THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Salary Department and the Director of the Civil Service Organization Department,
DECISION:
Article 1. Position and Functions
The Salary Department is an organization under the Ministry of Home Affairs, with the function of advising the Minister in managing state policies, salary systems, allowances, living expenses, and bonuses for civil servants, public officials, and contractual workers in state agencies and state-affiliated organizations; and assisting the Minister in performing the standing duties of the Steering Committee for Research and Implementation of State Salary Policy Reform.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Assist the Minister in drafting proposals for salary policy reform as assigned by the Government, Prime Minister, and other regulatory documents to be submitted to competent authorities for promulgation regarding state salary policies, systems, allowances, living expenses, and bonuses for civil servants, public officials, and public employees from central to commune levels, military salaries, and contractual workers in state agencies and state-affiliated organizations.
2. Submit to the Minister for issuance of documents:
a) Guidelines for implementing the Government's and Prime Minister's regulations on: salary policies and systems (minimum wage, pay scales; rank and grade levels; allowance systems; salary and income management); other policies and systems (principles for setting rank and grade levels, promotion systems, payment methods, living expenses, bonuses, and other systems based on salary) for civil servants, public officials, and public employees from central to commune levels: military salaries, and contractual workers in state agencies and state-affiliated organizations;
b) Guidelines for setting rank and grade levels for enterprise managers, officers, and soldiers when transferred or rotated to administrative or state-affiliated organizations.
3. Review and submit to the Minister for decision or provide opinions on early promotion for senior specialist-grade civil servants and equivalent positions; decide on transferring to senior specialist grades and equivalent positions; decide on promotion and grading for senior specialist-grade civil servants and equivalent positions without examination for those who have announced retirement, after consulting with the Civil Servant-Viên chức Department. Participate in providing opinions on appointing senior specialist-grade positions, professor ranks, and associate professor ranks before the Civil Servant-Viên chức Department submits to the Minister for decision.
4. Lead the implementation of tasks related to establishing and implementing salary and wage systems for personnel in associations and non-governmental organizations after consulting with the Non-Governmental Organization Organization Department and the Civil Servant-Viên chức Department.
5. Participate with relevant agencies in formulating economic and social policies related to salary policies, allowances, living expenses, and bonuses for civil servants, public officials, public employees, military forces, and workers in the business sector.
6. Provide professional guidance on salary policies, allowances, living expenses, and bonuses for the Personnel Organization Departments of Ministries, ministerial-level agencies, and government-affiliated agencies, Provincial Departments of Home Affairs under centrally governed cities, and state-affiliated organizations.
7. Monitor implementation and assist the Minister in resolving requests, complaints, accusations, and anti-corruption efforts related to salary policies, allowances, living expenses, and bonuses for civil servants, public officials, public employees, military forces, and contractual workers in state agencies and state-affiliated organizations.
8. Conduct comprehensive statistical work on salaries and incomes for civil servants, public officials, and public employees, and statistics on consumer price indices over different periods. Apply information technology in professional work; establish databases on salary-related information and coordinate with the Information Technology Application Center to manage, exploit, and utilize databases to serve leadership and management by the Ministry.
9. Lead or participate in researching scientific topics and provide training on salary policies for civil servants, public officials, and public employees. Organize domestic and international conferences on salary issues and other systems based on salary according to the Minister's directives.
10. Organize mid-term and final reviews of the implementation of salary policies, allowances, living expenses, and bonuses for civil servants, public officials, public employees, and workers within the authority of the Ministry of Home Affairs.
11. Perform other tasks assigned by the Minister.
12. Assist the Minister in performing the duties of the Standing Office of the Steering Committee for Research and Implementation of State Salary Policy Reform (hereinafter referred to as the National Salary Steering Committee):
a) Organize the activities of the Drafting Group of the State Salary Policy Reform Proposal to prepare programs, plans, and work contents according to the National Salary Steering Committee's operational program.
b) Prepare documents for the Minister to sign on behalf of the National Salary Steering Committee to submit to competent authorities or send to Ministries, ministerial-level agencies, government-affiliated agencies, and provincial people's committees under centrally governed cities regarding matters related to research and implementation of the State Salary Policy Reform Proposal.
c) Coordinate with relevant ministries and sectors to lead the research and development of proposals for salary policy reforms as assigned by the National Salary Steering Committee.
d) Assist the Minister in reviewing to submit to the State Remuneration Steering Committee for decision on projects related to salary scales, pay tables, allowances, living expenses, bonuses, financial autonomy mechanisms, and wage autonomy at state agencies, state-affiliated organizations, and armed forces (military and police) established by ministries, sectors, and localities;
e) Coordinate with relevant agencies to implement steps towards remuneration policy reform and urge inspections to ensure the synchronous implementation of measures for remuneration policy reform to achieve set objectives;
g) Propose timely measures to address issues arising during the implementation of remuneration policy reform; conduct interim reviews and comprehensive assessments of the implementation of remuneration policy reform in each period;
Article 3. Organization and Working System
1. The Department shall have a Director, several Deputy Directors, and other civil servants;
2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:
a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;
b) Assign tasks, monitor, urge, and inspect the performance of Deputy Directors and civil servants within the Department;
c) Sign on behalf of the Minister to respond, clarify, provide guidance on business matters, and request information from organizations with functions and responsibilities for managing remuneration at state agencies or individuals regarding issues related to remuneration management;
d) Coordinate with organizations within the Ministry and relevant agencies in resolving issues related to the functions, duties, and authorities of the Department;
e) Implement information dissemination activities for civil servants within the Department according to the Ministry's work regulations;
g) Decide on the contents of reports, interim reviews, comprehensive assessments, and recommendations to the Minister on policies and solutions in implementing the Department's tasks;
h) Organize the implementation of Ministry regulations; manage civil servants and assets assigned according to the Ministry's classification;
3. The Deputy Department Head performs professional tasks and assists the Department Head in managing one or several aspects of work as assigned by the Department Head; is responsible to the Department Head for the assigned tasks.
4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.
5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership directly works with Deputy Directors or specialists, Deputy Directors or specialists shall be responsible for implementing the leadership's opinions and promptly reporting back to the Director;
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature;
Repeal Decision No. 79/2003/QĐ-BNV dated November 12, 2003 of the Minister of Home Affairs on the functions, tasks, powers, and organizational structure of the Remuneration Department;
2. The Head of the Ministry's Office, the Director of the Remuneration Department, the Director of the Cadre and Civil Servant Organization Department, the Heads and civil servants of related organizations subordinate to the Ministry of Home Affairs are responsible for implementing this Decision./.
