Regulations on the functions, tasks, powers, and organizational structure of the International Cooperation Department

THE MINISTER OF FINANCE
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Circular No. 1912/BNV-TCBC dated August 15, 2003 of the Ministry of Home Affairs regarding agreement on establishing rooms at some units of the Ministry of Finance;
Considering the proposal of the Director of the International Cooperation Department and the Director of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1: The International Cooperation Department is a unit within the state management machinery of the Ministry of Finance, with the function of assisting the Minister of Finance in implementing international integration and cooperation tasks in fields under the State management of the Ministry; organizing the implementation of foreign affairs work of the Ministry of Finance.
Article 2: The International Cooperation Department has the following tasks:
1. Serving as the focal point for implementing international integration and cooperation activities of the Ministry of Finance.
2. Taking the lead in coordinating with units and organizations under the Ministry to submit to the Ministry strategies, action programs, long-term plans, annual plans, draft regulatory legal documents on international integration and cooperation in fields under the State management of the Ministry; participating in building the national financial strategy.
3. Organizing the implementation and guiding, inspecting units and organizations under the Ministry in carrying out strategies, action programs, plans, regulatory legal documents on international integration and cooperation.
4. Regarding the implementation of international integration tasks:
a. Studying and proposing to the Ministry directions, goals for implementing international integration in fields under the Ministry's management;
b. Leading or coordinating with relevant units and organizations under the Ministry to develop negotiation plans for bilateral and multilateral agreements on import-export taxes, insurance services, tax advisory services, auditing, accounting, customs, pricing, and other management areas according to the division of labor by the Minister;
c. According to the division of labor by the Ministry, leading or participating in the Ministry's negotiation delegations or officially representing the Ministry when authorized by the Minister of Finance to participate in government negotiation delegations or delegations from other agencies with foreign counterparts based on approved international integration negotiation plans;
d. Coordinating with units and organizations under the Ministry to implement negotiation results in the field of international integration of the Ministry;
đ. Participating in proposing and researching to build mechanisms and policies under the Ministry's State management serving the process of international economic integration.
e. Coordinating with units and organizations under the Ministry to conduct inspections and urging ministries, sectors, localities in complying with mechanisms and policies related to the implementation of Vietnam's commitments during the process of international economic integration.
g. Managing the Ministry of Finance's representatives abroad according to the division of labor by the Minister.
5. Regarding the implementation of international cooperation tasks:
a. Leading and coordinating with units and organizations under the Ministry to study and propose directions, goals, contents, and partners for international cooperation of the Ministry of Finance; developing comprehensive plans and annual plans to implement international cooperation activities of the Ministry of Finance;
b. Representing the Ministry of Finance in relations with domestic and foreign organizations and individuals, foreign sponsors in building programs, projects, and international cooperation activities of the Ministry of Finance;
c. Leading and coordinating with units and organizations under the Ministry to prepare feasibility studies and project proposals for mobilizing foreign funding for the Ministry of Finance to be submitted to competent authorities for approval;
d. Submitting to the Minister of Finance for decision-making on organizational arrangements (such as setting up sub-committees, project management boards, working groups, etc.) to implement international cooperation programs and projects of the Ministry of Finance after they have been approved by competent authorities;
đ. Organizing the review of project documents and the results of project implementation for international cooperation programs and projects of the Ministry of Finance;
e. Monitoring progress, inspecting, and evaluating the results and effectiveness of international cooperation programs and projects of the Ministry of Finance to ensure the schedule, quality, and effectiveness of cooperation activities, creating conditions for programs and projects to be implemented according to plan;
g. Organizing coordination work during the process of fundraising and implementing activities between programs and projects to ensure synchronization and harmony in international cooperation activities of the Ministry of Finance;
h. Forecasting emerging issues, proposing and implementing preventive measures to limit risks; handling or submitting to the Minister of Finance for handling issues arising during the implementation of international cooperation programs and projects of the Ministry of Finance;
i. Submitting opinions to the Ministry or directly participating in issues related to finance concerning the international cooperation activities of other ministries and sectors according to the division of labor by the Ministry.
6. Regarding the implementation of foreign affairs work:
a. Implementing foreign affairs activities of the Ministry of Finance according to the division of authority; formulating regulations, guidelines, and inspecting units and organizations under the Ministry, program and project management boards of the Ministry of Finance in implementing national and Ministry regulations on foreign affairs work;
b. Coordinating with relevant units and organizations under the Ministry to prepare necessary documents, texts, and related matters to serve the leadership of the Ministry or units and organizations in exchanging and working with foreign counterparts on the content of international cooperation and integration of the Ministry of Finance;
c. Compiling and building annual plans for outbound and inbound delegations of the Ministry of Finance;
d. Organizing the implementation of translation and interpreting work and diplomatic protocol work according to regulations;
đ. Handling passport, visa, and other procedures for officials and civil servants of units and organizations under the Ministry (excluding organizations with delegated personnel management authority) traveling or studying abroad;
e. Processing, managing, and archiving incoming and outgoing foreign-related documents related to the Ministry's foreign affairs activities.
8. Submit to the Ministry for the establishment of boundaries of responsibility and coordination relationships among units and organizations under the Ministry in carrying out international integration and cooperation tasks of the Ministry.
9. Organize statistical work, analysis, and forecasting of international and domestic economic and financial situations affecting the Ministry's international integration and cooperation process; implement information and reporting systems as prescribed by the Ministry.
Article 3: The Director of the International Cooperation Department has the authority:
1. To request units and organizations under the Ministry to provide relevant information on international integration issues within their management scope; provide reports on international cooperation activities, the situation and progress of implementing projects carried out by these units and organizations, and matters related to the Ministry’s external affairs.
2. To receive relevant documents and materials concerning the performance of the Department's tasks.
3. To directly handle or sign transactional correspondence with foreign counterparts to carry out assigned tasks.
Article 4: The International Cooperation Department consists of one Director and several Deputy Directors.
The Director is responsible for comprehensive management of the Department's civil servants according to the Ministry's regulations; organize training and capacity enhancement for civil servants; be accountable to the Minister of Finance for all Department activities.
Deputy Directors are accountable to the Director for the tasks assigned to them.
The International Cooperation Department includes the following divisions:
1. ASEAN Division
2. WTO Division
3. Program-Project Division.
4. External Affairs Division.
Specific tasks of each division are defined by the Director of the International Cooperation Department.
The International Cooperation Department operates under a specialist system combined with division organization.
For tasks performed under the specialist system, the Director of the International Cooperation Department is responsible for organizing work and assigning duties to each civil servant in accordance with their job title standards, capabilities, and trained expertise to fulfill assigned tasks.
The staffing of the International Cooperation Department is determined by the Minister of Finance.
Article 5:This Decision takes effect from the date of signing. Decree No. 03/1999/QĐ/BTC dated January 8, 1999, issued by the Minister of Finance regarding the tasks, authorities, and organizational structure of the International Relations Department, is hereby repealed.
The Director of the International Cooperation Department, the Director of the Cadre Organization Department, the Head of the Ministry of Finance's Office, and the heads of organizations and units under the Ministry are responsible for implementing this decision./.
