Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government and Decree No. 44/2011/NĐ-CP dated June 14, 2011 of the Government amending and supplementing Article 3 of Decree No. 189/2007/NĐ-CP dated December 27, 2007 on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government and Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP on the establishment, approval, and management of overall planning for economic and social development;

Pursuant to Decision No. 0632/QĐ-BCT dated February 11, 2011 of the Ministry of Industry and Trade approving the outline and budget for implementing the planning scheme for gasoline service stations along National Highway 1 to 2020, with consideration to 2025;

At the proposal of the Director of the Planning Department,

DECISION:

Article 1. Approves the Planning Scheme for Gasoline Service Stations Along National Highway 1 to 2020, with Consideration to 2025, with the main contents as follows:

1. Development Orientation

- Ensuring sufficient and safe supply of gasoline for vehicles on National Highway 1 while meeting the socio-economic development requirements of localities along National Highway 1, combining economic and social development goals with national defense and security objectives.

- Ensuring quality of commercial services, improving business efficiency, and protecting consumer interests. Combining gasoline sales with other commercial services to create static traffic points as part of the infrastructure of national highways.

- Mobilizing all financial resources from society, but prioritizing state-owned enterprises (Petrolimex, PV Oil, PETEC...) to invest to ensure fuel supply under all circumstances.

2. Development Objectives

- Building a modern and unified system of service stations to meet the demand for various types of fuels (gasoline, bio-fuel, LPG...), ensuring fuel supply for vehicles on National Highway 1.

- Reorganizing existing service stations, firmly eliminating small and poorly designed ones that do not comply with general urban planning standards or violate safety standards. Efficiently utilizing the technical facilities of existing service stations, reducing fire prevention, firefighting, and environmental sanitation risks.

- Saving land, combining fuel supply services with other commercial services.

3. Development Orientation

- New service stations must have a reasonable pump column structure to allow for combined (or converted) fuel supply from gasoline, diesel to LPG, and reserve land to ensure fuel supply for various types of vehicles (including bio-fuels).

- The system of service stations must meet technical standards and construction regulations regarding distance, storage tanks...

- Combining new construction and renovation to ensure harmonious and efficient economic development.

4. Development Planning

4.1. Criteria for Establishing Service Stations

4.1.1. Regarding Area and Scale

- Type 1 Service Station: Must have at least 6 pumps (1-2 nozzles each) with a rest area, overnight parking lot, and other commercial services. Minimum land area (excluding non-usable land next to the road) must be 5600 m², with a frontage width of at least 70 meters.

- Type 2 Service Station: Must have at least 4 pumps (1-2 nozzles each) with other commercial services. Minimum land area (excluding non-usable land next to the road) must be 3000 m², with a frontage width of at least 60 meters. In urban areas, this can be reduced to 1000 m² with a frontage width of at least 40 meters.

- Type 3 Service Station: Must have at least 3 pumps (1-2 nozzles each). Minimum land area (excluding non-usable land next to the road) must be 900 m², with a frontage width of at least 30 meters. In urban areas, this can be reduced to 500 m² with a frontage width of at least 20 meters.

- At locations far from fuel sources and difficult to transport, additional emergency storage capacity of 50 to 100 m³ may be added.

4.1.2. Distance Criteria

- Distance between two Type 1 Service Stations ≥ 40 km.

- Distance between two Type 2 Service Stations ≥ 20 km.

- Distance between Type 3 Service Stations and Type 1 and 2 Service Stations:

+ In urban areas: ≥ 2 km.

+ Outside urban areas: ≥ 12 km.

4.1.3. Location Criteria

- Convenient connection to infrastructure: transportation, electricity, water supply, communication to minimize investment costs and ensure business efficiency.

- Ensuring the distance between service stations according to the criteria specified in Point 4.1.2 Clause 4.1 of this Decision.

- Ensuring requirements for fire prevention, firefighting, and environmental safety (according to national construction standards generally and design standard TCVN - 4530-2011: Gasoline Service Station - Design Requirements) and related standards.

- On sections of roads coinciding with expressways, when there is a median strip, service stations should be staggered on both sides of the road.

4.2. Planning for Service Stations

4.2.1. Period 2012-2015

- Constructing 79 new service stations, including 8 Type 1, 20 Type 2, and 51 Type 3 (List in Appendix 1).

- Renovating and upgrading the architectural construction of 111 service stations to meet minimum Type 3 standards, ensuring neatness, fire prevention, and environmental safety (List in Appendix 2).

- Relocating 68 existing service stations (List in Appendix 3).

4.2.2. Period 2016-2020

- Constructing 25 new service stations, including 4 Type 1, 12 Type 2, and 9 Type 3 (List in Appendix 1).

- Continuing to renovate and upgrade 33 service stations not included in relocation to meet similar Type 3 standards (List in Appendix 2).

- Relocating 16 existing service stations (see List in Appendix 3).

4.2.3. Orientation for the Period 2021-2025

Continue to renovate and upgrade the architectural construction of stores not within the scope of clearance or relocation to ensure they are as neat and tidy as model petrol stations types 1 and 2, thereby forming service trade complexes.

5. Main Solutions and Policies

- Capital Solution: Utilize 100% self-balanced capital or credit loans from enterprises to construct petrol stations.

- Land Solution: Organize bidding for land use rights for enterprises.

- Management Solution: Ensure compliance with the State's regulations on petrol business activities as stipulated in Decree No. 84/2009/NĐ-CP dated October 15, 2009 of the Government on petrol business. Firmly cease operations of petrol stations that do not conform to planning, lack a Business Registration Certificate for Petrol Business Conditions, violate road boundaries, fail to meet Vietnamese construction standards, do not ensure fire safety and environmental protection, and affect social order. Strengthen inspections and oversight of petrol station owners, and firmly handle violations related to petrol business, such as operating without a Business Registration Certificate for Petrol Business Conditions, failing to ensure social order and safety regarding planning, construction, fire safety, environment, traffic, and violating measurement and quality requirements for petrol.

- Environmental Protection Solution: Focus on implementing key tasks such as determining the location and design of petrol stations in accordance with planning, adhering to economic and technical industry standards and environmental hygiene standards; implementing environmental protection measures in petrol facilities; enforcing inspection regulations and strict penalties for violations; defining responsibility allocation and coordination management among departments in directing and supervising environmental protection activities in the commerce sector.

- Support Policy for Relocation and Clearance: Implement appropriate support policies and prioritize new locations according to planning for petrol stations required to be relocated or cleared.

6. Implementation organization.

1. The Ministry of Industry and Trade shall be responsible for announcing, directing, and inspecting the implementation of the Planning System of Petrol Stations along National Highway 1 until 2020, considering up to 2025.

2. People's Committees of provinces where National Highway 1 passes through shall direct the Department of Industry and Trade to cooperate with local departments to study and propose mechanisms and policies to implement the planning and monitor the construction of petrol stations according to criteria specified in Point 4.1.1 Clause 4.1 Article 1 of this Decision.

Any issues encountered during implementation should be promptly discussed with the Ministry of Industry and Trade for resolution.

Article 2. This Decision shall take effect from the date of signing.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the central government where National Highway 1 passes through, and relevant organizations and individuals are responsible for enforcing this Decision./.
