Article 24regulations on registration, management, and use of motor vehicles,

specialized motorcycles within the Ministry of National Defense

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Department of Technology,

The Minister of National Defense issues the Circular stipulating the registration, management, and use of motor vehicles and specialized motorcycles within the Ministry of National Defense.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular regulates the registration, management, and use of motor vehicles and specialized motorcycles within the Ministry of National Defense.

2. The registration, management, and use of motor vehicles and specialized motorcycles by military enterprises that have been equitized with State ownership below 50% of the charter capital are not within the scope of regulation of this Circular.

Article 2. Applicability

Organizations, units, entities, and individuals related to the registration, management, and use of motor vehicles and specialized motorcycles within the Ministry of National Defense.

Military enterprises (including military enterprises that have been equitized with State ownership above 50% of the charter capital) having motor vehicles and specialized motorcycles registered for civilian license plates at the Public Security Agency.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Military vehicles including motor vehicles and specialized motorcycles equipped for subordinate agencies and units under the Ministry of National Defense managed and used for military and national defense purposes.

2Motor vehicle including cars (including car chassis with installed special equipment, car trailers, electric cars); track vehicles; trailers, semi-trailers pulled by cars; two-wheeled motorcycles, three-wheeled motorcycles, motorbikes (including electric motorcycles).

3. Specialized motor vehicles including military specialized motorcycles, construction motorcycles; agricultural and forestry motorcycles, and other types of specialized motorcycles participating in traffic equipped for agencies and units within the Ministry of National Defense as prescribed in Appendix IV issued together with this Circular.

4. Vehicle registration plate (inspection plate) is a plate attached to motor vehicles and specialized motorcycles displaying letters and numbers issued by the competent authority; this is a legal symbol regarding the rights and responsibilities of managing and using military vehicles of agencies and units.

5. Vehicle registration certificate is a legal document certifying the rights and responsibilities of managing and using military vehicles of agencies and units within the Ministry of National Defense.

Article 4. Registration plates for motor vehicles and specialized motorcycles

1. The Motor Vehicle Bureau/TCKT produces registration plates for motor vehicles and specialized motorcycles according to the model prescribed in Appendix II issued together with this Circular and issues them to agencies and units after completing the vehicle registration procedures as stipulated in Article 23 of this Circular.

2. The registration plate symbols for motor vehicles and specialized motorcycles are prescribed in Appendix III issued together with this Circular for each agency and unit directly under the Ministry of National Defense.

The General Staff decides and announces the registration plate symbols for motor vehicles and specialized motorcycles for newly established agencies and units directly under the Ministry of National Defense.

3. If the registration plate is lost, blurred, broken, or damaged, the agency or unit directly managing it has the responsibility to inspect and report to the Motor Vehicle Bureau or the higher-level equipment management agency up to the level directly under the Ministry of National Defense to request the Motor Vehicle Bureau to issue a new or replacement plate according to the provisions of Article 24 of this Circular.

Cars, trailers, semi-trailers, and specialized motorcycles must complete the registration of auxiliary number systems according to the provisions in Appendix II issued together with this Circular before being put into use.

Article 5. Registration certificates for motor vehicles and specialized motorcycles

1. The Motor Vehicle Bureau/TCKT prints the registration certificates according to the model prescribed in Appendix I issued together with this Circular and issues them to agencies and units after completing the registration procedures as stipulated in Article 23 of this Circular.

2. Agencies, units, and individuals are responsible for managing and using the registration certificates according to the provisions of this Circular. When the registration certificate is lost, blurred, or torn, the agency or unit directly managing it must inspect and report to the Motor Vehicle Bureau or the higher-level equipment management agency up to the level directly under the Ministry of National Defense to request the Motor Vehicle Bureau to issue a new or replacement certificate according to the provisions of Article 24 of this Circular.

Article 6. Origin documents for motor vehicles and special-purpose motorcycles

1. For domestically produced and assembled vehicles: The quality inspection certificate at the time of factory release.

2. For imported vehicles

a) Purchased domestically, purchased through agency contracts:

For motor vehicles: Electronic data on vehicle origin obtained from the Vehicle-Motorcycle Department via the Government's dedicated data transmission network (CPNET) or the import vehicle origin declaration form (for vehicles imported before July 1, 2021); certificate of technical safety and environmental protection quality (this does not apply to military vehicles imported for defense purposes).

For special-purpose motorcycles: Customs declaration form; certificate of technical safety and environmental protection quality or notification of exemption from technical safety and environmental protection quality inspection issued by the competent authority.

b) For vehicles exempted from all customs procedures, including:

Document from the Ministry of National Defense regarding the handling of special customs procedures for importing military equipment;

Document from the customs authority confirming the imported goods (specifying that the goods have passed the surveillance area);

Document from the entrusted import enterprise confirming the chassis number and engine number of imported motor vehicles and special-purpose motorcycles.

3. For imported motor vehicles and special-purpose motorcycles that are gifts, aid, non-commercial imports, or movable assets (direct imports), including:

a) Customs declaration form in accordance with the regulations of the Ministry of Finance;

b) Import permit for gifted vehicles;

c) Aid confirmation document issued by the Ministry of Finance for aid vehicles;

d) Receipts for import tax and special consumption tax for non-commercial imports and movable asset imports.

4. For vehicles registered with the Public Security Agency or the Department of Transportation: The origin documents shall be implemented according to the regulations on issuing and revoking registration certificates and license plates for road motor vehicles of the Ministry of Public Security and the regulations on registering special-purpose motorcycles of the Ministry of Transport.

5. In case of loss of origin documents for motor vehicles and special-purpose motorcycles, the relevant agencies or units must provide an explanatory document along with a copy of the origin documents issued by the issuing agency.

Article 7. Handling specific cases regarding chassis numbers and engine numbers

1. For imported vehicles

a) Motor vehicles and special-purpose motorcycles with chassis numbers and engine numbers on Etiket, painted numbers, blurred, or rusted numbers will be registered based on the numbers confirmed by the customs authority;

b) Motor vehicles and special-purpose motorcycles confirmed by the customs authority only have VIN numbers without chassis numbers or engine numbers will be registered based on the VIN numbers;

c) Motor vehicles and special-purpose motorcycles that have been renumbered chassis and engine numbers will not be registered unless accompanied by an explanatory document from the customs authority or an import agency with confirmation from the manufacturer.

2. For domestically produced and assembled motor vehicles and special-purpose motorcycles with engine and chassis numbers stamped or blurred numbers that cannot be read, the numbers will be reissued based on the numbers recorded in the quality inspection certificate at the time of factory release.

3. For registered motor vehicles and special-purpose motorcycles, if the engine or body has been replaced and there are no numbers, the numbers will be reissued based on the registration plate number.

4. The Vehicle-Motorcycle Department is the sole entity authorized to reissue chassis and engine numbers.

Article 8. Prohibited Acts

1. Forgery of documents; alteration of frame numbers, engine numbers; repair, erasure, modification of information recorded on registration certificates.

2. Self-production, use of license plates not in accordance with Article 4 of this Circular; purchase, sale, lease, loan, rental, mortgage of vehicles, license plates, registration certificates.

3. Replacement of engines of unknown or illegal origin.

4. Provision of motor vehicle documents for military motor vehicles to be operated illegally by non-military personnel.

5. Use of motor vehicles, special-purpose motorcycles for purposes other than intended; joint ventures or associations with organizations or individuals outside the Military.

6. Handing over motor vehicles, special-purpose motorcycles to persons who do not meet the conditions to operate on public roads.

7. Operating motor vehicles, special-purpose motorcycles without being assigned tasks (except in special duty cases or technical condition checks).

Chapter II

REGISTRATION, MANAGEMENT, USE OF MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES

MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES

Section 1

PRINCIPLES, FORMS, REGISTERING AUTHORITIES FOR MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES

Article 9. Principles of Registration, Management, and Use

1. Motor vehicles and special-purpose motorcycles must strictly comply with legal regulations and the Ministry of National Defense's provisions regarding registration and management.

2. Management of quantity, quality, types, brands, groups, usage status, and synchronization; implementation must be thorough, strict, and consistent from grassroots level to strategic management agencies.

3. Use according to purpose, mission, vehicle group, technical combat capabilities; ensure absolute safety and effectiveness.

Article 10. Forms of Registration

1. Official Registration.

2. Temporary Registration.

Article 11. Registration Managing Authorities

1. The Ministry of National Defense uniformly manages and registers motor vehicles and special-purpose motorcycles.

2. The Vehicle-Motorcycle Department assists the Minister of National Defense in managing and registering motor vehicles and special-purpose motorcycles as stipulated in this Circular.

Section 2. REGISTRATION DOCUMENTS FOR MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES

Article 12. Registration Documents for Motor Vehicles and Special-Purpose Motorcycles with Pre-1989 Aid Origin

1. Decision of the General Staff to include in military equipment.

2. Confirmation document from the head of the agency or unit under the Ministry of National Defense regarding the aid origin of the vehicle.

3. Application form for registration of motor vehicles and special-purpose motorcycles as specified in Appendix I attached to this Circular.

4. Warehouse dispatch order (applicable to motor vehicles and special-purpose motorcycles that have been warehoused).

5. Delivery and receipt record.

Article 13. Registration Documents for Motor Vehicles and Special-Purpose Motorcycles Equipped by the Ministry of National Defense

Registration documents for motor vehicles and special-purpose motorcycles equipped by the Ministry of National Defense include:

1. Documents specified in Clauses 1, 3, 4, and 5 of Article 12 of this Circular.

2. Copies of contracts, termination agreements, financial invoices (not applicable to motor vehicles and special-purpose motorcycles purchased centrally by the Vehicle-Motorcycle Department).

3. Proof of vehicle origin as prescribed in Article 6 of this Circular.

Article 14. Registration Documents for Motor Vehicles and Special-Purpose Motorcycles Purchased by Units

1. Initial registration documents, including the documents specified in Clause 1 and Clause 3 of Article 12 of this Circular and the following documents:

a) Copy of purchase contract, termination agreement, or entrustment contract and termination agreement;

b) Copy of financial invoice;

c) Proof of vehicle origin as prescribed in Article 6 of this Circular.

2. Registration documents for motor vehicles and special-purpose motorcycles registered at police agencies or transportation departments, including the documents specified in Clause 1 and Clause 3 of Article 12 of this Circular and the following documents:

a) Copy of purchase contract, termination agreement;

b) Copy of financial invoice (applicable when purchasing motor vehicles and special-purpose motorcycles from organizations or individuals with business registration);

c) Proof of vehicle origin as prescribed in Article 6 of this Circular (the agency or unit purchasing the vehicle is responsible for going to the police agency or transportation department to complete procedures for receiving the transfer certificate, relocation form, or movement declaration and original vehicle documents, and transferring them fully to the vehicle-motorcycle authority or equipment management agency subordinate to the Ministry of National Defense for transfer to the Vehicle-Motorcycle Department);

d) For motor vehicles and special-purpose motorcycles owned by units already registered at police agencies or transportation departments, points a and b of Clause 2 of this Article do not apply.

Article 15. Documents for registering motor vehicles and special-purpose motorcycles transferred between agencies and units directly under the Ministry of National Defense

1. Decision of the General Staff on the transfer of motor vehicles and special-purpose motorcycles.

2. Application form for registering motor vehicles and special-purpose motorcycles as prescribed in Appendix I attached to this Circular.

3. Handover record of vehicles.

4. Registration certificate, license plate, and vehicle history.

Article 16. Documents for registering motor vehicles and special-purpose motorcycles transferred internally within agencies and units directly under the Ministry of National Defense

1. Decision on the transfer of motor vehicles and special-purpose motorcycles by the head of the agency or unit directly under the Ministry of National Defense.

2. Application form for registering motor vehicles and special-purpose motorcycles as prescribed in Appendix I attached to this Circular.

3. Handover record of vehicles.

4. Vehicle registration certificate.

Article 17. Documents for registering motor vehicles and special-purpose motorcycles that are given, donated, provided as aid, imported non-commercially, or imported as movable property

1. Documents for registering motor vehicles and special-purpose motorcycles that are given or donated include the documents specified in Clause 1 and Clause 3, Article 12 of this Circular and the following documents:

a) Document of giving or donating from the donor.

b) Certificate of origin of motor vehicles and special-purpose motorcycles as stipulated in Article 6 of this Circular.

2. Documents for registering motor vehicles and special-purpose motorcycles provided as aid, imported non-commercially, or imported as movable property include the documents specified in Clause 1 and Clause 3, Article 12 of this Circular and the following documents:

a) Confirmation document of the Ministry of National Defense for aid vehicles.

b) Copy of the sales contract and copy of the financial invoice (if any) for non-commercially imported vehicles or imported as movable property.

c) Certificate of origin of the vehicle as stipulated in Article 6 of this Circular.

Article 18. Documents for registering motor vehicles and special-purpose motorcycles that have been refurbished

1. Decision of the competent authority allowing the refurbishment of motor vehicles and special-purpose motorcycles.

2. Application form for registering motor vehicles and special-purpose motorcycles as prescribed in Appendix I attached to this Circular.

3. Certificate of quality and technical safety of motor vehicles and special-purpose motorcycles after refurbishment.

4. Registration certificate for motor vehicles and special-purpose motorcycles that have already been registered.

5. For motor vehicles and special-purpose motorcycles that have not yet been registered, there must be a decision of the General Staff to equip them militarily and a certificate of origin of motor vehicles and special-purpose motorcycles as stipulated in Article 6 of this Circular.

Article 19. Documents for registering motor vehicles and special-purpose motorcycles that have been replaced with engines of the same type

1. Application form for registering motor vehicles and special-purpose motorcycles as prescribed in Appendix I attached to this Circular.

2. Request document of the head of the technical agency directly under the Ministry of National Defense.

3. Certificate of conformity upon factory release of the vehicle after engine replacement.

4. Handover record of the vehicle upon factory release.

5. Vehicle registration certificate.

6. Certificate of origin of the engine.

a) Engine received from the warehouse of the Motor Vehicle Bureau/Technical Logistics: Warehouse release order.

b) Engine purchased by the unit itself:

Factory release quality inspection report (for domestically produced and assembled engines);

Customs declaration form as prescribed by the Ministry of Finance (for imported engines);

Copy of the purchase contract and settlement contract;

Copy of the financial invoice.

c) Engine repaired at factories or workshops

Technical condition inspection record before repair;

Certificate of conformity upon repair completion.

Article 20. Documents for registering and issuing additional license plates for motor vehicles serving Party and State leaders; military business vehicles that have already been registered with civilian license plates

1. Decision of the General Staff on the registration and issuance of motor vehicle license plates.

2. Application form for motor vehicle registration as specified in Appendix I attached to this Circular.

3. Copy of the Registration Certificate and original file of the motor vehicle according to the procedures for issuing and recalling registration certificates and license plates for road motor vehicles stipulated by the Ministry of Public Security.

Article 21. Documents for introducing registration and issuing civilian license plates for motor vehicles and specialized motorcycles of enterprises and agencies under the Military

1. Motor vehicles of military enterprises

a) For initial registration:

Introduction letter issued by the Vehicle Bureau/TCKT (the agency or unit sends it to the Vehicle Bureau/TCKT, including the following documents: a request for introduction letter from the vehicle agency or equipment management agency of units under the Ministry of National Defense; authorization to purchase vehicles from the competent authority; copy of the origin certificate and purchase-sale file according to regulations);

Origin certificate of the vehicle according to the procedures for issuing and recalling registration certificates and license plates for road motor vehicles stipulated by the Ministry of Public Security and regulations on registering specialized motorcycles of the Ministry of Transport.

The enterprise brings the introduction letter and documents to the registration authority of the Ministry of Public Security or the Ministry of Transport for registration.

b) For vehicles that have already been registered with military license plates:

Decision of the General Staff allowing registration with civilian license plates;

Introduction letter issued by the Vehicle Bureau/TCKT;

Copy of the Registration Certificate and original file of the vehicle as specified in Section 2 Chapter II of this Circular.

The enterprise brings the introduction letter and documents to the registration authority of the Ministry of Public Security or the Ministry of Transport for registration.

2. Motor vehicles of agencies and units that have already been registered with motor vehicle license plates and specialized motorcycle license plates.

a) Request document of the Minister of National Defense and approved by the Minister of Public Security;

b) Introduction letter issued by the Vehicle Bureau/TCKT (the agency or unit submits to the Vehicle Bureau/TCKT: a request for introduction letter from the vehicle agency or equipment management agency of units under the Ministry of National Defense; copy of the request document of the Minister of National Defense sent to the Ministry of Public Security);

c) Copy of the Registration Certificate and original file of the motor vehicle and specialized motorcycle as specified in Section 2 Chapter II of this Circular.

The agency or unit brings the introduction letter and documents to the registration authority of the Ministry of Public Security or the Ministry of Transport for registration.

3. Documents for replacing, reissuing registration certificates and license plates for motor vehicles and specialized motorcycles; transferring ownership and moving are carried out according to the procedures for issuing and recalling registration certificates and license plates for road motor vehicles stipulated by the Ministry of Public Security and regulations on registering specialized motorcycles of the Ministry of Transport.

Article 22. Issuance of temporary license plates for motor vehicles and specialized motorcycles

1. Cases for issuing temporary license plates

a) Vehicles that have been decided by the General Staff to be equipped for military use, but the files are incomplete as specified in Article 13 of this Circular;

b) Vehicles that have been decided by the General Staff to allow units to purchase independently, but the files are incomplete as specified in Article 14 of this Circular;

c) Vehicles given, donated; aid; non-trade imports, imported vehicles as movable assets with incomplete files as specified in Article 17 of this Circular;

d) Imported, manufactured, or assembled domestically during the transfer process;

đ) Survey vehicles, test vehicles; vehicles belonging to projects and programs approved by the Minister of National Defense.

e) Temporary license plates shall be implemented according to the provisions in Appendix I attached to this Circular.

2. Documents for temporary registration of motor vehicles and specialized motorcycles

a) Official letter requesting from the head of the main agency directly under the Ministry of National Defense or the head of the agency assigned by the Ministry of National Defense to purchase motor vehicles and specialized motorcycles.

b) Copy of the file for cases specified in points a, b, and c of Clause 1 of this Article;

c) Transfer plan, test run plan; document from the competent authority proving that the motor vehicle or specialized motorcycle is part of research topics, tests, or projects for cases specified in points d and đ of Clause 1 of this Article.

3. The validity period of temporary license plates is recorded on the plate but does not exceed 90 days from the date of issue.

4. In addition to the provisions in Clause 1 of this Article, the General Staff decides to issue motor vehicle license plates or temporary license plates for special and urgent tasks.

Article 23. Registration Procedure

1. Departments and units under the Ministry of National Defense shall be responsible for preparing registration files for each case of motor vehicles and special-purpose motorcycles as stipulated in Section 2 Chapter II of this Circular, to be sent via the military network (scanned copy) or directly to the Motor Vehicle Department/TCKT.

2. Within ten days from the date of receiving valid files, the Motor Vehicle Department/TCKT shall be responsible for checking the validity of the files, and units shall be responsible for sending original files for cases where files were submitted via the military network to be presented to the Director of the Motor Vehicle Department/TCKT for approval.

In the event that the file is not valid, the Motor Vehicle Department/TCKT shall issue a document requesting the department or unit to supplement the file, with the time taken to supplement the file not being counted towards the processing period.

3. After the Director of the Motor Vehicle Department/TCKT approves the registration file, the Motor Vehicle Department/TCKT shall issue license plates, registration certificates, and vehicle records to departments and units; individuals assigned the task of receiving license plates, registration certificates, and vehicle records must present an introduction letter and sign the handover logbook.

Article 24. Reissue, Replacement, and Revocation of License Plates and Registration Certificates for Motor Vehicles and Special-Purpose Motorcycles

1. Cases of reissuing or replacing registration certificates: The registration certificate is blurred, torn, lost, or has expired.

2. Cases of reissuing or replacing license plates: The license plate is blurred, broken, or lost.

3. Files for reissuing or replacing

a) A request document from the head of the technical department under the Ministry of National Defense (for cases where the registration certificate is lost, it must be inspected and confirmed by the competent authority of the Motor Vehicle Department/TCKT that it has not been seized);

b) A registration form for the vehicle as specified in Appendix I attached to this Circular (not applicable for cases of replacing or reissuing license plates);

c) A detailed report clearly stating the reason for loss by the driver or person responsible for management, with confirmation from the unit commander at the level of regiment or equivalent;

d) The license plate and registration certificate of the vehicle (in cases where they are blurred, torn, broken, damaged, or have expired).

4. Procedure

a) Departments and units under the Ministry of National Defense shall be responsible for preparing files according to the provisions of Clause 3 of this Article, to be sent via the military network or directly to the Motor Vehicle Department/TCKT;

b) Within ten days from the date of receiving complete valid files, the Motor Vehicle Department/TCKT shall be responsible for checking, registering, and presenting to the Director for approval;

In the event that the file is not valid, the Motor Vehicle Department/TCKT shall issue a document requesting the department or unit to supplement the file, with the time taken to supplement the file not being counted towards the processing period.

5. Revocation of license plates and registration certificates in the following cases:

a) Vehicles removed from the inventory or vehicles transferred between departments and units under the Ministry of National Defense;

b) Vehicles that have exceeded their service life or transferred to registration at public security agencies;

c) Lost license plates and registration certificates that cannot be recovered, the head of the technical department under the Ministry of National Defense shall be responsible for reporting and explaining to the Motor Vehicle Department/TCKT for consideration and resolution.

Section 3

MANAGEMENT AND USE OF MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES

Article 25. Management of Motor Vehicles and Special-Purpose Motorcycles

1. The Motor Vehicle Department/TCKT is the advisory body assisting the Chief of the General Technical Department and the Minister of National Defense in directing the implementation of management over the quantity, quality, types, and synchronization of motor vehicles and special-purpose motorcycles carrying military license plates and civilian license plates of departments, units, and enterprises within the Ministry of National Defense.

2. Heads of departments, units, and enterprises within the Ministry of National Defense shall be responsible before the Minister of National Defense:

a) Managing the quantity, quality, and types of motor vehicles and special-purpose motorcycles carrying military license plates and civilian license plates within their managed departments, units, and enterprises;

b) Mobilizing, grouping, and determining the usage status and synchronization of motor vehicles and special-purpose motorcycles within subordinate departments and units.

3. The vehicle-motorcycle department of the unit shall be responsible for organizing measures to maintain technical coefficients and improve the quality of vehicle management for motor vehicles and special-purpose motorcycles according to the decisions of the commanding officer and guidance from the higher-level vehicle-motorcycle department.

Article 26. Use of motor vehicles and special-purpose motorcycles

1. For drivers of motor vehicles:

a) Must have a military driving license appropriate to the type of vehicle as prescribed;

b) In case of driving a vehicle with military license plates serving Party and State leaders, a civilian driving license may be used;

c) Must strictly comply with legal regulations and regulations of the Ministry of National Defense.

2. For drivers of special-purpose motorcycles:

a) If they do not have a driving license for automobiles, they must have a certificate of traffic law knowledge training;

b) A certificate for operating special-purpose motorcycles;

c) Must strictly comply with legal regulations and regulations of the Ministry of National Defense.

3. In cases where vehicles exceed weight limits, size restrictions, or are tracked vehicles; transporting oversized or overweight cargo on roads under normal conditions must be carried out according to the regulations of the Ministry of Transport; in emergency situations, they must follow the regulations of the Ministry of National Defense and take measures to ensure road traffic safety and road construction safety as prescribed by law.

4. In cases where vehicles illegally carry goods and are temporarily detained, the goods and means of transport shall be transferred to competent authorities for handling according to the law. Drivers who violate traffic regulations will be disciplined according to the Regulations on Military Unit Management of the Vietnam People's Army or prosecuted criminally according to the law depending on the severity of the violation.

5. Military inspection forces and military control forces must closely cooperate with relevant agencies, inspecting the activities of motor vehicles and special-purpose motorcycles; civilian-licensed vehicles of military enterprises participating in traffic. When violations are detected, they must be corrected promptly and handled according to military regulations and the law.

6. Commanders at all levels of agencies and units are responsible for the use of motor vehicles and special-purpose motorcycles managed by their agencies and units.

Article 27. Conditions for motor vehicles and special-purpose motorcycles to participate in traffic

1. For motor vehicles, there must be:

a) Registration number plate;

b) Registration certificate;

c) Valid inspection sticker affixed to the windshield;

d) Auxiliary number system;

đ) Work permit for the vehicle;

e) For cargo-carrying vehicles, there must be cargo documents. In special cases, this must be carried out according to the provisions of the law.

2. For special-purpose motorcycles: Follow the provisions set forth in points a, b, d, e of Clause 1 of this Article.

3. When performing driving practice tasks, in addition to the provisions of Clause 1 of this Article, there must be:

a) Driving practice permit;

b) Practice vehicle sign.

4. In cases of test runs or trials, there must be:

a) Repair orders or test run/trial plans approved by authorized bodies;

b) "Test Vehicle" warning signs with a red background and white letters (dimensions 297mm x 210mm) hung at the front and rear of the vehicle.

5. Motor vehicles serving Party and State leaders must have:

a) Registration number plate;

b) Registration certificates as stipulated in Appendix I attached to this Circular;

c) Other documents as prescribed by law.

6. Vehicles with civilian license plates of military enterprises must comply with current laws.

Chapter III

RESPONSIBILITIES OF RELEVANT AGENCIES, UNITS AND ENTERPRISES

Article 28. The General Staff

shall decide to equip military vehicles including motorized vehicles and specialized motorcycles for use within the Ministry of National Defense.

Article 29. The Technical General Department

1. The Director of the Technical General Department assists the Minister of National Defense in managing state affairs related to registration, management, and use of motorized vehicles and specialized motorcycles within the Ministry of National Defense.

2. The Motor Vehicle Department under the Technical General Department

a) Shall be responsible before the Minister of National Defense and the Director of the Technical General Department for directing, guiding, implementing, and organizing the execution of work related to registration, management, and use of motorized vehicles and specialized motorcycles within the Ministry of National Defense;

b) Shall introduce to the vehicle registration agencies of the Ministry of Public Security and the Ministry of Transport to register and issue civilian license plates for vehicles of military enterprises and units;

c) Shall organize vehicle registration, issuance of license plates, and certification of registration according to the provisions of this Circular; guide, direct, inspect, manage, and use vehicles in accordance with the laws and regulations of the Ministry of National Defense;

d) Shall study and propose competent authorities to issue guiding and directing documents; regulations on management and use; systems of business records; statistical and reporting systems ensuring uniformity and standardization within the Ministry of National Defense;

đ) Shall manage and store registration files of motorized vehicles and specialized motorcycles in accordance with the law.

Article 30. Relevant Agencies, Units, and Enterprises

1. Heads of agencies and units shall be responsible before the Minister of National Defense for the registration, management, and use of motorized vehicles and specialized motorcycles in accordance with the law.

2. Central Motor Vehicle Departments under the Ministry of National Defense:

a) Shall assist heads of agencies and units in implementing work related to registration, management, and use of motorized vehicles and specialized motorcycles; civilian-numbered vehicles of military enterprises as prescribed;

b) Shall be responsible for the legality of application files;

c) Shall strictly comply with the guidance, inspection, and direction of the Motor Vehicle Department under the Technical General Department regarding work related to registration, management, and use of motorized vehicles and specialized motorcycles as stipulated by the Ministry of National Defense.

Chapter IV

IMPLEMENTING PROVISIONS

Article 31. Effective Date

This Circular shall take effect from February 8, 2022, and replace Circular No. 102/2016/TT-BQP dated June 29, 2016, issued by the Minister of National Defense on the registration, management, and use of motorized vehicles within the Ministry of National Defense; Circular No. 172/2018/TT-BQP dated December 27, 2018, amending and supplementing certain articles of Circular No. 102/2016/TT-BQP dated June 29, 2016, issued by the Minister of National Defense; and Circular No. 102/2021/TT-BQP dated July 22, 2021, amending and supplementing certain articles of Circular No. 102/2016/TT-BQP dated June 29, 2016, and Circular No. 172/2018/TT-BQP dated December 27, 2018, issued by the Minister of National Defense.

Article 32. Transitional Provisions

1. Military vehicle registration certificates issued before the effective date of this Circular shall continue to be used, renewed, or replaced using Form No. 03b, Form No. 03d, and Form No. 04b of Appendix I attached to this Circular until infrastructure and technical conditions allow printing on PET material, at which point they will be renewed or replaced using Form No. 03a, Form No. 03c, and Form No. 04a of Appendix I attached to this Circular.

2. Registration of motorized vehicles and specialized motorcycles through the military network shall be implemented when infrastructure and technical conditions ensure compliance with the provisions of this Circular.

3. Within twelve months from the effective date of this Circular, central units under the Ministry of National Defense shall establish registration files for specialized motorcycles that have been equipped militarily but not registered in accordance with this Circular, and submit them to the Motor Vehicle Department under the Technical General Department for registration.

Article 33. Responsibility for Implementation

The Chief of General Staff, the Director of the Technical General Department, the Head of the Motor Vehicle Department under the Technical General Department, heads of agencies and units, relevant organizations, and individuals shall be responsible for implementing this Circular./.
