Amending and supplementing Article 3 of Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade stipulating the functions, tasks, powers, and organizational structure of
the Ministry of Industry and Trade
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Considering the proposal of the Minister of Industry and Trade,
DECREE:
Article 1. Amending and supplementing Article 3 of Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade as follows:
"Article 3. Organizational Structure
1. Department of Planning.
2. Department of Finance.
5. Legal Affairs Department;
4. The Legal Affairs Department.
5. International Cooperation Department;
6. Ministry Inspectorate.
8. Inspectorate;
8. Department of Science and Technology.
9. Department of Heavy Industry.
10. Department of Light Industry.
11. Department of Import-Export.
12. Department of Domestic Market.
13. Department of Mountainous Area Trade.
14. Department of Asia-Pacific Market.
15. Department of European Market.
16. Department of American Market.
17. Department of African, West Asian, and South Asian Market.
18. Department of Multilateral Trade Policy.
19. Department of Propaganda and Awards.
20. Energy Administration.
21. Market Management Agency.
22. Electricity Regulation Agency.
23. Agency for Trade Promotion.
24. Local Industry Agency.
25. Agency for Safety and Environmental Technology in Industry.
26. Agency for E-commerce and Information Technology.
27. Competition Management Agency.
28. Chemicals Agency.
29. Commercial Offices in Foreign Countries and Territories.
30. Representative Office of the Ministry of Industry and Trade in Ho Chi Minh City.
31. Secretariat of the Competition Council.
32. Institute for Industrial Strategy and Policy Research.
33. Institute for Trade Research.
34. Industry and Trade Newspaper.
35. Industry Magazine.

37. Central Training and Refresher Course Institute for Industry and Trade Cadres.
The units prescribed from Clause 1 to Clause 31 of this Article are organizations assisting the Minister in state management, while the units prescribed from Clause 32 to Clause 37 of this Article are public service units under the Ministry.
The Office of the Ministry, the Inspectorate of the Ministry, the Representative Office of the Ministry in Ho Chi Minh City, and the Departments of Planning, Legal Affairs, Organization and Cadre Affairs, International Cooperation, Science and Technology, Heavy Industry, Multilateral Trade Policy, Import-Export, Domestic Market, Asia-Pacific Market, European Market, American Market, African, West Asian, and South Asian Market, and Department of Propaganda and Awards shall be organized into divisions.
The Minister of Industry and Trade shall submit to the Prime Minister for approval the functions, tasks, powers, and organizational structure of the National Energy Administration, Electricity Regulation Agency, Competition Management Agency, Market Supervision Agency, permission to establish commercial offices in foreign countries and territories, and issue a list for other public service organizations remaining under the Ministry.
Units assisting the Board and inter-ministerial organizations shall operate according to the decision of the Prime Minister when establishing the Board and inter-ministerial organizations."
Article 2. Effective Date
This Decree takes effect from August 15, 2011.
Article 3. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
