Regarding the issuance of the Regulation on the Organization and Operation of the Accounting and Finance Department
GOVERNOR OF THE STATE BANK OF VIETNAM
Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam No. 10/2003/QH11 dated June 17, 2003;
Pursuant to the Law on Accounting No. 03/2003/QH11 dated June 17, 2003;
Pursuant to the Construction Law number 16/2003/QH11 dated December 10, 2003;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;
Pursuant to Decree No. 52/2003/ND-CP dated May 19, 2003, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
At the proposal of the Director of the Accounting and Finance Department and the Director of the Cadre and Organization Department;
After reaching agreement with the Minister of Internal Affairs,
DECISION:
Article 1. Issued with this Decision is the "Regulation on the Organization and Operation of the Accounting and Finance Department."
Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. The Decision number 95/1999/QĐ-NHNN dated March 23, 1999 of the Governor of the State Bank of Vietnam regarding the issuance of the Regulation on the Organization and Operation of the Accounting and Finance Department and previous regulations contrary to this Decision are hereby repealed.
Article 3. The Head of the Office, the Directors of the Cadre and Organization Department and the Accounting and Finance Department, and the Heads of relevant units under the State Bank of Vietnam are responsible for implementing this Decision.
RULES ON ORGANIZATION AND OPERATION
OF THE ACCOUNTING AND FINANCE DEPARTMENT

PART I
GENERAL PROVISIONS
Article 1. The Accounting and Finance Department is a unit within the organizational structure of the State Bank of Vietnam, having the function of advising the Governor to implement state management over accounting, payment technical operations, investment construction, and exercising the rights of the representative owner of the state capital at enterprises in the banking sector according to the provisions of the law; assisting the Governor in directing and organizing the accounting work, financial management, asset management, payment activities, and investment construction of the State Bank of Vietnam.
Article 2. The Accounting and Finance Department has its own seal for use in business activities according to the provisions of the law.
Article 3. The head of the Accounting and Finance Department is the Director; the Deputy Directors assist the Director. The Director and Deputy Directors are appointed by the Governor. The organization and operation of the Accounting and Finance Department shall be carried out according to the principle of centralized democracy and the chief executive system.
Chapter II
TASKS AND POWERS
OF THE ACCOUNTING AND FINANCE DEPARTMENT
Article 4. The Accounting and Finance Department has the following tasks and powers:
1. Advising the Governor to perform state management functions over accounting in the banking sector, specifically:
a) Drafting and submitting to the Governor for promulgation legal normative documents in the field of accounting and finance within the State Bank of Vietnam's system according to the provisions of the law; guiding, monitoring, and inspecting the implementation by units;
b) Drafting and submitting to the Governor for promulgation legal normative documents in the field of accounting applicable to credit organizations according to the provisions of the law; guiding credit organizations in their implementation;
c) Submitting to the Governor for approval and signature legal directives and solutions to issues in the field of accounting and finance in the sector according to the provisions of the law.
2. Advising the Governor to manage the field of payment technical operations in the banking sector; organizing the implementation of payment transfer activities between units under the State Bank of Vietnam; guiding and organizing net settlement and other payments between banks and other service providers.
3. Advising the Governor to perform state management functions over investment construction activities in the banking sector according to the provisions of the law.
4. Taking the lead and coordinating with related units to advise the Governor to exercise the rights and obligations of the representative owner of the state capital at state-owned enterprises in the banking sector according to the provisions of the law (except for the Central Credit Union Fund).
5. Taking the lead and coordinating with related units to draft and implement plans for reform and restructuring of subordinate enterprises under the State Bank of Vietnam.
6. Advising the Governor to organize and implement accounting work, financial management, and asset management of the State Bank of Vietnam, specifically:
a) Managing and recording comprehensively, accurately, and promptly all types of centralized funds and assets of the State Bank of Vietnam according to the provisions of the law.
b) Organizing the implementation of financial revenue and expenditure activities of the State Bank of Vietnam, including:
- Preparing and submitting to the Governor for decision-making the annual financial plan; notifying, monitoring, and inspecting units' implementation of approved plans;
- Inspecting, auditing budget estimates, final accounts of fixed asset purchases, and annual financial income and expenditure final accounts of units;
- Implementing the establishment of various types of funds and payment to the state budget according to the provisions;
- Serving as the focal point for compiling the financial plans of public institutions and education training budgets for the State Bank of Vietnam. Notifying units to implement after obtaining approval from the competent authority; monitoring implementation and reporting periodically according to prescribed procedures.
7. Advising the Governor on managing and organizing the implementation of investment construction activities of the State Bank of Vietnam, specifically:
a) Serving as the focal point for compiling and drafting investment construction plans of units for submission to the Governor for decision-making; notifying and coordinating with units to implement approved investment construction plans.
b) Auditing or coordinating with functional agencies to audit or hire consultants to audit investment construction projects and equipment purchases according to current regulations.
c) Urging, inspecting, and supervising the implementation of investment construction projects according to the provisions of the law.
d) Organizing the implementation of capital allocation, settlement, and finalization of investment construction projects according to current regulations.
8. Implementing financial reporting and financial transparency systems according to the provisions of the law.
9. Coordinating with related units to organize training in accounting, payment, financial management, and investment construction for units within the banking system.
10. Leading or participating in scientific research on accounting, payment technical operations, and the application of technology in accounting and payment activities; implementing international assistance projects for accounting and payment activities according to the Governor's assignment.
11. Performing other tasks assigned by the Governor.
Chapter III
ORGANIZATIONAL STRUCTURE AND MANAGEMENT
Article 5. The organizational structure of the Accounting and Finance Department includes:
1. The System - Consolidation Section;
2. The Financial Management Section;
3. The Investment and Basic Construction Management Section;
4. The Centralized Accounting Section;
5. The Inter-bank Payment Control Section;
6. The Inspection Section.
The working regime of the Accounting and Finance Department shall be carried out under the mechanism of independent officers combined with section organization, and in accordance with accounting laws. Specific tasks and authorities of each section and independent officers shall be stipulated by the Department Head.
Article 6. Tasks and Authorities of the Department Head
1. Organizing the implementation of functions and tasks as prescribed in Article 4 of this Regulation; being responsible before the Governor and the law for all activities of the Department.
2. Deciding on the work program and plan of the unit and applying necessary measures within his/her authority to fulfill assigned tasks.
3. Signing on administrative documents by delegation or at the Governor's request according to the Governor's classification and delegation.
4. Managing and utilizing staff according to the Governor's classification and delegation.
Article 7. Tasks and Authorities of the Deputy Department Head
1. Assisting the Department Head in directing and managing certain aspects of work as delegated by the Department Head and being responsible for assigned tasks.
2. Signing on behalf of the Department Head on administrative documents as delegated by the Department Head.
3. When the Department Head is absent, a Deputy Department Head authorized by the Department Head shall manage the unit's operations, be responsible for resolved matters, and report back when the Department Head returns.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. Amendments and supplements to this Regulation shall be decided by the Governor of the State Bank./.
