Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."

DECISION:

Article 1. These Regulations are promulgated together with this Decision on the organization and implementation of administrative reform tasks of the Ministry of Agriculture and Rural Development.

Article 2. This Decision takes effect from the date of signing.

Article 3. The Director of the Ministry's Office, heads of subordinate agencies and units of the Ministry shall be responsible for implementing this Decision.

REGULATIONS

ON THE ORGANIZATION AND IMPLEMENTATION OF ADMINISTRATIVE REFORM TASKS OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

These Regulations govern the contents regarding the organization and implementation of administrative reform tasks of the Ministry of Agriculture and Rural Development.

Article 2. Applicability

- Administrative agencies, subordinate units of the Ministry (hereinafter referred to as units), projects with administrative reform content, and other organizations directly under the Ministry of Agriculture and Rural Development.

- Cadres and civil servants in charge of administrative reform of the Ministry.

- Other agencies, units, organizations, and individuals related to the administrative reform activities of the Ministry.

Chapter II

SYSTEM OF MANAGEMENT, GUIDANCE, AND IMPLEMENTATION OF ADMINISTRATIVE REFORM TASKS

Article 3. System of management, guidance, and organization of implementation of administrative reform tasks of the Ministry

1. Leadership of the Ministry: The Minister is responsible for all aspects of administrative reform work of the Ministry and assigns one Deputy Minister to directly guide.

2. Advisory bodies: Departments are responsible for advising the Minister and guiding subordinate agencies and units of the Ministry on each field and content of administrative reform as follows:

- The Legal Department is responsible for the content of institutional reform of the Ministry and sector, focusing on the development, inspection, and evaluation of the implementation of regulatory legal documents;

- The Personnel and Organization Department is responsible for the content of organizational reform, improving the quality of cadres and civil servants of the Ministry and sector;

- The Finance Department is responsible for the content of public financial reform of the Ministry and sector;

- The Science, Technology, and Environment Department is responsible for the content of electronic administration of the Ministry and sector;

- The International Cooperation Department is responsible for establishing connections, sharing experiences, and the content of administrative reform of international projects of the Ministry;

- The Ministry's Office is responsible for the content of modernizing offices, simplifying administrative procedures, and administrative documents.

3. Permanent and coordinating body: The Ministry's Office, specifically the Permanent Office for Administrative Reform.

4. Implementing bodies: Departments, Bureaus, Inspectors, the Ministry's Office, Centers under the Ministry, the Enterprise Reform and Management Board, the Agricultural Project Management Board, the Forestry Project Management Board, the Central Water Resources Project Management Board are responsible for implementing administrative reform tasks assigned by the Ministry and according to the functions and tasks of their units.

5. Supporting bodies: International programs and projects of the Ministry with administrative reform content.

6. Special Task Forces: established to carry out important and specific tasks within a defined period (implementing ISO, one-stop service, simplifying administrative procedures, etc.).

Article 4. Implementation of administrative reform tasks of units

- The head of the unit shall be responsible to the Minister for the administrative reform work of the unit; directly direct or assign a unit leader to organize the implementation of administrative reform tasks of the unit.

- The head of the unit assigns tasks to a department (Department, Group) responsible for advising, organizing the implementation, and summarizing the administrative reform work of the unit.

- The head of the unit assigns an officer in charge of administrative reform work (hereinafter referred to collectively as the administrative reform liaison officer) to directly advise, urge, and summarize the administrative reform work of the unit. Specific tasks are stipulated in Article 6 of this Regulation.

Article 5. Permanent Office for Administrative Reform

The Permanent Office for Administrative Reform under the Ministry's Office performs the function of permanent coordination and centralization of the administrative reform program and plan of the Ministry; guiding, inspecting, urging, and summarizing the implementation of administrative reform by agencies and units under the Ministry; organizing the implementation of administrative reform contents assigned by the Ministry's leadership.

Article 6. Administrative Reform Liaison Officer

The administrative reform liaison officer, assigned by the heads of units, has the following responsibilities:

1. Grasping and studying policies, plans, tasks, and contents of administrative reform by the Government and the Ministry to proactively advise and propose to the unit head to build the administrative reform plan of the unit and organize its implementation;

2. Receiving policies, plans, and directives from the Ministry through the Permanent Office for Administrative Reform to report and propose to the unit head for implementation;

3. Assisting the head in guiding and urging organizations and individuals within the unit to implement administrative reform tasks;

4. Budgeting funds for administrative reform services;

5. Taking the lead in organizing the implementation of certain administrative reform tasks assigned by the unit head;

6. Participating in administrative reform activities requested by the Permanent Office for Administrative Reform;

7. Summarizing and reporting the results of administrative reform of the unit according to the Ministry's regulations to the Permanent Office for Administrative Reform for consolidation.

Article 7. International Programs and Projects Supporting Administrative Reform

The Steering Committee and Management Board of international programs and projects supporting administrative reform or containing components supporting administrative reform of the Ministry must thoroughly understand the Ministry's administrative reform policies and plans to proactively integrate them into project activities; implementing information and reporting systems to consolidate into the Ministry's overall administrative reform reports, programs, and plans.

Coordination, cooperation activities, information, and reporting systems of international programs and projects supporting administrative reform or containing components supporting administrative reform of the Ministry shall be carried out according to the specific regulations of the Ministry.

Chapter III

IMPLEMENTATION OF THE ADMINISTRATIVE REFORM PLAN

Article 8. Ministry's Administrative Reform Plan

1. Five-year Plan: based on the Party's policy, the Government's administrative reform program, and the Ministry's administrative management requirements, the Minister will make decisions to develop a five-year administrative reform plan and assign specific tasks to advisory and consolidating agencies to organize the development of the plan for submission to the Minister for approval.

2. Annual Plan: based on the five-year plan, advisory agencies will proactively detail it into annual administrative reform plans within their assigned areas. The Permanent Office for Administrative Reform will consolidate these into a comprehensive plan of the Ministry for submission to the Minister for approval.

3. Monthly and quarterly administrative reform tasks: based on the annual administrative reform plan, the Permanent Office for Administrative Reform will detail these into monthly and quarterly tasks for issuance by the Deputy Minister in charge of administrative reform.

Article 9. Administrative Reform Plans of Units

The Heads of units shall base on the five-year administrative reform plan, annual plans, monthly administrative reform tasks of the Ministry, and the requirements to perform the functions and tasks of their units to organize the development of the annual administrative reform plan, quarterly and monthly administrative reform tasks of their units.

Article 10. Implementation and Evaluation of Administrative Reform Plans and Tasks

1. The Minister shall chair meetings with the Heads of units every six months and annually to evaluate the results of implementation and deployment of the administrative reform plans and tasks of the Ministry.

2. The Deputy Minister responsible for administrative reform shall chair quarterly coordination meetings with advisory agencies and central agencies to evaluate and deploy the quarterly administrative reform tasks of the Ministry. Depending on the content of the quarterly coordination meetings, leaders and key administrative reform officials from relevant units may be invited.

3. Advisory agencies shall proactively organize the implementation of administrative reform tasks of the Ministry within their assigned areas.

4. The Heads of units shall link the implementation and evaluation of administrative reform tasks with the mid-term and annual reviews of their unit's work; organize specialized meetings on administrative reform as required by the unit.

5. The Office of the Permanent Steering Committee for Administrative Reform shall urge and compile the results of the implementation of administrative reform tasks of the units; serve as the focal point to assist the Ministry in evaluating and deploying administrative reform plans and tasks of the units; organize quarterly or ad hoc coordination meetings with key administrative reform officials to deploy administrative reform tasks of the Ministry.

Article 11. Reporting System

1. Monthly Reports: All Departments and advisory agencies must submit reports on the results of implementing the administrative reform tasks of their units in the previous month and the administrative reform tasks for the next month to the Office of the Permanent Steering Committee for Administrative Reform before the 15th of each month for compilation and submission to the Ministry of Home Affairs before the 20th of each month.

2. Quarterly, Semi-annual, and Annual Reports: All Bureaus, Departments, Inspectors General, the Ministry’s Office, subordinate centers, the Reform and Enterprise Management Board, the Agricultural Project Management Board, the Forestry Project Management Board, the Central Project Management Board for Water Resources Projects, and international support programs for administrative reform must submit reports on the administrative reform activities of their units to the Office of the Permanent Steering Committee for Administrative Reform before the 10th of the last month of each quarter (quarterly report); before June 10 (semi-annual report); before November 30 (annual report) for compilation and submission to the Ministry of Home Affairs before the 20th of the last month of each quarter.

Unit reports must clearly state the results achieved, difficulties encountered, recommendations, and plans for administrative reform in the next quarter, half year, and year.

3. Ad Hoc Reports, Specialized Reports: Depending on the requirements, the Office of the Permanent Steering Committee for Administrative Reform shall take the lead in advising the Ministry to implement specific measures.

Article 12. Inspection System

Depending on the requirements of administrative reform work, advisory agencies, permanent agencies, and central agencies shall proactively propose to the Ministry for approval to organize inspections of the implementation of administrative reform tasks of subordinate units of the Ministry, Provincial Departments of Agriculture and Rural Development.

Chapter IV

ADMINISTRATIVE EXPENSES FOR ADMINISTRATIVE REFORM

Article 13. State budget

1. The Finance Department shall take the lead in drafting the annual financial plan to serve the administrative reform work of the Ministry for consolidation into the Ministry's annual financial plan; coordinate with the Office of the Permanent Steering Committee for Administrative Reform to allocate administrative reform funds of the Ministry to units; guide units to manage and use administrative reform funds in accordance with regulations.

2. The Office of the Permanent Steering Committee for Administrative Reform shall take the lead in preparing detailed budgets for the annual administrative reform funds allocated to the Office of the Ministry for management to serve the directive, operational, and implementation tasks of the Ministry's administrative reform programs and departments.

3. Units with separate accounts shall proactively draft plans, budgets, manage, and use administrative reform funds in accordance with current regulations.

4. Programs and projects on administrative reform requiring large funding will be considered and approved separately by the Ministry.

Article 14. Funding for international programs and projects

The Management Board of international programs and projects supporting administrative reform shall proactively support funding for the Ministry’s and units’ administrative reform activities.

Chapter V

RESPONSIBILITIES AND REGIMES FOR STAFF AND PUBLIC OFFICIALS ENGAGED IN ADMINISTRATIVE REFORM WORK

Article 15. Responsibilities

1. The Minister shall be responsible before the Prime Minister for directing the implementation of administrative reform tasks within the scope of the Ministry's state management; deciding the five-year and annual administrative reform plans of the Ministry, implementation plans for government administrative reform programs and projects assigned, and other important issues.

2. The Deputy Minister in charge of administrative reform shall assist the Minister in directly guiding the implementation of the Ministry's administrative reform tasks according to the program and plan already approved by the Minister.

3. Heads of advisory, permanent, and consolidating agencies shall be responsible before the Minister and the Deputy Minister in charge of administrative reform for the fields and tasks assigned by the Ministry; actively propose, guide, and inspect the implementation of units under their management field.

4. Heads of subordinate agencies and units of the Ministry shall be responsible before the Minister and the Deputy Minister in charge of administrative reform for the results of the administrative reform tasks assigned by the Ministry; actively organize the construction and implementation of the unit's administrative reform program and plan and report to the Ministry on the results achieved.

5. Administrative reform focal points shall be responsible before the unit head for the implementation of assigned administrative reform tasks.

6. International support programs and projects on administrative reform or containing administrative reform components shall closely align with the Ministry's administrative reform programs and plans to proactively integrate support activities for the implementation of the Ministry's administrative reform, implement information and reporting systems as prescribed.

Article 16. Regime

1. Staff and public officials engaged in managing, directing, and operating administrative reform work of the Ministry (advisory, permanent, and consolidating agencies), administrative reform focal points of units managed by the Office shall enjoy monthly allowances from the Office fund as decided separately by the Ministry.

2. Staff and public officials engaged in managing, directing, and operating administrative reform work of units with separate accounts, depending on specific conditions of each unit and current regulations, the Head shall decide the beneficiaries and monthly allowance levels.

3. Administrative reform focal points not serving as department heads or deputy department heads shall enjoy responsibility allowances equivalent to those of deputy department heads at the Ministry level.

4. In addition to monthly allowances, staff and public officials engaged in managing, directing, and operating administrative reform work of the Ministry and units may be sent for observation, study, and training to improve administrative reform and state administration management skills both domestically and internationally, considered for planning, appointment, early salary increase, and commendation.

Chapter VI

IMPLEMENTING PROVISIONS

Article 17. Rewards and Disciplinary Measures

1. The Office of the Permanent Steering Committee for Administrative Reform shall draft and submit to the Minister for promulgation regulations on criteria for evaluating the annual administrative reform performance of units, which is an important criterion for assessing the completion of political tasks by such units.

2. Units under the Ministry that fail to complete assigned administrative reform tasks or do not strictly comply with this Regulation will be criticized or subject to appropriate disciplinary measures depending on the severity of the situation by the Minister.

Article 18. Implementation Organization

1. During the implementation of this Regulation, if there are any difficulties, units shall promptly report to the Ministry (through the Office of the Permanent Steering Committee for Administrative Reform).

2. The Office of the Permanent Steering Committee for Administrative Reform shall monitor compliance with this Regulation; compile and propose timely solutions to address difficulties and obstacles encountered during its implementation./.
