Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Pursuant to the Government's Decree No. 38/CP dated June 4, 1993, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Based on the proposal of the Department Head of the Department of Legal Propaganda and Education, the Department Head of the Department of Organization and Training of the Ministry of Justice,
DECISION:
Article 1. This Decision promulgates the Regulation on the organization and operation of the Department of Legal Propaganda and Education.
Article 2. This Decision takes effect fifteen days after the date of signature.
Article 3. Heads of units under the Ministry of Justice are responsible for implementing this Decision.
The Department Head of the Department of Organization and Training is responsible for supervising the implementation of this Regulation and together with the Department Head of the Department of Legal Propaganda and Education shall identify any difficulties or new issues arising (if any), report and propose to the Minister for consideration and amendment to ensure the perfection of the Regulation.

ORGANIZATION AND OPERATION OF THE DEPARTMENT OF LEGAL PROPAGANDA AND EDUCATION

PART I
FUNCTIONS, TASKS, POWERS, ORGANIZATION, AND STAFFING
Article 1. Functions
The Department of Legal Propaganda and Education is a unit under the Ministry of Justice with the function of assisting the Minister of Justice in exercising unified state management over legal propaganda and education work, the management and exploitation of legal bookshelves at communes, wards, and towns nationwide, and grassroots mediation work; it takes the lead in coordinating with relevant agencies and organizations to directly implement legal propaganda and education work and promote judicial activities.
Article 2. Tasks and Authorities
The Department of Legal Propaganda and Education has the following tasks and powers:
1. Developing long-term and short-term legal propaganda and education programs and plans and directing their implementation; taking the lead or participating in drafting and reviewing normative legal documents assigned by the Minister;
2. Assisting the Minister in his capacity as Chairman of the Steering Committee for Legal Propaganda and Education Work of the Government in performing the duties of the steering body; coordinating with central-level relevant agencies to monitor and propose commendations for collectives and individuals with outstanding achievements in legal propaganda and education work;
3. Directing, guiding, and monitoring local judicial organs and legal departments of Ministries and Sectors in implementing legal propaganda and education work, managing and exploiting legal bookshelves, and building forces for legal propaganda and education;
4. Directing, guiding, and monitoring local judicial organs in implementing grassroots mediation work; building a team of mediators;
5. Coordinating with functional agencies of the Ministry of Education and Training and relevant Ministries and Sectors to monitor, guide, and direct legal education work in schools;
6. Coordinating with relevant agencies and organizations to monitor and guide legal propaganda and education work in the press; reporting on practical experiences in building and implementing laws to serve leadership guidance activities;
7. Taking the lead in coordinating with units under the Ministry to compile and distribute professional bulletins and materials to serve legal propaganda and education work, management and exploitation of legal bookshelves, grassroots mediation, and promoting judicial activities;
8. Compiling information and statistics on legal propaganda and education activities, management and exploitation of legal bookshelves, and grassroots mediation nationwide and assisting the Minister in organizing mid-term and final reviews of such work;
9. Coordinating with relevant units to build and implement cooperation plans with foreign countries and international organizations on legal propaganda and education work, management and exploitation of legal bookshelves, and grassroots mediation;
10. Performing other tasks assigned by the Minister.
Article 3. Organizational structure and staffing.
1. The Department of Legal Propaganda and Education consists of a Director, Deputy Directors, and specialized civil servants.
2. The staffing of the Department of Legal Propaganda and Education belongs to the administrative staffing of the Ministry of Justice and is allocated by the Minister of Justice based on the proposal of the Director of the Department of Legal Propaganda and Education, the Director of the Department of Organization and Cadre Training.
Chapter II
DUTIES AND POWERS OF CIVIL SERVANTS IN THE DEPARTMENT
Article 4. Duties and powers of the Director.
The Director of the Department of Legal Propaganda and Education is a leading civil servant heading the Department and is personally responsible to the Minister of Justice for organizing and implementing the duties and powers of the Department as stipulated in Article 2 of this Regulation.
The Director has the following specific duties and powers:
1. Organizing the development and directing the implementation of the Department's work plan;
2. Assigning specific tasks; coordinating activities and supervising the implementation of tasks by Deputy Directors and other civil servants in the Department;
3. Signing on behalf of the Minister to issue guiding and directing documents for local judicial agencies, legal institutions of Ministries and sectors regarding legal propaganda and education; managing and utilizing the Legal Library, grassroots mediation;
4. Using funds efficiently to serve legal propaganda and education, building, managing, and utilizing the Legal Library, grassroots mediation;
5. Providing information to civil servants in the Department according to current work reporting regulations;
6. Implementing democratic regulations in the organization and operation of the Department;
7. Representing the Department in relations with agencies, organizations, and individuals when resolving issues related to the organization and activities of the Department;
8. Performing other tasks assigned by the Minister.
Article 5. Duties and powers of Deputy Directors.
Deputy Directors are leading civil servants assisting the Director in carrying out the assigned tasks and are responsible to the Director for the tasks they oversee.
Deputy Directors have the following specific duties and powers:
1. Developing work plans within their assigned responsibilities and submitting them to the Director for decision;
2. Independently implementing the contents of the assigned tasks; monitoring, inspecting, and reporting to the Director on the results of assigned tasks;
3. Informing civil servants in the Department about relevant professional issues within their assigned tasks;
4. Acting on behalf of the Director in relations with agencies, organizations, and individuals when authorized by the Director;
5. Performing other tasks assigned by the Director.
Article 6. Duties and powers of specialized civil servants.
Civil servants in the Department of Legal Propaganda and Education enjoy rights and fulfill obligations as prescribed by law for civil servants and have the following specific duties and powers:
1. Developing work plans and implementing assigned tasks, being responsible to the Director for the results of those tasks, ensuring that the Department collectively fulfills its functions and tasks;
2. Within their duties and powers, independently handling matters according to prescribed procedures, steps, and deadlines;
3. Based on work programs and plans, proactively or collaboratively maintaining coordination with civil servants and individuals from relevant agencies and units within the Ministry to effectively carry out assigned tasks. If new issues arise, report to the Director for resolution; propose rewards for units under supervision;
4. Building and preserving work files and documents within their assigned areas;
5. Studying theoretical materials, policies, and current laws; improving speaking and writing skills;
6. Adhering to labor discipline, work reporting systems, Ministry regulations, and Department regulations;
7. Receiving information related to assigned tasks and other information as prescribed by current laws;
8. Enjoying benefits and policies as prescribed by laws on cadres and civil servants.
Chapter III
WORKING REGIME
Article 7. Principles of Work.
The Department for Legal Propaganda and Education operates under a directorate system, ensuring the principle of democratic centralism combined with the promotion of individual capabilities and responsibilities of each civil servant. Each civil servant is assigned to oversee one or more specialized business operations and legal fields; they receive tasks and are directly responsible to the Department Head.
Article 8. System for Building and Implementing Work Plans.
1. Based on the Ministry's work program, the Department Head directs the construction and organization of implementation of monthly, quarterly, and annual work plans for the Department.
2. Based on the Department's monthly, quarterly, and annual work plans, the Department Head guides civil servants in building personal work plans, supervising and guiding civil servants in organizing their implementation.
Article 9. System for Drafting Documents and Materials.
1. For documents signed by the Ministry leadership, after receiving guidance from the Department Head on the content of the document, the civil servant or group of civil servants tasked with drafting the document will organize its preparation.
Depending on the nature, level, and importance of each specific document, the civil servant or group of civil servants tasked with drafting the document may propose that the Department Head organize the collection of opinions from other civil servants within the Department or relevant agencies and organizations; compile and refine the draft document before reporting it to the Department Head.
Before submitting to the Ministry leadership, the Department Head reviews and countersigns the document and is responsible to the Ministry leadership when the document is issued.
2. For documents signed by the Department Head, after receiving guidance from the Department Head, the civil servant or group of civil servants assigned to draft the document will proceed accordingly.
For directive and guidance documents for localities, legal affairs of the Ministry and Sector, the civil servant or group of civil servants assigned to draft the document, depending on the nature, level, and importance of each specific document, may propose to the Department Head to organize the collection of opinions from other civil servants within the Department; lead in incorporating opinions, refining the draft, and submitting it to the Department Head.
3. For materials related to legal education and propaganda, management and exploitation of the Legal Library, grassroots mediation, and materials promoting judicial activities, the civil servant or group of civil servants assigned to gather and compile these materials will actively collect and organize resources, draft outlines and plans, and submit them to the Department Head.
After approval by the Department Head, the civil servant or group of civil servants assigned will organize the construction of those materials.
The Department Head assigns one or a group of civil servants to edit the materials. The Department Head is responsible for the content of the materials and directs their issuance.
Article 10. Meeting System.
1. Weekly, Department leadership convenes to assess the implementation of work, exchange necessary information related to the Department's activities, and unify the work plan for the following week.
2. Monthly, Department leadership holds a meeting with all civil servants to evaluate the Department's work performance for the month, listen to feedback and suggestions from civil servants regarding issues related to the Department's activities in the following month.
The Department Head may call emergency meetings to promptly address important matters of the Ministry or the Department.
Article 11. Regulations on Dispatching Staff for Work Trips and Meetings.
1. The dispatching of civil servants for work trips and meetings shall be based on their professional expertise, duties, and assigned tasks.
2. Civil servants dispatched for work trips and meetings shall have the responsibility to promptly report to the Director in writing or directly about the contents of the meetings they have attended, the results of the official duties performed, issues arising that need resolution, and suggestions.
Article 12. Information System.
1. Monthly, at the general staff meeting of the Department, the Director or Deputy Director authorized by the Director shall inform the civil servants about the situation regarding the implementation of tasks of the sector, the Ministry, and the Department.
2. Providing information and materials to relevant parties must be approved by the Director or the Deputy Director directly responsible.
Civil servants may not disclose or provide information and materials without formal instructions from the Department's leadership.
Article 13. Management of Documents, Files, and Materials.
1. Civil servants in the Department shall be responsible for managing various types of official documents and materials within their assigned field of work according to current state regulations on file retention and preservation.
2. Civil servants assigned secretarial duties shall be responsible for collecting and tracking official documents and materials after they have been processed by the Director.
3. Official documents and materials sent out by the Department must be kept in the Department with one copy, and duplication by the Department’s secretarial staff is only allowed upon request by the Department's leadership.
4. Official documents and materials stored in the Department must be neatly organized, managed, and retained according to current state regulations, ensuring ease of access for reference when necessary.
Article 14. Labor Management System of the Department.
1. The labor management of the Department shall comply with the provisions of the Civil Servant Law and other relevant laws.
2. Civil servants taking annual leave, emergency leave, or personal leave must report to the Director for scheduling and arranging, ensuring it does not affect the overall work plan of the Department.
3. Civil servants participating in teaching and scientific research must report to the Director for review and resolution, while also completing their assigned professional tasks.
Article 15. Evaluation, Reward, and Disciplinary Measures for Civil Servants.
Annually, the Department organizes a comprehensive evaluation of the work performance of civil servants according to the Ministry's regulations, conducts reviews for commendation titles, and proposes rewards.
The examination, proposal for rewards and disciplinary measures, salary increments, and implementation of other policies and benefits shall be conducted democratically and transparently in accordance with the law.
Chapter IV
WORK RELATIONSHIPS
Article 16. Implementation of Leadership Directives.
The Department of Legal Education and Propaganda is directly under the direction of the Minister and the Deputy Minister in charge. Relations between the Department of Legal Education and Propaganda and the Ministry of Justice's leadership are carried out according to the Working Regulations of the Ministry's leadership.
Article 17. Work Relations with Units Under the Ministry.
The relationship between the Department and units under the Ministry is one of equal level and coordinated activities.
1. In relations with media units under the Ministry, the Department monitors, compiles, and evaluates the activities of legal education and propaganda, reflecting the activities of the Ministry of Justice; organizes regular press meetings for the Ministry's leadership to direct key legal education and propaganda activities quarterly and annually.
2. In relations with legislative drafting units, the Department provides information reflected in the media about the practical implementation and enforcement of laws; serves as the focal point for gathering information, identifying problematic issues concerning constitutionality, legality, and effectiveness, and making recommendations for handling them; participates in legislative drafting activities led by the Ministry; receives information about legislative activities.
3. In relations with the Ministry's Office and the Planning and Finance Department, the Department receives material resources, financial support, and working tools according to general regulations.
4. In relations with other units, the Department collaborates on related tasks and promotes judicial work.
Article 18. Relations with the Party Committee of the Ministry, the Trade Union Committee, and the Youth Communist League Committee of Ho Chi Minh of the Ministry.
In relations with the Party Committee, the Trade Union Committee, and the Youth Communist League Committee of Ho Chi Minh of the Ministry, the Department shall coordinate to convey the Party's guidelines and policies, state laws, resolutions of the Party Committee, and the Trade Union of the Ministry to civil servants within the Ministry; promote cultural and social activities.
Article 19. Relations with Branch Committees and Trade Union Groups, Women's Groups.
1. The Department's leadership shall coordinate with the Branch Committee's Leadership to manage ideological work, cadre work, and professional work, ensuring that civil servants strive to fulfill their tasks.
2. The Department's leadership shall coordinate with the Trade Union Group and the Women's Group to encourage and create conditions for civil servants to complete assigned tasks; care for the living standards of civil servants, build solidarity, mutual assistance in both work and life.
Article 20. Relations with relevant agencies and organizations at the Central level.
In relations with relevant agencies and organizations at the Central level, the Popularization and Legal Education Department shall perform:
1. Serve as the coordinating link with legal institutions, functional units of Ministries and Sectors to guide, direct, and organize the implementation of legal popularization and education work, management, and exploitation of the Legal Bookcase.
2. Coordinate with functional units of the Ministry of Education and Training and related Ministries and Sectors to develop programs, compile textbooks, teaching materials, and learning materials on law; train and nurture teachers; monitor, guide, and direct the teaching and learning of law in schools.
3. Coordinate with functional units of the Ministry of Culture, Sports and Tourism to enhance legal knowledge for cultural and information staff; integrate legal content into cultural and information activities.
4. Coordinate with newspapers and radio stations to establish special pages and columns for promoting and introducing legal documents, legal construction and implementation activities, exemplary cases of living and working according to the Constitution and laws.
5. Coordinate with political and socio-political organizations to implement legal popularization and education work, grassroots dispute resolution work.
Article 21. Relations with local judicial agencies.
In working relations with local judicial agencies, the Popularization and Legal Education Department shall perform:
1. Guide local judicial agencies in developing annual and periodical legal popularization and education plans; guide the implementation of professional activities, legal popularization and education, management, and exploitation of the Legal Bookcase at communes, wards, towns, and grassroots dispute resolution work.
2. Assist local judicial agencies in disseminating legal documents, nurturing professional skills, and updating legal information for legal popularization and education staff and grassroots mediators.
3. Coordinate to direct pilot projects, summarize experiences in legal popularization and education work, Legal Bookcase management and exploitation, grassroots dispute resolution work to replicate exemplary cases nationwide.
