Pursuant to Resolution No. 29/2021/QH15 Pursuant to Resolution No. 29/2021/QH15 dated July 28, 2021 of the National Assembly on the medium-term public investment plan for the period 2021-2025; Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies to support the Economic Recovery and Development Program;

Decree No. 40/2020/NĐ-CP Pursuant to Decree No. 40/2020/NĐ-CP dated April 6, 2020 of the Government detailing the implementation of certain provisions of Law on Public Investment;

Pursuant to Resolution No. 11/NQ-CP Pursuant to Resolution No. 11/NQ-CP dated January 30, 2022 of the Government on the Economic Recovery and Development Program and the implementation of Resolution No. 43/2022/QH15 of the National Assembly on fiscal and monetary policies to support the Program;

Pursuant to Decision No. 769/QĐ-TTg Pursuant to Decision No. 769/QĐ-TTg dated June 24, 2022 of the Prime Minister approving the investment orientation for the Construction Project of the Cao Lãnh - An Hữu Expressway, Phase 1;

Pursuant to Decision No. 17/2022/QĐ-TTg Pursuant to Decision No. 17/2022/QĐ-TTg dated July 28, 2022 of the Prime Minister on the delegation of authority to implement projects and project components under the Economic Recovery and Development Program;

Based on the proposal of the Minister of Transport in Report No. 14346/TTr-BGTVT dated December 14, 2023 and the report on the results of the review by the Ministry of Planning and Investment in Document No. 9800/BC-BKHĐT dated November 23, 2023 regarding the adjustment of the investment orientation for the Construction Project of the Cao Lãnh - An Hữu Expressway, Phase 1.

DECISION:

Article 1. Approving the adjustment of the investment orientation for the Construction Project of the Cao Lãnh - An Hữu Expressway, Phase 1 (Project) with the following contents:

1. The preliminary total investment cost of the Project is VND 7,496 billion (Seven thousand four hundred ninety-six billion dong).

2. Source of funds: State budget.

a) Component Project 1: Total amount approximately VND 3,640 billion

- For the period 2021-2025 approximately VND 2,155.8 billion, including:

+ Funds from the Economic Recovery and Development Program amounting to VND 745 billion (as per Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly and Decision No. 202/QĐ-TTg dated March 8, 2023 of the Prime Minister);

+ Central government's medium-term public investment plan funds for the period 2021-2025 amounting to VND 1,410.8 billion (as per Resolution No. 93/2023/QH15 dated June 22, 2023 of the National Assembly and Decision No. 888/QĐ-TTg dated July 24, 2023 of the Prime Minister).

- To be carried over to the period 2026-2030 approximately VND 1,484.2 billion (to be allocated within the central government's medium-term public investment plan funds for the period 2026-2030 in accordance with the relevant laws).

b) Component Project 2: Total amount approximately VND 3,856 billion

- For the period 2021-2025 approximately VND 2,941 billion, including:

+ Funds from the Economic Recovery and Development Program amounting to VND 459 billion (as per Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly and Decision No. 202/QĐ-TTg dated March 8, 2023 of the Prime Minister);

+ Central government's medium-term public investment plan funds for the period 2021-2025 amounting to VND 872 billion (as per Resolution No. 93/2023/QH15 dated June 22, 2023 of the National Assembly and Decision No. 888/QĐ-TTg dated July 24, 2023 of the Prime Minister);

+ Central government's medium-term public investment plan reserve funds for the period 2021-2025 (adjusted from the increased revenue of the central budget in 2022 according to Resolution No. 40/2023/NQ-UBTVQH15 dated November 15, 2023 of the Standing Committee of the National Assembly) amounting to VND 1,610 billion.

- To be carried over to the period 2026-2030 approximately VND 915 billion (to be allocated within the central government's medium-term public investment plan funds for the period 2026-2030 in accordance with the relevant laws).

3. Update information on component projects

- Component Project 1 (Km0+000 - Km16+000) with a length of about 16 km located in Dong Thap Province, the preliminary total investment cost is approximately VND 3,640 billion (including land clearance costs of about VND 623 billion).

- Component Project 2 (Km16+000 - Km27+430) with a length of about 11.43 km located in Dong Thap and Tien Giang Provinces, the preliminary total investment cost is approximately VND 3,856 billion (including land clearance costs of about VND 1,255 billion).

4. Other contents remain unchanged as per Decision No. 769/QĐ-TTg dated June 24, 2022 and Decision No. 17/2022/QĐ-TTg dated July 28, 2022 of the Prime Minister.

Article 2. Implementation

1. The Ministry of Transport

- Responsible for proposing the adjustment of the investment orientation for the Project and compiling the information and data in the Feasibility Study Report for the adjusted Project.

- Coordinate closely with the People's Committees of Tien Giang and Dong Thap Provinces and related ministries and agencies during the implementation of the Project; ensure regular inspections of progress and quality in compliance with the law, ensuring transparency, quality, efficiency, and timely completion.

2. Ministry of Planning and Investment

- Fully responsible for the content of the feasibility study report for the adjusted Project.

- Take the lead in coordinating with relevant ministries, sectors, and localities to review and balance funding sources to implement the Project according to schedule and legal regulations.

- Monitor the implementation of this Decision, report to the Prime Minister in accordance with the law.

3. People's Committees of Tien Giang and Dong Thap Provinces

- Fully responsible for the information and data approved for construction plans, total investment costs, budgets; the results of the feasibility studies for investment projects serving as the basis for the Feasibility Study Report for the adjusted Project.

- Study and fully adopt the review opinions of the Ministry of Planning and Investment in Review Report No. 9800/BC-BKHĐT dated November 23, 2023 during the process of preparing and adjusting the feasibility study reports of component projects and making investment decisions in accordance with the law.

- Lead and coordinate closely with the Ministry of Transport and related ministries and sectors during the implementation of the project; ensure compliance with all legal regulations; fully responsible for selecting contractors with sufficient capacity to implement the Project in accordance with the law, ensuring transparency, quality, efficiency, and timely completion; prevent corruption, waste, and loss of state assets and funds.

Article 3. Implementation Provisions

1. This Decision takes effect from the date of issuance.

2. The Ministers of the Ministries of Planning and Investment, Finance, Transport, Construction, Natural Resources and Environment, Agriculture and Rural Development; the Chairpersons of the People's Committees of the provinces of Tien Giang, Dong Thap; and the Heads of relevant units shall be responsible for implementing this Decision./.
