THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decision No. 161/2003/QĐ-TTg dated August 4, 2003, issued by the Prime Minister on the Regulations on Training and Capacity Building for Civil Servants and Public Officials;
Considering the proposal of the Director of the Training and Capacity Building Center for Civil Servants and Public Officials and the Head of the Cadre Organization Department,
DECISION:
Article 1. Position and Functions
1. The Training and Capacity Building Center for Civil Servants and Public Officials (hereinafter referred to as the Center) is a public service unit under the Ministry of Home Affairs serving the state management function with the mission to train and enhance the professional knowledge, legal knowledge, and management skills within the scope of state management of the Ministry of Home Affairs for civil servants, public officials, and state employees; conducting scientific research and cooperation in the field of training and capacity building for civil servants and public officials.
2. The Center operates autonomously and is responsible for its own implementation of tasks, organizational structure, staffing, and finance according to the provisions of the law. The Center has legal personality, a seal, and is entitled to open accounts at state banks and treasuries.
3. The Center's headquarters is located in Hanoi City.
Article 2. Tasks and Powers
1. Cooperate with the Cadre Organization Department and related units to develop annual training and capacity building content, programs, and plans for civil servants, public officials, and state employees, issue teaching plans, and implement them.
2. Lead or cooperate in compiling course programs, textbooks, and training materials within the assigned level.
3. Lead or cooperate with relevant agencies and units to prepare and organize the implementation of training and capacity building programs, projects, and courses for civil servants, public officials, and state employees:
a) Organize classes to train and enhance theoretical and specialized professional knowledge in various fields of state management of the Ministry of Home Affairs for civil servants, public officials, and state employees.
b) Pre-service training; training and capacity building for clerical grades and assistant grades; cooperate in organizing training and capacity building for senior assistant grades and senior grades for civil servants, public officials, and state employees in the home affairs sector. Coordinate with related agencies and units to organize capacity building for computer knowledge, foreign languages, and other supplementary knowledge for civil servants, public officials, and state employees in the home affairs sector.
c) Coordinate in organizing refresher courses and updating new knowledge, and deepening specialized knowledge for civil servants, public officials, and state employees in the home affairs sector.
d) Provide legal knowledge, management knowledge, and other skills for leaders and managers in the home affairs sector, civil servants and public officials at the commune level, and other positions when assigned by the Minister.
4. Issue certificates and certificates to civil servants, public officials, and state employees upon completion of training and capacity building programs according to the regulations of the Ministry of Home Affairs and the law.
5. Implement information reporting and statistical systems regarding training and capacity building activities according to the regulations.
6. Develop and submit to the Minister for promulgation the Rules on the organization and operation of the Center.
7. Based on the overall planning and plans of the Ministry, establish long-term, five-year, and annual plans for the development of the Center in accordance with the requirements of the Ministry and the practical needs for training and capacity building for civil servants and public officials, submit these plans to the Minister of Home Affairs for approval, and implement them after approval.
8. Cooperate and link with domestic and international training institutions to fulfill the training and capacity building tasks for civil servants and public officials according to their functions and tasks approved.
9. Conduct scientific research, transfer technology, provide consulting services, and supply services related to training and capacity building according to their functions and tasks and the law.
10. 11. Establish, manage physical infrastructure, equipment, funding, libraries, information databases serving the training, capacity building, and scientific research activities of the Center.
12. Perform other tasks assigned by the Minister and as prescribed by law.
Article 3. Organization and Working System
1. Structure
a) Director and Deputy Directors
The Director shall be appointed by the Minister of Home Affairs. The Deputy Directors shall be appointed by the Minister of Home Affairs upon the recommendation of the Director.

2. Working System
The Center operates under a director-led system, with the Center Director being responsible to the Minister of Home Affairs for all Center activities. Deputy Directors are responsible to the Director for their assigned tasks. Staff members are responsible to unit leadership and the Center Director for performing their duties and responsibilities.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature.
The Head of the Ministry's Office, the Director of the Cadre and Civil Service Organization Department, the Heads of units under the Ministry, and the Director of the Cadre and Civil Service Training and Capacity Building Center are responsible for implementing this Decision.
