THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport;
Pursuant to the Investment and Construction Management Regulations issued pursuant to Decree No. 42/CP dated July 16, 1996 and Decree No. 92/CP dated August 23, 1997 of the Government amending and supplementing certain articles of the Investment and Construction Management Regulations;
Pursuant to the Tendering Rules issued pursuant to Decree No. 43/CP dated July 16, 1996 of the Government and Decree No. 93/CP dated August 23, 1997 amending and supplementing certain articles of the Tendering Rules;
Considering the actual implementation of the Tendering Rules for construction works in the transport sector, to improve the quality of tender organization ensuring the selection of contractors who meet both quality and construction progress requirements while saving costs but still maintaining and developing contractor capacity.

Article 1: Now hereby promulgates "Certain regulations on tendering for construction works for investment projects under the management of the transport sector" attached to this decision.
Article 2: THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
All previous regulations contrary to these regulations are abolished.
Article 3: The Heads of the Ministry's Office, Heads of Departments under the Ministry, Directors of the Department of Inspection and Quality Control of Transport Works, Heads of specialized management Departments, General Directors of the Vietnam Railway Corporation, General Directors of the Project Management Boards directly under the Ministry, General Directors of State-owned Enterprises directly under the Ministry, Directors of Provincial Departments of Transport, and Heads of agencies and units in the transport sector are responsible for implementing this Decision.
