Article 3: The Chairpersons of the People's Committees of provinces and centrally governed cities; Heads of the Office, Directors of the High School Department, Heads of units related to the Ministry of Education and Training are responsible for implementing this Decision.

Secondary School Graduation and High School Graduation Examinations
(Issued together with Decision No. 17/2002/QĐ-BGD&ĐT dated April 5, 2002 of the Minister of Education and Training)

 Chapter I

GENERAL PROVISIONS

Article 1. Scope and objects regulated

These regulations stipulate the organization, management, content of graduation examinations; the organization and activities of examination committees and inspection teams; the delegation of management authority over examinations; and the work of rewarding and disciplining during examinations.

The provisions of these regulations apply to secondary school graduation examinations and high school graduation examinations.

Article 2. Purpose, Requirements, and Basis for Graduation Assessment

The purpose of the secondary school and high school graduation examinations is:

To assess and confirm the level of education acquired by students at the end of a grade level according to the curriculum issued by the Ministry of Education and Training.

To serve as a basis for directing students after graduation; for further study, vocational training, and labor production and social activities.

To provide a basis for evaluating the teaching and learning outcomes of schools at the secondary level; and for assessing the educational management work at each grade level.

The examination must meet the following requirements:

Strictness, safety, fairness, accuracy, and suitability to the students' level.

Basis for graduation assessment and classification:

Classification of conduct and academic performance of students in the final year of grade 9 or grade 12 (hereinafter referred to as the final grade).

Scores of graduation examination subjects

Chapter II

DATE OF EXAMINATION, SUBJECTS, CONTENT OF EXAMINATION

Article 3. Organization of the Examination and Examination Date

One graduation examination for secondary school and one graduation examination for high school are organized each year.

The examination date is specified in the annual school calendar by the Ministry of Education and Training.

In special cases, the Minister of Education and Training may decide to organize two secondary school graduation examinations in one school year and delegate the People's Committee of provinces and centrally governed cities (hereinafter collectively referred to as provincial level) to specify the examination date for the second examination.

Article 4. Subjects

The subjects for secondary school and high school graduation examinations are announced by the Ministry of Education and Training no later than March 31 each year.

The examination format, schedule, and time limit for each subject are specified in the examination guidelines issued annually by the Ministry of Education and Training.

Article 5. Examination Program and Content

Students who study according to a program will take the examination according to that program; the examination content is the entire final grade program.

Students belonging to the category defined in Clause 2, Article 6 of this Regulation must also take all subjects, examination content, and examination form as prescribed for the year of organizing the examination.

Chapter III

ELIGIBILITY FOR EXAMINATION AND EXAMINATION DOCUMENTS

Article 6. Examination Candidates

Students who have completed the final grade program at various types of junior high schools and high schools in the year of organizing the examination.

Students who have completed the program of a level in previous years but did not meet the conditions for taking the examination or took the examination but did not graduate, and other special cases permitted by the Ministry of Education and Training to take the examination (hereinafter referred to collectively as self-study candidates).

Article 7. Eligibility for Examination

Students as specified in Clause 1, Article 6 of this Regulation shall be recognized as meeting the eligibility requirements for examination if:

They are students of the specified grades in junior high school or high school (continuous or non-continuous study); they are evaluated and classified in terms of conduct and academic performance in each class; they are promoted according to current regulations.

Evaluation and classification in the final grade;

b.1) Conduct classified as average or higher.

b.2) Not classified as poor in academic performance.

b.3) Not absent from school more than 45 sessions (absences counted cumulatively whether in one instance or multiple instances).

Not during the period of temporary detention, arrest, or deprivation of civil rights.

Students specified in Clause 2, Article 6 of this Regulation shall be recognized as meeting the eligibility requirements for examination if:

Not during the period of temporary detention, arrest, or deprivation of civil rights; not during the period of disciplinary action prohibiting examination.

They are confirmed by the commune or ward (collectively referred to as commune level) where they reside and recommended to take the examination if they strictly comply with state policies and laws and local security regulations; participate in social activities organized by the locality; have good lifestyle and morality.

Specifically, students who do not meet the eligibility requirements for examination due to being classified as poor in academic performance in the final grade must register and take the end-of-year examination at their final grade school in some subjects with an average score below 5.0 so that the examination score replaces the subject's average score to recalculate the annual average score and meet the academic performance requirements as stipulated.

Age limit for examination (for students currently studying and self-study candidates): not exceeding 21 years old for the junior high school graduation examination, not exceeding 24 years old for the high school graduation examination.

At least ten days before the examination date, the School Principal must publicly announce those students who do not meet the eligibility requirements for examination as specified in Clauses 1, 2, and 3 of this Article.

Article 8. Examination Documents

For the category specified in Clause 1, Article 6 of this Regulation:

Academic record (original):

a.1) Junior high school academic record (for the junior high school examination)

a.2) High school academic record (for the high school examination)

A certified copy of the birth certificate

Graduation certificate (original):

c.1) Elementary school graduation certificate (for the junior high school graduation examination).

c.2) Junior high school graduation certificate or supplementary junior high school graduation certificate (for the high school graduation examination).

Application for examination with a 4cm x 6cm photograph affixed and stamped over the photograph issued by the school.

(d) Certificates to qualify for preferential treatment (if applicable) include:

đ.1) Certificate for children of martyrs, wounded veterans, disabled veterans, and those entitled to benefits equivalent to wounded veterans issued by the Veterans Affairs Office at the district level.

đ.2) A certified copy of the household registration book indicating residence in mountainous, remote areas, new economic zones, or particularly difficult communes confirmed by the People's Committee of the commune or notarized by a state agency.

(e) Certificates to qualify for bonus points (if applicable) include:

e.1) General vocational training certificate.

e.2) Certificate for winning awards in examinations organized by the education sector or jointly with relevant sectors at provincial level or above, including: outstanding student competitions in cultural subjects, experimental and practical examinations (Physics, Chemistry, Biology), arts, sports, drawing, international letter writing, and Casio calculator competitions.

Certificates for preferential treatment and bonus points must be submitted before the examination date to be valid.

For the category specified in Clause 2, Article 6 of this Regulation, in addition to the documents specified in Points a, b, c, d, đ of Clause 1, Article 8 of this Regulation, the following additional documents are required:

Application for graduation examination (junior high school or high school)

Certificate from the People's Committee of the commune where the candidate resides, as specified in Point b, Clause 2, Article 7 of this Regulation, confirming that the candidate is not under temporary detention, arrest, or deprivation of civil rights.

Certificate from the school where the candidate studied the final grade regarding academic classification (for students classified as poor in academic performance) as specified in Point c, Clause 2, Article 7, and confirming that the candidate is not under disciplinary action prohibiting examination.

Chapter IV

GRADUATION

Article 9. Bonus point levels

Students participating in the following contests and activities will be awarded bonus points when graduating with the following point levels:

Winning individual awards in the final grade cultural subject competition:

a.1) Winning national-level awards or first-place provincial awards: 2 points added

a.2) Second-place provincial award: 1.5 points added

a.3) Third-place provincial award: 1 point added

Winning individual and team awards in arts, sports, drawing, international letter writing, Casio calculator, and experimental/practical subject (Physics, Chemistry, Biology) competitions organized by the education sector in collaboration with relevant sectors at provincial level or above:

b.1) Individual awards:

National-level awards or first-place provincial awards (Gold Medal): 2.0 points added,

Second-place provincial awards (Silver Medal): 1.5 points added

Third-place provincial awards (Bronze Medal): 1.0 points added

b.2) Team awards (soccer, volleyball, six-person volleyball, table tennis, badminton, shuttlecock, track and field, choir, duet) are as follows:

Only national-level awards are eligible for bonus points.

The number of players, athletes, performers on the team ranges from 2 to 22, as specifically defined by the Organizing Committee of each event.

The bonus points for individuals in team awards are calculated similarly to individual awards as specified in Point b.1, Subpoint b, Clause 1, Article 9 of this Regulation.

b.3) Students who win different awards in various competitions at one educational level shall only be entitled to one bonus point level based on the highest award they have received.

Students who obtain a vocational certificate in a test organized by the Department of Education and Training shall be granted bonus points according to the classification recorded in the certificate as follows:

Excellent: 2 points; Good: 1.5 points; Average: 1 point.

If students simultaneously possess multiple certificates entitling them to bonus points as stipulated in Points a, b, and c of Clause 1, Article 9 of this Regulation, they shall only be entitled to the highest bonus point level which is:

For junior high school: 3 points

For senior high school: 4 points

The bonus points provided for in Points a, b, and c of Clause 1, Article 9 of this Regulation shall be maintained throughout the entire educational level. Independent candidates shall not be entitled to bonus points.

Article 10. Examination scores, graduation examination scores, and graduation classification scores

Examination scores:

Grading will be done on a scale of 10 and rounded off to 0.5 as prescribed:

From 0.25 to below 0.75 will be rounded off to 0.5

From 0.75 to below 1.0 will be rounded off to 1.0

Graduation examination scores and graduation classification scores shall be taken to two decimal places without rounding.

Article 11. Recognition of Graduation

Students meeting the examination conditions, not subject to disciplinary action from having their papers canceled upwards, with no paper receiving a zero score, and having the graduation examination scores specified below for each category shall be recognized as having graduated:

Category 1: 5.0 points or higher for ordinary students

Category 2: 4.75 points or higher for students belonging to one of the following categories:

Children of war invalids or veterans with disabilities under 81%, children of those entitled to benefits similar to war invalids or veterans with disabilities under 81%; children of heroes of the armed forces or labor heroes.

Having a parent who is an ethnic minority, residing and studying in economically, culturally, and socially developed areas.

Han students with permanent residence registration and having studied for three years or more in mountainous, remote, island, new economic zone, or particularly difficult commune areas.

Category 3: 4.5 points or higher for students belonging to one of the following categories:

Having a parent who is an ethnic minority, residing and studying in mountainous, remote, island, new economic zone, or particularly difficult commune areas, or currently studying at boarding schools for ethnic minorities at the district level or above.

Children of martyrs, war invalids with disabilities of 81% or higher, children of those entitled to benefits similar to war invalids or veterans with disabilities of 81% or higher.

Students meeting multiple preferential criteria shall only benefit from the highest criterion.

Article 12. Classification of Graduation

Graduated students shall be classified into three categories: excellent, good, and average, based on the following criteria:

Excellent:

Annual classification for the final grade: conduct rating excellent, academic performance rating excellent.

Graduation classification score (GCS) of 8.0 points or higher

No examination score below 7.0

Good:

Annual classification for the final grade in both conduct and academic performance must be good or higher.

Average score of 6.5 points or higher. Graduation classification score (GCS)

No examination score below 6.0

Average: remaining cases of graduation

The graduation classification criteria above apply to all candidates specified in Article 9 of this Regulation.

Article 13. Exemption from Graduation Examination

Recipients:

Grade 12 students summoned by the Ministry of Education and Training to participate in recruitment or international competition training in certain subjects.

Final-grade students selected by a central agency to participate in international sports, cultural, and artistic competitions.

Conditions:

In addition to the number of days off stipulated in Section b.3 Point b Clause 1 Article 7 of this Regulation, the following conditions also apply:

Being summoned at the end of the second semester of the final grade class.

Year-end classification in the final grade class: conduct rating good, academic performance from satisfactory or higher (for the subjects specified in Point a Clause 1 Article 13) or average or higher (for the subjects specified in Point b Clause 1 Article 13).

Being listed on the exemption examination list according to the circular of the Ministry of Education and Training or having a circular requesting exemption from examination and confirmation of participation in training and competition in accordance with regulations of the selection agency sent to the Department of Education and Training before the graduation exam date.

Students exempted from examination are recognized as graduates and classified for graduation according to the following criteria:

Excellent:

The final grade class year being rated with excellent academic performance, good conduct, and equivalent to a graduation classification of excellent with a graduation classification score of 9.0 points.

Satisfactory;

The final grade class year being rated with both academic performance and conduct from satisfactory or higher, and equivalent to a graduation classification of satisfactory with a graduation classification score of 7.0 points.

Average: All remaining cases.

Students exempted from examination who wish to have a higher graduation classification to enjoy incentives in vocational high school, college, and university entrance examinations according to the regulations of the Ministry of Education and Training must take the graduation examination.

Article 14. Special graduation

Students belonging to the categories specified in Clauses 1 and 2 Article 6 of this Regulation, if meeting the examination conditions, may be considered for special graduation in the following cases:

Falling ill or having a sudden special event before the examination day (including the case of not taking the first examination session) and unable to take the examination and not more than 10 days prior to the examination organization date.

Conditions:

Annual classification in the final grade class in terms of academic performance and conduct are both satisfactory or higher.

Documents:

b.1) Hospital admission and discharge records issued by hospitals at district level or higher (if sick) or confirmation from the People's Committee of the residential commune (if having a sudden special event).

b.2) School's proposal record for special graduation consideration where the student registered to take the examination.

Falling ill or having a sudden special event after taking at least one subject and unable to continue taking the examination or after falling ill or having a sudden special event voluntarily taking the remaining subjects.

Conditions:

a.1) Scores of all taken subjects are at least 5.0 points.

a.2) Final grade class classification: academic performance from average or higher, conduct from satisfactory or higher.

Documents:

b.1) Confirmation record of the Examination Board.

b.2) Hospital admission and discharge records from hospitals at district level or higher (if sick) or confirmation from the People's Committee of the residential commune (if having a sudden special event).

Students graduating through special graduation are all classified as average.

Article 15: Re-examination:

1. The object eligible for re-examination is the subject specified in Clauses 1 and 2 Article 6 of this Regulation.

2. Conditions: The test score is lower than the annual average score of that subject by two points or more.

3. The re-examination score of the test will be recognized if it is higher than the initial marking score by one point or more and replaces the initial marking score for calculating the graduation examination score or the graduation classification score.

4. Procedures:

a) Students must submit a re-examination application form for the test score according to the prescribed model of the Ministry of Education and Training to the school where they registered for the graduation examination.

b) Based on the re-examination conditions for the test score, the school reviews and compiles a list of re-examination requests (indicating clearly the test score and the annual average score of the subject for re-examination) and sends it to the District Education and Training Office (for junior high school) or the Department of Education and Training (for senior high school).

c) The District Education and Training Office, the Department of Education and Training is responsible for receiving and transferring the entire list and re-examination application forms to the Re-examination Board.

5. Time frame:

a) Application receipt: Five days after the temporary graduation list announcement.

b) The re-examination process must be completed within 15 days from the date of application receipt.

6. Re-examination of test scores can only be conducted once per annual graduation examination period.

Chapter V

TESTS AND GRADING BOARDS FOR GRADUATION EXAMINATIONS

Article 16: Test.

1. Graduation examination tests for junior high school and senior high school must meet the following requirements:

a) Assessing basic knowledge, ability to apply knowledge, and practical understanding of students according to the final grade curriculum and textbooks issued by the Ministry of Education and Training.

b) The content of the test must ensure scientific accuracy, rigor, and standardization. The wording and sentences in the test must be clear, coherent, and free of errors.

c) Distinguishing the level of students.

d) Suitable for the time allocated for each subject.

2. In one examination period, each subject has an official test and a backup test with similar requirements and content. Each test includes marking guidelines and grading scales.

3. Tests and marking guidelines are classified as confidential materials under Clause 3 Article 2 of Decision No. 81/TTg dated March 2, 1994, of the Prime Minister.

Article 17: Members of the Examination Question Setting Council.

1. Each province shall establish one Examination Question Setting Council for junior high school graduation. Nationwide, one Examination Question Setting Council for senior high school graduation shall be established.

2. Composition of the Examination Question Setting Council for junior high school graduation.

a) Chairperson: Director or Deputy Director of the Department of Education and Training. In special cases, this may be replaced by the Head of the Secondary Education Division or the Head of the Testing Division (if available).

b) Vice-Chairpersons: Heads or Deputy Heads of the Secondary Education Division and the Testing Division (if available).

c) Secretary and members appointed by the Director of the Department of Education and Training, selected from specialists in the Secondary Education Division, the Testing Division (if available), departments under the Department, excellent teachers currently teaching subjects at junior high schools.

d) For each subject, there must be at least two people jointly setting examination questions.

3. Composition of the Examination Question Setting Council for senior high school graduation.

a) Chairperson: Deputy Minister of Education and Training.

b) Vice-Chairpersons: Directors, Deputy Directors of the Secondary Education Division, and leaders designated by units under the Ministry of Education and Training.

c) Secretary and members of the Council appointed by the Minister of Education and Training, selected from specialists in units under the Ministry, lecturers from universities, researchers from educational research institutes, editors from educational publishers, excellent specialists from secondary education divisions under provincial Departments of Education and Training, and excellent teachers currently teaching at senior high schools.

d) For each subject, there must be at least two people jointly setting examination questions.

Article 18: Duties and powers of the Examination Question Setting Council.

1. Tasks of the Council:

a) Organize the drafting of examination questions, marking guidelines, and grading scales.

b) Organize the distribution of examination questions, marking guidelines, and grading scales.

c) Resolve issues related to the printing of examination questions, their content, and marking guidelines during the examination period.

2. Duties of the drafters of examination questions:

a) Draft examination questions, marking guidelines, and grading scales for the official and backup examinations, submit them for approval by the Chairperson of the Examination Question Setting Council.

b) Print the approved examination questions, marking guidelines, and grading scales for their respective subjects; package, seal, and deliver the examination questions, marking guidelines, and grading scales; bear personal responsibility for the requirements of the examination question content as stipulated in Point b, Clause 1, Article 16.

c) Duties of other members: As assigned by the leadership of the Council.

3. Authorities:

a) Select and decide on the official and backup examination questions, marking guidelines, and grading scales for each subject.

b) Assign specific tasks to members; implement rewards and propose rewards for outstanding leaders and members; impose disciplinary actions and propose disciplinary actions for those who violate regulations or fail to complete their tasks.

c) Manage funds and implement financial regulations currently in effect.

d) The Chairperson of the Council is responsible for managing and organizing the implementation of the assigned tasks of the Council and its members.

Chapter VI

THE PRINTING COUNCIL FOR SENIOR HIGH SCHOOL GRADUATION EXAMINATION QUESTIONS

Article 19: Composition.

Each province or city shall establish one or two (if necessary) Printing Councils for senior high schools, operating under strict isolation principles and ensuring confidentiality throughout the examination period.

Composition of the Printing Council for Examination Questions:

1. Chairperson: Director or Deputy Director of the Department of Education and Training. In special cases, this may be replaced by the Head of the Secondary Education Division or the Head of the Testing Division (if available).

2. Vice-Chairpersons: Heads or Deputy Heads of the Secondary Education Division and the Testing Division (if available).

3. Secretary and members appointed by the Director of the Department of Education and Training, selected from specialists in the Secondary Education Division, the Testing Division (if available), and relevant departments under the Department.

Article 20: Tasks.

1. Duties of the Director of the Department:

a) Be fully responsible for receiving sealed examination questions, organizing their delivery to examination councils; ensure the safety and confidentiality of the examination questions during transportation.

b) Specify the deadline for printing examination questions and marking guidelines.

2. Responsibilities of the Board:

a) Receive and store examination questions and marking guidelines.

b) Print sample examination questions before mass printing and send them to the examination rooms; request technical clarifications about the printing process and examination question content during printing according to the specific guidance of the Ministry.

c) Print examination questions for each subject according to the quantity specified by the Chairperson.

d) Package, seal, and deliver the examination questions to the designated dispatching department as prescribed by the Chairperson.

Article 21: Powers.

a) Organize the implementation of the Council's duties, assign specific tasks to Vice-Chairpersons and members.

b) Implement rewards and disciplinary actions for Council members according to the Regulations. Manage funds and implement expenditures according to current financial regulations.

c) The Chairperson of the Council is responsible for managing and organizing the implementation of assigned tasks within the Council.

Chapter VII

THE EXAMINATION COUNCIL FOR GRADUATION EXAMINATIONS

Article 22: General Provisions.

1. The Graduation Examination Board shall be established to carry out all preparatory work and organize the graduation examination at a location selected by the Department of Education and Training (for secondary schools) or the District Education and Training Office (for junior high schools).

2. The number of leaders (Chairman and Vice Chairmen), secretaries, and supervisors of the board shall be determined by the competent authority establishing the board according to the number of candidates taking the exam. At each examination board, there must be a minimum of 20% reserve supervisors compared to the total number of supervisors specified for each examination room.

3. Within each Board, the Chairman and all supervisors must be mobilized from schools without students participating in the examination at that board. At most, only half of the Vice Chairmen and Secretaries can be from the local school.

4. All members of the Examination Board and those serving on the Examination Board shall not have children, siblings, brothers-in-law, sisters-in-law, wards, or foster children participating in the examination.

5. Each examination room shall have no more than 25 candidates; there shall be two supervisors responsible for monitoring inside the examination room; outside supervisors shall be assigned by the Chairman of the Examination Board based on specific conditions of the examination venue, but there must be at least one supervisor for every two examination rooms.

6. Inter-school Examination Boards may be established depending on the specific conditions of each locality and examination period.

Article 23: Composition of the Examination Board.

1. Chairman and Vice Chairmen: Principals or Deputy Principals (if insufficient, the Educational Council Secretary may be appointed) of junior high schools (for junior high examinations) or secondary schools (for secondary examinations).

2. Secretary: Principals, Deputy Principals, Educational Council Secretaries, or Heads of specialized departments of junior high schools (for junior high examinations) or secondary schools (for secondary examinations).

3. Supervisors: Teachers currently teaching at junior high schools and secondary schools within the locality.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country.": Duties and Authorities.

1. Duties:

a) Examine and verify all application files and related examination files, consider the eligibility of candidates, and confirm their status at least one day before the examination date.

b) Inspect all physical facilities, necessary procedures, security conditions, and quality to ensure the examination proceeds safely and strictly.

c) Receive and securely store examination papers until the start time of each subject, organize the examination, and implement tasks to ensure its smooth conduct.

d) Collect examination papers, secure them; prepare records and files as prescribed; hand over all examination papers, records, and files to the District Education and Training Office (for junior high examinations) or the Department of Education and Training (for secondary examinations).

đ) Monitor and urge the implementation of the Examination Regulations by board members and candidates.

2. Authorities:

a) Refuse to accept the examination venue if it does not meet the material conditions and safety requirements for the examination, and report to the County Steering Committee and Inspection Team (for junior high schools) or the Provincial Steering Committee and Inspection Team (for secondary schools) for resolution.

b) Refuse to accept examination papers if signs of confidentiality breaches or difficulty in ensuring paper security are detected, and report to the higher-level Examination Inspection Steering Committee for instructions on handling.

c) Implement disciplinary measures ranging from reprimand to preparing a record recommending invalidation of the candidate's examination papers, disqualification from continuing the examination, or recommending a ban from examination for one to two years based on the severity of the violation of the Examination Regulations.

d) Implement disciplinary measures ranging from reprimand to suspension of duties for supervisors and other staff involved in the examination based on the severity of the violation of the Examination Regulations.

đ) Propose commendations to the competent authorities for staff and teachers participating in the examination and candidates based on their achievements and contributions during the examination.

e) Manage financial resources and organize the examination according to current financial regulations.

g) The Chairman of the Board is responsible for managing and organizing the implementation of assigned tasks within the board.

Chapter VIII

GRADING BOARD FOR GRADUATION EXAMINATION

Article 25: General Provisions

1. Each provincial level may establish one or two Examination Boards for junior high school and high school graduation examinations depending on the number of candidates, management conditions, and material facilities.

2. The Examination Board shall have an independent sealing section responsible for assisting the Chairman in sealing, unsealing examination papers, transferring unsealed papers to marking teams, and other specific tasks assigned by the Chairman.

3. Each Examination Board may have a computer section with the following specific duties:

a) Encoding the seals of examination papers.

b) Entering scores after each day of marking for each subject.

c) Entering scores of subjects in the name and score recording sheet, making copies to be sent to marking teams for verification.

d) Compiling lists of graduates and ranking them.

đ) Preparing tables, charts, minutes, and reports as prescribed by the Chairman and as required by higher authorities.

4. The number of leaders, secretaries, examiners, sealing sections, computer sections, and service staff of each Examination Board shall be determined by the competent authority establishing the board based on requirements, tasks, and the specific number of examination papers.

5. All members and those serving in the Examination Board must not have children, siblings, spouses, or wards who are participating in the examination.

Article 26: Composition of the Examination Board.

1. Examination Board for junior high school graduation:

a) Chairman:

a.1) If the provincial level establishes one board: Director or Deputy Director of the High School Department, or the Testing Department (if any).

a.2) If each district establishes one board: Director or Deputy Director of the Education and Training Department.

b) Vice Chairmen shall be selected from leaders and specialists of the High School Department, Testing Department (if any), Principals, and Deputy Principals of junior high schools. Each vice chairman shall be responsible for one subject or a group of related subjects.

c) Secretary shall be selected from specialists of the High School Department, Testing Department (if any), specialists of the Education and Training Department, Principals, and Deputy Principals of junior high schools.

d) Examiners: Teachers from districts, counties, towns, cities under the province (hereinafter referred to as county level), currently teaching final-year subjects.

đ) If the results of the junior high school graduation examination are used as a basis for admission to grade 10 of high school, some teachers from high schools who teach the same subjects can be mobilized to join the Examination Board.

2. Examination Board for high school graduation:

a) Chairman: Deputy Director of the Department of Education and Training, in special cases, the Director or Deputy Director of the High School Department or Testing Department (if any) may replace the Director.

b) Vice Chairmen: Directors or Deputy Directors of the High School Department, Directors or Deputy Directors of the Testing Department (if any), Principals or Deputy Principals of high schools. Each vice chairman shall be responsible for one subject or a group of related subjects.

c) Secretary: Specialists of the High School Department, Testing Department (if any), Principals, and Deputy Principals of high schools.

d) Examiners: Teachers from high schools under the jurisdiction of the Department, currently teaching final-year subjects.

3. The number of leaders, secretaries, examiners, sealing sections, computer sections, and service staff of each Examination Board shall be determined by the competent authority establishing the board based on requirements, tasks, and the specific number of examination papers.

4. All members and those serving in the Examination Board must not have children, siblings, spouses, or wards who are participating in the examination.

Article 27: Duties and Authorities of the Examination Board.

1. Duties of the Examination Board:

a) Receiving examination papers and examination files transferred by the Department of Education and Training (for high school examinations) or the Education and Training Department (for junior high school examinations).

b) Organizing the sealing process.

c) Organizing the marking of unsealed examination papers.

d) Organizing the unsealing process, scoring.

đ) Organizing the graduation assessment and ranking, compiling graduation lists.

e) Implementing quick reports and comprehensive marking result reports.

g) Summarizing the marking process and graduation assessment; completing minutes, statistics, reports, and examination files; handing over all examination papers and examination files to the Education and Training Department (for junior high school examinations) or the Department of Education and Training (for high school examinations).

2. Duties of the marking teams:

c) Check and review daily marking scores and scores of examination papers sent by the computerized department according to the Chairman of the Examination Marking Board's instructions.

b) Organizing joint marking of at least ten examination papers before individual marking and joint marking of special cases decided by the Chairman of the Examination Board.

c) Organizing marking according to the principle that two examiners independently mark one paper and as stipulated in Clause 1 of Article 10 of this Regulation.

d) Checking and reviewing daily marking scores and scores in the score recording sheet sent by the computer section as prescribed by the Chairman of the Examination Board.

đ) Preparing disciplinary recommendation minutes (if any) and reports on the marking results of the marking team.

3. Authorities of the Examination Board:

a) Reviewing and deciding to invalidate examination papers based on minutes of the Examination Supervision Board or through the discovery of violations of the Regulations by students during the marking process as recorded by the marking team.

b) Disciplining members of the board who violate the Regulations according to the severity of the violation and current regulations. Immediate suspension of the duty of a member who seriously violates the Regulations during marking can be proposed to the competent authority for consideration and decision.

c) Managing finances and implementing rewards or recommending rewards for those who excellently complete their tasks based on achievements.

d) The Chairman of the Board is responsible for managing and organizing the implementation of assigned tasks within the board.

Chapter IX

APPEALS BOARD

Article 28: General Provisions.

1. If there are appeals regarding examination scores, each provincial level shall establish an Appeals Board to review and resolve appeals regarding examination scores for both junior high school and high school examinations.

2. In necessary cases, the Ministry of Education and Training will establish a National Appeals Board:

a) The composition and number of members of the National Appeals Board shall be prescribed by the Minister of Education and Training.

b) The National Review Board has the duty to re-examine the papers and decide on the examination of the re-examined papers. The score of the paper is the re-examination score of the National Board.

3. Other complaints about the examination (other than the score of the paper and the examination file) shall be resolved by the Education Inspectorate.

Article 29: Composition of the provincial review board.

1. Chairman of the board: Director or Deputy Director of the Department of Education and Training.

2. Vice chairmen of the board:

- Head or Deputy Head of the Secondary General Education Division or Examination Division (if any).

- Chief or Deputy Chief of the Education Inspectorate of the Department.

3. Secretary: Specialist of the Secondary General Education Division, Examination Division (if any), Inspectorate of the Department of Education and Training.

4. Examiners: Specialists with competence of the Secondary General Education Division, Examination Division (if any), experienced teachers from secondary schools (for lower secondary schools), general secondary schools (for general secondary schools) who have taught or are currently teaching subjects in the final grade. Each subject must have at least one pair of re-examiners.

5. Those whose children, brothers, sisters-in-law, brothers-in-law, wards, or foster children have requested a re-examination of their papers by the Examination Board shall not participate in the Review Board.

Article 30.: Tasks and Powers

1. Duties:

a) Examine the complaints and files transferred by the Department of Education and Training, the District Education and Training Office.

b) Retrieve the papers, create new seals, organize the re-examination of the papers according to the marking guidelines and scoring criteria stipulated for two examiners to mark independently on one paper.

c) Conclude the new score of the paper.

d) Prepare minutes, lists of students graduating or changing graduation classification due to score changes, dialogue minutes between the initial marking pairs (if any) into the re-examination file to submit to the Department of Education and Training.

4. In cases where the new score of the paper differs from the initial score by two points or more, the Review Board must organize a dialogue between the initial marking pair and the re-examination marking pair. If there is no agreement between the two pairs of markers regarding the score and no conclusion can be made about which pair is at fault, the initial score shall remain unchanged.

5. Papers (and accompanying seals) that have had their scores changed must be sealed and stored separately.

6. Lists and results of re-examinations shall be publicly announced and posted at each secondary school after being approved by the Department of Education and Training (for lower secondary schools) or the Ministry of Education and Training (for general secondary schools).

7. The Chairman of the board is responsible for managing and organizing the work of the board.

Chapter X

APPROVE GRADUATION RESULTS, ISSUE GRADUATION CERTIFICATES, AND STORE FILES

Article 31: Approve graduation results.

1. Preliminary approval of graduation:

a) For lower secondary schools: District Education and Training Office

b) For general secondary schools: Department of Education and Training

c) After obtaining preliminary approval results, lower secondary schools and general secondary schools are permitted to publish temporary graduation lists for students. Temporary graduation certificates are signed by the Principals of lower secondary schools and general secondary schools and are valid until the official certificates are issued.

2. Official approval:

a) For lower secondary schools: Department of Education and Training

b) For general secondary schools: Ministry of Education and Training

c) The time for official examination approval follows the specific schedule of the Ministry of Education and Training and the Department of Education and Training.

Article 32: Issue Graduation Certificates.

1. The issuance of graduation certificates is carried out in accordance with regulations and guidance issued by the Ministry of Education and Training.

2. The Director of the Department of Education and Training is responsible for managing and directing the issuance of lower secondary school graduation certificates, general secondary school graduation certificates, copies of graduation certificates, and related certificates concerning bonus point addition and priority placement in the graduation examination as stipulated and guided by the Ministry of Education and Training.

Article 33: Documents and Record Keeping.

1. The graduation examination documents for junior high school and high school include:

a) Name and Score Sheet

b) List of students recognized as graduates

c) List and documents of students who are granted special graduation, exempted from examination, allowed to graduate, or have their graduation classification adjusted after re-examination or resolution of complaints regarding examination documents.

2. Graduation examination documents shall be kept long-term at District Education and Training Departments, Provincial Education and Training Departments, and the Ministry of Education and Training according to regulations on分级管理。

3. Student documents will be returned after the temporary list of graduates is announced.

4. Regulations on other types of documents shall be guided annually by the Ministry of Education and Training.

Article 34. Principles and Procedures of the Examination Board.

1. The Chairperson, Vice-Chairpersons, and the marking team must be present at the examination marking location beforehand to perform tasks reserved for the Board's leadership and marking. Specific times shall be determined by the Director of the Provincial Education and Training Department based on the number of examination papers that the Board needs to mark.

2. The marking team must be arranged in a separate workspace isolated from the examination marking locations.

The marking team shall only hand over marked examination papers to the Chairperson of the Examination Board or a Vice-Chairperson authorized by the Chairperson.

During the examination marking process, no one except the leaders of the provincial education and training departments, the chairperson of the examination board, members of the examination steering committee, and higher-level examination inspection teams may enter the marking team's workspace.

3. The group leader must control and implement the examination marking guidelines accurately. If there are unresolved questions or errors in the text within the group, the leader must request guidance from the examination steering committee and inspection team, and absolutely must not change the marking guidelines or scoring criteria independently.

4. Before distributing papers to examiners, the group must jointly mark ten papers to ensure all group members thoroughly understand the marking guidelines. When scoring these joint-marked papers, "jointly marked" must be clearly noted along with signatures from the group leader and an examiner.

5. Except for the jointly marked papers, each examination paper must be independently marked by two examiners, recording scores separately according to the marking code. After both examiners have completed marking, the group leader shall instruct them to unify the scores on the examination paper and the score sheet, using both letters and numbers, and sign together. Scores should be recorded in red ink. If the examiners wish to change the score, they must cross out the original score, write the new score in both letters and numbers, and sign to confirm the score adjustment.

6. The total score of an examination paper is the sum of the scores of each section. The minimum score for each section is 0.25. The overall score is an integer or decimal number ranging from 0 to 10, with the decimal part being either 0 or 5.

7. Apart from the Re-examination Board, no one has the authority to modify the scores of examination papers that have been agreed upon by two examiners.

8. It is strictly prohibited for the Examination Board to re-mark and alter scores of papers that have already been marked.

9. Recording scores on the name and score sheet in each examination room must be done by a marking team consisting of one reader, one recorder, and one checker. If there are mistakes, the scorer must cross out the incorrect score, write the correct score next to it, and note the reason for the correction in the remarks section. At the end of each score sheet, the names of the reader, recorder, and checker, as well as the total number of score modifications, must be clearly stated, and all three must sign.

In cases where the name and score sheets are created through computer systems, there must still be one reader, one floppy disk inserter, and one checker. At the end of the name and score sheet, the names of all three individuals must be clearly stated, and all three must sign.

Chapter XII

APPEALS BOARD

Article 35. Re-examination of Examination Papers.

1. Candidates have the right to request a re-examination of their examination papers if their scores are more than two points lower than the average score of their class in the final grade.

2. Applications for re-examination must be submitted to the Provincial Education and Training Department within ten days from the date of public announcement of the examination results.

3. A Re-examination Board shall be established when any of the following conditions occur:

a) There is an application for re-examination as stipulated in Clause 2 of this Article.

b) The Director of the Provincial Education and Training Department finds evidence of improper marking contrary to the Examination Board's marking guidelines and examination questions.

c) The Ministry's Examination Steering Committee and Inspection Team requests it.

Article 36. Re-examination Board.

1. The Re-examination Board is an organization established to reassess the results of re-examined papers as provided in Clause 3 of Article 35.

2. Composition of the Re-examination Board:

a) The Chairperson of the Board is the Director or Deputy Director of the Provincial Education and Training Department.

b) The Vice-Chairperson of the Board is the Head of the Continuous Education Division or the Professional Division of the Provincial Education and Training Department.

c) The Secretary of the Board is a specialist responsible for supplementary education examination work at the Provincial Education and Training Department.

d) Examiners are teachers who are proficient in their subject areas and consistently demonstrate fairness and accuracy during the marking process.

Individuals accused of violating the Examination Regulations shall not participate in the Re-examination Board.

Article 37. Duties, Powers, Principles, and Procedures of the Board.

The duties, powers, principles, and procedures of the Re-examination Board shall be the same as those prescribed for the Examination Board.

The Chairperson of the Board is responsible for reissuing marking codes to maintain the confidentiality of candidates' names.

The Re-examination Board may adjust scores only if the re-marked score differs from the previous score by one point or more.

Article 38. Time Limit for Re-examination.

Re-examination must be conducted before the fifteenth day from the date of the examination result announcement and must be completed within ten days. The re-examination results must be publicly announced after approval by the Ministry of Education and Training.

Chapter XIII

REVIEW AND RECOGNITION OF EXAMINATION RESULTS.

Article 39. Review and Recognition of Examination Results.

The Director of the Provincial Education and Training Department is responsible for reviewing and recognizing the examination results of the Supplementary Junior High School Graduation Examination Board. Preliminary review of the Supplementary High School Graduation Examination Board's results.

The results of the Supplementary High School Graduation Examination shall be officially announced after approval by the Ministry of Education and Training.

Examination results shall be publicly posted at the District or County Education and Training Departments, Continuous Education Centers, or Supplementary Cultural Education Schools.

Article 40. Responsibilities and authorities of the Director of the Department of Education and Training in preliminary review and recognition of examination results.

1. Responsibilities:

- Verify the list of graduates proposed by the Examination Board.

- Sign to recognize the list of graduates, sign the Graduation Certificates for candidates after approval by the Ministry.

2. Authorities:

- Cancel the results of the Secondary Vocational School Graduation Examination.

- Cancel the examination results of candidates, examination rooms in the Secondary Vocational High School Graduation Examination.

- Propose the Ministry of Education and Training to cancel the examination results of a Graduation Examination Board for Secondary Vocational High School.

Article 41. Examination files.

Examination report files sent by the Department of Education and Training to the Ministry:

1. For the Secondary Vocational High School Graduation Examination including:

- Report on the overall supervision work of the examination by the Department of Education and Training, accompanied by various statistical data;

- List recording names and scores of candidates' exams;

- List of graduates;

- Decisions establishing the steering committee and examination inspection board, the Board for printing exam questions, invigilation, and marking;

- Minutes of the invigilation and marking boards;

- Other minutes related to the Secondary Vocational High School Graduation Examination;

- Re-examination file (if any) including: Decision to establish the board, summary minutes, list of graduates after re-examination, and other related minutes.

2. For the Secondary Vocational Middle School Graduation Examination including:

- Report on the organization of the examination and examination results;

- Decision to establish the Exam Question Drafting Board;

- A set of exam questions and marking guidelines;

3. Deadline for submission:

- All files above must be at the Ministry (Department of Continuing Education) no later than 25 days from the last exam date.

- All re-examination files (if any) must be at the Ministry (Department of Continuing Education) no later than 50 days from the last exam date.

Article 42. Storage of examination files.

1. The Department of Education and Training, the Military School Administration Bureau store:

a) Indefinitely:

- List recording names and scores of candidates' exams;

- List of graduates;

- Graduation Certificate issuance book.

b) For 3 years:

- Decisions establishing Secondary Vocational High School Examination Boards;

- Candidate appeal files;

- Disciplinary files.

c) For 1 year:

- Decisions establishing Secondary Vocational Middle School Exam Question Drafting Boards;

- Exam questions and marking guidelines (including envelopes containing exam questions);

- Various types of minutes;

- Candidates' papers;

- Other types of files.

2. Storage period: Calculated from the last exam date of each examination period.

3. Examination application files of candidates returned to District Education and Training Departments, Continuing Education Centers, or secondary schools for return to candidates after completing all examination tasks.

Chapter XIV

EXAMINATION STEERING AND INSPECTION COMMITTEE, EXAMINATION SUPERVISION

1. The "Labor Medal" second class shall be awarded or posthumously awarded to individuals meeting one of the following criteria:. Examination Steering and Inspection Committee of the Ministry of Education and Training.

Annually, the Ministry of Education and Training establishes the Examination Steering and Inspection Committee for Graduation Examinations.

1. Composition:

a) The Chairperson is assumed by a Deputy Minister of Education and Training.

b) Vice-Chairpersons are assumed by Directors or Deputy Directors of the Department of Continuing Education, the Department of Secondary Education, and some leaders of relevant agencies under the Ministry.

c) Members are officers from the Department of Continuing Education, the Department of Secondary Education, and some officers from relevant agencies under the Ministry.

2. Duties and authorities of the Ministry's Steering and Inspection Committee with respect to Secondary Vocational High School and Secondary Vocational Middle School Graduation Examinations:

- Direct, inspect, and supervise the organization of examinations by localities and in the military.

- Suspend examinations and cancel examination results in places where there are violations of the Examination Regulations and organizational guidelines issued by the Ministry.

- Suspend participation in examinations of members of Examination Boards, security personnel, service staff, and members of lower-level Examination Steering and Inspection Committees when they violate Examination Regulations or lack the capability to perform their duties.

- Request the Department of Education and Training to establish a Re-examination Board when the marking by the Marking Board is inaccurate.

- Recommend the Minister to commend units and individuals with outstanding achievements or impose disciplinary actions on units and individuals who violate Examination Regulations.

Examination supervision in localities or in the military may be undertaken by a member or a team of members of the Examination Steering and Inspection Committee.

Article 44 |||. Awards

Recipients: cadres, teachers, students, and service staff who have made contributions in organizing the examinations.

Forms of commendation:

Public commendation before the Examination Board and notification to the school.

The Head of the District Education and Training Department issues a certificate of merit.

The Director of the Department of Education and Training issues a certificate of merit.

The Chairman of the People's Committee at the district level issues a certificate of merit.

(d) The Chairman of the People's Committee at the provincial level issues a certificate of merit.

(e) The Minister of Education and Training issues a certificate of merit.

Responsibility for commendation:

The Invigilation and Marking Board is responsible for reviewing and deciding on commendations within its authority and proposing lists for commendation by competent authorities for cadres, teachers, and students with outstanding achievements.

The District Education and Training Department (for middle schools), the Department of Education and Training (for high schools) is responsible for preparing files and implementing commendations according to current regulations on competition based on recommendations from the Invigilation and Marking Boards.

Article 45. Disciplinary Measures

For Officials, Teachers, and Service Personnel

The implementation of disciplinary measures against officials and civil servants who are leaders, teachers, and service personnel involved in organizing graduation examinations shall be carried out in accordance with the provisions of Government Decree No. 97/1998/NĐ-CP dated November 17, 1998 on disciplinary measures and material responsibility for civil servants, and Circular No. 05/1999/TT-TCCP dated March 27, 1999 issued by the Government's Organizational and Cadre Management Board guiding the implementation of this Decree.

For those who are not civil servants participating in graduation examinations, penalties shall be implemented according to the terms of their labor contracts and current laws.

For officials, teachers, and service personnel involved in examination activities if they violate regulations while performing their duties at examination boards and their actions directly affect the examination, they must be recorded in a report and immediately suspended from their current positions.

Authority to Suspend:

The authority that decides to establish an examination board has the right to decide to suspend the work of the leadership of that examination board.

For Students:

Warning before the Examination Board if violating any of the following provisions:

a.1) Using any form to copy another student's answers, having been warned twice but still continuing to violate.

a.2) Allowing another student to see their answers or passing notes to another student, having been warned twice.

Not allowing them to continue taking the remaining subjects or nullifying their test papers if committing any of the following deficiencies:

b.1) Bringing materials serving the content of the examination into the examination room during the period from when the questions are read until the end of the exam time (whether used or not).

b.2) Receiving pre-written solutions from outside under any form.

b.3) Using another person's test paper (or scratch paper) to submit as their own test paper or producing identical answers due to copying each other, discovered by the examiner during marking.

Prohibiting them from taking exams for 1 to 2 years if committing any of the following deficiencies:

c.1) Assaulting invigilators, examiners, or service personnel of examination and marking boards.

c.2) Causing disturbances leading to loss of security and order in the examination area, resulting in serious consequences for the examination.

Any violations not specified in points a, b, c, d of this Article, once discovered, will be referred by the Education Inspectorate together with the Secondary School Department, and the Examination Department (if applicable) to the Director of the Department of Education and Training for decision on disciplinary measures according to Clause 2 of Article 45 (including the revocation of previously awarded graduation certificates).

Documentation and Procedures for Implementing Disciplinary Measures Against Students Taking Examinations.

Documentation.

a.1) At Examination Boards:

Report at the time of violation, signed by the offending student and two invigilators in the examination room.

Examination Board's disciplinary review report (specifying the level of discipline).

Collected evidence and materials.

a.2) At Marking Boards:

Report of the marking team.

Examination Board's disciplinary review report (specifying the level of discipline).

Test papers of the offending students.

Procedures.

b.1) Examination Board:

Review, decide, and announce warning and reprimand disciplinary measures before the Examination Board.

Record reports on other disciplinary cases not within the jurisdiction of the board to report to the competent authority.

b.2) Marking Board:

Review the disciplinary reports of Examination Boards transferred by the Department of Education and Training, and the marking teams.

Discipline and record recommendations for disciplinary measures.

b.3) The entire disciplinary file of students sent to the Department of Education and Training (for middle school examinations), to the Department of Education and Training (for high school examinations),

Disciplinary measures for students taking examinations must be announced before the Examination Board, secondary schools in the locality, and notified to the parents and place of residence of the students.
