CIRCULAR

REGULATIONS ON THE MANAGEMENT AND USE OF FUNDS FOR IMPLEMENTING SHORT-TERM TRAINING PROJECTS ON INFORMATION SECURITY AND SAFETY WITHIN THE FRAMEWORK OF THE HUMAN RESOURCE DEVELOPMENT PROGRAM FOR INFORMATION SECURITY AND SAFETY UNTIL 2020

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 99/QĐ-TTg dated January 14, 2014 of the Prime Minister approving the Program on Training and Developing Human Resources for Information Security and Safety until 2020;

At the proposal of the Director of the Administrative and Public Service Financial Department;

The Minister of Finance issues this Circular regulating the management and use of funds for implementing short-term training projects on information security and safety within the framework of the Program on Training and Developing Human Resources for Information Security and Safety until 2020.

Article 1. Scope of Application

This Circular regulates the management and use of funds for implementing short-term training projects on information security and safety (ISAS) within the framework of the Program on Training and Developing Human Resources for Information Security and Safety until 2020, which has been approved by the Prime Minister under Decision No. 99/QĐ-TTg dated January 14, 2014 (hereinafter referred to as Program 99).

Article 2. Implementing Entities

4. Members of the national network for incident response to ensure cybersecurity; units specialized in incident response and cybersecurity; operational teams for emergency response to ensure cybersecurity; cybersecurity incident response teams.

2. People's Committees of provinces and centrally governed cities.

3. Enterprises, financial organizations, banks, state-owned corporations, and economic groups.

Article 3. Sources of Funds

1. State budget, including central and local budgets according to current budget allocation levels.

2. Revenue sources of agencies and units permitted to retain and use according to the law.

3. Contributions from enterprises and other lawful funding sources as prescribed by law.

Article 4. Training Recipients

1. Officials, civil servants, and employees working in ISAS in specialized units for information technology of Ministries, ministerial-level agencies, government agencies, and other central-level agencies.

2. Officials, civil servants, and employees working in ISAS in specialized units or departments for information technology under General Departments, Bureaus, or public service units (if any).

3. Officials, civil servants, and employees working in ISAS in Provincial Departments of Information and Communications, Information Technology Centers under People's Committees of provinces and centrally-administered cities (including Data Centers, Integrated Data Centers, and technical operation units of local information technology application systems such as electronic portal systems, email systems, single-window electronic systems, and electronic document management systems).

4. Leaders and key officials of Ministries, central-level agencies, and localities.

5. Specialized officials in ISAS at enterprises, financial organizations, banks, state-owned corporations, and economic groups.

Article 5. Content and Levels of Expenditure

The content and levels of expenditure for activities implementing short-term training projects on ISAS under Program 99 shall be carried out in accordance with Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance on the preparation of budget estimates, management, and use of state budget funds for training and capacity building for officials and civil servants. In addition, this Circular provides guidance on certain additional contents and levels of expenditure as follows:

1. Rent for facilities, including:

a) Rent for classrooms.

b) Rent for computers, projectors, and specialized equipment for practical training on information security such as Firewalls, IPS/IDS, Routers, Switches, and other necessary equipment.

The level of expenditure will be based on actual implementation while complying with legal provisions on the selection of contractors in regular procurement.

2. Expenditure for domestic main lecturers, assistant lecturers, and technical staff:

a) Expenditure for main lecturers, assistant lecturers, and technical staff:

Based on actual conditions, available budget, and the complexity of the course, the agency or unit responsible for organizing the training courses will decide specific expenditure levels appropriate for high-demand courses that may require hiring experts with remuneration agreed upon or applying an increase factor of 1.5 to 3.0 times the current remuneration standard, specifically as follows:

- Expenditure for domestic main lecturers: A maximum of 100,000 VND/hour/lecturer for training courses on management and operational skills for ISAS for managers; not exceeding 120,000 VND/hour/lecturer for advanced skill training courses for ISAS personnel; not exceeding 200,000 VND/hour/lecturer for international certification courses on ISAS;

- Expenditure for assistant lecturers and technical staff: Not exceeding 50,000 VND/hour/person.

In cases where special technical requirements arise, the Ministers of Ministries, Heads of Central Agencies, and Chairmen of Provincial People's Committees will decide the specific remuneration levels for lecturers in writing to implement.

b) Living expenses for domestic main lecturers, assistant lecturers, and technical staff:

Depending on the location and duration of the training sessions, the agencies or units responsible for organizing the training courses will decide on meal allowances for lecturers but not exceeding the accommodation allowance stipulated in Circular No. 97/2010/TT-BTC dated July 6, 2010 of the Ministry of Finance on travel expenses and meeting organization costs for state agencies and public service units, and guidelines issued by ministries, sectors, and localities to implement Circular No. 97/2010/TT-BTC of the Ministry of Finance.

c) Travel expenses for main lecturers, assistant lecturers, and technical staff: Including air tickets, train tickets, taxi fares for travel during teaching, reimbursed based on actual expenses incurred.

3. Expenditure for foreign lecturers:

a) Remuneration for foreign lecturers shall be agreed upon between the training institution and the lecturer but not exceeding 20,000,000 VND/person/day.

b) Other expenses for foreign lecturers such as meals, accommodation, travel, and translation services shall be implemented in accordance with Circular No. 01/2010/TT-BTC dated January 6, 2010 of the Ministry of Finance on the regulations for receiving foreign guests for work in Vietnam, organizing international conferences and seminars in Vietnam, and hosting guests domestically.

4. Training and capacity building according to international certificates of companies (authorized units of companies): payment shall be made according to the contract between training institutions and providers, including training copyright costs and original training manuals (if any); ensuring compliance with invoice regulations and bidding and procurement regulations for goods and services.

5. For online training and capacity building, in addition to the expenses stipulated in Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance, the following expenses are also allowed:

a) Expenses for developing framework programs and compiling curricula: implemented in accordance with Circular No. 123/2009/TT-BTC dated June 17, 2009 of the Ministry of Finance, which specifies the content and levels of expenditure for developing framework programs and compiling curricula for subjects in undergraduate, college, and vocational secondary education.

b) Expenses for digitizing lectures for online training and capacity building: implemented in accordance with Circular No. 194/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance, guiding the level of expenditure for creating electronic information to maintain regular operations of agencies and units using state budget funds.

c) Expenses for producing video lectures: apply the standard for producing knowledge dissemination programs as stipulated in Circular No. 30/2010/TT-BTTTT dated December 31, 2010 of the Ministry of Information and Communications, promulgating temporary standards on labor and equipment consumption in television program production.

d) Expenses for purchasing and developing software for online training and capacity building: implemented in accordance with regulations on software development and procurement.

đ) Expenses for renting and purchasing services to maintain and store lectures on the internet: payment shall be made according to the contract between training institutions and providers, ensuring compliance with invoice regulations and bidding and procurement regulations for goods and services.

6. During implementation, if the legal documents cited for application in this Circular are amended, supplemented, or replaced by new legal documents, they shall be applied according to the amended, supplemented, or replacing documents.

Article 6. Budget Preparation, Management, and Utilization

1. Budget Preparation: Annually, during the time for preparing the state budget in accordance with the State Budget Law, agencies and units assigned tasks under Project 99 shall, based on the short-term training needs for ANATTT, develop plans and budgets for implementing the task of training ANATTT personnel of their own agencies and units, consolidate them into the annual training and capacity building plan for civil servants, and submit them to the Ministry of Home Affairs for consolidation (for central ministries and agencies), and to the Provincial Department of Home Affairs (for local agencies). At the same time, they shall consolidate them into the annual budget plan of the ministry or agency and submit it to the financial authority at the same level for consolidation and submission to the competent authority in accordance with regulations.

2. Allocation and Assignment of Budget: Based on the budget allocated by the competent authority, the head of the agency or unit is responsible for allocating and assigning the budget to the units organizing the implementation (including the budget for implementing Project 99).

3. Utilization and Settlement of Budget: The utilization and settlement of the budget must ensure the implementation of Project 99 in accordance with the State Budget Law, guiding documents, and provisions of this Circular; at the end of the year, it shall be consolidated into the annual budget settlement of the agency or unit in accordance with regulations.

Article 7. Implementation Organization

1. The Ministry of Information and Communications shall take the lead in compiling training programs and textbooks to meet the training requirements of short-term courses; organize the selection of training units with the ability to implement short-term technical ATANTT training courses for IT staff and high-level technical ATANTT staff in specialized IT units of central ministries and agencies and localities; train ATANTT knowledge for leadership and key cadres of ministries, sectors, and localities; and train according to international ATANTT certificates.

2. Central ministries and agencies and localities shall organize short-term ATANTT training courses for staff working in ATANTT in specialized IT units of central ministries and agencies, in provincial Departments of Information and Communications, and IT Centers under People's Committees of provinces and centrally-administered cities, and other relevant cadres, civil servants, and officials within their management scope, based on the training programs, textbooks, and guidance of the Ministry of Information and Communications, and their own financial capabilities.

3. Enterprises, financial organizations, banks, holding companies, and state economic groups: Depending on their needs and financial capabilities, they shall proactively negotiate with training institutions to send staff to attend courses and pay fees accordingly.

Article 8. Effective Date

1. This Circular takes effect from January 1, 2016.

2. During implementation, if there are difficulties or obstacles, agencies and units shall report to the Ministry of Finance for timely resolution.
