigned tasks and handle arising situations;

b) Being familiar with the technical condition and repair cycles of the watercraft, managing and recording all relevant documents according to regulations;

c) Fulfilling the duties of the first mate if there is no first mate appointed on the watercraft;

d) Proposing changes or refusing to accept crew members if they are deemed not qualified or competent according to regulations; recommending appropriate rewards or disciplinary actions for crew members under their management;

e) Refusing to operate the watercraft if it is deemed unsafe and reporting to the person who ordered the movement of the watercraft; if not accepted, requesting the person who ordered the movement of the watercraft to sign in the logbook.

2. Responsibilities and authorities of the first mate

a) Carrying out professional and technical work assigned by the captain; directly overseeing maintenance and repair of systems and equipment on the watercraft, identifying malfunctions and reporting them to the captain for timely measures;

b) Taking over the captain's duties if the captain is absent and authorized by the captain or if the captain suddenly becomes unable to perform his duties.

Responsibilities of the chief engineer and second engineer

1. The chief engineer is directly responsible for the engine system of the watercraft and has the following responsibilities:

Article 4. a) Managing and being familiar with the technical condition of the engine system; organizing the allocation and supervision of the engine during operation.

b) Implementing full regulations on engine operation, equipment; performing emergency, regular, and periodic maintenance to ensure efficient engine operation;

c) Checking the receipt and use of fuel and spare parts;

d) Stopping the operation of part or all of the engine system if deemed unsafe and immediately reporting to the captain; if not accepted, requesting confirmation in the engine logbook;

e) Fulfilling the duties of the second engineer if there is no second engineer appointed on the watercraft.

2. Second Engineer

Assists the chief engineer in some of the technical work and has the responsibility

a) Directly overseeing one shift when assigned by the chief engineer;

b) Taking over the chief engineer's duties when the chief engineer is absent or in case of sudden emergencies where the chief engineer cannot continue to perform his duties.

Responsibilities of other crew members

1. Responsibilities of sailors

Article 5. a) Maintaining and cleaning the deck, superstructure, compartments, and hull above water level; checking and lubricating winches, cables, etc.;

b) Performing mooring, unmooring, anchoring, tying up, and untying duties when the watercraft arrives at or departs from the dock;

c) Regularly being present at designated positions;

d) Performing other assigned tasks.

2. Mechanics are directly responsible for operating the engine, under the direct command of the chief engineer or second engineer assigned to oversee technical matters, and have the following responsibilities:

a) Fully executing assigned tasks; monitoring technical parameters of the engine during operation; promptly reporting any issues to the shift supervisor;

b) Regularly cleaning the engine and engine room; participating in maintenance and repairs as required by the chief engineer or second engineer;

c) Performing other assigned tasks.

3. Radio technicians are responsible for the communication system, under the direction of the captain, and have the following responsibilities:

a) Managing the communication system on the watercraft; ensuring continuous communication.

3. A radio technician is the person responsible for the communication system, under the direction of the captain, and is responsible for:

a) Managing the communication system on the vessel; ensuring that the communication system is always operational.

b) Master the technical condition, maintenance, repair of machine and equipment failures; receive replacement parts and report to the captain.

Article 6. Responsibilities of the motorboat driver

The motorboat driver is the person directly controlling the machine and is responsible for:

1. Managing and using the technical features of the motorboat well.

2. Regularly checking the technical condition; receiving fuel, replacement parts, and ensuring maintenance and repair so that the motorboat operates well;

3. Being subject to direct command from the unit's management and usage leadership.

Chapter 3.

STANDARDS FOR RANKS, STAFFING AND AUTHORITY TO APPOINT CREW MEMBERS AND MOTORBOAT DRIVERS

Article 7. Standards for ranks of crew members on river vessels

1. Officers and soldiers appointed as captains, first mates, chief engineers, and second engineers on patrol vessels and transport vessels operating on rivers must have a river vessel captain or chief engineer certificate issued by the Public Security sector or the Transport sector, appropriate to the type of vessel being operated.

2. Officers and soldiers appointed as crew members or engineers on patrol vessels and transport vessels operating on rivers must have a professional certificate for crew members or engineers issued by the Public Security sector or the Transport sector.

3. Officers and soldiers with certificates for chief engineer or chief engineer but not appointed as captain, first mate, chief engineer, or second engineer shall assume the role of crew member, engineer, or other tasks assigned by the head of the unit using the vessel.

Article 8. Standards for ranks of crew members on ocean-going vessels

1. Officers and soldiers appointed as captain, first mate, chief engineer, or second engineer on ocean-going vessels must have a Certificate of Competency issued by the Public Security sector or the Transport sector, appropriate to the vessel's gross tonnage, engine power, and operational area.

2. Officers and soldiers appointed as crew members or engineers on patrol vessels and transport vessels operating along the coast must have a professional certificate for crew members or engineers on coastal vessels issued by the Public Security sector or the Transport sector.

3. Officers and soldiers appointed as radio technicians must have a professional certificate issued by the Public Security sector or the Ministry of Information and Communications.

Article 9. Standards for motorboat drivers

Officers and soldiers driving motorboats must have a motorboat driving certificate issued by the Public Security sector or the Transport sector.

Article 10. Authority to appoint ranks of crew members and motorboat drivers

The Director of the Department, the Commander of the General Guard Command, the Heads of Provincial Public Security Departments; the Heads of County Public Security Departments, the Wardens of prisons and detention centers, the Battalion Commanders of units using watercraft have the authority to appoint ranks of crew members and motorboat drivers under their management.

Article 11. Staffing of crew members

1. Staffing of crew members is the minimum number of crew member positions in one work shift on watercraft as stipulated in Article 12 of this regulation.

2. Those specified in Article 10 of this Regulation are responsible for staffing the required number and correct positions of crew members and drivers of watercraft.

Article 12. Classification of watercraft for staffing crew members on inland waterways

1. Group 1

a) Watercraft performing patrol duties with total main engine power over 400 horsepower;

b) Watercraft performing transport duties with full load displacement over 500 tons or carrying capacity over 100 people.

2. Group 2

a) Watercraft performing patrol duties with total main engine power over 150 horsepower to 400 horsepower;

b) Watercraft performing transport duties with full load displacement over 150 tons to 500 tons or carrying capacity over 50 people to 100 people.

3. Group 3

a) Watercraft performing patrol duties with total main engine power over 15 horsepower to 150 horsepower;

b) Watercraft performing transport duties with full load displacement over 15 tons to 150 tons or carrying capacity over 12 people to 50 people.

4. Group 4

a) Watercraft performing patrol duties with total main engine power from 5 horsepower to 15 horsepower;

b) Watercraft performing transport duties with full load displacement over 5 tons to 15 tons or carrying capacity over 5 people to 12 people;

c) Unpowered watercraft with displacement from 1 ton to 5 tons or carrying capacity up to 5 people, powered watercraft with main engine power up to 5 horsepower or carrying capacity up to 5 people.

5. Group 5

Primitive watercraft with full load displacement under 1 ton or carrying capacity under 5 people or rafts.

6. Group 6

Other types of motorized boats.

Chapter 4.

SYSTEM OF LICENSES, PROFESSIONAL CERTIFICATES, AND RANKS OF CREWMEMBERS

Article 16. System of licenses and professional certificates

The system of licenses and professional certificates includes:

1. Licenses for captains, chief engineers, and professional certificates for crew members, engineers, and drivers of inland waterway vessels;

2. Licenses and Certificates of Competency for captains, chief engineers, crew members, and engineers on ocean-going vessels;

3. Professional certificates for motorboat drivers;

4. Professional certificates for radio technicians.

Article 17. Licenses and professional certificates for ranks of crew members on watercraft operating on rivers

1. Licenses for captains and chief engineers

2. Professional certificates for drivers, crew members, and engineers

Article 18. Specialized certificates for captains, chief engineers, sailors, machinists, radio operators on ships.

Article 19. Specialized certificate for motorboat drivers

Chapter 5.

REGULATIONS ON TRAINING, TESTING, ISSUANCE AND REISSUE OF MOTORBOAT DRIVING CERTIFICATES

Article 20. Recipients and application materials for training and issuance of motorboat driving certificates

1. Training recipients include officers and soldiers of the People's Public Security

2. Application materials for training and issuance of motorboat driving certificates

a) A dispatch letter from the unit sending personnel for training;

b) A health certificate issued by a hospital at district level or higher;

c) Four color photographs measuring 2cm x 3cm

Article 21. Training Program

a) Theory

- Legal documents on inland waterway traffic, with a study time of 8 hours;

- Methods of using and operating motorboats, with a study time of 8 hours.

b) Practical

- Trainees practice exercises on operating motorboats on long routes; entering and leaving ports, fixed docks, and alongside moving vessels;

- The minimum practical training time for each trainee must be 8 hours of direct driving.

2. The National Traffic Police Bureau shall issue teaching materials, textbooks, lesson plans, and test questions to serve the training and issuance of motorboat driving certificates and ensure uniformity nationwide.

Article 22. Content of the examination for motorboat driving certificates

1. The content of the examination for motorboat driving certificates includes:

a) Written examination;

b) Practical examination

2. Examination results are pass or fail; if the written examination is not passed, the practical examination cannot be taken; if the written examination is passed but the practical examination is not, the practical examination must be retaken.

Article 23. Examination board and authority to issue motorboat driving certificates

1. Composition of the examination board

a) The examination board established by the Directorate of Waterway Traffic Police consists of:

- The Chairman of the examination board is the Director or Deputy Director of the Directorate of Waterway Traffic Police;

- The Vice-Chairman of the examination board is the Head or Deputy Head of the relevant department within the Directorate of Waterway Traffic Police;

- Members of the examination board are officers and soldiers with appropriate technical expertise.

b) The examination board established by the provincial or municipal public security bureau consists of:

- The Chairman of the examination board is the Director or Deputy Director of the provincial or municipal public security bureau;

- The Vice-Chairman of the examination board is the Head or Deputy Head of the Waterway Traffic Police Department or the Traffic Police Department.

- Members of the examination board are officers and soldiers with appropriate technical expertise.

2. Responsibilities of the examination board

- Issuing examination regulations;

- Organizing examinations, invigilation, and marking in accordance with regulations.

Article 24. Authority and分级授权培训和颁发摩托艇驾驶员证书

1. The Director of the Directorate of Waterway Traffic Police is responsible for organizing training, establishing examination boards, and issuing motorboat driving certificates to officers and soldiers of the People's Public Security belonging to various General Bureaus, the Security Guard Bureau, directly subordinate units of the Minister, and local public security units upon request.

2. The Directors of provincial or municipal public security bureaus are responsible for organizing training, establishing examination boards, and issuing motorboat driving certificates to officers and soldiers of units under their management.

Article 25. Motorboat driving certificate

1. The motorboat driving certificate does not have a validity period and is only issued to officers and soldiers.

2. The motorboat driving certificate is registered confidentially by the Directorate of Waterway Traffic Police for printing, distribution, and management; localities are not allowed to print and use them.

3. If the motorboat driving certificate is damaged or lost, it will be reissued within five days from the date of receiving the dispatch letter requesting reissue.

Chapter 6.

IMPLEMENTATION

Article 26. Responsibilities of the General Police Corps

1. Guide, monitor, and inspect the implementation of this Regulation.

2. Organize printing, management, and distribution of documents and forms for the work of appointing seafarer positions and training to issue Motorboat Driver Certificates.

Article 27. Responsibilities of the Force Building Department

Guide local public security units with watercraft to allocate sufficient personnel and seafarer positions; annually coordinate with the General Police Corps to develop plans for seafarer training.

Article 28. Responsibilities of the Finance Department

Budget and provide funding for seafarer training according to the annual plan of the Ministry.

Article 29. Responsibilities of units equipped and managing the use of watercraft

1. Implement the appointment of seafarer positions and issuance of Motorboat Driver Certificates within their own management authority.

2. Annually report the training plan and results for issuing Motorboat Driver Certificates to the General Police Corps (Waterway Traffic Police Bureau) for overall monitoring./.
