CIRCULAR
Guidelines on rewarding and encouraging competition at the construction site of Son La Hydropower Plant

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 92/QĐ-TTg dated January 15, 2004 of the Prime Minister approving the investment project for Son La Hydropower Plant;
Implementing Notification No. 132/TB-VPCP dated June 25, 2007 of the Office of the Government regarding the conclusions of Prime Minister Nguyen Tan Dung, Head of the State Steering Committee for the Son La Hydropower Plant Project;
After reaching consensus with the Ministry of Industry and Trade, the Vietnam General Confederation of Labor, and the Vietnam Electricity Corporation, the Ministry of Finance provides guidelines on rewarding and encouraging competition at the construction site of Son La Hydropower Plant as follows:
Part I
GENERAL PROVISIONS
1. Scope and Applicability
1.1. Scope of Application:
These Circulars provide guidelines on rewarding and encouraging competition for the linked competition movement at the construction site of Son La Hydropower Plant (Construction Project) aimed at motivating and encouraging material rewards for collectives and individuals with outstanding achievements in the linked competition movement to accelerate construction progress; put the project into operation according to the approved schedule or ahead of schedule.
In addition to rewards under these Circulars, the achievements of collectives and individuals in the linked competition movement at the construction site of Son La Hydropower Plant may serve as grounds for rewarding and encouraging competition under the Law on Competition and Rewards.
1.2. Applicability:
This applies to units, organizations, and individuals participating in the construction of Son La Hydropower Plant including:
a. The consortium of contractors for the Son La Hydropower Plant Construction Project as stipulated in Document No. 1148/TTg-CN dated August 20, 2007 of the Prime Minister, including:
- Sông Đà Corporation - Main Contractor.
- Member contractors: LICOGI Corporation; LILAMA Corporation; Binh Duong 12 Corporation.
b. The main consulting firm for surveying and designing the Son La Hydropower Plant Project.
c. The management board of Son La Hydropower Plant Project.
d. Units participating in security on the construction site of Son La Hydropower Plant.
e. Other units, organizations, and individuals related to the construction of Son La Hydropower Plant.
2. Principles of Rewarding and Encouraging Competition
2. 1Rewards and encouragement for competition shall be implemented when the project is completed according to or ahead of the annual construction progress milestones approved and ensuring quality; when collectives and individuals achieve outstanding results during the construction process.
2. 2. The reward money and levels of encouragement for competition shall be implemented through the Reward and Encouragement Fund and must be publicly announced to workers on the construction site of Son La Hydropower Plant.
3. Sources of Reward Money for Encouraging Competition
The source of reward money for encouraging competition is allocated from the 5% savings from designated bidding as stipulated in Notification No. 132/TB-VPCP dated June 25, 2007 of the Office of the Government.
Part II
SPECIFIC PROVISIONS
1. Reward and Encouragement Fund
The Reward and Encouragement Fund is managed by the Management Board of Son La Hydropower Plant Project, organized for accounting and payment upon decision of the competent authority.
2. Forms of Rewarding and Encouraging Competition
2. 1Rewards are given based on the approved construction progress milestones for each phase.
2. 2. Special rewards are given to outstanding collectives and individuals who have achieved remarkable results during the construction process.
3. Time Markers for Rewarding and Encouraging Competition; Launching and Summarizing the Competition Movement
3. 1. Time Markers for Rewarding and Encouraging Competition
These are the key milestones in the overall schedule of the Son La Hydropower Plant Project (Construction Project) approved by the Prime Minister in Decision No. 671/QĐ-TTg dated June 1, 2007.
Detailed progress milestones are approved annually by the Vietnam Electricity Corporation and according to the General Contract signed between the Management Board of Son La Hydropower Plant Project and the General Contractor.
3. 2. Launching and Summarizing the Competition Movement
Annually, based on the approved construction progress milestones, the Vietnam General Confederation of Labor takes the lead in launching competition movements on the construction site, providing motivation for units to strive to complete the agreed competition targets committed among parties involved in constructing the Son La Hydropower Plant.
At the end of each competition launch period, the Steering Committee for the Linked Competition Movement to Construct Son La Hydropower Plant (established by Decision No. 2126/QĐ-TLĐ dated October 17, 2005 of the Vietnam General Confederation of Labor) conducts summaries, evaluations, and recommends rewards for collectives and individuals with outstanding achievements.
4. Authority to Decide on Rewards and Encouragements
The Vietnam General Confederation of Labor examines and decides on rewards and encouragements based on recommendations from the Steering Committee for the Linked Competition Movement to Construct Son La Hydropower Plant.
5. Grounds for Determining Rewards and Encouragements
5. 1. For construction contractors and equipment installers, it is completing the construction progress milestones and competition targets committed, based on:
1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: The General Contract signed between the Management Board of Son La Hydropower Plant Project and the General Contractor.
b. The acceptance certificate of the Acceptance Committee.
c. The linked competition agreement for constructing Son La Hydropower Plant.
5. 2. For consulting firms, it is completing the consulting work progress milestones and competition targets committed, based on:
1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: The Consulting Work Contract signed between the Management Board of Son La Hydropower Plant Project and the main design consultant.
b. The acceptance certificate of the consulting work.
c. The linked competition agreement for constructing Son La Hydropower Plant.
5. 3. For other units and individuals, it is:
1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: Completion of assigned tasks.
b. Active participation in competition movements launched by the Steering Committee for the Linked Competition Movement to Construct Son La Hydropower Plant.
5. 4. For special rewards, it is outstanding achievements of exemplary collectives and individuals contributing to accelerating construction progress.
6. Content of Reward Expenditure and Levels of Reward
6. 1. The content of reward expenditure includes:
1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: Allocate for organizing the launch ceremony, interim review ceremony, final summary ceremony, and awarding ceremony including the following items: venue rental; decoration; publicity (through banners, posters, slogans); embroidery of flags, printing of certificates of merit; other expenses serving meetings of the Steering Committee for the joint campaign to build the Son La Hydropower Plant.
b. Allocate for awarding incentives to units and individuals.
6. 2. The total amount allocated for awarding incentives on the construction site of the Son La Hydropower Plant is two billion VND annually; implemented from 2007 to 2012.
The specific amount allocated for each organization of the launch ceremony, interim review ceremony, final summary ceremony, and awarding ceremony; specific levels of incentive awards for each milestone, for special awards, and for each unit and individual shall be reviewed and decided by the General Confederation of Labor of Vietnam based on the proposal of the Steering Committee for the joint campaign to build the Son La Hydropower Plant.
7. Establishment and management of the incentive award fund
The Project Management Board of the Son La Hydropower Plant shall open a separate account for the Incentive Award Fund at the place where the payment account for the project is opened.
Annually, the Project Management Board of the Son La Hydropower Plant shall allocate two billion VND from the five percent savings from designated bidding to the Incentive Award Fund and organize the management and accounting of the incentive award funds.
Any remaining incentive award funds from the previous year that were not utilized shall be carried over to the next year for continued use. After completion of the entire project, if there is any surplus in the Incentive Award Fund, the remaining incentive award funds shall be returned to the investment capital of the Vietnam Electricity Corporation.
8. Payment and settlement of incentive award funds
The Project Management Board of the Son La Hydropower Plant shall implement payments for incentive award expenses according to the decision of the General Confederation of Labor of Vietnam; settle the annual incentive award budget and the overall settlement of the incentive award budget for all years, and submit them to the General Confederation of Labor of Vietnam for approval.
The approval time for the settlement of the annual incentive award budget shall be completed before January 31 of the following year. The overall settlement of the incentive award funds must be completed no later than three months after the completion of the entire project.
Part III
IMPLEMENTING PROVISIONS
This Circular takes effect fifteen days after its publication in the Official Gazette.
During implementation, if any issues arise, relevant agencies and units should promptly report to the Ministry of Finance for necessary amendments and supplements to ensure compliance./.
